Both the tennis instructor and DD told the paper before they broke the story that it wasn't true, but they ran the story anyway. And having a sex addiction doesn't mean he cheated on his wife, so I imagine it does make a difference to both David and Tea. If she didn't deny saying those things he could not possibly win this suit. She had to sign a document denying speaking to them or denying saying what was said. Whew. Anyway she did, or there would be no suit. So unless they have her on tape talking, they will settle out of court. He'll win a small victory but probably lose his wife anyway. Sucks. His show is great though. I think this lawsuit may be about the implcation for the divorce. If he and Tea are planning on settling terms, particularly child custody, David having a confirmed affair may make a difference. Perhaps he really didn't have an affair with the tennis instructor and she's just some woman trying to get her 15 minutes of fame by shooting off her mouth and implying she had an affair with him and he wants to put a stop to it. And if this counter-rumor is all being leaked from the His People/Her People end? (like John Meyer and Jennifer Aniston, but with way more subtlety!)
