So even if the divorce was official it would still be adultery. What Jesus was trying to make people understand is that marriage is not about pleasure or happiness or exciting sex -- all of which will fade away no matter who you're with -- but about duty and commitment and being there for someone to the end. It's a social contract. Otherwise everything dissolves into chaos. Which it has. Unless that person really (REALLY) didn't know that the man/woman they were involved with was married, they have as much responsibility as the married person. Basically, the cheatee (is that a word? Okay, maybe the marriage is on the rocks--marriages can be saved and have been, espcially if there are children involved. But the cheatee is too selfish to care if his/her involvement is helping to cement the destruction of a marriage. Everyone has to take responsibility for what they do and who it affects.
