Donald Sterling is the 80 year-old owner of the LA Clippers, an NBA team. He’s in the process of divorcing his wife of 50 years, who is currently suing his mistress, a 38 year-old woman named V. Stiviano. (Her photo is above.) Sterling’s wife is attempting to recover some of the 1.8 million dollars her estranged husband lavished on Stiviano over the four years he’s been dating her.
As you’ve likely heard, two audio recordings of Sterling saying horribly racist things have come out. You can listen to them on TMZ and Deadspin. (The Deadspin audio is a continuation of the TMZ tape.) The audio was recorded and may have been released by Stiviano, who is said to be in possession of over 100 hours of recordings of Sterling. (Sterling’s lawyer has denied that his client released the tape.) TMZ reports that Sterling is trying to reach some kind of settlement with Stiviano in order to ensure that no more audio is released to the media.
In what has come out so far, Sterling is heard telling Stiviano to remove all black people from her Instagram and not bring African Americans to see the Clippers games, including famous sports stars like Magic Johnson. Silviano is of mixed race, and that’s not ok with Sterling, who said, of her race, “you’re an enemy to me.” and told her that she should try to pass as Latina. He also told her to remove separate photos from Instagram where she’s posing with Magic Johnson and with LA Dodgers baseball player, Matt Kemp. (Kemp is also of mixed race as Silviano points out in the recording.)
Here’s some of what this doddering racist idiot said:

DS: “You can sleep with [black people]. You can bring them in, you can do whatever you want. The little I ask you is not to promote it on that … and not to bring them to my games.” (5:15)

In the recording on Deadspin, Sterling twists Stiviano’s words, tries to derail the conversation and blame her and it’s frustrating to listen to, to say the least. He plays the victim while saying horribly hateful things and then denying it. Stiviano tries to placate him with juice and by saying she’s sorry when she has nothing to apologize for.
This is huge news and a lot of people are saying that Sterling should be suspended from the NBA. I agree. President Obama, a basketball fan, has spoken out about this controversy. He was asked about it in a press conference while he was in the Philippines and he said, very aptly, “When ignorant folks want to advertise their ignorance, you don’t really have to do anything. You just let them talk. That’s what happened here.” Obama also said that he had confidence that the NBA commissioner “will address this.”
The President then brought the conversation around the the larger issue of race. “The United Stated continues to wrestle with a legacy of race. Slavery and segregation, that’s still there. The vestiges of discrimination. We’ve made enormous strides, but you’re going to continue to see this percolate up every so often. We just have to be clear and steady in denouncing it, teaching our children differently, but also remaining hopeful that part of why statements like this stand out so much is because there has been this shift in how we view ourselves.” That was so well put and true.

Oh my GOD, who cares what some rude old jerk said in a private conversation? Sure he’s an ass (as if we couldn’t tell that from his bold-faced flaunting of his adultery) but he’s perfectly entitled to his opinions, no matter how dumb or nasty they may be. You need to familiarize yourself with his history a little better before saying ‘move along’. The man has been sued over his racism several times. As a slumlord, he refused to rent to blacks and Hispanics. He has been sued for discrimination in the workplace. Among other disgusting things he has done, he would bring his young girlfriends into the showers when his players were showering and say things like “look at those beautiful black bodies” as if they were his property deserving of zero respect.

