We had to know this was coming. Once the first Melania Trump controversy came, you knew that people would start looking at her story more closely. Basically, it’s been open season on Melania ever since she stood up at the RNC two weeks and gave a partially plagiarized speech. Since then, we learned that, oh right, Melania has been lying about having a college degree for years too. The Trump campaign maybe (??) released some nude photos of Melania in the hopes of distracting everyone from weeks of controversy, but now it looks like those nude photos are going to be the centerpiece of yet another mess. Those nude photos were taken during Melania’s early years in New York, where she worked as a model. But… now people are examining the time line and wondering if Melania’s immigration status was always completely legal. As in, she probably fudged her visa paperwork for years so she could model in America, despite her own claims that she went to Europe periodically to renew her visa. Nude photographs published this week are raising fresh questions about the accuracy of a key aspect of Melania Trump’s biography: her immigration status when she first came to the United States to work as a model. The racy photos of the would-be first lady, published in the New York Post on Sunday and Monday, inadvertently highlight inconsistencies in the various accounts she has provided over the years. And, immigration experts say, there’s even a slim chance that any years-old misrepresentations to immigration authorities could pose legal problems for her today.

While Trump and her husband, Republican presidential nominee Donald Trump, have said she came to the United States legally, her own statements suggest she first came to the country on a short-term visa that would not have authorized her to work as a model. Trump has also said she came to New York in 1996, but the nude photo shoot places her in the United States in 1995, as does a biography published in February by Slovenian journalists. Representatives of the Trump campaign and the Trump Organization did not address detailed questions about the timing and circumstances of Melania Trump’s arrival in the country, but campaign spokeswoman Hope Hicks responded to the emailed questions by stating, “Melania followed all applicable laws and is now a proud citizen of the United States.”

The Trump campaign and Trump Organization representatives did not address questions about the type of visa Trump first used to enter the country, but it has been widely reported that she came here on an H-1B work visa. Writer Mickey Rapkin, who interviewed Melania for a May profile in the luxury lifestyle magazine DuJour, said she confirmed as much to him. “When I interviewed Melania, I mentioned that she’d come to New York on that H-1B visa, and she nodded in agreement,” Rapkin wrote in an email to POLITICO.

Trump’s tale of returning to Europe for periodic visa renewals is inconsistent with her holding an H-1B visa at all times she was living in New York — even if it was the lesser-known H-1B visa specifically designed for models — said multiple immigration attorneys and experts. An H-1B visa can be valid for three years and can be extended up to six years — sometimes longer — and would not require renewals in Europe every few months. If, as she has said, Trump came to New York in 1996 and obtained a green card in 2001, she likely would not have had to return to Europe even once to renew an H-1B. Instead, Trump’s description of her periodic renewals in Europe are more consistent with someone traveling on a B-1 Temporary Business Visitor or B-2 Tourist Visa, which typically last only up to six months and do not permit employment.

If someone were to enter the United States on one of those visas with the intention of working, it could constitute visa fraud, according to Andrew Greenfield, a partner at the Washington office of Fragomen, Del Rey, Bernsen & Loewy, a firm that specializes in immigration law.

There’s a ton of information and evidence in that Politico story, and I would recommend reading the full piece. The gist is what I excerpted though – Melania and Donald have both lied about when Melania came to America to model, which was 1995, not 1996. She’s lied and misrepresented the status of her visa in those years, and likely lied about what kind of visa she had. She is a citizen now though, or at least that’s what she says – she became a permanent resident of the US in 2001, and a US citizen in 2006, more than a year after she married Donald Trump, as all foreign nationals married to American citizens can apply for American citizenship. 2006 was the same year Melania and Donald welcomed their son Barron. Which begs the question: is Barron Trump an anchor baby? I’m sorry!!! I apologize for that joke, but I just kept saying it to myself and laughing.

Anyway, Melania was “forced” to issue a statement about this mess, and wouldn’t you know? Her statement really doesn’t clarify anything. What kind of visa did you have, Melania? Show us your long-form birth certificate visa!!

        My mother came from Europe & I have a lot of friends that are not from the US. The first time I read the piece I think in Vanity Fair (first time Melania tried to spin her story), I told my hubby she was full of crap. When the Politico piece came out yesterday hubby told me someone finally brought to light what I’d been saying all along. It just never sat right with me that she glossed over the truth & got away w/ it, yet her meal ticket wants to throw out millions of people & redo the Visa system. I am still waiting though for someone to explain to me how a highly paid escort, I mean model is an occupation that is worthy of a green card though. It’s not like she was Heidi Klum, Naomi Campbell, or any other well known model. There were & are plenty of beautiful women starting out that could do her job. Just saying.. There is a lot more to her story..

