Tracy Morgan given a pass after taking off his SCRAM anklet early

top-cwp-001310.jpg

I wish I were a celebrity. If I were, I could drive around drunk and get in a little trouble the first time, but not so much the second time. I could be told I have to wear an alcohol monitoring device around my ankle, but I could take it off early because I didn’t like it. And I could afford fancy lawyers and doctors to say it was medically necessary to take it off… because being annoyed is a medical problem. To be fair, Tracy Morgan is kind of a minor celebrity, but he’s big enough to be able to afford to ignore judges and cops and laws and such. After he got 2 DUIs within about six month of each other – one in Los Angeles and one in New York City – Morgan was forced to go to rehab, do community service, and attend AA meetings. Pretty standard issue. He also had to wear a SCRAM anklet – you know, that alcohol monitoring device that Lindsay Lohan voluntarily sported six months ago to show the world how sober she was… before she went to rehab a few more times. Well apparently the SCRAM bracelet didn’t agree with Tracy Morgan, and he decided to go ahead and take it off early. That got him in a bit of hot water with the judge, who was going to make him keep it on even longer after he admitted to drinking alcohol over the summer – until Morgan produced photographic evidence along with doctors’ reports saying that it was medically necessary for him to take it off – and the judge agreed!

Tracy Morgan has made peace with his prosecutors. A Los Angeles judge ruled Tuesday that the 30 Rock funnyman has completed the terms of his DUI-related probation and will not be punished for taking off his alcohol-monitoring ankle bracelet a wee bit early, the L.A. City Attorney’s Office confirmed to E! Online.

Morgan, who on Sept. 18 was ordered to keep his Secure Continuous Remote Alcohol Monitoring device on for another 80 days after he copped to imbibing booze over the summer, claimed in court last week that he took the accessory off early due to “medical issues.”

After reviewing several letters from doctors and one from the company that manufactures SCRAM bracelets, as well as a handful of photos depicting the nature of the undisclosed medical condition, the judge concluded that Morgan had a valid reason to untether himself before the court-ordered end date.

According to Morgan’s attorney, Blair Berk, Morgan has voluntarily been taking daily breath or blood tests to prove that he’s staying on the wagon. No further court appearances on his case are scheduled, said City Attorney’s Office spokesman Frank Mateljan.

[From E! News]

Boy I would really like to know what “medical issue” arose from this bracelet that was so terrible a judge let Morgan take it off. Last time I checked, the bracelet wasn’t made out of rabid pack of angry bees that sting you at random to check the level of alcohol in your blood. Because I know SCRAM considered this bumble-based technology and quickly ditched it. So if the problem is anything less than bees, I really can’t figure out how it could possibly be so bad that a judge agreed to let the guy take it off. Unless the judge was actually paid off by the bee industry. Wait, that would make no sense. But so does taking a bracelet off for “medical reasons.” So I’m pretty sure it must be bee related after all.

Lost’s Daniel Dae Kim says he’s “Deeply Ashamed” by DUI

top-screen-capture-professional-13-89.jpg

Well the “Lost” curse may have struck again in the form of Daniel Dae Kim’s arrest on DUI charges last week, but at least he’s being a little more humble and dignified than some of his costars were. Kim issued an apology in which he said he was ashamed and embarrassed by his actions. He thanks those that have been supportive, and acknowledges that he has disappointed people and apologizes. This is in contradiction to Michelle Rodriguez, who abused police and has ranted for years about how unfair it is that she was punished for breaking the law.

Daniel Dae Kim, the Lost star arrested in Hawaii Thursday on a DUI charge, says he’s sorry. “I am deeply ashamed and embarrassed by the events of Thursday morning,” the actor says in a statement to TMZ. “It saddens me to know that I jeopardized the welfare of the kind people of Hawaii, a community that I love and call my home. It is my intention to cooperate fully with the police and I am grateful to them for their sensitivity throughout this matter,” Kim adds. “To my friends, family, colleagues and fans, thank you for your kind words of support. To those I have disappointed I can only ask that you accept my heartfelt apologies.”

