Video shows Joe Francis’ attack from behind on Playboy model Jayde Nicole

The feud between “Girls Gone Wild” scumbag Joe Francis and Playboy model Jayde Nicole continues to rage on. We told you about the L.A. nightclub incident in which Jayde poured a drink on Francis after she saw him aggressively hitting on her friend. Joe retaliated by grabbing the model from behind by the hair, throwing her to the ground and kicking her. Now, there is video that supports Jayde’s claims, taken from the club where the incident occurred. The video clearly shows Francis coming up behind Jayde while her back is turned and viciously dragging her through a crowd of people by the hair.

“He can’t lie anymore!” Jayde Nicole speaks out for the first time since the attack, describing her nightmare experience at the hands of Joe Francis while watching RadarOnline.com’s explosive never-before-seen security video of the incident.

Early in the morning on Friday, August 28, Jayde, her boyfriend Brody Jenner and a group of friends were at Hollywood hot spot Guys and Dolls when Jayde spotted Joe and said he was grabbing her friend and trying to kiss her. Jayde reached through a crowd and dumped her shot-glass drink on Joe’s shoulder. She then turned back to the bar.

That’s when the violence started. Joe pushed bar patrons aside, reached through the crowd and grabbed Jayde by the hair, viciously yanking her to the floor and dragging her through the crowd. A melee ensued, with Brody and others chasing Francis through the bar.

As she stood up barefoot and sat at the bar Jayde said she had no idea what had just happened to her. “I was traumatized at this point,” the former Playboy model told RadarOnline.com. Conflicting reports from Jenner and Francis say that the two got into a fist fight outside the club and Brody was tasered by someone.

Jayde’s lawyer, Ronald Richards, defended his client and slammed Francis’ violent reaction and the defense he’s been using – “This was not any self defense by Mr. Francis.”

Radar has the video exclusively, so we can’t post it here. But the footage, while black and white and kind of grainy, clearly shows what happened in the club. Unfortunately there’s no video of the fight that happened outside the club, but my theory is that Francis unleashed a couple of thugs on Brody Jenner because he didn’t want to mess up his hair.

Sean Penn has long been known for his bad temper. He’s certainly not a happy-go-lucky sort, and comes across as rather surly much of the time. Given all that, it’s not surprising to hear that he attacked a paparazzo on Friday. The photographer, Jordan Dawes, was at the Brentwood Country Mart taking photos of celebs from inside his car. As Sean Penn pulled into the parking lot, Dawes started photographing him. However things got ugly when Dawes got out of his car and Sean saw him – and went ballistic, chasing, kicking, and hitting the guy.

The paparazzo in the alleged Sean Penn scuffle is not taking his supposed altercation with the actor lying down. Photographer and self-proclaimed documentarian Jordan Dawes spoke to E! News exclusively about his alleged beat-down Friday afternoon, for which he filed a police report against the Oscar winner.

According to Dawes, he and four other photographers and videographers were waiting at the Brentwood Country Mart for the Milk star that afternoon. When Penn got out of his car, the photog started snapping pictures of the actor from his vehicle, which he claims was parked about 50 feet away from Penn.

When Dawes got out of his car and started taking photos of Penn, that’s when Penn approached him, the photog said. “He beelined it for me and started kicking me in the legs,” Dawes said. “As I was backing away, I was still shooting. Then he got me to the other side of the street and punched me in the arm and in my camera.” According to the shutterbug, the 49-year-old star threatened to “put him in a box” and told him he would remember his face.

“My camera was damaged,” Dawes said. “I’m all bruised up…I empathize with the photographers now, I really do. It’s horrifying.” The paparazzo said he turned in photos taken during the alleged attack to authorities, but hasn’t decided whether to take civil action against Penn.

E! News has confirmed that a police report was filed in the incident. “We can confirm that a battery report involving a member of the paparazzi was taken on Friday the 2nd at about 1:15 p.m. in the 300 block of Mesa Drive, but we are not confirming the names in the complaint,” Officer Karen Rayner of LAPD Media Relations said.

