Lindsay Lohan checked into Betty Ford last night, allegedly (update)

Let’s all take a deep breath (of crack fumes) and recap what went down yesterday. Lindsay rejected the Hamptons rehab facility because they wouldn’t let her smoke, so she waited until the very last minute to fly to California (in hysterics, apparently) to check herself into a rehab in Newport Beach called Morningside. LL’s lawyer and the prosecutor met with the judge in an emergency hearing because no one had signed off on this new rehab, and the judge basically said “EH” and let LL stay at Morningside pending further approval. As it turns out, WHILE the hearing was going on, Lindsay had checked out of the rehab because OMG OF COURSE. So here’s what has happened since:

*Allegedly, Lindsay had 12 hours to return to the rehab, which it doesn’t look like she did. This morning, the city attorney is going to go to the judge and ask for an arrest warrant. A source tells Radar, “Lindsay leaving the rehab center that a judge was actually allowing her to stay in was a big mistake. Making that decision has serious consequences and if she doesn’t have her attorney deal with this tonight then the City Attorney is going to go to court in the morning to get a warrant for her arrest.”

*TMZ says that Lindsay never in fact checked into Morningside at all – she just rolled up in her SUV, never got out of the car, and then the SUV left. And she never came back. TMZ says that if Lindsay doesn’t show up by 6 am PST (9 am EST), the arrest warrant will be issued.

*TMZ also says that Lindsay has “begged” Shawn Holley to return as her lawyer because LL is “angry” with Mark Heller for recommending Morningside. TMZ says – and this probably comes straight from the Teflon Cracken’s mouth – that Lindsay “decided she didn’t want to go” to Morningside when she learned (from TMZ!) that Morningside had its license revoked. Ha.

*As for Holley, LL was apparently in contact with her throughout the day yesterday and Holley has agreed to take Lindsay back as a client (OH GOD). Holley has been in touch with prosecutors, trying to get them to agree to a rehab facility other than Morningside. Mark Heller might be fired now?

*And Radar claims that Lindsay has been “cleared” to enter Betty Ford (again), in a deal brokered by Shawn Holley. A source says, “Lindsay cut a last minute deal with the D.A. to go to Betty Ford. Shawn Holley helped to broker the agreement with [Los Angeles] City Attorney [Terry White] late Thursday night. It’s unclear if she has checked in.”

*Radar’s source: “Lindsay cannot stand her current lawyer and thinks he doesn’t know what he is doing. So late Thursday, from hiding, she began calling emailing Shawn incessantly. Shawn has always had a soft spot for Lindsay, even after everything she has pulled. She hates to see her suffering.”

*Another source claims that Lindsay was going to treat Morningside like a hotel: “Lindsay had her ‘publicist’ call all day on Thursday making outrageous demands … like that she needed her cell phone with her at all times. It’s like she thinks Morningside is a hotel. The staff at the facility doesn’t need nor want this drama. Lindsay’s actions on Thursday were very disruptive.”

So, I guess LL will probably be heading back to Betty Ford, which is where she was a few years ago, and they kept giving her day passes to go out drinking. When she returned to that facility after breaking her curfew one night, one of the staffers tried to stop her and punish her and Lindsay beat the woman with a phone. I can’t imagine that Betty Ford wants LL back, but who knows? And I guess she has less than an hour to check in. I’ll update if there’s anything more…

UPDATE: TMZ says that Lindsay is now “safely ensconced” at Betty Ford. Apparently, she checked in last night after Shawn Holley negotiated with the city attorney. TMZ says, “We’re told prosecutors will back off their promise to seek an arrest warrant today … although they still have to get the judge to sign off on Betty Ford, but it looks like that will just be a formality.”

    …Unlikely though. California’s judges seem to be ball-less and permissive.

      California jails are over crowded. 90 day sentence means maybe 3-5 days in jail. She needs like a Britney lock down situation; without it having to go to attempt suicide first. Lots of doctors, therapists, and a period to allow for withdrawal.