Kim, who plays Jin-Soo Kwon on the ABC series, was arrested around 3 a.m. Thursday morning for allegedly driving drunk in Hawaii, where the show is filmed. He’s the latest Lost actor to be charged with drunk driving – Cynthia Watros and Michelle Rodriguez were busted on DUI charges in 2005.

[From People]

Well if nothing else, the guy has some good PR reps and lawyers. He also saw what Cynthia Watros and Michelle Rodriguez’s DUI arrests did to their jobs on the show… and to their careers in general. Kim’s character is much more essential to the show than Watros and Rodriguez’s, but on “Lost” no actor is safe from an angry cloud of smoke smacking them to death against a rock. I don’t know why, but to me it sounds like Kim is pretty sincere in his apology. I couldn’t find any other history of legal problems, so let’s hope this was a one time thing and he learns from it.

Another “Lost” star busted for DUI

top-csh-013912.jpg

What is with the cast of “Lost”? What must their bosses be like, to drive them to such heavy drinking? And then driving? I can’t remember the last time one show had so many actors with the same problem. My next pick for DUI getting was Matthew Fox. Can’t say why. Oh, because I once heard him say in an interview that he knows he’s incredibly manipulative and he likes to spend a lot of time naked. And I just thought “Ding! You’re going to be the next one to drink too much.” Okay not really, but my money was definitely not on Daniel Dae Kim, who plays Jin-Soo Kwon.

Hollywood actor Daniel Dae Kim has become the fourth major cast member of television’s “Lost” to be arrested in Hawaii, TMZ.com said Thursday. Kim, who plays Jin-Soo Kwon on the mystery series filmed in Hawaii, was arrested by Honolulu police early Thursday on suspicion of drunken driving. The Honolulu Advertiser reported Kim was arrested around 3 a.m. and released about two hours later. Details of the arrest weren’t immediately available, TMZ.com said.

Kim’s cast-mates Michelle Rodriguez and Cynthia Watros were arrested for DUI in December 2005. Both actresses, whose characters have since been killed off the show, pleaded guilty. In September of 2006, Adewale Akinnuoye-Agbaje was arrested for disobeying a police officer and driving without a license. His character was also killed off. The charges were later dropped.

[From United Press International]

You know that means he’s going to get killed off! I don’t know if the producers of “Lost” are really law-abiding citizens, or if they don’t want bad press, or if they want their actors to keep a relatively low profile. But what are the odds that the other three got in trouble and just coincidentally got written out of the series? I loved Michelle Rodriguez’s line about how her character was always just supposed to be a one year thing. Bull. I was already pretty stressed about “Lost” in general, but now I’m going to be all uppity until it comes back on the air in February. Yeah, freaking February.

Michelle Rodriguez sentenced to Christmas in jail & 6 months

I really have absolutely no respect for Michelle Rodriguez. It seems like she’s just an extremely self-centered individual the likes of which you don’t often see – even in Hollywood. Rodriguez has been sentenced to six months is jail for not completing her community service – and forging documents to make it look like she did. How much did she forget to do? One day. So instead of just showing up and doing something useful for someone else (not to mention paying her debt to society) Rodriguez forged the documents – and was caught. Now she’ll have a good long while to think about her selfishness – and I’m guessing eventually bitch and moan on her blog about how she didn’t deserve it and it’s all everyone else’s fault. That was her reaction after having to wear an ankle alcohol monitoring bracelet due to her DUIs. Poor dear, if only the legal system would ease up and change its strict, archaic laws and let people get hammered and swerve along winding highways. And don’t fear that Michelle will be let out after a few hours due to prison overcrowding like last time – the judge has specifically prohibited it.