No one from Sean Penn’s camp has responded as of yet. I find it really hard to figure out who to sympathize with here. Yeah, celebrities know that when they become famous, photographers are going to hound them. But when you see videos of the way the paparazzi does it – how many there are, how loud they are, how close they are – it’s hard not to sympathize with anyone living like that. I would never want to be famous for that reason alone. The excessive money would probably help soften the blow though. Obviously Sean Penn wasn’t being surrounded by a throng of paps. But I can see how, over the years, the sight of any photographer could get to be too much. We all have our breaking point, and Sean Penn’s is obviously a shorter distance than most people’s.

That said, he’s still responsible for his actions. I can imagine why he might have done what he did, but I’m not saying it’s okay. He assaulted a man who wasn’t harming him in any way, just annoying him. Oh, and he looked like an absolute buffoon doing it, according to these TMZ photos. Being that Jordan Dawes is a paparazzo, I’m assuming it’s safe to say he’ll be filing a massive civil suit shortly. I’m betting Penn will settle quietly out of court – I’m guessing $15,000. That just feels like the right number for being kicked by Sean Penn, and just enough to get the guy to drop his case.

My question is, when will Dawes’ pictures come out? Those have got to be some interesting shots.

Courtney Love attacks man who walked in on her on the toilet

Ordinarily, I can’t really stand any Courtney Love story, but this one struck me. Page Six is reporting that Courtney attacked a defenseless man (a pharmacist!) at a party. It seems the guy, named Sebastian Karnaby (sidenote: there are pharmacists named Sebastian?) accidentally walked in on Courtney Love while she was using the bathroom. And yes, “using” means “her skirt [was] around her ankles.” Sebastian walked out quickly, but Courtney hiked up her skirt, quickly exited the bathroom, and began attacking the poor bastard. Sebastian claims that Courtney was like a “possessed woman” and that seeing her on the toilet wasn’t a “pretty sight”. Shiver.

The rocker “went nuts” when a guest at a party at the Standard Hotel opened an unlocked bathroom door and saw her on the toilet with her skirt around her ankles.

According to the astonished, unintentional intruder, Love flew out of the loo, launched herself at him and threatened to have him thrown out.

Sebastian Karnaby, a pharmacist, tells Page Six he was trying to leave the party for the Times’ T style magazine at the hotel’s new Boom Boom the other night when he had the encounter with Love.

He said, “I couldn’t find my way out and asked someone to show me the door.” He opened the door he was led to, and “there was Courtney Love, sitting on the toilet with her skirt around her ankles.”

Karnaby says he was shocked and slammed the door shut, but that wasn’t enough for Love. He relates, “She stormed out screaming, ‘I am going to get you thrown out!’ She jumped on me, went crazy and dragged me over to security by the arm and claimed that I’d attacked her.

“They were trying to calm her down, but she was out of control. She was like a possessed woman. I absolutely did not attack her — I was trying to get away,” Karnaby said. “Thankfully, she’d remembered to pull up her skirt.”

He says security told him, “It’s best you get away as fast as possible.”

“I never wanted to see Courtney Love on the toilet,” he said. “It wasn’t a pretty sight. I just wanted to get out of there.”

Enjoying the party in a more civilized fashion were editor Stefano Tonchi, co-hosts Jeff Koons and Simon Doonan, Josh Hartnett, Helena Christensen, and photographer Terry Richardson.

Other guests at the party confirmed Karnaby’s story. Love’s rep refused to comment.

That’s the kind of thing that would scar me for life – that is, the part about seeing Courtney on the toilet, not the part about her attacking me. At this point, Courtney has probably attacked most people in Los Angeles, London and New York. I would imagine everyone has their “Courtney Love went berserk on me and here’s the scar” story. I’ve actually had people walk in on me in the toilet before – you know how it is, you’re in some sketchy dive bar, the lock doesn’t work, and you really need to pee. I didn’t freak out, I just shouted “I’m in here, dude!” Because I’m classy.

