Gabriel Aubry & Halle Berry’s lawyers came to an “amicable agreement” apparently

There are about a million new pieces of Gabriel Aubry-Halle Berry news, and each media outlet is offering their own slightly tweaked version. From what I gather, Gabriel and Halle’s lawyers were in court yesterday and a deal was either worked out in court, or the lawyers had worked something out beforehand, so a deal was made and no one is really expounding on any of the particulars of said deal. Here are some highlights from the various coverage:

*TMZ says the lawyers spent “hours” together working to resolve all of the issues yesterday. The agreement which was hammered out is described as “amicable” and a source tells Page Six, “The agreement extends beyond the family law court.”

*The joint written statement: “The parties have reached an amicable agreement. There will be no further statements regarding this matter.” Gabriel showed up to court yesterday, but Halle did not.

*Radar’s source says: “Olivier will NOT be present in the future during the times that Nahla is dropped off and picked up between Gabriel and Halle. This was very important to Gabe going forward because he feared for his safety. Gabe was supposed to have Nahla on Thanksgiving, according to their custody agreement, but Halle asked if she could have the little girl that day and Gabe said yes. He had no obligation to do so, but he had been acting in good faith and knew it meant a lot to Halle, so he did it. Gabe was absolutely blindsided by Olivier and his rage.”

* The Page Six source also says “it would not be a surprise” if Olivier Martinez lets his criminal restraining order against Gabriel Aubry expire. And Radar’s source says Gabriel won’t proceed on his restraining order against Olivier. So that was probably part of the deal too.

*Halle and her team have started leaking to Us Weekly now… maybe because People Mag is tired of her BS? Us Weekly’s Team Halle source says, “They keep playing this game and Nahla is used as a pawn. It’s her I feel sorry for. All [Halle] wants is a normal family life.” Us Weekly’s print edition also promises to expound further on Gabriel’s “anger issues” or something.

*An LAPD Commander named Andrew Smith told People Mag that the Olivier-Gabriel fight is still being investigated but “Our officers have initially concluded that Aubry was the primary instigator.”

So, is it over now? Doubtful. I think it’s wishful thinking to say that we’ll go another year before there’s another outburst or attack or abuse claim. Christmas is coming… another opportunity for drama, you know?

Gabriel Aubry’s beatdown was not caught on Halle’s security cameras, of course

Gabriel Aubry and Halle Berry will be back in court today. I think. Probably. Honestly, there was a lot of oddly contradictory information that came out of Tuesday’s family court hearing about possibly rescinding Halle’s emergency protective order, but I think the bottom line is that everyone will be in court today because if Halle wants the protective order to stay in place, she’s got to prove that Gabriel really is a threat to her, to Nahla and to Olivier Martinez. Which continues to be bizarre because it looks like the only thing wrong with Olivier following the “fist-fight” is that he screwed up his beatin’ fist. And, as you can see from the photos of Gabriel’s injuries, it doesn’t even seem like Gabe threw one punch. It looks like Gabe was just Olivier’s punching bag.

I’ve seen this information in the comment threads, but I never saw TMZ or Radar report it, so I didn’t know what to make of the gossip. Apparently, Gabriel concerns were misplaced about the security cameras on Halle’s property. According to TMZ, the cameras were never going to be of use to Gabriel. Of course:

There is no video surveillance footage of the violent Thanksgiving Day showdown between Gabriel Aubry and Halle Berry’s fiance Olivier Martinez — and it’s all because of Halle’s old stalker.

Law enforcement sources tell TMZ, when detectives visited Halle’s home last year to investigate a scary stalker situation, they advised her to re-position her home security cameras to face the fences surrounding the property … in order to catch a possible intruder.

Halle obliged … and the cameras have remained facing the fences ever since … and could not have captured the front door area of the home where the fight between Halle’s past and present men took place.

Law enforcement sources tell TMZ, detectives have reviewed the available footage — shot at the time of last week’s brawl — and confirmed the fight went down outside of the cameras’ field of vision.

As for Gabriel’s claim that Halle could have erased the video — we’re told cops DO NOT believe the security footage was altered in way … it just plain missed the shot.

I think the “proof” that Olivier attacked Gabriel (and not the other way around) is in Gabe’s injuries as compared to Olivier’s. I think the “proof” that Olivier’s attack was premeditated should be everything that came immediately following the beatdown – the “citizen’s arrest”, the first version of events pushed out by Halle and Olivier, and the immediate emergency filing of the protective order. Do I think that the lack of security footage means anything? Eh. Halle does have a crazy stalker. And it makes sense that the security cameras would be positioned to face those people trying to get in, as opposed to Halle’s interior driveway, inside her gate or whatever.

As for that totally random thing that I mentioned yesterday, where some of Gabe’s legal documents referred to Halle as his “ex-wife” – “sources” told TMZ that Halle and Gabriel were definitely never married. So there.

