Johnny Depp wants Amber Heard silenced with a confidentiality agreement

Remember when we thought this summer was going to be full of drama and tragedy from Johnny Depp and Amber Heard? While there was a solid month of drama, by the time their hearing was postponed back on June 17th, the craziness had started to die down. They’re scheduled to appear in court on August 15th to give testimony about the abuse, the restraining order and more. Since mid-June, there’s been relative quiet, which I suspect has been the goal of the lawyers and the court anyway. I’ve been hoping that Depp’s lawyers and Heard’s lawyers have been quietly negotiating some kind of comprehensive settlement. But now I don’t know. Depp’s team has filed new documents aiming to keep Amber and her team silent. Depp’s lawyers are asking the court to put a confidentiality agreement in place so that they can turn over Depp’s financial records without it leaking. Here’s part of the filing:

“Johnny does not dispute that Amber is entitled to the majority of the information sought in her discovery requests and subpoenas. He willing to produce the documents necessary for Amber’s evaluation,” the docs read. “He has asked, however, that a confidentiality agreement be executed prior to the production of documents in order to protect the parties’ privacy. This case has been extraordinarily public since its inception. There have been daily articles in the domestic and foreign press about this proceeding and the parties’ lives. Every detail of this action has been chronicled by the media and it has become one of the most heavily publicized celebrity divorces in recent memory.”

Thus, Depp’s team argues, “Amber’s need for financial information to resolve this case is distinct from the public’s appetite for information about celebrity divorces. Yet Amber has inexplicably refused to sign any agreement to maintain confidentiality in this action. Johnny has proposed two different versions of a confidentially agreement and has expressed his willingness to consider revisions and/or an alternate agreement drafted by Amber’s counsel.”

The documents reveal that Depp—to no avail—asked Heard to sign a confidentiality agreement on May 27, 2016, noting that many media outlets have sited “sources close to Amber” in their coverage of the divorce. In fact, Depp’s lawyer, Laura Wasser, pointed out one TMZ article in which she believes Heard’s attorney, Samantha Spector, leaked information to TMZ

“We agree to your proposal that ‘both sides would do everything in their power to prevent any further publicity and/or media disclosures about this matter, the case and the parties’ without exception,” Wasser states. “On 6/10 TMZ posted a story which contained specific provisions of the verbal settlement offer made to you…Not only did you not comply with your proposed agreement, you violated provisions.”

The documents also indicate that the two teams tried to settle in mid-June into order to “avoid media exposure” and “resolve the matter amicably,” and that Depp was willing to use the mediator Heard proposed. However, they failed to schedule a meeting. Now, as Heard proceeds to request more information, Depp continues to press for confidentiality.

“Johnny is merely trying to protect the documents and information Amber seeks from unwarranted disclosure to the media and other individuals not involved,” the docs read.

Does anyone else think it’s a bit rich for Depp’s lawyer to cry foul about Amber’s team leaking to TMZ? Throughout May and June, Team Depp was leaking to TMZ on a daily basis. TMZ was running pro-Depp stories consistently, full of information that only people deep in Depp’s camp would know. While I don’t doubt that Amber’s team has leaked information to E!, People and TMZ as well, turnabout is fair play.

I also think it’s interesting that Depp wants such a tight rein on his financial information specifically. In the past month, Depp has been making some strange financial moves, like selling his Basquiat paintings and putting his French chateau up for sale. Hm…

      I would assume to make sure he isn’t hiding money by letting the band mates make $1000s on gigs where he claims he only made $20 and then getting it back from them after the settlement. Similar to how Taylor Swift didn’t buy a house next to the Kennedys, but rather had one of her people buy it for her. So she didn’t technically buy it, but it’s hers. Depp could be technically not making money from his band, even though he is.

      I can only assume she thinks they’re hiding assets for him? I have absolutely no knowledge on legal matters like this … but maybe he’s been funneling money to them that he will be getting back after the proceedings are complete?

      In divorces where one of the parties is a touring musician, it is typical to get financial details about the funds spent/generated by the tour as a whole.

    I hate to say it but his request is entirely reasonable. Unless the confidentiality agreement goes beyond the scope of the financial documents? I continue to believe her but this is poor strategy if true.