Jayde Nicole says Joe Francis attacked her from behind

2008 Playboy Playmate of the year, Jayde Nicole, has issued an official statement regarding the attack she suffered at the hands of “Girls Gone Wild” mogul Joe Francis at a Hollywood club late last week. According to Nicole, Francis attacked her from behind, threw her down, and punched her in the face. Reports that came out last week claim that Francis’ attack occurred after Nicole through a drink at him. If you watch a paparazzi video on TMZ taken right after the incident, Nicole is visibly upset and shaken and shows the bruises near her eye that she says were inflicted by Francis. She comes across as completely believable. Francis claims that Nicole’s boyfriend, reality star Brody Jenner, is the one who punched him out of nowhere and that all he did was kind of grab Nicole. Jenner then ended up getting tased by someone that night outside the club, which Francis didn’t mention as far as I could tell. This wasn’t the first bar fight between Jenner and Francis – they were involved in previous altercation in March, at which time Francis is also alleged to have hit Nicole.

Joe Francis claims he was sucker punched. But Jayde Nicole insists it’s Francis who prefers to take the cheap shots.

“Jayde Nicole was the victim of a violent assault when she was attacked from behind, thrown down to the ground by her hair and beaten in the face and body in front of multiple witnesses by a person identified as Joe Francis,” her rep, Jerry Shandrew, said in a statement Monday.

Shandrew says that the Playboy Playmate will not be talking too much while authorities investigate the rumble that occurred early Friday between Francis, Nicole and her boyfriend, Brody Jenner, outside a Hollywood club. Instead, they’d rather the police be the ones making all the noise.

Noting that Nicole filed a police report immediately afterward and has been cooperating with the cops, Shandrew added, “Because of the ongoing criminal investigation of Mr. Francis, it will be inappropriate to comment further at this time out of respect for the law enforcement process.”

Of course, Nicole’s version of the story couldn’t be any different from Francis’, as he has admitted to maybe a bit of hair pulling and denied everything else.

Francis maintains Nicole poured a drink on him inside Guys and Dolls that night, and, in turning around, he may have grabbed her hair.

He told E! News Friday that, after security had helped him get outside, it was an unprovoked Jenner who hit him in the face. “He coldcocked me,” Francis said. He threatened legal action against Jenner afterward for accusing him via Twitter of beating on Nicole.

But according to Nicole’s rep, there is photographic and video evidence of Francis attacking her, not to mention hospital records of her injuries.

“It is the hope of those who love and care about Jayde that Mr. Francis will be prosecuted to the fullest extent of the law,” Shandrew said.

Radar Online has more details of the night in question, and apparently the altercation started because Jayde and Brody were with an ex girlfriend of Joe Francis’, model Abbey Wilson, at the club. Wilson gave Radar a statement about what happened, and by her account Francis grabbed her and forcibly tried to kiss her. She said that Jayde then intervened but she wasn’t sure if Jayde threw a drink at Joe at all. Then Francis grabbed Jayde by the hair and pulled her back, but the rest was supposedly out of view:

“As I tried to get away from him Jayde intervened and (Francis) grabbed her hair and she fell backwards. I’m not sure if a drink was poured over him though. The next thing a whole bunch of people surrounded us and I couldn’t see any actual physical attacks.”

It sounds like Wilson is being super careful not to incriminate anyone in her statement, and I would bet that she witnessed much more than she’s owning up to. She also says that in the year she lived with Francis he was never violent toward her and she never witnessed him being violent toward anyone else. I find that hard to believe, and maybe she’s scared of the guy and is covering up for him, but whatever.

Joe Francis still faces federal tax evasion charges. His trial is scheduled to start on October 14. E! Online asked a rep from the US Attorney’s Office if Francis’ attack on Nicole could put him behind bars while he awaits trial. The rep said it’s too early to tell. The judge isn’t going to take kindly to Francis beating up a woman at a club, though, and maybe it will earn him some more jail time. He’s already spent 11 months in jail without bail on a civil charge for using underage girls in his videos which he claimed that was a gross travesty of justice and whined that the judge and prosecutor had it out for him. The guy spent most of his time in a Nevada jail of his choice where he had phone and Internet privileges, though, so it’s not like he was truly hurting. Francis faces up to ten years in federal prison for tax evasion, and that experience will be nothing like his last stint in jail. There’s at least some justice in this world.