        Well then something that is GENUINELY locked down. Being made to go there and stay there with no ‘special’ treatment. Cold turkey.

        It’s just stupid and embarrassing for the whole system when you look at all the crap she gets away with, without anybody even trying to put their foot down. You can tell she truly thinks she’s above it all and laws don’t apply to her – and nobody is proving her wrong.

Sorry, just don’t see anything working for her. They need to just let her take care of herself except I know she’ll take an innocent life with her!

        California jails are overcrowded because all of those non-violent drug offenders. Lets make sure we lock up someone for smoking pot to relax on the weekends, but let this violent, dangerous, entitled, strung out POS go to a “rehab” resort.

        I think she does have a soft spot. But Lindsay is marketing and publicity for her. All I know is I am thoroughly impressed with her as a criminal lawyer in many ways from all the coverage and would hire her.

      Love the name! Shawn is no fool. It’s possible that when Shawn first took Lindsey on Lindsey could pay her bills, but once her credit and income went south Shawn set up an escrow account. In case you don’t know that’s when A owes B. B wants to be sure A pays them. A and B both trust C as an independent 3rd party to hold A’s money and distribute it to B when A owes B. That was fun to type and I hope it wasn’t confusing. So Shawn may have made sure Lindsey put money aside that she can’t withdraw and Shawn always gets paid.

      Now if the IRS is still freezing her accounts this might have been frozen too. And this could all be bs too. Shawn may not really be back, but that could be my wishful thinking.

      Either any or all of the above, or Lohan’s crack shenanigans are worth their weight in gold — i.e., publicity for Holley and her practice. Granted, Holley is an established attorney and I can’t imagine she’s hurting for clients. But I worked at a law firm years ago, and as I recall, even the partners had to work hard at “rainmaking.” So maybe repping Lohan is worth it, just because doing so keeps Holley and her firm in the papers and in potential clients’ minds? Hmmmmm ….

    I honestly can’t decide if she’s smart enough to pull all these crack shenanigans so that when she does deign to go to Betty Ford, the judge and prosecutor will just let it slid because at least she’s in a facility somewhere, or if she’s high and entitled or what.

    Despite myself I’d still like to see her get sober, lie low for a couple of years and then make a come back. I think she’s too far gone though. And sadly, her parents are just as bad as she is, so there’s no one who could take on a conservatorship or anything like that.

Just think of the interviews, books, movie etc., that they will be shilling. Knowing them, they will probably fight both over and at her funeral. They’ll get their own channel on TMZ.

    As someone from outside the US I really don’t understand how this legally works. So as long as her attorney (who ever that may be) is in contact with the DA and brokers another clinic for her, this whole thing will blow over and she can do her rehab?

    It was hard to follow from the beginning, but after yesterday I feel that this whole mess is nothing more than a serious wake up call for the California Judicial system that the jokes on them.

    If I were living in California I’d fear that this case could become a precedent for future misdemeanor offenders, which means that you can just drag things out until the end of time without any consequences whatsoever.

      As someone who lives in the US and has an associates in law, I don’t understand how this legally works. Trust me, this is not normal procedure. It’s LOHAN Procedure.

      It is an aggravating case to follow especially if you are an American living in a state with stricter laws and punishments.
      The key to understanding all of this chaos, is to realize just how overcrowded California prisons are. People end up only serving days per a month sentence for non-violent crimes.

        Lindsey doesn’t have friends with money. She has “friends” and I use that term loosely, that give her drugs and private jets. Cash seems unlikely. And though there is definitely special treatment for those rich, white, famous girls the treatment Lindsey is receiving is absurd. For whatever reason she never gets punished and all are baffled as to how she gets away with it.

        That statement “Because, of course” is often written here and that is the best way to sum it up.