“Michelle Rodriguez was sentenced Wednesday to six months in jail for violating probation in a DUI case. ‘(She) admitted violating her probation by failing to provide proof of completion of her community service and for consuming alcohol three times while wearing an alcohol-monitoring device,’ said the L.A. City Attorney’s office in a statement. The Lost star must report to a Los Angeles County jail by Dec. 24. Superior Court Judge Daviann L. Mitchell also ruled that the actress is not to be granted an early release, despite L.A.’s jail overcrowding. She was also ordered to complete 30 days of road clean-up duty.

“The City Attorney’s office had alleged that Rodriguez turned in a false document showing that she completed one day of service on Sept. 25, court filings show. The actress later stated that she was in New York on that date. Her attorney, Shawn Chapman Holley, did not immediately respond to requests for comment. Last month, her previous attorney, Richard Beada, said: ‘We believe this is all due to a clerical error. My client did complete the full 30 days.’ Rodriguez, 29, had been serving an extended probation term for numerous driving infractions.

“In May 2006, she served only four hours and 20 minutes of a two-month sentence at the Lynwood, Calif., jail for violating probation, stemming from a DUI arrest in Hawaii in December 2005. She served, however, just over two days in a Honolulu jail in that case. In June 2004, Rodriguez had been placed on three years’ probation after pleading no contest to DUI and driving with a suspended license from two separate incidents in the Hollywood area in 2003.”

[From People]

Well at least she’s serving a lot of time and going to be forced to do some more community service. Normally I’d be annoyed if a person had to do was community service, but that seems to be what Michelle hates the most. I mean she actually chose jail over it one point. So I hope she’s forced to spend a lot of time helping other people – I can think of few things that would make her angrier. And we all know she has a bit of a fondness for the ladies in prison. I think it’s something about all the denim they wear.

I can’t believe she was stupid enough to drink while wearing an alcohol monitoring device. She’d claimed in several of her blogs and interviews that the thing would go off if there were any alcohol in her mouthwash or shampoo – it was that sensitive. She was probably planning on blaming her drinks on the bracelet. Or I could be full of it, I just want to believe the worst about her at this point. I hope they stick her in a daycare for community service. I can think of few things that would make her pissier than a bunch of happy toddlers. Not fair to the kids, but fun for me.

Picture note by Celebitchy: Michelle Rodriguez is shown on 9/29/07 outside of court after she was told she would have to complete just 16 hours of community service to serve her debt to society. That’s just two freaking days and she couldn’t manage it! Thanks to Splash News for these pics.

Kiefer Sutherland will spend Christmas in jail

top-csh-017513.jpg

Well Kiefer Sutherland copped a plea deal in his DUI case, and is set to start serving 48 days in jail right before Christmas. That makes me happy. I’m not really a fan of his (I know a lot of you are die hard “24” addicts) – he’s just got way too long a rap sheet for me. Whenever I see him on TV, I keep thinking (DUI DUI DUI DUI) – it’s distracting enough that I really can’t enjoy the guy. Which is too bad, because I’m told he’s pretty talented. According to the terms of the agreement, Sutherland doesn’t have to do all his time at once. Boy is that a cushy deal. Why not just give him a Lay-z-boy and a selection of fancy chicken nuggets in his cell while you’re at it?

“‘Based on the agreement, Sutherland will first serve 18 straight days in county jail for violating probation’ says veteran DUI attorney Lawrence Taylor. ‘He’ll be spending Christmas and New Year’s behind bars.’

“After that, Sutherland, 40, will have six months to complete an additional 30 days for the DUI – which he can even serve on weekends if he chooses to do so. He’ll be allowed to serve the second portion of his sentence in a city jail (which is seen as less harsh than a county facility).”

[From People]

It sounds like the National Guard for drinkers. “If you’re willing to commit two weeks a year and one weekend a month, you too can drink all you want and then drive home, probably running over a wide assortment of animals.” I think the California legal system should put that on some fliers. I’m glad he’s going to do some actual jail time, I just think it should interfere with his life a little more.