Joe Francis beats Playboy Playmate, gets punched by Brody Jenner

Once upon a time, Joe Francis was a slimy creep whose worst crimes against women consisted of making millions by getting college girls drunk enough to coerce them into removing their clothes and doing things they wouldn’t normally do. Oh, and if the rumors are to be believed, he’s probably the one who gave Paris Hilton herpes. But now, you can add woman-beater to that list, after an epic fight at a club in LA last night. Joe punched and kicked former Playboy Playmate Jayde Nicole after she did what every woman in America would love to do – threw a drink in his face. (Personally, I would have kicked him in the balls, but that’s just me.) Because every man knows that an appropriate response to having some liquid thrown in your face is to punch, kick, and throw someone to the ground, right?

Brody Jenner was in an epic fight outside of Guys and Dolls this morning, with Girls Gone Wild honcho Joe Francis.

Jenner just spoke with us by phone. According to Jenner, he and his girlfriend, Jayde Nicole, were at the club celebrating his birthday, when Jayde saw Francis hitting on an ex-girlfriend of his (Francis’), Jenner says “unrelentingly.” Jayde felt he was harassing the woman — whom Jayde and Brody know — and she threw a drink on Francis.

Jenner says Francis then pulled Jayde’s hair, punched her in the face and threw her to the ground and began kicking her. Security broke it up and Francis got dragged away — Brody followed.

Jenner says he started yelling at Francis and both men were ejected from the club.

Outside the club, Jenner says he tried to get back in to see Jayde but security wouldn’t let him. Jenner then saw Joe, punched him in the face, and then someone tased him and he fell to the ground.

Francis left the scene. The cops — who say a call came in at 2:46 AM for battery — came but no one was arrested.

Jayde tells TMZ she will press charges against Francis.

Jayde has a black and blue cheek, her face is swollen, she has a bruised left rib and her lower abdomen is sore. Some of her hair also got pulled out.

UPDATE: Brody put the following message on his Twitter: “Joe Francis beat up my lady this morning for no reason! Pulled her to the ground, punched & kicked her..what does that say about him. How can you call yourself a man when you beat up a girl?? Joe Francis is a piece of sh*t. Joe Francis needs to be in jail!!!”

Is anyone really surprised that Joe Francis would physically assault a woman? After all, he has built an empire out of treating them like objects, so this is the next logical step. And I never thought I would say this about Brody Jenner, but he gets big points for stepping in. I wonder who exactly tased Jenner- perhaps one of Joe’s security thugs?

John Corbett gropes random autograph-seeking female fan

I was totally a hardcore fan of Sex and the City when it was on HBO. I absolutely hated the movie, though, and I hated the post HBO-SATC message that somehow the show was totally empowering for women, or that these women were modern heroines, all of that stuff. I watched the show because I thought the characters were interesting, the stories and the dialogue were funny and often touching, and because of the fantasy-escapism of the clothes, the apartments, and the men. I have most of the seasons on DVD, and I watch them when I need a pick-me-up, but I don’t think it helps to glorify the characters or their actions. Because when it comes down to it, Carrie Bradshaw was a mess. She’s was a vapid, judgmental, self-defeating, immature, self-abusing narcissist whose only redeeming quality was her devotion and love for her friends. That was actually the brilliance of the show – everyone knows women like that, every woman has some of those qualities and everyone has a friend like that. In that way, the show was relatable.

I went off on that tangent all to say this: Carrie had a good thing with Aidan (John Corbett), and she totally screwed it up. When Carrie cheated on Aidan with Mr. Big, I hated her. When they got back together, and he proposed, I knew she would screw it up. He was too good for her. She was too high-maintenance and self-absorbed for him. Ever since John Corbett’s appearance on the show, I’ve thought of him with great affection, but I know he’s not really Aidan. This story just confirms it:

“Sex and the City” hunk John Corbett, swilling Mexican food and tequila shots with guy pals at Casa Vega in Sherman Oaks, CA came on like your average jerk barfly when a sexy Brazilian femme fan begged him to pose for a pic – then screamed and twisted away as he grabbed her South of the Border, squeezed hard and hooted: “Hey, Brazil, where you going? Come here and give me some!”