      I’m the same, being outside the US & totally confused by this mess of legal wrangling. I’m pretty sure where I am, anyone skipping out on a court ordered rehabilitation sentence would immediately be issued a bench warrant & once in police custody would be sent to a remand centre to await a new court hearing. A remand centre is a prison basically, & there would be no bail, until a hearing.
      I just don’t understand how LL is able to pretty much do whatever pleases her & the court system basically enables her behaviour.
      I have read here on CB, plenty of comments to prove that people in the US are just as baffled & frustrated by her unending cycle of ‘special’ treatment by the Californian courts, & the hope that justice will prevail to get her off the streets & serve her the punishment & rehabilitation that she deserves. Yet she continues to get away with her cracked out dangerous (to herself & others) behaviour. Is the cult of fame really so powerful that LL (or any other person with some claim to celebrity) can be afforded such treatment? Can the overcrowding in Californian jails really be such a problem that a repeat offender can escape any real punishment? I just don’t get it.
      I’m not trying to be factious or trying to put down the American legal system, I honestly just don’t understand it & would appreciate an explanation. Though I have the feeling that the majority of American people are just as confused as I am as to why this woman keeps escaping any form of real consequences for her actions as I am.

        The over-crowding in California prisons is SO BAD that they’ve let out murderer, man-slaughterers, and violent rapists. (Due to civil rights lawsuits, which apparently scare the pants off them.) So rather than keep the most violent offenders incarcerated in the more crowded maximum security facilities, they let them go free or transfer them to lesser-secure facilities.

        But by ALL MEANS, keep the recreational weed smokers in jail and the famous and semi-famous out of jail at all costs!

      We have for-profit jails in this country. And the people who own them lobby for every little itty bitty drug offense (like smoking pot on the weekends) to merit serious jail time. Then they get paid by the state for each prisoner. Then they let prisoners out as soon as they possibly can. Also, every state has a different system, and California lets celebrities get away with murder. You can bet that if all this went down in New York, things would look very different.

      Lohan seems to push it farther than most in the blatant disrespect angle, though. That’s not normally something judges put up with, no matter the state. When I saw that her attorney was interrupting the judge yesterday, and the judge didn’t care, I was astounded. Normally both the lawyer and his client would pay for that. There does seem to be something else going on here — Lindsay or her family know where someone’s bodies are buried.

        Privatization of the prison system has completely corrupted justice. They said it was going to make things cheaper, when actually it is MORE expensive and results in more inmates.

        Maybe LA judges are more laid back about interruptions. Back when Paris Hilton was in front of the judge that managed to put her in jail for three weeks and make it stick, even dragging her out of the sheriff’s house arrest to do it, her mother was so outrageously mouthy and disrespectful that I was sure she’d be hit with contempt of court. But she wasn’t. Also Paris outright lied to the judge without getting perjury charges. I think she was denying knowing her license was suspended when the cop who caught her earlier (before her more recent reckless driving adventure) had her sign a doc saying she understood she was not allowed to drive and after just a warning, sent her home in the passenger seat while her passenger drove. So they’re pretty mellow compared to judges elsewhere.

        LadyD – Some Chiefs of Sheriffs are elected; others are appointed. I’m not certain, but elections happen less frequently than appointments, so maybe they just don’t give a fig.

        I don’t know what the heck is going on with the LASD, but they let a murderer go free less than 24 hours ago – OOPS! – and the DA is promising that mistake won’t be happening again. (So there’s that, I guess.)

        The LAPD & LASD are notorious for being corrupt, racist, and claiming they’re trying to “repair their reputation” whilst failing to do so. (Don’t get me wrong: I’m sure there are honest men and women out there trying their best to do their jobs with integrity. But there are still plenty who are not.)

    what makes this worse is that LL waited until the last minute to pull this crap. The judge should take into consideration that she had a few months to square away her rehab details, but was jetsetting around the globe partying in south america, etc.

