Gray’s Anatomy heartthrob Eric Dane and wife Rebecca Gayheart are still angry about the “naked people hanging-out” tape of them distributed by celeb gossip site Gawker.com. In fact, they’re ready to take it to court. It’s been reported that the couple is filing a lawsuit against Gawker for more than $1 million in damages.
Eric Dane and Rebecca Gayheart are looking to settle the score with the website that published their naked non-sex threesome tape.
Dane and Gayheart filed a lawsuit today in L.A. County Superior Court, claiming Gawker.com had not only unlawfully posted almost 4 minutes of the private video that was shot behind closed doors, but “maliciously” distributed the video and included nude shots of the fabulous threesome — the third wheel was former beauty queen Kari Ann Peniche.
Dane and Gayheart want more than $1 million in damages. Their lawyer — legal pit bull Marty Singer — is also asking for an injunction to pull the plug on the video.
UPDATE: 5:30 PM ET: Gawker’s publisher, Nick Denton, just twittered his response to the lawsuit: “To quote the great Marty Singer — Eric Dane’s lawyer — if you don’t want a sex tape on the internet, ‘don’t make one!’”
It certainly is embarrassing, and I wouldn’t want video of me naked circulating the Internet. But $1 million? Really? Has this video hurt their careers that much? And what about Mindy McCready, who is rumored to be the one who stole the tape and sold it to Gawker in the first place- where does she fit into the law suit? It would have been hard for Gawker to post it if she hadn’t dangled it in front of them, right?
Anyway, it looks as though the couple may be getting their wish to start a family. Rebecca Gayheart was photographed running errands recently, sporting what appears to be an early second trimester baby bump. Unfortunately, the photos also show Rebecca smoking a cigarette. If she’s smoking, I’m kind of hoping she isn’t, in fact, pregnant. If she is pregnant, I hope she quits smoking quickly. I don’t think I need to go into the mountains of studies done on this topic - one only need look at the warning labels on the side of a pack of smokes to get the abridged version. Anyway, this couple has been through a lot lately, so I hope things start to look up for them.

Alright, I looked at the pics and she looks pregnant to me–and I really hope she quits smoking. I know it’s hard. I did it. I just remember my doctor telling me it was like someone squeezing the cord everytime I took a hit and cutting off everything to the baby. I don’t know if that’s true, but it really hit home for me and as much as I hated it, I quit. And my son is 8 and I haven’t smoked since…which made us both healthier. There. Lecture done.

second, it does effectively cut off everything that goes to the baby.
I remember in HS health class they showed us a film of a pregnant woman who smoked. They hooked her baby up to a fetal monitor, and every time she took a puff, the baby’s heart would stop briefly.
even after birth, a woman (if she’s breastfeeding) shouldn’t start up again. nicotine gets into the mother’s milk and apparently smoking makes the milk taste bad so the baby doesn’t consume as much.

I’m going to say that she’s not pregnant because she strikes me as someone who’s at least smart enough to know not to smoke while pregnant, especially in this day and age.
I think she’s probably packed on a couple pounds and is wearing some unflattering clothes?
I mean, I’m teeny, but sometimes, I pick an outfit that makes me look preggers too.

To be a celebrity–even a D-list (what has she even done lately to be famous)–means so consequences for something as serious as this.
What about the family of that little boy??

Totally agree with Maddie. Only I’ll add that they shouldn’t even make one in the first place. It’s just dumb of them to think it won’t ever get out.

I’m sure part of her ‘drug’ issues is the kid that she hit with her car,while on the phone.
Probably ruined her chance at a happy,at peace life.
Quit with the ‘what about the child’s family’…you know?
things do happen; she made a bad choice,and has to live with it for the rest of her life.
Not an excuse,but when sh*t happens,what do you want her or anyone to do? I mean,she has to live her life…
I’m sure drugs are her way of coping with that reality of what happened. IMO.

lrm, I totally agree with you. I’m sick of hearing about this accident every time her name is mentioned. It amazes me that people allways see just one side: “this could happen to my kid”, that’s truth, but you could be the one driving the car, too. It was an accident, shit happens to everyone. If this had happened to me, I don’t know how I could cope with something like that.

Check out her smoking pics in CDAN - it looks like a rolled joint. I’m pretty sure she was smoking marijuana, the smoke looks like marijuana smoke and shes holding it, with her chin out and her mouth slightly open.

Why do we talk about when she killed that kid, but not when Matt Broderick killed two people in a car and was fined less than $200? Not saying that killing kids is good or anything, but no one was saying he shouldn’t be a parent because of it…

I think I may have already posted this -
but - Depending on when she found out she was pregnant and what her doctor advised her this may apply.All of my friends who have been pregnant and smokers have been advised by their doctors to reduce the amount they smoked over a few weeks as a gradual withdrawal as opposed to ‘cold turkey’. They have been told this is less stressful on both baby and mother.
Hopefully if she is pregnant she is cutting down and eventually quitting. It may not look good (I dont support smoking), but for all we know she is in fact doing the right thing.

I suppose we should add Laura Bush and Brandy to the list since they were involved in traffic fatalities. It was an accident, we don’t know how we as individuals would deal with the aftermath of a tragic situation. It’s terrible for it to be used continuously as a weapon against her..

Are these stars so stupid to make a tape and not put it some where (safety deposit box)and not leave it willy nilly lying around for some one to find it and post it on the web.