I l’ve listened to the full transcript of the conversation. What he says is very reminiscent (not that i would know, i was born in 93) of what people used to say during the segregation era. I honestly don’t even think his age has anything to do with it and it definitely shouldn’t be used as an excuse. Sterling was born in Chicago and went to school and law school in LA – he’s not an old grandpa in some backwoods swamp.
And like Mich say, he has a well and storied history of saying/doing racist things. This guy views minorities, and specifically black people, as commodities – assets he can profit off, objects he can benefit from. That’s what his players and his sidepiece are to him. I also think he was jealous of how much Stiviano admires Magic Johnson. Again, i listened to the full transcript and towards the end, he honestly sounded hurt at how Stiviano was talking about what a great person Magic Johnson is. What power does the NBA commission have over the owner of a team? I’m not really familiar with the NBA commission and I’m not a big basketball fan so I’m admittedly pretty ignorant on this subject. I obviously think Sterling is an ignorant jag, but if he didn’t break a law how can the NBA interfere with his property rights? Is there some sort of ethics clause that he broke? Someone enlighten me!!
Silver can’t really do anything and he’s pretty much said as much. It’s up to the owners’ association to handle this, but so far, only three have spoken out against Sterling. Michael Jordan is the only non-white owner, too, so I’m not holding my breath for any real change to happen. These people knew how bad Sterling was and they still approved his purchase of the Clippers, so I don’t expect them to suddenly be not-okay with him and boot him out.
Commissioners–NBA and NFL at least–are like American presidents. They can’t change any laws but can suggest changes. The owners are one house of Congress, the Players Union the other house. So he can set agenda, he just can’t do it willy nilly.
If Sterling has violated something *monetarily*, the league–and therefore Silver–can then take over ownership (like the Hornets in the NBA or the floundering Coyotes were propped up by the NHL). But since he hasn’t, the team will likely stay with him.
HOWEVER since he is in the midst of a divorce and the team was purchased while he was married and California is No-Fault, his wife could take ownership if the blowback is loud enough.
big basketball/NBA fan here and I think it’s obviously beyond appalling and pretty bummed that the Commissioner is limited in what he can do. Within his official capacity, the Commissioner is still “working for” the owners. That’s the structural hierarchy in the NBA. In terms of punishing him, the Commissioner can do:
1. Fine him a couple of million dollars (drop in the bucket for a guy who’s a billionaire)
2. Suspend him.
Neither of these measures is severe enough IMO. A suspension is temporary and money is hardly an object for this guy. That’s why commentators and sports personalities (like Stephen A. Smith) have been encouraging other owners to speak out against him and that the NBA should issue a statement akin to: “We don’t have the power to strip him of his owner’s rights BUT as a league we do not want to have anything to do with him.” The idea is to devalue the team and lower its worth so that corporate sponsors take notice and pull out–further devaluing it.
The idea is that a guy like this may not care about all the “noise” associated with what’s happening but he’ll care if a team valued at $550 million starts to lose its value drastically because of what it’s worth.
But at the end of the day- very little a Commissioner can actually do to pressure an Owner to sell or to strip him of his powers =\
Let me make sure I understand. No one can really do anything directly to Sterling, they can only do indirect things to devalue/hurt the team/franchise? By indirectly punishing Sterling, it’s going to directly punish a lot of innocent people who work for the team. How sad.
It’s really frustrating that Commissioner Silver doesn’t have any further recourse than maybe (I repeat MAYBE) taking away/lowering a draft pick, or levying a fine on Sterling for “conduct unbecoming an owner” as a representative of the league. The way the NBA is structured, Silver can’t remove Sterling from his position as an owner because it would violate anti-trust regulations, and we all know Sterling is sleazy and douche-y enough to sue.

It is like how in states like Iowa it is illegal to videotape food processing plants…where past recordings have documented unsanitary food handling (including one that lead to a 500 MILLION egg recall). Food manufacturers have made it illegal to tape them committing CRIMES. How is that just? Documentation of illegal activity, especially when it comes to food contamination or employment practices, shouldn’t be discouraged, IMO.

The wife is suing for Transfer of Community property. If they finally divorce, she is eligible for half of his billions. I think she is suing proactively for the $1.8 Million to prevent him from unloading a lot more of the community property to the mistress to hold during the divorce. Some men put their money in kids accounts to keep it away from their wives in divorce settlements.