        That reminds me of a comment about American automobile heir Henry Ford’s three wives. The first one was from a “good” family in high society circles. The second one was an Italian countess who lots of style and pizzazz. And the third one was a “model” (rumoured escort) from an auto show that premiered the industry’s new car models one year. The comment was “From class (wife #1) to brass (wife #2) to ass (wife #3)”. It seems that Trump has followed the same path 🙂

        Wow. I’ve been saying all along that I think she was a prostitute and if that ever comes out it’s over. I have never heard anyone else say it. I’m glad there is someone else who sees this! We know she lied about being a college grad, she lied about her visas…I don’t believe for one second she speaks five languages either, unless you count being able to say “me love you long time” in all of them.

      Mrs. Trump claims that the nude pics taken in New York during her 1995 visit was unpaid work, just to get her name out there. But her housing and other costs were being paid for. How many “tourists” get an apartment and other misc costs paid for by a company or an agency? That’s called working honey.

      She was illegally working under a tourist or Business visa that’s why she had to leave the country yearly to get her visa renewed. I knew many foreign students in college with student visas and they were required to leave the US each year for a short time period and then come back. Melania and Drumf have been telling this BS story for years to people ignorant of Visa laws and gotten away with it, same with the degree lies.

      I don’t care about her nude pics or her plagiarized speech but I do care that her husband has been going after other immigrants smugly while she was guilty of breaking immigration laws. This is the cornerstone of Trump’s campaign along with his so-called wealth while refusing to release his taxes.

    And that kind of illegal immigration is the most prevalent here but the least talked about. The people from European or other favorable (Caucasian-leaning) countries, who come on student or temporary visas and just disappear into the vast American landscape. Wanna reform immigration? Start with reforming that. And then let’s see how many people start changing their tunes, when the browns aren’t the main targets.

      You’re right, a lot of people don’t realize how many undocumented (or visa-jumping) pale people we have. Back during the height of the Sanctuary movement, I saw statistics that there were at least as many Irish “illegals” in the US as Salvadoran. I just can’t get excited about such things…. Undocumented folk contribute to this country just as my ancestors did, they just don’t get much back (they actually pay a lot of taxes in various forms) and have to deal with extra stress since their lives (and the lives of their families) could be turned upside down any time. I don’t think I could take the stress myself.

        Used to think ‘expat’ meant you were from somewhere else and on a sort of long overseas work assignment but have come to see it apply to privileged upper-class and generally white people who moved almost entirely by choice (IE not suffering in the old country) – and yet they move through the same immigration process as everyone else. They are, on paper, immigrants too.

      Yes, yes, yes. I know of some people from my country who have done this, or paid americans to marry them. Yet no one even looks because they’re white as can be.
      This is why I believe racism is the base of the problem, not inmigration.
      My own country is struggling with illegal inmigration (and now refugees) and while I appreciate inmigration (as the granddaughter of inmigrants) illegal inmigration is a problem to any nation.

        I have not been following because I am not american and I get very angry about Trump, but after the Khans speech and the aftermath, I have been paying more attention. If he lies about his wife’s situation, he will easily lie about more things. I see that crying baby incident as a big sign of who he is as a person and as politician.
        I am appalled there are people who are his groupies. I am more ashamed that I have family (Mexican descent) who are surely voting for him.

    I vote to give her a pass, ironic though it all is considering her obnoxious husband and his frothing at the mouth over immigration. She’s suffered enough dealing with The Donald…. Anyway, I wouldn’t go after a non-famous person for this under the same circumstances. So I won’t go after her. Yeah, she might have lied about this if those recently published pics were taken in the US (I had thought they were done in Europe?). But I’d rather just ignore it. She’s a US citizen now, has an American husband and an American kid. I’d like to deport her husband, but not her.

    She really didn’t sign up for this. She didn’t want The Donald to run for President. We can have plenty of fun going after The Donald for pretty much everything he says, since he lies all the time himself.

Her husband has made his positions on immigration the centerpiece of his platform and has held her up as a shining example of how it should be done, so long as the immigrant isn’t Mexican or Muslim because all Mexicans are rapists and all terrorists are Muslim in his world view, and she has not only gone along for the ride but given several interviews and speeches putting that view forth. If you don’t want your husband to run for the Presidency, you talk him out of running for the Presidency.

        Anyway – I figure the kid has a hard enough road with The Donald as his father. I remember how worried I was about having to go off in the uncertain custody of my doofus father until I was assured I was old enough that the judge wouldn’t make me.