“The 24 star is ordered to appear in Metropolitan Court in Los Angeles on Dec. 21 for formal sentencing. He’s expected to plead no contest to a misdemeanor DUI count and admit that he violated probation from a 2004 DUI conviction. He will then be taken into custody by sheriff deputies on the spot and transported to the L.A. Men’s Central Jail. The plea deal stipulates that he cannot be released on home electronic monitoring. Sutherland released a statement late Tuesday saying, ‘I’m very disappointed in myself for the poor judgment I exhibited recently, and I’m deeply sorry for the disappointment and distress this has caused my family, friends and co-workers on 24 and at 20th Century Fox. I appreciate the support and concern that has been extended to me these last weeks both personally and professionally.’

“His studio, 20th Century Fox, indicated that the jail term would not affect the show’s production. Sutherland will have until July 1 next year to show proof to the court that he completed the 30 days of jail time. Anything less will be deemed as another probation violation, the agreement says. Sutherland will also be sentenced to five years’ probation, complete an 18-month alcohol education program and attend weekly alcohol therapy sessions for six months.”

[From People]

On the one hand, I’m glad that it seems like celebs are having to serve actual time and aren’t getting as much special treatment lately. On the other hand, the guy has a really long rap sheet, and I don’t think something as convenient as this jail sentence is going to do anything to temper his self-destructive, entitled attitude.

Lindsay Lohan talks about her “talent”

top-87888217wm.jpg

Lindsay Lohan is really good at saying just the right things to reporters, and using a lot of AA/therapy speak. There’s nothing wrong with that in general, but coming from her it seems really disingenuous. Lohan talked with “OK” magazine about her recovery and her plans to stay in Hollywood and not waster her “talent.” Here’s the problem Lindsay. “I Know Who Killed Me,” “Just My Luck,” and “Herbie Fully Loaded.” Pretty much all of those would indicate a severe lack of talent. So you might want to work on getting some before you worry about wasting it. Just a thought.

“Don’t look for Lindsay Lohan on the Hollywood club scene — or any Hollywood scene — anytime soon. Just hours after leaving Cirque Lodge treatment center in Utah, Lohan tells OK! magazine (on stands nationwide Friday) that she’s settling in the mountains. ‘I’m staying in Utah until it’s time to shoot Dare to Love Me,’ Lohan says, ‘and then I plan on returning to Utah so I can stay focused and avoid other distractions.’ (Lohan has a small role in the story of Tango legend Carlos Gardel.) But she’s not saying goodbye to the Hollywood industry. ‘Absolutely not — never! I’m here to stay,’ says the actress, 21. ‘My talent is a gift, and I’m going to use it in the right way.’”

[From USA Today]

So easy. Want to mock in a terrible, mean way. Don’t want to trigger relapse…. Ahhh! Pain radiating down my body! Can’t do it! Lindsay Lohan, Celebitchy and I got together and had a discussion, and we decided that you are the most hated of the Idiot Trifecta. And that’s not an award to be trifled with, you really have to earn that crap. You know, by stealing people’s cars and chasing their mothers through the streets of L.A. in a drug-fueled craze. As messed up as Britney and Paris are, as far as we know they don’t combine illicit substances with a severe, unchecked rageaholic personality disorder. They’ve certainly got other shit going on, but they don’t seem to commandeer cars, run over a guy’s foot, and chase people. Just a thought on the first – and easiest – step to improving your lot in life.

Want a little more trite AA speak from Lohan? Well she’s serving it up with her usual dose of sincerity/poor me mentality.

“Lohan checked into Cirque Lodge in early August, days after her second DUI arrest in less than two months and after two attempts at rehab. That second arrest, she says, was her ‘rock-bottom. Everything in my life came to a point where I had to make a decision; the arrest that night helped me come to a point where I had to make one.’ She acknowledges addiction and substance abuse and lying to cover up a serious problem. But Lohan doesn’t detail her drug and alcohol use. As part of her recovery, Lohan isn’t placing blame on anyone, and she says she plans on surrounding herself ‘with good people who have their hearts and their minds in the right places.’ She adds that during rehab, she has been in contact with only her family.