Escaping from Corbett’s creepy clutches, La Tourista dashed out the door. Said an unamused galpal: “We were shocked. Corbett really manhandled her!”

Totally ridiculous. I would have slapped the sh-t out of him. There’s absolutely no explanation for this kind of gross behavior – not even if he was totally loaded on tequila. Is it worse if I mention that I think he’s still with Bo Derek? I think they’re still together. Ugh… I hate when an actor who plays a beloved character acts so douchey. Maybe it’s not true. I hope so.

Chris Brown ordered to stay away from Rihanna for 5 years

Chris finally received his formal sentencing late Tuesday afternoon for his guilty plea in his February felony assault on Rihanna. As per his plea deal, Chris will not be serving a jail sentence. His formal sentencing includes: 1,400 hours (six months) of community service, a year of domestic violence classes, fines, and fives years of probation in which he can have no contact with Rihanna, including phone and e-mail contact. The last time Chris was supposed to be sentenced (earlier this month) he had a tentative deal to give another public apology, this time on Larry King Live. There was no such deal this time.

Chris Brown will spend 1,400 hours removing graffiti and washing cars for assaulting Rihanna.

Brown, 20, was formally sentenced in a Los Angeles courtroom Tuesday to six months of community labor in Virginia after he pleaded guilty in June to one count of felony assault against Rihanna, 21.

Brown’s six-month labor sentence will be supervised by the chief of police in Richmond, Va., who wrote to the judge that Brown would perform graffiti removal, cleaning and maintaining grounds, and washing cars.

The singer, who looked solemn and wore a black pinstripe suit and matching tie, was also sentenced to five years of probation, a year of domestic violence classes, and was ordered to pay fines. He was accompanied in the courtroom by his mother and at least one bodyguard.

As part of his plea bargain with prosecutors, a second felony charge of making criminal threats was dropped. Rihanna was not present for the hearing.

Donald Etra, an attorney for the “Umbrella” singer, had previously asked the judge for lesser restrictions on communication and contact between the two singers.

However, L.A. Superior Court Judge Patricia Schnegg ordered Brown not to have any communication with Rihanna for the next five years, which includes phone and email contact. Brown was also ordered not to come within 100 yards of Rihanna – 10 yards if they’re both at the same event.

Toward the end of the hearing, Judge Schnegg warned Brown, in an apparent reference to reports that the two singers may have had contact against court order: “I’m not immune to any chatter on the airwaves. Do you understand, Mr. Brown, that any violation of this order is a violation of your probation and it comes with the possible penalty of prison?” Brown responded “Yes.”

Last month, Brown publicly apologized for the incident, saying, “I have told Rihanna countless times, and I am telling you today, that I am truly sorry and that I wasn’t able to handle the situation both differently and better.”

I’m sure there will be some people who still debate what happened that night between Chris and Rihanna, and whether Chris is truly sorry. Personally, I wish he had gotten jail time, but I think the fact that Rihanna, as the victim, spoke out publicly and privately to the Los Angeles police and district attorney’s office was what saved him from doing time. Six months of community service is nothing to scoff at, and if Chris doesn’t comply to the very letter and spirit of his sentence, perhaps he will end up in jail.

Chris Brown to be sentenced for assault, might get community labor

Well the Chris Brown/Rihanna criminal matter is almost over, for the most part. Brown is being sentenced today, and it’s expected he’ll be doing something between community service and hard labor, known as community labor, and it’ll be about six months long. Basically it means he’ll do something along the lines of scrubbing graffiti or picking up trash. A little harder than ladling soup at a shelter, but not quite as tough as dragging giant boulders from one place to another or whatever hard labor is these days.

Chris Brown has pleaded guilty and publicly apologized for beating Rihanna, but after Wednesday afternoon, plenty more hard work lies ahead.

The 20-year-old R&B singer is scheduled to be sentenced to five years of probation and six months of community labor. A judge has said she wants Brown, who will likely be allowed to serve his probation in his home state of Virginia, to do work that is comparable to graffiti removal or roadside cleanup.