        I really do think focusing on this will backfire, though. Many people will think it’s bullying to go after her just because she married an obnoxious jerk. So although yes, it is true she has been complicit by giving interviews supporting him, I don’t know what pressure The Donald puts on her. I think we can safely assume the comedians will never let people forget it, and that might be enough to add it to the list of Trump hypocrisies.

        I completely agree with Lilac. She doesn’t get a free pass. Melania and Chump have both BRAGGED about how she’s always been a law abiding immigrant. In fact, she has been portrayed as, “one of the good ones.” Would her lying on this matter be an issue if she was somebody else? Probably not. However, her husband’s platform is allllllll about cleansing this country of illegals, so there ya go. I hope the media digs deeper into her having to fly in and out of the country to get her passport stamped.

    Ooh this makes me so mad. My husband is from the UK and although we knew how easy it was to commit visa fraud like Melania (have him come over on a tourist visa, get married then get our hands slapped), we wanted to do it the right way. Fast forward to a year later and the government still wants information on a warning he received 7 years ago!!!! AND we have a lawyer. I’m glad we’re doing it the right way but by god if this isn’t the most tedious, straining process.

    I think if more privileged people had to go through the same they’d see how difficult it was for someone married to a US citizen, let alone a hardworking brown person. What about the ‘illegals’ with their CHILDREN here? I just can’t imagine how hard that process must be.

    My favorite part of this story is that when the news broke reporters went around asking Trump supporters how they feel knowing Melania Trump was likely an illegal alien and broke our immigration laws and nearly all of them said they didn’t mind.

    Shocking right?? Nope, apparently because it was a long time ago, she has been a good citizen, and that it’s not the type of immigration they’re worried about they were all willing to let her off the hook!

    So reemember guys: the obsession over gay marriage is REALLY about protecting the sanctity of marriage. Preventing female autonomy is TOTALLY about the sacredness of babies lives. Stopping illegal immigration and breaking the legal immigration system down further has NOTHING to do with racism. Making America Great Again while disregarding everything that actually DID make it great to push xenophobia and racism is ALL a figment of your imagination!

    God I truly just have nothing left for the Republican Party, if it withers and dies after this election I might just dance on a table and have a drink.

    i dated someone who arrived in America on a H1B1. He is a scientist is a very specific field of Microbiology so he was extended a offer here. Once here he was able to apply for his green card and get it, meaning that he was no longer commited to the initial employer and can try for employment elsewhere in the US. This was just a precaution in case he was abused and really did need to leave a toxic environment. From what I gathered, that specific visa is given to folks who are working a specific field like tech, science, etc., essentially one that will contribute to the advancement of the country. So, Tangerine is going after this specific visa while abusing it ( which means he forged the reason he was hiring them because he needed 200 ‘engineers’ for Trump Septictank) and his wife should have never had one (really dude, she just gave a interview about it months before). So, they are both liars and commit a serious crime and could potentially be POTUS and FLOTUS. Okay Trump supporters, okay.

That being said Trump and his hypocrisy has made a deal of calling Hilary Clinton the devil, pretending he’s quite religious, and specifically targeting the looks of both his fellow political opponents and their wives. If it comes out Melania was a wank model it’s gonna hit the fan.

I really believe that they’re used as distraction, to show what a great piece of ass Trump can bag, and as bait, to make the left reveal some lower instincts. The pictures might alienate some Jesus freaks, though not if you look at the comment section on Breibart (actually, don’t do that, it will give you bile and headaches). In the mean time, nobody should mirror the far-right’s misogyny.

        I don’t know if people actually care what kinds of photos she did, but she’s always touted as a “model” who broke through, but except for her height nothing about her or her photos really look model-esque occupation-wise to me. People criticize Kendall Jenner for not looking like a true model, but she looks like one next to Melania!

If she was, that would be considered gainful employment and in violation of her visa (assuming she was on the tourist visa). All that needs to happen now is for the photographer to cough up the model release, which he/she has to have done if they had any intention of publishing or selling. Even if she received photos as the consideration, that’s still payment.

    As a naturalized American myself, I am just in disbelief that Melania could qualify for H1B! A lot of my friends came here on work visas and waited for 10-15 years to get a green card, all while holding down full-time jobs, buying homes, and actively and positively participating in the US economy.
    I’m sorry, but what did SHE contribute to qualify for a green card? How in the world could they POSSIBLY justify that they could not find an American to do her job, which is a pretty strict requirement for most work visas? I mean, I have a hard time imagining this even for a super model (invite her for a shoot – sure, but give her a path to citizenship over it?), and Melania sure wasn’t a super model, heck, if those pictures are representative, she’s no model at all.