      Once again, Depp is trying to portray himself as the victim. I seriously doubt the confidentiality agreement was limited to his finances. At this stage in the process, it would be foolish for Amber to give up her leverage.

      As for why Depp is so paranoid about his finances (if that is, indeed, his real motivation), I suspect he has blown through an ungodly amount of cash in recent years.

        Exactly. The financial thing is the excuse, the reason put forward to justify gagging Amber but I have little doubt that the agreement as set forth by Depp’s team is limited to said finances. He wants to shut her up. She’s smart not to sign. If anything, she should counter with a confidentiality agreement that is expressly limited to the financial aspects and includes nothing else, if that’s possible.

        It’s perfectly reasonable for Depp to want that info kept private, but I highly doubt that’s the only thing he’s trying to keep private here.

        I completely agree with you, Megan. Just as he probably didn’t heed his attorney’s and Ms. Paradis’ likely recommendation to draw up a prenup, he may have ignored his accountant’s advice on so many things.

        I still can’t believe that Mr. Depp hasn’t been urged to see a doctor, or perhaps he has, but refused.

      I agree with Megan. They claim they’ve submitted two agreements for her review, and I guarantee you neither of those agreements were limited to disclosure of his financial information. If they had been, I doubt she would have refused to sign. They would have included provisions to try to silence her regarding the domestic violence, hoping if it wasn’t in the press, people would eventually forget and he’d be able to rebuild his image and brand.

      I read an article yesterday where it was stated that not only did he want financials private, but also WITNESS testimony. Boy does NOT want evidence of his abuse out there in public records. THAT’S most likely behind her not signing a NDA. A$$wipe!

        Exactly! There’s no way that he just wants her to shut up about finances. Because she would’ve signed it back in May! Interesting that he tried to shut her up on May 27th and she refused to sign that crap since then.👏🏾👏🏾👏🏾👏🏾 I’m pretty sure witness testimony is public record in California so he can’t stop that anyway.😔 If she’s lying then sue her like she sued your buddy Satnkhop Depp! He wants to keep her quite for a reason.

        I read it as a confidentiality agreement for any expert witnesses dealing with the financial documents. I also understood that Amber’s lawyers were invited to modify the agreement or come up with their own version, but chose not to. It doesn’t really matter at this point, because the court is being asked to impose confidentiality and they will make a decision about what is reasonable.

    I bet the terms were unfairly broad. Like they require her to be silent on the eventual settlement which would allow him to screw her over. I bet they also tried to sneak in terms that would have silenced the DV too. I’m glad Amber is being smart. I hope she never signs, I want a proper tell all when she eventually publishes her story; and you know she will, eventually.

      Exactly. Her entire plan has been to play this out in the press to her fullest advantage. She doesn’t want a private quick divorce. She has been leaking everything to the press and putting roadblocks up and delays to drag it out as long as she can. And as an abuser of record (Amber) she’s very familiar with how to play the system (courts and police) as well as play to the public. She is a succubus and I hope she gets screwed at the end of the day just like Mel Gibson’s last baby momma.

      Actually, this proves the opposite. If she only wanted money then she would sign the confidentiality agreement, get the check, cash it and go live her life. She is saying no to the money in exchange for her to be able to tell her story & she is not taking the money for a muzzle.

    I can understand wanting his finances kept private because they might reveal medical history within them, so I don’t see why it’s so hard to understand. Besides why should his finances be made public it’s not like he was caught in a ponzi scheme that took money from innocence people. The wanting to know band members finances is just weird no matter how one looks at it. Also why does she keep wanting things from before they were married? First the condos and range rover, now this? That’s not what she’s entitled to. Doesn’t she see that by continuing to do that she comes off as a golddigger. I don’t think she has good representation.

      He is perfectly justified in wanting that info kept private, but it’s highly likely that isn’t the ONLY stuff he wants kept private and the confidentiality agreement reflects that. She likely hasn’t agreed because of that. She keeps asking for stuff she isn’t “entitled to” so she has bargaining chips to “give up” during negotiation. There’s always a back and forth with concessions on both sides, but if you have nothing to concede it can get unfair very quickly and you could end up with far less than you’re actually entitled to. Depp’s team is playing that for all it’s worth to make Amber look bad, even though it’s a very common and expected (at least by the lawyers) tactic.

