I put this in the links yesterday, but it looks like it might be a major story. Apparently, Perez Hilton tweeted a photo of Miley Cyrus yesterday, and it was a major upskirt pic of Miley climbing into a car without panties. Note: I’m not interesting in finding the photos, even if they are edited or whatever, and I’m not going to provide a link for them either. So, Perez tweeted Miley’s vadge, and all hell broke loose. Now Perez is being called a child pornographer:
Perez Hilton might be in some hot water after posting an uncensored photo of Miley Cyrus’ private parts to his Twitter account.
Early Monday morning, Hilton posted a picture of the 17-year-old pop star wearing a short white dress and no underwear. In the photo, Cyrus is in the midst of climbing out of an open-topped convertible car with her lady parts exposed.
For his two million plus followers to see, the celebrity blogger posted the picture with the following introduction, “If you are easily offended, do NOT click here. Oh, Miley! Warning: truly not for the easily offended!”
But it’s the celebrity blogger that might need a warning. Cyrus is underage. Police might consider her naked image child pornography.
Recently, Cryus has been facing a barrage of criticism for being too sexy due to skimpy concert outfits and her edgy single, “Can’t Be Tamed”
It is unclear if Hilton will face any legal trouble, but he might be setting himself up for yet another celebrity feud.

Salon has big piece about whether this is in fact child pornography. I do think that question needs to asked, and the technical answer is “yes”. However, and I know a lot of people are going to be mad at me for saying this, but I can’t help but think that there are circumstances that – I hate to say it – make me think that Perez isn’t completely in the wrong. Sure, posting photos of a 17 year old girl’s vagina will probably get him some well-deserved scorn and he totally should have used better judgment, and yes, Miley is only 17 years old, and I’m glad that the photos have been taken down on many, many sites. But, in Perez’s defense (I just dry heaved), it is Miley Cyrus. Her costumes for her recent European promotional tour left little to the imagination, and although she’s not legally an adult, she’s not a “child” either. And why was she going commando in a loose, billowy, nearly see-through skirt? Of course, there’s some evidence to suggest that she was wearing panties, and that Perez might have ‘Shopped the image. In which case… I can’t defend Perez. Ugh.

I do not think he should have to go to jail. She is the underage little girl who chose to show her vadge. The one’s who should be going to jail are her mother and father, for failing to be good parents.
It is Perez’s job to give the gossip, so everyone is fair game.

I would like to send Perez Hilton to prison for screwing up my old computer. It froze every time I tried to go to his site, so I never have gone there since. Plus, he’s annoying.
However, I wouldn’t send him to jail for child porn, that’s really overkill. However again, he really ought to show more judgment and not show private parts of anyone under 18.

cause we love reading about it. I have always found Perez distasteful. But sometimes I read his site, and it makes me laugh. Vanity Fair editor’s page says “we are in the advanced stages of a drastic celebrity de-evolution” (in regard to the hey-day of “Liz-n-Dic”.) This is thanks, I think, in no small part to Perez Hilton. However I think he feels safe in posting this about Miley. He would never have put something like this up about Demi or her kids, for example. She’d sue in an instant.

15 years old Tallulah Willis (Bruce/Demi) is a regular topic of conversation on his website, I believe. People were up-in-arms about a set of pics where her butt is hanging out of some short-shorts (that were TOO short) as she’s hugging her father.
She was not bare-assed, so I guess very few (aside from Demi and her angry tweet) took him to task on it, although the posts are still accessible.

I don’t think he should go to jail, he isn’t a child pornographer, he should pay a fine or something, some kind of punishment. He posts pics of all naked celebs, so its not like he targets kids. Miley isn’t a child either really. I still think he shouldn’t have posted them. I am also a little annoyed that the girl wasn’t wearing underwear. Really? We’re going to shame and blame the victim? Not wearing underwear does not equate to allowing people to take pictures up your skirt. It was a poor choice, no doubt, but no way does the action serve as nonverbal permission to post her lady bits on the internet.
I saw the picture on another site that was trying to prove that she was indeed wearing underwear. The picture was shot from far away. This was not a “Britney incident” where she stepped out of a car and spread her legs open for the paps. From what I could tell, Miley wasn’t even aware that her picture was being taken.
Upon receiving the photo, Perez Hilton had a choice: to post it or to ignore it. Being the evil famewhore that he is, he choice the former. Just because Miley went commando doesn’t mean that Perez can’t exercise some thought and dignity about things. He made a choice. It was a bad one, end of story.