The “Run It!” singer pleaded guilty in late June to felony assault before a preliminary hearing in which Rihanna was likely to testify.

The former couple never faced each other at that hearing. As Brown left through one door, Rihanna entered the courtroom from a private entrance… Brown said in a public apology video posted on his Web site July 20 that he had repeatedly apologized to Rihanna for the attack. He called his conduct “inexcusable” and pledged to do better.

“I saw firsthand what uncontrolled rage can do,” he tells viewers. “I have sought and am continuing to seek help to ensure that what occurred in February can never happen again.”

Schnegg will consider a report by probation officials and has warned Brown that he will face substantial scrutiny. She told him in June that he’ll have to return to California every three months and attend domestic violence counseling.

I always found Brown’s statement about seeing “firsthand what uncontrolled rage can do” to be very removed from responsibility. The phrasing makes it sound like he was watching someone else beat the shi*t out of Rihanna. And the thing about seeking help to make sure what happened can never happen again also seems to have an implication of lack of responsibility, like it wasn’t entirely Brown’s choice. Will never happen again is appropriate.

Despite supposedly being broken up, Rihanna is petitioning the court to remove the restraining order protecting her from Brown.

“If asked, we will tell the court that all that’s necessary is a level-one order: That Brown not annoy, molest or harass her,” Rihanna’s lawyer Donald Etra tells PEOPLE. “No stay-away order was ever requested by Rihanna, nor did she ever believe it was necessary.”

But if they’re really broken up, what could it hurt? The order required Brown to stay 50 yards away from her and only 10 if they’re at the same event. If Rihanna and Chris are truly over, then why would she want to be closer than 10 yards to him?

The domestic violence classes Chris Brown has to attend are expected to last at least a year. I’m not sure what a better solution would have been in this case. I would have liked to see him serve some real time behind bars, but admittedly that is purely retributive. It wouldn’t teach him how to better handle his emotions. Brown has made a bunch of PR-required “I’m sorry” statements in the last couple months, but he’s also done just as many asshole-ish things that completely negate anything he’s said. Like when he poked fun at the whole thing by getting a $300,000 custom made diamond necklace that says “Oops!” Someone like that will never fundamentally be sorry.

Naomi Campbell smacks, scratches, attacks a paparrazo

Dude, how many times is Naomi Campbell going to go postal on random people? It seems like every few months Naomi goes completely crazy and beats the hell out of someone with whatever is around. For her assistant, Naomi actually beat the woman with a bejeweled phone. I believe that fight was over a pair of jeans. Once, Naomi went totally crazy on a yacht, and caused thousands of dollars worth of damage – all because she didn’t care for the wine and appetizers. Then, last year, Naomi had a massive temper tantrum at Heathrow, assaulting and spitting on a police officer, all over one misplaced bag. Naomi has been charged and convicted of various crimes dealing with her anger issues, so it’s not like it’s all a case of mistaken identity or one rare bad day. The crazy bitch has issues, and I’m surprised we don’t hear about her tantrums more often.

The latest incident occurred in the island of Lipari, Italy. Naomi was on holiday with her friend, Russian billionaire Mikhail Prokhorov, when a photographer (Gaetano Di Giovanni) got within slapping distance of Naomi. According to Di Giovanni’s statements to the press, Naomi “slapped him and hit him with her handbag” and Naomi’s “nails had damaged his left eye”. While Di Giovanni’s vision was compromised, he could “hear that her bodyguards and her boyfriend were trying to drag her away”. Good Lord, I would have paid to see that.

Naomi Campbell has been accused of attacking a photographer and putting him in hospital during a holiday in Italy with her billionaire boyfriend.

Gaetano Di Giovanni claimed his face was scratched and bruised after Miss Campbell, 38, allegedly slapped him and hit him with her handbag. The supermodel’s ‘nails had damaged his left eye’, Mr Di Giovanni was reported telling Italian newspaper La Repubblica.

Miss Campbell’s representative denied the attack took place and said in a statement: ‘Media reports circulating that Naomi Campbell attacked a photographer in Lipari, Sicily are completely untrue. The photographer was seen following Naomi Campbell on a small boat, taking photographs, the day after the alleged incident.’