      Yes there is a reason to sign. The divorce gets over quickly, and she would get a settlement she could live with. Her real leverage is her knowledge and her ability to stay quiet. I see only one reason for her to not sign any kind of confidentiality agreement. She thinks he is broke or limited resources, and signing one means she couldn’t make money off of a tell all then. Still think that might be a pretty big long shot. I think Johnny probably has more money than she could make off this story. Shelf life on these stories with the public is very small.

      As far as criminal charges go, all of her actions and correspondence really don’t show that she is that interested in pursuing that avenue. Again I know the police would have to pursue, but they do need a willing victim, and she hasn’t really been that as she hasn’t filed anything formally complaining, just calling them to an incident and applying for a restraining order. Honestly, reading this and others I think this is just lawyers posturing, and typical of most contentious divorces with abuse thrown in, but this isn’t about the abuse here. This relationship is a lot of things, but it is a very contentious divorce so this is not a surprise. I am sure with a bit of negotiating they will settle. Hopefully, Amber gets what she wants and needs and can move on.

        I used to think it was suspicious that she didn’t take legal avenues, but then I read about domestic violence conviction and sentencing. The crime she accused him of (throwing an iPhone at her face) is a misdemeanor and a very low one since he didn’t cause her severe injury. The punishment is probation and community service AT BEST. He would be let off with a warning since he has no previous record of domestic violence. Given that, I think it’d be pointless to file charges. He wouldn’t even be punished.

        But surely the punishment isn’t important, it is the conviction that counts, it is the principle. A restraining order isn’t going to stop him if he really wants to get to her and hurt her, it requires a relatively low level of proof so a lot of people will not be convinced by it and there is a very good chance it will result in her not being invited to industry events, if it means he can’t go. A conviction would make it very difficult for the industry to invite him over her and it would a big boost for other DV victims.

    I think it’s perfectly reasonable that he would want to keep his financials private. It’s no one’s business but theirs. He’s entitled to spend his money how he wishes, whether it’s on drugs or bad jewellery, he earned it. Though whether he deserves such incredible wealth it is another thing entirely.

    It’s not possible to violate provisions of a “proposed” agreement. Somebody please call out attorney Wasser on that. If it wasn’t signed, just put in front of you for consideration, it isn’t anything to abide by. Heard did not violate any provisions because as the offers were rejected. But yeah, keep playing Depp as the victim.

    No doubt, the confidentiality agreements proposed most definitely cover more than just his finances. I actually see the continual reference to financial disclosures as a smoke screen. This is about forcing her not to tell details of his abuse. The End.

    P.S. Though I’m sure his finances aren’t as impressive as they used to be. Coke and booze expenses add up pretty quickly.

    P.S.S. That has got to be the most God-awful hair cut I’ve seen in a while. Not only completely unflattering, but bordering on Arian Nation style. Now is not the time to be trying to look like some kind of biker criminal. Just dumb!

      I saw a brief interview with Marilyn Manson, and he said that he and Johnny shaved their hair into mohawks together. Manson shaved Depp’s hair. He was also “joking” that he and Johnny were engaged now. Ugh.
      It was at the AP Music Awards red carpet interview with Manson.

    His lawyer Wasser is friends with Harvey Levin at TMZ! So who’s been leaking stories to them? Immediately after Amber filed for divorce tmz did a hit piece on Amber with an article about how much his family ‘hated’ her. That was before the abuse allegations came out so they wanted to try and smear her because they knew what was coming. Who leaked that phony story to tmz. Couldn’t be Wasser right?😆😆 And I don’t blame Amber for not wanting to sign any confidentiality agreement because she’s been controlled and abused by him for years,and now he’s still trying to do it. There’s no way he wants her to shut up only about financial stuff.     I’m sure most people in his life have to sign an agreement to stay quite because I read a story last year from Depp’s nephews ex wife,where she claimed that Depp and his sister had a falling out over the care of their mother. She had to sign an agreement saying that she wouldn’t contact Depp or their mother. It was nullified because he used a fake name to file🙄🙄

    All the people in his life on his payroll/enablers have signed theses agreements. That’s why the people around him won’t tell him the truth. They’re being controlled and by money and silence and don’t want to loose their buddy/paycheck.