    They should throw her in Jail for a bit, AND then make her do the 90 days of rehab after (no concurrently)..

    I have a feeling the end is near for her. I think she might go on a huge bender before going to rehab and end up dead. It is sad that she has no one in her life steering her in the right way. Her parents are awful people. It really is sad.

      I don’t even care anymore if she dies; I just hope she does it without hurting anybody else. Statistically speaking, she’s just as likely, if not more than likely, to hit someone else when she’s driving around on one of her benders than she is to hurt herself.

      There comes a point in life where you just can’t blame your bad parents and your sad upbringing for your failings anymore. This is true no matter what situation you are in life. It’s even more true when you’re a formerly rich celebrity who had chance after chance after chance handed to you on a diamond platter, and you had multiple concerned people trying to help you, and access to some of the best rehabs out there. Lohan likes being like this and she enjoys getting away with it, and will never voluntarily change.

        @duncecap – And it always does seem to happen that way, doesn’t it? Just recently we had a case here in MD where this guy was hit by a drunk driver as he was standing on the sidewalk in front of his place of business (Baltimore City Hall!) – he just went outside at lunchtime to enjoy a few minutes of sunshine and some asshole ran him over and killed him. The other guy was okay, of course!

    I think I’m going to start living with a new attitude. I’m going to assume if I want something, everyone will bend over backwards to give it to me. If something doesn’t go my way, I’m going to whine and make it go my way. And though I’ve never been involved in the legal system, if I am I’m going to tell the judge and prosecutor exactly what I want, when I want it and how they’re going to get it for me.

    I’m torn! On the one hand I would hate to see her go away for any length of time, how would I get my daily crackie updates? Who would I turn my snark to? On the other hand I wonder how can she get away with all of this stuff? Who is she blowing? If I was a DA I would be foaming at the mouth to teach this crackvoiced pig a lesson, yet they continue to let her walk all over them.     First of all, this constant “90 days” in jail thing can’t be right. She’d get 90 JUST for yesterday’s violation. Top that off with the violation on the jewelry case she got when she pled no contest in the lying to Cops case, plus the punishment for that lying to cops crime, and she is looking at WAY more than 90 days in the clink. She took the 90 days IN REHAB as an alternative to a longer jail sentence…and now that sentence would presumably be even longer.

    Or am I more delusional than LoBlo herself?

    I used to roll my eyes at this chica but now I’m mad. She’s been given chance after chance on top of chance and she just throws it away. How does she manage it? How many people get screwed in the California Justice–screw that “Legal System” and this walking tornado of fail, coke, and poor choices is still doing her thing?

    I wasn’t calling for Paris Hilton to be put in jail but Lindsay needs to be put under the jail. This judge needs to get some testicular fortitude, throw the walking biohazard in jail for the full 90 days or if she can’t hack it, a mental health facility.

    Supposedly fear is the beginning of wisdom and she has neither.

    Oh geez-why do people think still think she’s ever going to jail? I mean, for an actual sentence-being sprung after 90 minutes because of overcrowding doesn’t count. I don’t know why she’s so pissed at her lawyer-despite his in competence, he’s still managed to get her LOTS of publicity and she’s still doing whatever the hell she wants and for no money too.

      Lemon, I completely agree. My Dad was a hardcore addict and in and out of prison my entire childhood. ENTIRE childhood. The only thing that got through to him was locking him away for years. It’s really sad to see someone go down this road. I can’t ever imagine taking glee or wishing death on anyone in this situation.

    Well I can’t say I’m surprised at Lohan. I am surprised at Shawn – I guess I thought for some reason that she was better than circus-style business dealings.

    1. How can Shawn do anything if she is not officially representing Lohan and hasn’t dice January.

    Lohan clearly has the BEST PR team in the world! (Sarcasm). What are they thinking? I can’t believe they think that any of her decisions over the past year are in her best interest and are clearly enabling her every move.
    Ever heard of crisis or reputation management? If Lohan wants to try to resurrect her “career” (her words… I don’t think she has an ounce of talent for – or interest in – “real” acting) then she’s going about it in the worst way possible.