Mr Di Giovanni told the Italian newspaper: ‘First she hit with her bag, screaming at me and then she tried to slap me. I managed to avoid her – but her nails still got my eye.’

‘For a few seconds I could not see a thing. I could hear that her bodyguards and her boyfriend were trying to drag her away.’

Police on Lipari said no complaint had been made to them.

Lipari is part of the Eoliean Islands, a chain which stretches between Sicily and the mainland and is popular with celebrities.

Miss Campbell arrived on the island with Mikhail Prokhorov on his yacht after spending several days in the south of France. Last year the Streatham-born model, known for her temper, admitted attacking police at Heathrow in a row over lost luggage.

My favorite part is the image of Naomi’s bodyguards dragging her away from giving the guy an even worse beat down. Naomi is like a vampire or a rabid dog. When she smells blood, she just wants to attack even more. But still, Naomi denied the stuff even happened… could it be that this is one of those rare times when she didn’t attack anyone? My guess? Probably not. The incident fits in with Naomi’s previous behavior, so I’m buying it.

Amy Winehouse in court today for punching fan in the eye

Amy Winehouse took the stand in her defense today during her assault trial in London. Last year she punched a dancer, Sherene Flash, who’d asked to take a photo with her at the Berkeley Square charity summer ball. During her testimony, Amy essentially claimed that Flash was all up in her grill. But she put it the British way, noting, “‘She lent down all over me. She had her face down by me.’” Nothing she said sounded all that convincing or explained why she reacted with a punch – which she essentially denied was even a punch.

By the same measure, said Winehouse, Flash “was pretty much leaning on me. She’s a big girl. She was being overly presumptuous. I’m not Mickey Mouse. I’m a human being.”… In the dressing room area backstage, the singer, 25, said that as she moved her left hand across her face, she pushed her right hand upwards, towards Flash. “She’s there, she’s tall. I wanted her away from me,” she told the court. “I thought: ‘Do I get a choice in this? Hello?’ People are mad, people are rude.”

As if to emphasize the height differences, the 5′, 2½” Winehouse moved away from the evidence box and showed chief Magistrate Timothy Workman her flat pink ballet pumps. “And my hair does make a difference,” the often-beehived singer added.

Earlier, prosecuting lawyer Lyall Thompson told the court that there was “nothing accidental about Miss Winehouse’s actions. It may be that well-known figures find such requests tiresome, but they need to develop strategies” to deal with them. “She acted with deliberate and unjustifiable violence,” he said of Winehouse allegedly landing a “direct blow” to Flash’s face with her right hand.

Flash called the cops and later saw a doctor. She said she was left with a “slightly swollen” right eye after the incident. Flash told the court that she had been dancing at the event and then, later, went backstage with a friend to see if they could meet the Grammy-winner.

She said that she had not touched Winehouse. Asked by Winehouse’s lawyer Patrick Gibbs if she had “misread” the situation, Flash answered, “Even if I did, it doesn’t give someone the right to punch me in the face.”

Flash, who admitted she was “tipsy,” described Winehouse as seeming “drunk.” Other witnesses concurred, with Jack Jefferson saying of her performance earlier: “Her speech was slurred and she didn’t appear to be in control of her physical actions.”

So Amy’s defense is essentially that she didn’t punch Sherene Flash but that she used her right hand to push her away. She also seems to be arguing that as a much smaller person, she felt physically intimidated by the way Flash was so close to her. The problem is that other witnesses saw Amy punch Sherene Flash. She also headbutted a photographer at the same event. And not a paparazzo – an official photographer for the fancy ball. She was also described as extremely inebriated – no eyebrow raising here.

It seems likely that Amy perhaps intended merely to push away Sherene Flash and may have felt that’s what she was doing. But most likely she was drunk and clumsy, and really did punch her. Nonetheless, it seems unlikely she’ll do any serious time (the max would be six months). I’m guessing she probably will be found guilty, but be given some kind of nominal probation. And to her credit – Amy hasn’t physically assaulted anyone in months.