“[On] The feud between her father and mother, Dina, saddens Lohan, she says, ‘I wish it would stop. It hurts when two people you love argue with one another. I don’t think any child wants to see their parents argue or see their family fall apart. Unfortunately, it happens, and when it does, they should do it with as little effect on their children as possible.’ Lohan says her rehab experience was ‘sobering’ and ‘humbling. It made me look at myself, and all of the people, places and things in my life in a different way. I was in there for substance abuse, after all.’ Still, relapse is on her mind. ‘If I wasn’t (worried), I’d be living in denial. Temptation is always there, but now I’ll avoid it the right way.’”

[From USA Today]

If all that stuff wasn’t coming out of Lindsay Lohan’s mouth, I’d be really tempted to write a lot of “Oh good for her, it seems like she’s finally starting to figure it all out.” But that girl is incredibly manipulative. She just manages to take things to a whole new level, and she’s commercializing her recovery by doing rehab and post-rehab photo shoots for “OK.” They claim she’s not getting any money, but I’m sure she’s being compensated in some way. My guess is crack, meth, and a big SUV. All the ingredients for more Lindsay Lohan tabloid fodder.

Picture Note by Jaybird: Here’s Lindsay taking a break from rehab last Sunday in Utah, sharing a cigarette with fellow rehab patients. Images thanks to Splash Photos.

Michelle Rodriguez may end up back in women’s jail… just like she likes it

top-87887251wm.jpg

Michelle Rodriguez seems hell-bent on her whole “I’m the victim” “the system is the problem” line of thought when it comes to her DUI conviction. Michelle has a pretty involved rap sheet that began long before her most recent DUI arrest in Hawaii while she was filming “Lost.” In 2002, she was arrested for assault after getting into a physical fight with her then-roommate. The roommate refused to press charges. In 2003, she was charged with eight misdemeanors including hit and run and a DUI. She pleaded no contest to the hit and run, DUI, and driving with a suspended license. Want to know how much time she spent in jail? A grueling 48 hours. She also had to do community service in two New York City morgues, and finished a three-month alcohol program. As a result, Rodriguez was placed on probation for three years. So all she had to do at that point was just not drink and drive and run people over. Sounds fairly easy, right? Well apparently not so much.

Between August 24th and October 1st 2005, Rodriguez was pulled over three times in Hawaii for speeding, and given tickets for doing 83 mph in a 55 zone, 90 mph in a 35 zone, and 80 mph in a 50 zone. But did that hamper her style? Nope. Because she then decided to outdo herself and drive home (speeding, naturally) after drinking. She was charged with a DUI and eventually pleaded guilty. And you know what really says a lot about her character? Rodriguez chose to pay a $500 fine and go to jail for five days instead of having to do 240 hours of community service. Because isn’t jail always better than doing something good for others?

That arrest was a violation of her previous probation, so Rodriguez was back to jail for the probation violation as well. Though she was sentenced to 60 days in jail, she only spent a matter of hours in what I can only assume was the lady’s shower, before she was released due to overcrowding. Rodriguez also had to serve 30 days of community service and work with Mothers Against Drunk Driving, along with wearing an alcohol-detecting ankle monitor, which she repeatedly bitched about publicly, comparing the experience to George Orwell’s novel “1984.”

But Michelle’s hatred of helping others has hampered her again: it appears she hasn’t actually done all of her community service, and hasn’t done her required alcohol education program.

“Rodriguez went to court Friday to answer to the latest claims by the city attorney’s office, which said the former ‘Lost’ actress submitted a document stating she performed community service on Sept. 25, 2006, but later admitted she was actually in New York City that day. If she is found to have violated terms of her probation, Rodriguez could face between 477 to 537 days in county jail and a $2,000 fine. Rodriguez, 29, kept quiet in court as her attorney, Richard Beale, argued that she performed 30 days of community service and said ‘a clerical error’ caused the discrepancy in the paperwork.