    I say good riddance and don’t let the door hit ya where the good lord split ya!

I guess Shaun just needed a respite from LILO & now she ready to come out fighting for her again. I hope for SHC it’s like one of those bad relationships where you make that mistake of letting the person back in & 2 minutes don’t go by & you know in your knower it was the wrong thing to do.

Lohan will get by with anything they let her get by with…none of this would be possible without the complicity of judges, DAs, etc. Turn your ire to the public officials- whose salaries YOU PAY- who have allowed this POS to thrive.

      Agreed. There have been people in Hollywood and in real life who have struggled with substance abuse and I have sympathized with them because under the drugs I could see some good. But I think Lilo is just a shi**y person drugs or no drugs

At the time, I rolled my eyes and called it “sensationalism”, but I think about that story every time I read about her pulling these shenanigans.

    Look at Drew Barrymore – now there was a deck to be dealt with …same for Brooke Shields, and look how they turned out? So although harder, this ‘bad parents’ excuse has proven to be not enough to excuse such awful behavior. She has become a sociopath and is such an unchecked narcissist that she will do nothing to improve herself. She is the perpetual victim. She never got sick of herself being a joke… instead, has just found ways to push the envelope. And this is why no one has anymore empathy for her.

    Drew had that moment, and turned her life around.

    Brooke Shields empowered herself and took control of her life.

    Lindsay is another sad story of a child star headed for death. Too bad she doesn’t love herself enough to put on the breaks.

    So, I’m guessing that Shawn Holley made an agreement with the Betty Ford Center that the Cracken isn’t subject to the same rules and regulations as the other patients. She’s going to treat this as just another spa vacation.

    Blohan will probably still get day passes for shopping, Starbucks and trips to the hair dresser. She just won’t be able to make extra money by calling the paps and selling the photos.

    Betty Ford is incredibly expensive, but it worked for a family member when nothing else did so I give it high marks. But it takes time, and preferably includes family members in regular group therapy sessions. I doubt LL will stay long enough, and her family (parents) probably need an extended stay in rehab as well. It also takes a commitment to changing your environment once you leave so the old temptations, friends, etc. don’t drag you down. In other words, I doubt this will be any different than all the other times, but I wish her the best of luck. She’s going to need it.

      It’s not the place but the person if your dedicated to getting help then the treatment will work. if your not dedicated then no matter how great the rehab facilities is, its not going to change a thing.

    She’s Been there…Done That…Escaped from the sober living house. Maybe this time they have a “lock down” facility, I personally don’t see how the program (allegedly based on the AA 12 step program) has changed since she was last there. Maybe they will make one tailored made to her “terminally unique” illness. Did they allow her to take Adderal the last time she was there? I kind of thought they taught complete abstinence in their program from people I know who have gone there.

      He seemed nutty, but didn’t know what he was doing? I don’t know. He still managed to negotiate a deal where she could go to an unlicensed facility in CA where she could smoke and probably shoot up too. So he couldn’t be that incompetent.

      Then again, it seems that no matter who represents or doesn’t represent Lindsay, she always gets off. I swear she could walk up to somebody and shoot them point-blank in full view of twenty cameras, and still get off with community service or something.

        He was disbarred in New York a few years ago. Apparently he’s so dreadful the prosecutors there used to, out of pity, quietly tell the man’s clients that they might want to get a better lawyer.

        I think Heller’s willing to be unethical, and that’s why he was of value to The Cracken. He ambushed the prosecution with a change of rehab, then spin-doctored the situation such that the judge said, “Well, it might be okay, so fine for now, until the prosecution has a chance to investigate.”

