Michael Lohan is filing for a conservatorship for Lindsay

Michael Lohan was bitching just a couple days ago that his ex wife, enabling mom-in-denial, Dina, planned to file for a conservatorship for their daughter Lindsay. According to Michael, Dina and Lindsay’s business manager, Lou Taylor, were hatching a plot to control Lidnsay’s personal life, money and business dealings. Rather than wait for Dina to wrestle control over her daughter’s affairs, Michael is filing for his own conservatorship of Lindsay. He tells E! and Radar that he’s retained a lawyer and plans to file for a conservatorship run by two independent third parties “who don’t have an interest in Lindsays money, but rather her as a person and human being.” When has Michael shown that he has an interest in Lindsay as a human being? Was it when he sold tapes of her sobbing and begging for help?

As Kaiser mentioned on this earlier, it’s not a bad idea for someone to establish a conservatorship over Lindsay. The issue is that neither Michael nor Dina have her best interests at heart. Both are terrible parents, and both have ulterior motives. Even if Michael had a conservatorship established and gets it run by other people, he would try to influence those people and squeeze money out of his daughter. He’s earning money every time he runs to the press with news about her, and he’s been making a living by selling incriminating photos and tapes of the people he once claimed to love.

The good news is that Lindsay’s in rehab now, at an undisclosed facility in Orange County, CA. While I’m sure she’s resistant to the program and thinks she doesn’t need any help and that it’s everyone else’s problem, at least she’s there. She’s predictably said to be using rehab as a tactic to avoid or at least delay serving more time in jail.

Lindsay’s younger brother, Michael Lohan Jr., 22, issued a statement to People about his sister and he blamed everyone around her for enabling her, just like his father did. He said:

“People she was surrounded by – enablers, leeches, whatever you’d like to call it – made things very difficult,” he says. “It’s quite strenuous to right your wrongs when the people around you help justify your actions. Therefore, cloudy judgment made it easy for her to neglect those trying to guide her.”

“People with addictive tendencies do not get better overnight, so that cannot be expected. However, her commitment to her current recovery is a side effect of the realization of her past mishaps.”

Lindsay, who failed a drug test earlier this month and spent 14 hours in jail before posting bail, is “well-aware that she’s at a crossroad in life, and is fully committed to ensuring a healthier future,” says her brother.

“She has made conscious efforts to improve her lifestyle behaviors and to treat this process with great care. In order to continue her healing process, she’s willing to take whatever steps necessary,” Michael adds. “We – her mother, brothers, and sister – have been there for Lindsay every step of the way – despite what trashy news reports – and will continue to give her our support and strength during these arduous times.”

Last spring, Michael Lohan graduated from Ithaca College, where he studied business administration and played lacrosse. He remains close to sisters Lindsay and Ali, 16, and younger brother, Cody, 14.

At least one of the Lohan family members has some sense, although I suspect that statement was carefully crafted by Lindsay’s PR people. It’s interesting that Lindsay’s brother is careful to specify that it’s her mother, brothers and sister who have been there for her, while leaving out their ex con dad. Michael Lohan Sr. said something very similar about his daughter – that he “truly believe[s] that she’s finally in a place where she wants to be, but it’s just a few people in her life that keep leading her off that path and enabling her.” The Lohans might be divided in their opinion of who should be responsible for Lindsay but that all agree that it’s not a 24 year-old woman’s fault that she ended up in jail after two DUIs and multiple failed drug tests.

    Lindsay only allows the people around her who will enable her. Stop blaming them for her choices.

    Michael is the one who needs a conservatorship or a long stay in a mental hospital. He is a threat to those around him, and I think that qualifies.

    I’m not a Michael or Dina Lohan fan but I think I see Michael’s point of trying to be the 1st one to get a conservatorship for Lindsay. Yes, both Dina and Michael have flopped as parents but I also DO NOT trust Lindsay’s business manager Lou Taylor.

    She’s the money honey. Who else could’ve supplied Lindsay with the fancy cars and post her bail? Lou Taylor is not a woman to be taken lightly, imo. Someone should investigate into her background.

    If Lindsay even qualifies for a conservatorship and it gets approved by a judge I think her dad is doing the right thing in terms of asking for 2 independent 3rd parties to oversee Lindsay (the person) as well as her estate (finances). I read that Michael just wants to be a Petitioner.

    I still do not feel that conservatorships are great things for anyone. It’s a lot easier to get one than to get out of them. Just look at Britney Spears. She fought early on to just be able to get an attorney of HER choice but by that time the arrangement was in place and she is deemed to lack capacity (yes, even today) to hire or fire her attorney that she does have who was appointed by the court nearly 3 years ago.

    So, if Michael can get a conservatorship for Lindsay well then fine. I hate to say it but I prefer he get one for her rather than Dina and the team of managers who will only continue to enable Lindsay. And yeah they’ll get her back to working because it’ll benefit them as well as the conservatorship itself as it takes money to maintain a conservatorship.