“Superior Court Judge Daviann L. Mitchell granted Beale’s request to call two county sheriff’s supervisors who signed off on her community service forms to testify. A hearing was set for Oct. 12. In August, the judge found that Rodriguez had not completed a required alcohol monitoring program and ordered her to perform 30 days of road maintenance work. On Friday, the judge noted she had not completed the program or the maintenance work.

“Beale said she is making progress, but the judge admonished Rodriguez to take her probation more seriously. ‘I’m not impressed with your completion schedule,’ she said. ‘There were 55 people here in court today and all but very few have completed their responsibilities. They work on much less flexible schedules than you do.’”

[From Yahoo! News]

I hope Michelle Rodriguez goes back to jail. I bet she hopes so too. (In case you’re missing all the snide references - or just don’t follow Michelle Rodriguez with the macabre fascination that I do - she’s a sorta-closeted lesbian. Hence all the women’s prison and women’s shower jokes. Because I’m sophisticated like that). She’s talked a lot about how ridiculous and unfair the system is, and has written on her blog ad nausea about it. Honey, if you don’t like it, stop drinking. Stop hitting other cars and leaving the scene. Stop speeding when you knock too many back and decide it’s a great idea for you to drive home… really, really fast. Then you won’t feel like a victim of the system so much… and everyone else won’t feel like they’re about to be your hit and run victim. See how everyone wins!

Nicole Richie is having a boy, enrolls in alcohol awareness program

Nicole Richie has signed up for a year and half alcohol education program, called SB 38, according to People.com. She was ordered to attend alcohol education as part of her DUI sentencing, for which she also received three years probation, a $2,048 fine, and four days in jail, which was cut down to just 82 minutes when she showed up to serve her time on August 24.

It sounds like Richie will have to commit a lot of time to the program. The website for SB38 says she’ll have to do interviews with a counselor twice a week as well as put in 52 hours of group counseling. That’s an entire year of weekly one-hour sessions. She’ll also have to attend 12 hours of alcohol education. I wonder if she’ll see those shocking videos of car accident victims.

Multiple Offender Drinking Driver Program (SB-38), sometimes known as the SB-38 program, (named after the sponsoring Senate Bill 38 legislation) is for people who have been convicted of Driving Under the Influence (DUI) of alcohol or drugs on more than one occasion within a 7 year period. The program is 18 months in length and consists of 52 hours of group counseling, bi-weekly face –to- face interviews and 12 hours of alcohol education. Attendance at 12 step meetings is encouraged.

Whether or not the offender is ordered to go through the program by the court, he or she must complete it in order to get their drivers’ license returned. All multiple offenders have their licenses suspended or revoked for a period of 2-5 years. They must complete this state licensed program before the DMV will re-issue their license.

[From Santa Barbara Council on Alcoholism & Drug Abuse website via People.com]

It sounds like Richie is just doing what she has to do to get her life back on track, something that Britney needs dire help with. She has sworn off all drugs, alcohol and cigarettes for the health of her baby and is even said to be planning a drug-free natural birth.

Meanwhile The National Enquirer reports that six months-pregnant Richie is having a boy, and that her fiance Joel Madden is ecstatic:

“It’s a boy!” gushed soon-to-be daddy Joel Madden as he and pregnant paramour Nicole Richie shopped at Seattle’s Bootyland, buying baby tees imprinted with up-against-the-wall icons David Bowie, the Ramones, and Che Guevara… “He looked genuinely over the moon,” said a shopper. “He’s a bit nervous about being a new dad, but ecstatic that it’s a boy!”

[From The National Enquirer, print edition, Mike Walker’s column, October 1, 2007]

Well they have a 50/50 chance of being right. Back when Angelina was pregnant there were stories that she was having a boy, too.

