Dixie Chicks’ Natalie Maines is being sued for defamation


Natalie Maines isn’t one to keep her opinions to herself. The Dixie Chicks were riding high in country music until Maines made some political statements that backfired beyond measure with their core audience at the time. The Chicks kept making music, and they do make excellent music, but without the hyper-success they were enjoying before the comments.

Like it or lump it, Natalie Maines speaks her mind, but this time, it’s not going to just affect album sales, it may land her in court. Terry Hobbs, the stepfather of one of three boys murdered in 1993, is suing Maines, and to a lesser extent Martie Maguire and Emily Robison (the other two Dixie Chicks), for defamation after Maines spoke out about the murders. Maines, and others, said the 3 men who were convicted were railroaded and that evidence showed Hobbs was actually involved in the crimes.

Terry Hobbs, stepfather of Steve Branch, who was killed in 1993 with Christopher Byers and Michael Moore, filed suit in Pulaski County Circuit Court on Nov. 25. The suit names all three members of the Dixie Chicks, but focuses on Maines.

The suit seeks compensatory and punitive damages. Hobbs claims he suffered loss of income, injury to his reputation and emotional distress.

Maines attended a Dec. 19 rally in Little Rock, where she claimed Jason Baldwin, Damien Echols and Jessie Misskelley — known to sympathizers as the “West Memphis Three” — were innocent and that supposed new evidence pointed to Hobbs. Her comments echoed a Nov. 26, 2007, letter that was still on the Dixie Chicks’ Web site on Thursday, in which she claimed that new DNA testing of hair from the crime scene linked Hobbs to the killings and that his behavior after the slayings indicated his guilt.

The lawsuit says the claim is false.

Hobbs told the Arkansas Democrat-Gazette in a Feb. 1 interview that his reputation was in tatters and he wanted to clear his name.

No lawyer for Maines was listed in court filings and a publicist didn’t immediately return a call for comment. Hobbs’ attorney, J. Cody Hiland, didn’t immediately return a call for comment Thursday.

The lawsuit says Maines’ statements were “so extreme in degree as to be beyond the pale of decency and to be regarded as atrocious and utterly intolerable in civilized society.”

Assertions similar to those made by Maines were also made by lawyers seeking new trials for the three convicts.

The boys’ bodies were found by police a day after they vanished from their quiet, tree-lined neighborhood May 5, 1993. Police arrested the three after a confession by Misskelley in which he described how he watched Baldwin and Echols sexually assault and beat two of the boys as he ran down another trying to escape. A jury gave Misskelley a life-plus-40-year sentence for the killings. A later jury gave Baldwin a life sentence without parole. Echols, then 19, the oldest of the three, received the death penalty.

The Arkansas Supreme Court later upheld the convictions, but a later documentary sparked interest across the Internet, as well as among celebrities, including Maines, who felt the teens were railroaded by police for their interest in heavy metal music and the occult. Supporters say they raised more than $1 million for a legal defense fund for the three, enough to pay for lawyers, new DNA testing and a second federal appeal on behalf of Echols.

A judge has since denied defense motions for a new trial.

It seems like this guy is suing Maines because she’s the most high profile person to accuse him of the crime, but she’s not the only one if there are rallies being held. No matter what new evidence is out there, Maines isn’t judge and jury and shouldn’t be accusing someone of guilt. She feels strongly about this though and isn’t letting go. We’ll have to see what happens in this case and if she owes this man any damages and/or if the convicted young men are eventually granted new trials.

    These types of suits are hard to win, from what I’ve read. I hope he doesn’t win. It’ll be a huge blow to the first ammendment. Plus, if Natalie’s right (which she may not be) he’s a creep and doesn’t deserve a dime.

    I hate her, she doesn’t have any tolerance for anyone that doesn’t share her views, she really think that someone that disagrees with her is beneath her….hope he sticks it to her and takes her for everything she’s got!

    To accuse someone of murder is the media’s job, which is the case of the West Memphis Three….right?

    Anyways, elisha is right – these suits are hard to win.

    And rules, she’s simply a liberal who does not like Bush — how many people do you think are like that in this world? Nothing wrong about speaking her mind.

    I am from Memphis and there are a lot of sympathizers here for the West Memphis Three. I think it is WISER for celebrities/musicians to keep their political opinions to themselves but it is not necessarily BETTER or the right thing to do. Perhaps Ms. Maines should keep her political and civil rights actions and opinions out of concerts (for her own good and for the good of the Dixie Chicks)but I totally support her right to speak her mind and support the causes that mean so much to her.
    I personally became much more interested in the Dixie Chicks AFTER the whole Bush fiasco.