I despise Perez. I don’t think posting an upskirt would warrant jail time, however it does deserve a huge slap on the wrist. he should be fined everytime he talks ill or posts pictures like this on his website. The images should be forced down. I think Perez is a vile disgusting man. I used to enjoy reading his sites until he started picking on people that can’t defend themselves, ie teen celebrities, actors children etc. I remember when he used to make fun of Adam Sandler’s daughter. I haven’t been to his site in YEARS, but when I did visit, the main complaint I had was that his writing wasn’t nearly as good as other sites like his, and way more mean-spirited. (DListed, of course, and now I add Celebitchy to that list.) his main “thing” was drawing on celeb photos with a white “pen”…simplistic and puerile. but that describes his target audience as well.

Well, if the “child” can’t properly dress herself, then it is up to the parents to make sure she is dressed.
This “child” just cannot wait to grow up (just like all children) and do adult things. However, this particular child KNOWS she will be photographed, talked about, etc. So if she isn’t mentally challenged regarding being clothed, then she is doing it for publicity.

lawyer here. i am actually writing a book on this topic. under the letter of the law, he is a child pornographer. if he were to actually be charged and convicted (that is where the debate really lies), other than going to jail, he could also be placed on the national sex offender registry, which comes with its own set of legal issues. law enforcement has a lot of disrection in this area, so i doubt he’ll be charged, unless her parents make a stink (which i doubt, considering their history) or some zealous DA in the area wants to make a name for himself.

The intent is the thing; Perez THOUGHT it was real, or at the very least, was willing to PRESENT it as real,with a warning, no less. Doesn’t matter if it wasn’t…he presented as real. Miley cannot be held accountable for it…SHE didn’t publish it, he did. Is it child porn in the strict sense? Not so much, in comparison to the horrific stuff out there; but it is enough that he should be reprimanded in some way. With people like Perez the more he gets away with the more he’ll attempt. So when he publishes Elle Fanning or someone not within five months of eighteen, will that be over the line and child “porn”? Hell yes, more than likely, cuz she (Elle) is viewed as younger. @,,,,: That is a fair distinction to be sure, that Miley was on a photo shoot as opposed to being out on the party circuit when this happened.
I don’t think anyone can defend having this photo posted. I haven’t seen it so I don’t know if she was actually wearing panties and she was photoshopped to look like she wasn’t – if that is the case, that is really reprehensible and it’s a sad day when that’s the way the world works. I wouldn’t feel bad for Perez and that photog if they get some charges pressed against them.
My point is, yah, that sucks to have it happen to you but when you’re out there tramping it up enough on your own, trying to prove you’re a woman now because you can dance on a pole and wear next to nothing – because THAT empowers you – well, you don’t get any sympathy from me when other people try to exploit that image as well. It’s not like she’s just trying to be a little flirty and a little sexy in an age appropriate way. She is selling herself on in-your-face, blatant sexuality. No one should be buying these up-the-skirt shots ever. It encourages the paps to go further and further, encourages people to photoshop and start slanderous rumors that can’t be undone, all for our “entertainment.” The pap culture is disgusting and it’s exploding and will end badly if people don’t start making ethical decisions somewhere along the food chain. If Perez Hilton goes down, and I think he should, whoever snapped that picture and sold it should go down as hard or harder.

@ Atticus – I completely see where you are coming from and I hope you know that I am not trying to argue with you or insult you in any way.
I would be willing to bet a fair sum of money that she was indeed wearing flesh colored underwear, because her dress was white, and that she was filming something – be it a video or a whatever. The photos are grainy. It was definitely not a shot of her on the street, coming out of a car to go shopping with her legs wide open. It was a candid shot of her working on something.
She does put herself into a sticky situation by presenting such a hyper sexualized image. However, it presents the problem/question of where is the line drawn? Just because a woman dresses sexy and is in control of her sexuality doesn’t mean that she is asking to be violated. I think a commenter above mentioned the “she was asking for it” excuse/defense when a woman is raped. There is a big difference between having a bad reputation and having people post pictures of your bits on the internet when you didn’t mean to expose yourself, in my opinion at least.