    Right now though everyone’s focus should be Lindsay’s recovery. Work can wait. Hollywood isn’t going anywhere at all. She needs a good 2 years away from the cameras and delve deep into therapy for all that ails her. I hope things work out for the best for Lindsay. Good luck to all of them.

    Lindsay should maybe have something like the care that Drew Barrymore got. She went to rehab and after that she moved in with another couple who took care of her and helped her get a grip on her addiction by being very strict and guide her. Altho at that time Drew was still a minor if I recall correctly. Lindsay is an adult.

    At the moment I get the feeling that the Lohans want a conservatorship because Britney had one. It’s the Hollywood thing to do. I’m sure they’ll get a lot of press for it. Hopefully I am wrong about that though and that they are really sincere about her wellbeing.

    It is great that Michael is being pro active as far as Lindsay is concerned, but lets be honest here. Are his motives for her benefit? Hell no. Michael does not do ANYTHING that he does not stand to gain from, he is a con-artist. I would not trust ANY ONE that he is suggesting to be her conservator. You know that he will be running the show behind the scene. And he will suck the life out of Lindsay. The man is toxic. I really hope that any request by both of her parents is denied. This is crazy!

    I can totally see Britney Spears’ need for a conservator-ship because she has a mental problem along with kids. She really needs help.
    Being a selfish entitled spoiled brat is not a mental disorder. Lindsay is just making bad choices because she chooses to-I highly doubt she literally can’t see the difference from right or wrong.

    There have been reports that Lindsay is trapped for cash. Unliike Britney Spears, Lindsay doesn’t have that kind of money. I wonder if Michael Lohan realizes that.

    I don’t see how any of them can force this on Lindsay.

    She is not mentally incapacitated.
    She is spoiled and self centered.

    And that is not reason for anyone to have their personal rights trample on. If she wants to blow through her money, that is her right.

    It is not her responsibility to financially support her entire family… along with the managers and agents.

    And I suspect her criminal attorney will stop any of this from happening.

    What happen with Britney was a legit issue. The girl had a very public nervous breakdown. And I am still not convinced she is ever going to be 100% again.

    And I hope Michael Lohan gets his sorry ass ran out of the LA county. His only concern is about how much cash of hers, he can get his hands on.

    @Hautie i agree
    I don’t see why a conversatorship for Lindsay is even being possibly considered.
    Britney was allegedly being drugged,acting crazy and has children.
    None of that applies to Lindsay it was her choice to take the drugs and enter rehab again.
    I’m sure Shawn Chapman Holley would fight against this and considering Judge Fox has shown he is willing to ignore the law by refusing to set bail for a misdemeanor she would win.

    A conversatorship? Wrong answer. No one can do this but Lindsay and the question is.. does she want to stop doing drugs, drinking, being photographed in all her glory? Apparently not. You can’t blame enablers or family – this is strictly on her shoulders. If she wants to stop and be clean, she can leave and go get clean. Her issues are she’s spoiled and has no sense of right and wrong. Perhaps not her fault initially for she was raised badly, but as a young adult with world experience she needs to yank her head out of her ass and stand up for herself. Which I don’t see happening. Betcha a donut they’ll get their useless conservator deal and she’ll end up like Gary Coleman. Broke, rejected and bitter.

    From my understanding of conservartorship I am under the impression that one has to be mentally unstable. Lindsay isn’t mentally unstable she knows exactly what she is doing. IMO

    @Innocent, I bet Jude Fox KNEW it would be overturned. But sure as hell scared the crap out of Linds-which I think was the point.

    Nothing else seems to work, so maybe a scare tactic and tough love would.

    I’m all for Linds getting better, and that she should be separated from her enablers-INCLUDING and ESPECIALLY her mother. But don’t bash the judge. He is doing his best, and Linds keeps screwing up, there is only so much the courts can do. everyone wants to see Lind get better. Even those who hate her, because it is sad to seem someone with the enormous potential she had to be like this.

    but bashing those who are trying to help, doesn’t help anyone.

    I don’t really get that because Lindsay KNEW she was getting bailed out it was just a question of when. Maybe he was trying to keep her there for at least the weekend because Shawn Chapman Holley JUST managed to get her bail before the court closed.

    A friend of mine, whose brother has a serious mental illness, was unable to get a conservatorship for him because his doctor said no. He frequently goes off his meds and wanders off for weeks at a time. He also has severe hallucinations.

    I don’t see how anyone could get a conservatorship of Lindsay when she is taking care of her own basic needs and getting treatment for her addiction. Doesn’t make sense.