    To accuse someone of murder isn’t the medias job, it’s the job of the police. Natalie is rude and arrogant and even though I agree defamation cases are hard to win, I hope it costs her plenty.

    I’m from Memphis and we’ve all become accustomed over the years to intermittent concerts held on behalf of the West Memphis 3, here and around the country. I don’t see anything wrong with celebrities speaking their mind over public matters but even less is wrong with a musician speaking out for those jailed/sentenced to death for essentially subscribing to a subculture that embraces a particular genre of music. Besides, anyone who’s followed this case assumes this man is guilty – Maines isn’t alone.

    thanks to those ppl who are from memphis who posted – i was hoping to hear your views! maines is a very outspoken person and, love her or hate her, she is very talented. i am more of a pop fan so i like their music that crosses the genre lines… maybe that’s why i’m able to keep her music and her persona separate while it’s tougher for others. oddly enough, i have never heard of this case before this guy sued natalie maines.. so in essence, he’s calling attention to the case by suing her and hopefully garnering support for whatever the truth may be!

    Everyone is entitled to an opinion: however, celebrities need to be prepared for public backlash when they stand up and shoot their mouths off for their causes. It comes with the territory. I liked the Chicks but after publically excoritating our head of state (like him or not) at a sensitive time in human events was a BIG turnoff. No way around it, it taints your perception of a person. Have a good evening, everyone!

    Hey Trillion, You are right, there was a lot of reporting about the original stupidity of Miss Natalie. I think that was because she actually had fans before she made that remark. There are plenty of good musicians out there, without having to subsidize the ones who don’t have the good judgment to just “shut up and sing”. But my point is that if a minor artist made an inappropriate remark on the conservative side, we would never hear the end of it. A nonentity like Natalie Maines will never be exposed in the media, regardless of how reckless her comments. Best, Steve.

    There is a huge difference between pointing to some evidence that may exonerate and actually accusing someone (and esp. the father of a victim!)

    Her being stupid is one thing, but to be so narcissist and delusional and actully thinking she is the judge and jury is beyond my comprehension.

    How can she even accuse a father who has lost a loved one of something like that?
    Is she a detective? a lawyer who studied the case thoroughly?

    This women is unbelievable.

    She has ruined their careers…and yet she keeps on opening her freaking mouth and spewing without any thought beforehand.

    If I were one of the other two ladies in the group, I’d be clawing Natalie’s hair out right now for setting me back…AGAIN with her obnoxious mouth.

    The 1st Amendment is one thing. Libel and slander are another. Just like a celebrity to watch a documentary on television and then consider herself an expert on the case. This woman is not an activist. She’s an unmitigated idiot. Activists get things done. Natalie Maines just keeps digging that proverbial hole to China.

    It’s a shame she’s so completely stupid. They were such a bright spot in the music landscape, and I am very sad for all the songs that they will never get to record because Ms. Maines’ inability to behave with any modicum of public decency tanked their success.

    Firstly, it’s funny how you all talk about Nat committing slander while calling her ’stupid’ a ‘delusional narcissist’ and a ‘loudmouth idiot’ in the same breath. Secondly, the First Amendment won’t allow you yell ‘FIRE!’ in a crowded theater when it isn’t burning, but DOES allow you to talk about a theater that burned down, even if it’s not true. Think about it.

    John Mark Byers is who she should have named, bet he wouldn’t have sued, the court might have asked about his dead wife and why it was that Christopher wore the brunt of the attacks that day.
    In my humble but well researched opinion and after years following this case, believe he knows more than the average bear about his step-sons death and the sudden death of his wife, Chris’ mother, when it is alledged, she realised her husband was the ‘west memphis boogeyman’, not Damian Echols.
    She had all the right infomation, just blurted out the incorrect name, but then, she is known for her blurting issues, pity, she could have done a great goodness shining a light back into that case, now all she’s done is show the world her colon, again…

    What happened to freedom of speech people! If Maines wants to speak her mind let her. We all are speaking our thoughts, just as Maines. Your doing to her as the father has accused her of doing. Calling her names, truely smells of defamation of character in my book. There have been so many people in this screwed up world that has committed horrible acts of violence and walked away. Maybe the father did have a part in it. Who knows? He knows, maybe he wants to see how far he can go by sueing. Maines isn’t the only one saying things others are also. Why are there no law suits against them? I can see why this father is Mad as Hell, but singling one person out is outragious when she is not alone with her thoughts.