Wow, she’s really following the Britney/Lindsay playbook, huh? Um…she does know how it’s turning out for them, right? Hopefully it turns out to not be a real photo – no matter where you are or what you’re doing, if you’re wearing a skirt…put on underwear. It’s really very simple.
Whether or not it’s a real photo, he shouldn’t have posted it, and I’d like to see them slap a big old fine on him. If he does something like that again, prosecute. She is underage, and even if she weren’t, those photos are terrible and should not be bought and posted.

@NayNay – As terrible of a job as they are doing as parents, she is 17 they should not have to make sure she wears underwear. You also would feel differently if it was your child. She is still a minor, it is illgeal and she deserves the same protection as other minors. It is just not ok, there shouldn’t be any justification for child porn. EVER. He should go to jail, the people selling the photos should, and the person who took it should.
@Lesley- She wasn’t naked on the streets or exposing herself. The took a picture up her skirt. Otherwise people wouldn’t have know. Lots of people are saying it was photoshopped anyway. Plus, you can’t charge somebody with indecent exposure after the fact with only pictures as evidence.

@lolabella: I had the exact same experience- I liked Perez back in the day when his goal was to get 1,000,000 hits in a month and he was snarky, not mean. But then…it just got so, so bitter, and angry, and ugly, and the humor and lighthearted ribbing was gone. I’ve heard rumors that once the site took off he hired his sister to do the posts while he does his “celebrity” thing. This may be why it got so gross (and the spelling and grammar mistakes became rampant, something that was not a problem in the early days of his site).
As for Miley, yes, she courts the publicity by being provocative. And yes, she is a minor and as such her parents have the right to control her public image; they choose not to, and they have that right. At heart, I think she’s probably pretty decent: she’s not drinking, doing drugs, hitting nightclubs, getting arrested, falling down in public, passing out in club bathrooms…all the stuff that out of control teen stars can do. She’s dressing and dancing provocatively, and saying stupid shit that all 17 year-olds say (which is why we don’t usually give them a platform).
Perez Hilton is a college-educated, 30-something man who has been in Hollywood, and this business, for around a decade. He should have known better, and he should be held accountable.

A general thought to all, not directed in particular to anyone…Just so I’m clear, I don’t think Miley was asking for a doctored photo of her vadge to be posted. I agree that it’s pretty sick to take such a picture, to post such a picture, even worse to doctor a picture to make it look worse than it was. All I’m saying is it wouldn’t surprise me if Miley really was out there flashing her vadge like Lindsay, Paris and Britney because Miley’s behavior certainly makes her seem like the kind of person who would do such a thing. And because she herself is perpetuating this image, I feel very little to no sympathy for her when something like this happens to her, because the image of her that is being exploited is one of her own creation.
For example, my reaction to this happening to someone like Taylor Swift or Demi Lovato would be very different. Both girls present themselves in age appropriate ways – they don’t seem like prisses or prudes, they dress cute and flirty, but aren’t out there wearing next to nothing, pole dancing and proclaiming they can’t be tamed while doing some sexy dance moves dressed like slutty birds.
Oh and one more thing – if she was wearing flesh colored undies under a white dress, she is an idiot if she doesn’t think that someone catching sight of her when the wind blows her skirt or whatever isn’t going to think she’s going commando. Wear white undies under a white dress if you want to avoid that mistake. Flesh colored bras under clothing makes sense, it won’t show through. Flesh colored panties under pants or long skirts, ok. Flesh colored panties under short skirts – FAIL. (again, haven’t seen the pic so don’t know if her skirt was short but think it must have been for such a photo to have been taken)

What if he had posted a picture of Dakota Fanning’s vagina?
What if Dakota Fanning was filming something, and due to her costume she wasn’t wearing panties and while she was working some pap took an upskirt photo, and Perez twittered it?
How would we all feel about that?

It does not matter how a women or girl acts or what she does – unless an girl or women decides that she wants a picture of her genitals on a public arena (i.e. they sell photos to playboy) no one has the right to put a camera up her skirt when she is getting out of a car and post it.

Miley Cyrus is a child. It doesn’t matter if she acts like a child, or looks like a child, or sounds like a child. She is legally a minor until her 18th birthday, and anyone who owns a business in disseminating gossip and information should know damn well that those pictures are illegal to view, distribute, or possess. Irrefutably, absolutely without question, illegal. Mario Lavandeira/Perez Hilton should have gone straight to the authorities, but he’s a greedy, money-hungry prick.
He’s been chastised for posting pictures of minors before, and he even agreed to stop posting about people under 18 for six months. He knows that his policies were already controversial.