        But the new rehab was pretty clearly not one that would have ever been acceptable. Heller was trying to pull a fast one–which is perfect, because that’s exactly what Lindsay was trying to do too. They’re a good fit for each other–both have zero integrity and zero shame.

        Yes, it does look like that. Apparently she can’t do anything bad enough to get her the same treatment an ordinary person would get, i.e. a real prison sentence. Robert Downey Jr. was sent to prison, not county jail—prison—for a year & he hadn’t pulled half of Lindsay’s skullduggery.

        To me, it says everything that no judge has even suspended her driver’s license. That’s the least they could do. What did that last judge do—“suggest that she not drive”? Hahaha!

        People don’t get “suggestions” not to drive in the real law enforcement world—they lose their driver’s licenses. The entire thing is mind-boggling.

I mean none of the reasons she was arrested are for drugs so why does she get to decide to go to rehab? Can anyone who is arrested demand rehab over jail and even get to pick when they will go? This is what is baffling to me.

      The police had evidence she had been drinking, but because Lindsay claimed she wasn’t driving, they didn’t give her a breathalyzer.

      Then it turned out she had been driving, hence her conviction for lying to police.

      And the rehab was because alcohol had been a factor in the accident–although the authorities didn’t realize it until later.

    Why not call Jupiter Neptune and the ground the sky. Linzo was assigned to a certain rehab center as a plea bargain deal to avoid jail a real treat from the justice system for her. Lindsay has no intention of reforming herself as she attempts to shop around along with her shady lawyer for a rehab center that is less serious and will let her do her stuff that puts her in the state of where she is now. How much longer will Lindsay continue this cycle? This cycle has been going on for nearly ten years, more arrests and threat of arrest, more court room appearances, more personal debt, more unprofessional behavior on set and more drinking, drugs, chain smoking and hard parting. It is stupid how Lindsay just does what ever she wants in the justice system with impunity and some kid who made the mistake of holding pot get turned into a hardened criminal who will never be hirable. We know the law will tolerate Lindsays shenanigans and so will any BOTB production company who hires her but how long will Lindsays body tolerate

    The latest from Lainey is Morningside offered to pay Lindsay $30,000 to get treatment at their facility. When Linds showed up on their doorstep on Thursday, they didn’t come through with the cash so she left.

    Betty Ford has offered to let Lindsay stay at their center for FREE, and that’s why she’s there now. Apparently, Betty Ford wanted a second chance with Linds, after they had done so badly with her the first time around.

    Does anybody really believe that her New York lawyer recommended Morningside to her? Lindsay is the one who knew all about Morningside, he was setting up the New York rehab. She just wanted a place where she could sun herself on the beach and go shopping and visit Disneyland. She’s been telling everybody that will listen that she doesn’t need rehab, so she’s hardly expecting to actually, you know, rehabilitate herself. Several years ago, a judge (the one Lindsay flashed her FU fingernail at) was thinking of sending the lass to Morningside for 90 days (when it was still a licensed residential rehab) but she ended up at UCLA instead for rehab and mental evaluation. (UCLA pushed her into outpatient after only a month, and two weeks later the lass tested positive for cocaine.)

    Were there any other California rehabs on the list already approved by the DA’s office? I thought the whole idea was for her to do rehab and community service in the New York area since her family is there. She doesn’t even have a place to live in California.

    Ridiculous La Lohan is angry and bitter. She is extremely pissed off at her parents and is taking it out on herself and acting it out. The world around her doesnt make any sense and she can;t trust anyone and hates everyone and everything- you can even see it etched on her face now– she has perma-scowl and that frown line is getting deeper and she cant even force a friendly face– she just looks more and more chaotic and venomous not matter what she tries to say.

    Hell I;’d even believe it if rehab IS “pointless” for her becuase she doesn’t even drink.use that much— seems more likely to me she simply has extreme feelings and issues pent up inside, with no structure and no inhibition— just lots of money and lots of yes people/pests.
