Larry Birkhead says “I told you so,” media tries to drag it out as long as possible


You’ve surely heard by now that Larry Birkhead has predictably been named the father of Dannielynn Hope Marshall as determined by a DNA test. Addressing the media surrounding the Bahamian courthouse where he learned the results of the DNA test, Birkhead said “I hate to be the one to tell you this, But I told you so!”

Anna’s sneaky companion Howard K Stern has cared for the baby since Anna died, and recently vowed not to fight Birkhead for custody if he was found to be the biological father. Anna’s mother Virgie Arthur may wage a custody battle of her own despite taking Birkhead’s side on the paternity issue months ago. A custody hearing is scheduled for Friday.

Stern has invited Birkhead to spend time with the baby at his Bahamian squatter mansion and says that he will try to ease the transition for the infant.

While baby Dannielynn is expected to inherit hundreds of millions, there’s also the issue of who has control over the trust for the girl. In Anna’s out of date will, her deceased son Daniel was listed as her heir with Howard K Stern named trustee of his inheritance. The trustee earns 3% in trustees fees each a year, which would amount to $12.6 million. No wonder Stern is so quick to befriend the real father of the baby he once claimed was his and ensured was born in the Bahamas.

Now that the speculation over paternity of the sole heir to Anna Nicole’s estate has ended, the media is focusing on Birkhead. Newspapers are running an AP piece today asking who he is and trying to find out more details on the likeable well-coiffed father of Anna Nicole Smith’s only remaining child.

Birkhead is 34, was born in Kentucky, and is said to have a twin brother, but that has not been confirmed. The former paparrazo says he is “capable” of fatherhood and that he is the guardian of some nieces and nephews.

He had a nearly three year relationship with Smith from late 2003 to May, 2006 when they split when she was five months pregnant.

Birkhead has always insisted he was the father of Dannielynn, and is seen as a honorable figure in comparison to the questionable motives of Anna’s final companion Stern.

While Birkhead does seem to geniunely want custody of his daughter with the late playmate, the NY Times notes that the media has shaped his image and painted him as the hero in the Anna docudrama. Now they’re looking to extend this real-life reality series by getting more details on the characters. I for one just want it to be over with, and what nicer ending than a father reuinted with the baby he’s been fighting for?

    I think he has acted with a lot of class thru this whole ordeal, and I also thought he was the daddy since he first started this fight. I watched the interview yesterday, and he acted anything but smug. Hes just glad this part of its over, and wants to take his little girl home!

    I agree gg, If this were a movie it would be the finale.
    They are getting old.
    I don’t see him as actually being able to take care of her.
    The sad thing is if Anna were alive we wouldn’t have gotten this far.
    He better square up that money with Howard and hire those nannies right away.

    I’m honestly relieved. To be honest, I was already expecting that the DNA tests wouldn’t show any results and none of the possible fathers would have matched – and the search would have gone on forever! Birkhead seems genuine, but who knows – can you actually stay genuine with all that money on the back of your mind? But he’s always said that Dannielynn is his child, even before Anna was dead and he would have expected that much money, so.. I wish the little girl and her daddy all the best! The baby needs some peace from all this bullshit going on around her now..

To be honest, I was already expecting that the DNA tests wouldn’t show any results and none of the possible fathers would have matched – and the search would have gone on forever! Birkhead seems genuine, but who knows – can you actually stay genuine with all that money on the back of your mind? But he’s always said that Dannielynn is his child, even before Anna was dead and he would have expected that much money, so.. I wish the little girl and her daddy all the best!     He was trying to establish paternity while she was still pregnant, I don’t believe money is the main motivator here. I remember seeing pictures of him shopping for baby things and setting up a nursery before she was even born. He seems like a nice guy and really, if there was any dirt to be had on him they would have come up with it by now.

    Unfortunately, this news doesn’t mean Larry can just go pick up the kid and go home with her. It has nothing to do with custody, it’s only a biological test result.

    All it means is there’s a new protracted custody court battle for her actual custody. I seriously doubt Howie is going to be so magnanimous as to allow Larry to leave the country with her. But nobody knows what’s going to happen. And now Virgie is fighting Larry as well instead of siding with him.

    This unfortunately ain’t going away anytime soon. One thing I’ve noticed – from day 1 that baby has looked like Larry and looks more and more like him every day. So the testing results aren’t really some great revelation. Whether or not it gives him strength in court depends upon Bahamian law, which is not much like US child custody law.

    I find it interesting from a legal standpoint that Anna did not legally marry Howard in the US while pregnant, particularly if she wanted H.K. Stern to have permanent parental rights for DaniLynne as he maintains.

    It was my understanding that USA family law assigns parental rights to the man who is the legally wedded spouse of the mother at the time of the birth.

    For example, if Howard K. Stern had married ANS in the US during her pregnancy, even if it was known that Birkhead was biological father, then Stern would have legitimate parental rights, not Birkhead. Not to say that a legitimate marriage and assignment of parental rights to Stern could not ultimately be undone by the right attorney, depending on the judge and court, but it is very difficult, and I don’t know what the precedent on that is. My guess, ultimately Birkhead would not have won out and would have bankrupted in the process. Not being in family law, I cannot say this with 100 percent certainty.

    However, A.N.S. never legally married Stern as far as we know, and A.N.S. obviously dangled a commitment ceremony, to appease Stern, giving him a little more legal wiggle room because of the Bahamanian legal system differences.

    What a symbiotic relationship they had. Both bottom feeding off of one another. This Stern character is the ultimate example of an attorney who violates every level of ethics.

Additionally, this is a special situation and involves an estate and Trustee issues, so it will involve both family law and probate and estate planning experts alike.

    My guess on the marriage issue is she was just a commitment-phobe, even to the detriment of her daughter’s future, full well knowing the possible jeopardy. The woman lived one pill at a time and never thought ahead, clearly.

    I also feel she wasn’t really “in love” with Howard, but he may have been in love with her, so she didn’t really want to marry his mooching ass, so they concocted the lame KFC ceremony to make it look like they were a couple. I saw the photo spread and they looked very posed and fake to my eyes.

    i dont like larry burkehead….he is as fake as his blonde hair, and just cannot wait to get his hairy hands on the fortune that the baby may potentially inherit.
    i still wish that the baby could go into some kind of witness protection program where she could be raised by normal people who love her just for being her…set up a trust for the baby that she cant touch until she is about 30. larry dickhead shouldnt get money just because he was a sperm donor.