    I don’t know why every one is defending Britney’s conservatorship. She isn’t any more mental than Lohan. They both are spoiled uneducated brats who have never heard the word no. Why is it Hollywood or nothing for these girls? Let them get normal jobs out of the limelight even if it is at some grocery store. There are plenty of other talented actresses and singers out there who will gladly take their place. Why must we keep rewarding these idiot brats. Britney getting all those undeserved awards at the VMA’s was just ridiculous. If I don’t perform well at my job I don’t get praised and get a reward, why should it be any different for these brats. At least they will learn to take care of themselves.

    I basically feel the same about this as Hautie does. Spoiled and self-centered does not require a conservatorship. I can’t help but wonder, however, if the fact that Lindsay keeps doing drugs despite knowing she will be drug tested does in fact indicate some type of mental incapacity. At least, perhaps an argument could be made along those lines. I’m kind of being devil’s advocate in saying that, because I really don’t see the need for a conservatorship. I think she just needs better management and no contact with either of her idiot parents for a good long while.

    I was a Protective Payee for my sister. She just received a monthly check but most ofter blew it without paying her bills. When she was going to loose her house on the reservation for not making the payments (which were or/or around $100. for a new house) her other sibings & I caught her up but only if she would let someone else handle her finances.

    Not sure how widespread this is but you certainly don’t have to be rich. You just need someone to handle the bills & pass on the remainder to the payee. Of course Lindsay has no-one trustworthy. The person (my sister) must agree but when you’re on the verge of loosing everything most people will agree.

    I don’t think you can call Britney a spoiled woman, who didnt want to hear no. She clearly had a nervous breakdown, look at what she was doing? Shaving her head, attacking the paparazzi, speaking in a british accent and getting involved with that pap guy. She was NOT herself in the least. Plus she has two boys that since the dark time in 2007-08, she seems to have gotten much better. Is she back to the way she was in 2000? No. But she seems to be a WORK IN PROGRESS

    That is all thanks to the converatorship, that her dad was/is in charge of. He seems to really love his daughter. I remember when she had that MTV special in 09, and talked about her problems/issues. When she got dressed up and was giving the director ideas for her Comeback single “Womanizer” video. Her dad started crying saying how pretty she looked, and happy She just tried to laugh it off and say “Oh Dad” but you could see she was happy.

    It seems enertaining through music/dance is what she wants to do and she dosen’t have a good singing voice, but is a hella of a performer when she wants to be. I wish her TRUE LUCK. Now Lohan, I think she needs to get away from Dina.

    They are two completely different situations Britney is mentally ill and she is worth hundreds of millions of dollars plus she has two young children someone needed to take hold of the situation. Lindsay on the other hand is broke and it’s doubtful she can recover her image enough to have a film career. I think the worst thing for her sobriety would be to have her go to rehab for 30 days then immediately go to a movie shoot. She should cut off both her parents (especially her mother) and take a few years to become a decent person.

    If Micheal succeeds, Lindsay should go get a job at McDonald’s. If I was her, that’s what I would do. I would feel beyond infuriated that someone else was calling the shots in my life. ‘Course I don’t drink and I’m not a drug addict. (B.C bud aside, and only for nightmares). You would think that just the threat of conservator-ship would scare her straight. Although the word “think” probably isn’t in her vocabulary.

    @Musicfan – Well, you are probably right when you list all those things about Britney that would indicate she had at the very least a mental breakdown, but I still think if she hadn’t spent her life being surrounded by handlers and providing for her family and not marrying that guy and getting knocked up she would have been okay. She has no voice and that is obvious, of course in the music industry these days that isn’t even relevant anymore but to me it is and I think of her as a fraud as I do many of the singers who prefer to be called performers anyway.

    TG, Britney is a pop star and to say if she didn’t have her life then she would be ok is redundant. U have no idea that something else in a ‘normal’ life wouldn’t have triggered her mental health issues and breakdown.

    Yeh, Britney hasn’t the greatest voice but she didn’t become world famous 4 no reason – she has something be it charisma or just being in the right place at the right time.

    I am guessing u are a struggling musician, but this is how it works in every industry – it’s not just talent that ensures u suceed (sadly)

    Surely providing a performance that excites people which she has done is called entertainment, and people enjoy this regardless of whether it is fair or not

    Janet Jackson nor Madonna have a voice either. They aren’t Chaka Kahn or Barbara Streisland, Or Mariah Carey. yet they are true performers and have made hundred of million dollars.

    Britney Spears is more Janet/Madonna where she is a person with CATCHY songs and a hella of a dancer, so she has made her money honestly. She isn’t Paris or Kim K where you question why she is famous/rich?

    I’m rooting for Spears because she is TRULY trying to get back her life. There is nothing wrong with it. She had a nervous breakdown and needs help/and is getting it. I see no reason why she can’t continue doing what she seems to love. We can say its not right that her voice isn’t strong and she has done so well, but thats the nature of the buisness.

    I see Britney doing well in 2011, while unfortunately I see Lindsay still being coddled by the system, and end up hurting someone or herself!