      As someone who went through about the same amount of struggle as your friend it’s one reason I can’t give a damn about illegal immigration. When you want to do things the right way it’s basically torture and I argue it was a little better back then. Now with everything going on its utter chaos.

        well, there are a lot of horrors in this world that I can’t even fathom, and I am sure at least some illegal immigrants are fleeing those, and some legal trouble over here just cannot compare to what they would have to face back home. So, I could never side eye 🙂 ALL of illegal immigrants.

        Right??? Even if everything was “legal” because it was handled by lawyers, they still had to pull some unsavory shenanigans to get her a green card, I just can’t see how she could honestly qualify!
        I just read the other day that if you can invest $500.000 into an American business or property, there’s a way to qualify for a visa, so I suppose if she was already with Trump or with some other wealthy guy at the time, she could have gotten her green card that way, but that would be supremely funny because I’ve already seen Trump supporters attack Mr. Khan for “selling American citizenships”, a.k.a. making the entirety of America’s immigration law available to his clients.

      Thank you! I am a Civil Engineer and became a citizen through my father. However I have 3 close friends from: Colombia/ Dominican Republic and Eslovania, all of them Engineers with Master’s Degree and 1 with a PHD that qualified for the H1B Visa. This Visa is reserved for qualified professionals not “nude models” sponsored by Donald Trump’s agency….

    Knowing some models myself, they come for 3 months to US – they come for 3 months – they owe the agencies – housing, cell phone, transportation, and money for basics – food/personal grooming etc, think gym is not charged unsure – they owe them coming out the gate and go to castings all day, shoots etc, work fashion weeks. Most owe them money more then make and sometimes takes months, even year, and some cases never get paid for their work especially in Milan one model
    told me he was owed close to 35k in that country alone and in London half that much. The ones who do have the Visa etc get taxed to death according to another he was told in NYC he owed lots of taxes. Cost him almost 3k from what he said to get the working longer Visa. Most of these models I’m sure are not in the US legally working but the
    agencies make money off them left and right they get to travel, go to the big parties, party like rockstars while they are here and be eye
    candy for the well to do not like any one will tell on them. With Melania I doubt she was here legally, and it’s just shows what kind of
    hypocrite Donald Trump is the rules apply to everyone else but him in his twisted mind.

    Its hard to feel sorry for her but I’m sure when she signed up to marry Trump she was expecting to be a trophy wife and not a political one. It cant be easy living with him but I expect all the money will sweeten the pill somewhat.
    No doubt the Donald will find a way to blame the visa “confusion” on Hilary Clinton

    I am a Naturalized Citizen and let me tell you: I disagree One Thousand Percent with illegal immigration because it took me years and a lot of money to become a Citizen. However, I get really pissed off when Trump talks about Illegal Immigrants and points his short fingers ONLY to the Latinos. It is not a secret that a LOOOOOOT of Asians and European immigrants come to the country with the B1|B2 visa (tourist visa) and work ilegally in the country, not only that but they use their Visas for “birth tourism” where, us taxpayers, pay their hospital bills when they have their babies (born as US Citizens). Just my opinion.

    Just saw this CBS News post. The Modrling Agency claims Melania had her work Visa before she started with them. Well someone is lying because she would not have had to go all the way to back to her homeland every few months to renew (stamp) her Visa (not that she would have had to either way, she could have had it renewed at the airport or thru the Consulates office as my mom & friends had. Her story still doesn’t make sense.

      Is it possible the rules were different at that time? I know some countries require people to periodically leave for a certain period and then re-enter under certain types of visas. Don’t know the situation in the US at the time claimed. But if Trump is saying that she didn’t get paid- it does sound as though she did not have a work visa or else there would be no reason to say that. I do think the odds are slim that she didn’t get paid…. Maybe under the table. It doesn’t look like the kind of shoot someone would do for free, just to build up a portfolio.

        The rules were not that different back then. The only reason she would have to return to Slovenia every few months is if she were here as a visitor and did not have a work visa. She may have always had some kind of permission to be physically present in the US, but that does not mean she had the right visa for working in the US. Nor does it mean she truly qualified for a green card.

    Generally, its true women and men fitting the majority stereotypical definition of beauty (nose, lips, hair texture, height, weight, etc.) are favored. Hopefully, the pressure increases to ensure lady Trump’s immigration documents are made public (can’t have a double standard) and man Trump’s tax documents are made public . . . “birther” and “lock her up” chants becomes a deafening crescendo of “send her back . . . Send Her Back . . . SEND HER BACK.”