Nicole Richie is shown out on 9/27. Thanks to WENN for these photos.

Kiefer Sutherland could face serious jail time

csh-025466.jpg
Kiefer Sutherland not only committed a second DUI in under five years, a crime that will get him a mandatory five days in jail under California law if he’s convicted, he violated his probation. And TMZ points out that the judge for the case for which he violated probation, a 2004 DUI, is none other than Judge Michael Sauer, the guy who put Paris Hilton in jail for 45 days for driving on a suspended license.

Sutherland has a long history of driving-related arrests, and the judge could that into account.

He was also busted in 1989 and 1993 for reckless driving. Both incidents had DUI charges, which were dismissed. His 1989 arrest also including charges for carrying a concealed, loaded firearm, but that didn’t stick either.

Now he’s still on probation for that 2004 DUI, and getting another DUI three years later isn’t going to bode well for him. What seems most damning for Sutherland is the fact that Judge Sauer could be presiding. He sent Paris Hilton away and then made sure she stayed in jail and didn’t get a medical pass from the warden. It’s unclear to me whether he will still have jurisdiction over Sutherland’s case, but he’ll be sure to get a lesson if that guy is in charge of sentencing.

Sutherland is due in court on October 16.

Kiefer Sutherland is shown in a tux at the FOX Primetime Emmy After Party on 9/16, and in a brown shirt at the FOX TCA All Star Party at the Pier on 7/32/07. Thanks to PRPhotos.

Kiefer Sutherland gets long overdue second DUI

keifersutherlanddrunk2.jpg
24 star Kiefer Sutherland has been videotaped, photographed and witnessed in various compromising drunken situations, including performing karate in a restaurant, attacking a Christmas tree, and subsequently passing out on the floor of a hotel lobby, and taking his pants off at a restaurant. He’s pretty straightforward about his issues, and calls the Christmas tree incident his most embarrassing moment.

Now Sutherland has been popped for DUI for a second time in five years. He was pulled over at 1:34 AM in Hollywood after making an illegal U-turn last night and blew over twice the .08 limit on the breathalyzer. He was booked at 4:09 AM and got out about an hour an a half later after meeting bail of $25k. He was said to be cooperative in jail. Sutherland is due to appear in court on October 16:

TMZ has learned that “24″ star Kiefer Sutherland was busted on suspicion of DUI in West Hollywood last night, after allegedly blowing more than twice the legal limit of .08. This is the actor’s second DUI in the past five years — he was arrested in 2004. By California law, if he’s convicted, he must serve a mandatory minimum of five days in jail.

Police sources tell TMZ 40-year-old Sutherland was pulled over around 1:35 AM PST on the corner of La Cienega and Beverly. Sutherland was at the FOX Fall Eco-Casino party at Area nightclub earlier that evening. The photo in this story was taken at the event.

Sutherland, who was stopped after making an illegal U-turn, was arrested for misdemeanor DUI and transported to the Hollywood Police station. He was booked at 4:09 AM and released at 5:42 AM on $25,000 bail.

We’re told Sutherland was “cooperative and mellow” while he was in custody.

According to the L.A. Sheriff’s Dept. website, the actor is 5′10″ and weighs 150 lbs.

Sutherland is scheduled to face a judge on October 16.

[From TMZ.com]

If Sutherland is convicted or pleads guilty he faces a mandatory minimum of five days in prison. It seems like he’ll be the next celebrity to go to rehab in the hope of avoiding a stricter penalty for DUI. He should stay the hell away from Cirque Lodge in Utah. Lohan already has her hands full there with Richie Sambora, and another celebrity will just add to her already heavy workload.

Seriously, he could have killed someone and should face the penalty for his actions. It’s one thing to engage in drunken hijinks harming flora, it’s another to put people’s lives at risk.

Thanks to CityRag for the header image.