    I certainly would not blame her if she went for the money and exited this hellacious mess. But I hope she does not. I hope she stays the course. But we have no right to ask her to do that. While I would love for once to see a wife beater held accountable, society, the media and everyday people in her life make a beaten woman’s road incredibly difficult.

    And yes, I totally see the “confidentiality agreement” as a way to shut her up. He can say its about his financial assets, but he is looking for a way to keep her from testifying under oath that he BEAT HER repeatedly.

    According to People the confidentiality agreement is also about declarations of witnesses and experts to testify, that must sign non-disclosure agreements before. So it’s obviously not only about his finances but more than anything about what could come out in the court about the DV

    But even if it were only about the money, the comments from his lawyer are one of the best examples about why Amber must not sign an agreement. Johnny’s lawyer has been leaking information to TMZ on daily basis all these months but then she accuses Amber’s lawyer of leaking information one time in May 10 (just because TMZ said it was a source “close to Amber” which may not be truth). Who says that after Amber sign a confidential agreement, Johnny’s team wouldn’t leak info and blame it on Amber and take her to the court and get a good vengance? Does anybody think Johnny or his team of snakes are trustful to not plan a plot like that?

        I think it is highly unlikely that Wasser is asking the court to impose a gagging order that would prevent people from testifying in the court. The reference to May 10 was linked to Heard;s team, I believe, because of specific details that had been discussed between the lawyers.

        It’s not about to prevent people to testify, it’s about that those declarations must be “confidential”:

        “Johnny Depp has filed a petition seeking to keep the legal proceedings in his ongoing divorce from Amber Heard out of the public eye.

        According to court documents obtained by PEOPLE, Depp is requesting to keep any forthcoming information discovered during the proceedings, including financial information and witness statements, as confidential. Furthermore, he is requesting that any experts or witnesses who testify in the case be required to sign a nondisclosure agreement…”

        In other words, to prevent that any of the declarations of Amber’s witnesses to be known by the public. Amber already had forensic experts listed between her legal fees, she’s obviously getting experts to declare in the court

    I’m going through a divorce myself, though my ex and I are mediating, very cordial so far. Divorce with lawyers is a power game though, and I don’t think that Amber played her hand well in the media. Overall l just don’t think that the public is sympathetic to her, and I think it’s best for both parties to keep things private. Depp will not go down without a fight.

    While I have no issue with Depp wanting to keep his financials private I think its ridiculous that his lawyer is accusing Heard’s team of leaking stuff and talking to the press and the public when it’s Depp’s lawyer who seemingly has TMZ on speed dial.

    I could easily see Heard wanting to know if money is being funneled by his band, so that makes it relevant to the divorce. I could also see her team turning down the confidentiality agreement proposals from Team Depp because they are too broad and not specific enough to the finances and could open her to a suit from Depp if she talked about the abuse.

    Depp doesn’t strike me as trustworthy when his friends write articles on the Internet accusing his wife of blackmail (and Depp approves of these actions, judging by him texting Stanhope “thanks for being honest” and supporting him at the comedy club afterwards), so I imagine that makes agreeing to any confidentiality agreements or settling out of court difficult.

    @Shockadelicia81 He tried to get her to sign a confidentiality agreement on the 27th of May because she had said via a letter from her lawyer to Johnny’s team that she would go public if he didn’t agree to her demands by the 27th. Nobody, and I mean nobody would want allegations of abuse going public whether true or not. So he tried to keep her quiet so that she wouldn’t tell the public anything. If the allegations are true of course he would want them quiet. If they are false he would also not want them public. It makes perfect sense to ask for that no matter how true or not true the allegations are.

That story came from Stanhope’s article.She wanted to keep this private in the beginning, but almost immediately Wasser ran to Harvey Levin and started trashing Amber then she decided to not hide this anymore.And if the accusations are false of course you’d want that out in court because that’s a perjury charge. Let them keep lying their asses off!