Ack. The law is clear – a cheating spouse cannot divert household resources to an outside party, which is exactly what happened here.
The reason the mistress is so furious is probably because her lawyer explained to her that all those fancy things are going to be taken away from her and she doesn’t have any right to keep anything. This was one of those stories that my eyes just got wider, eyebrows higher and jaw dropping lower the more comments I read. They’re so horrible as to be unfathomable but unfortunately the attitudes are more prevalent than we’d like to admit. But on reflection this really isn’t a stand alone incident, or at least not an isolated one. Since about oh, I don’t know, Nov 2008 many comments that would normally be private have been made publicly. Obviously this guy thought they were private though.
How to suspend him? He’s still the owner of the team, can they oust him without it affecting the team playing. If they kick him out can’t he pack up the organization, or can the NBA force him to sell the franchise? Anyone know? I thought the players’ protest was about as much as they could do within the confines they have, I mean they still want to play. They still have pride in their work and their achievements. I don’t know about her pride, I mean WHAT THE???!!!!
I’ve been wondering about the legalities of this as well. I have so many questions:
1. were these private conversation (between Donald and V)? if so, can’t he technically sue her?
2. how can the wife sue the mistress? I remember reading a few years ago certain states allowed wives to sue mistresses – but on what grounds? Her husband is the one who allocated funds to the mistress.
3. How will Donald be penalized? Has there been any discriminatory practices with hiring? His blatant racism is disgusting, but is there a legal course of action that can or will be taken?
4. What can the players do? Surely they are under contract, but can they claim hostile work environment and opt out of playing?
5. This question is a little off topic – if there is legal recourse for his being racist, how will this further affect the NBC and NFL? If someone can be suspended or removed from their position for being racist will the leagues begin taking violent offenses more seriously then too? From the very basic knowledge I have of some football teams and basketball teams it seems like some players have been charged with violent offenses and are still allowed to play (example: rape, battery, etc).
6. Not a legal question – but how could this women sleep with him? Are material possessions really worth your dignity?
I don’t know the answers, but, as to number 1, I think that in some states, only one party has to be aware that the conversation is being taped for it to be legal. Blackmail is illegal, though, so I’m not sure why he isn’t using that.
As to number 2, I have heard of people winning over a million dollars by suing for alienation of affection, which is still on the books in some states.
1. California has a “two-party consent” rule where both people must know they’re being recorded http://www.dmlp.org/legal-guide/recording-phone-calls-and-conversations. However the initial audio was overheard at a basketball game, a public place, and is not subject to this.
2. She can sue because they have been married in California. She is making the case that that was “her money as well” that bought the mistress’ lambo. Since it was tagged as a gift, Mrs. Sterling will probably not get anything since the law has strict rules on gifts aka “No Take Backsees”.
3. He’ll probably be suspended and have to pay a fine. The owners hold the power in the NBA. Sterling LOVES going to court. He’s got money for days. He’ll tie you up in legalese for ever and watch your bank-account die.
4. The players can demand to be made free agents but I doubt the NBA would do so. They (the NBA) might allow it in this case but I am not holding my breath. He has been accused of work place sexual harassment and racism before and he just settled out of court. Again, money.
5. NBA players rarely get into trouble anymore (and I say this as a person that loves NFL ‘ball 3634% more than basketball). The NFL usually goes by the, “Is it in court yet? Innocent ’til proven guilty I NEED SOME SACKS FROM ALDON SMITH!” Star players (Ben Rothis–not googling, Aldon Smith, Ray Rice, Ray Lewis) benefit from being stars when you KNOW if it was the 2nd string punter, they’d be out on their arse. UNTIL it’s something like Aaron Hernandez and oh wait, people are dead, get out. If Star Power !=|> crime, you are safe. In reality, the NFL cares about what hurts it’s image, not so much of the court issues.

The point in the conversation where she asks if he wants her to change her skin color and the tone in his voice is all “Holy crap! You can DO that!? Wait while I get every credit card I have!” Before he realizes she was being facetious made me just about throw up. As if by changing skin color, one would somehow gain the humanity to not be treated as an “enemy” and be equal instead. With this whole fubar convo, I don’t even know where to begin.