Halle Berry “secretly” put her LA home on the market “a few weeks back”

I know you guys are already talking about all of this stuff in the other Aubry/Berry/Martinez post, but let’s just go ahead and cover all of this crap anyway. As we already knew, Halle Berry’s security cameras around her property were set up so that none of them caught Olivier and Gabriel’s fist-fight (or one-sided beatdown, as the evidence now suggests). We know that this giant legal and custodial and criminal clusterf—k went down on Thanksgiving, just a few weeks after a judge told Halle that she could not move to France with Olivier and Nahla because it would effectively end Gabriel’s custodial rights. We know that Halle has done everything – literally, everything – to try to strip Gabriel of his custodial rights. So then comes this suspicious story about Halle’s real estate:

Halle Berry has VERY quietly listed her Hollywood Hills mansion for $15 million … the same home where Gabriel Aubry and Olivier Martinez faced off in a violent Thanksgiving Day showdown … TMZ has learned.

Multiple real estate sources familiar with the deal tell TMZ … a few weeks back Halle gave a prominent realtor a pocket listing — a fancy term for property that isn’t advertised. The broker — Billy Rose with the high-end company, The Agency, has history with the house. He owned it a decade ago, renovated it and then sold it to actor Frankie Muniz, who sold it to Halle several years later.

Sources tell TMZ … Rose has quietly put out feelers to other realtors and potential buyers … with some success. We’re told last week Halle got an $11 million offer, but she’s holding out for more.

In case you’re in the market, it’s a 5-bedroom, 5,900 sq. ft. Tuscan-style estate, with a huge backyard, a 1,400 sq. ft. guest house … an awesome pool and spa … fireplaces galore … incredible landscaping … and oh yeah, a motor court — where Gabriel and Olivier settled their score.

“A few weeks back”??? I would like to know exactly when. I would like to know the exact date. I would like to know if Halle had quietly put her home on the market BEFORE the judge’s ruling on the move to France or AFTER. Of course, it’s perfectly possible that Halle simply doesn’t like her current house and she’s planning to buy another home in LA. But it’s still a sketchy move, right?

In addition to that, TMZ had another bizarre story which seems to come entirely from unnamed LAPD sources:

Although it appears no criminal charges will be filed against Gabriel Aubry in the Thanksgiving Day massacre of his face at Halle Berry’s house … cops on the scene concluded he was the instigator … TMZ has learned.

According to the police report, after interviewing Gabriel, Olivier Martinez and Halle, the investigating officer concluded, “Suspect [Gabriel] arrived at victim’s [Olivier] residence for child custody exchange. Suspect and victim engaged in verbal altercation. Suspect became upset and attempted to punch victim’s head but missed and struck victim’s right shoulder instead. Victim returned with 3 punches to the suspect’s head, causing him to fall to the ground. Victim’s fiance [Halle] notified police.”

It’s interesting … Olivier and Gabriel each claimed they said nothing to incite the other, but the report concludes both were smack talking.

According to the conclusions in the police report, Olivier acted in self defense: “Victim defended himself and punched the suspect.”

And law enforcement sources tell TMZ … Gabriel never told police about the alleged death threats made by Olivier both the day before and during the fight … threats he later claimed were made by Halle’s fiance. What’s more, cops contacted Gabriel after the fight and asked if he had more info, and he passed. There was no mention of death threats.

Nonetheless … in the end law enforcement believes it’s a case of mutual combat and it’s almost certain Gabriel will not be prosecuted.

This just reads as a reiteration of the original story which was pushed out by Team Halle on Thanksgiving. And here’s my problem with the continuing story line of “Gabriel never mentioned any of this on the day of the fight”: as we now can see from Gabriel’s awful injuries and his side of the story, he had been brutally beaten and Olivier had slammed his head into concrete. That’s head trauma, a concussion, and I think it’s weird that everyone is like “well, he should have told his side of the story even though he had just been knocked unconscious” or whatever.

Were Gabriel Aubry’s visitation rights reinstated? Reports are mixed.

Well, bad news for Gabriel Aubry. But it’s not as bad as it could be. Gabriel was in family court yesterday to see if the court would rescind (withdraw?) Halle Berry’s emergency protective order against Gabe. Halle got the emergency order seemingly hours after the Thanksgiving fight between Gabriel and Olivier Martinez, and she let it be known that she would be seeking a permanent restraining order against Gabriel so that he would no longer have access to Nahla. Gabe battled back by filing for his own restraining order against Olivier, and making a declaration that Olivier had instigated the fight, and Olivier had tried to kill him. Well, the bad news is that the judge decided to let the emergency protective order stand as-is. The good news is that the order is only valid until Thursday, when Halle and Gabriel will likely be back in court arguing their different stories on what went down:

Gabriel Aubry took another lump in his war with Halle Berry today … a judge just rejected his bid to have the restraining order removed … which means he still can’t visit with his daughter Nahla.

Gabriel had gone back to court today to ask the judge to lift the emergency restraining order that was issued against him on the day he got beat up by Halle’s fiance Olivier Martinez.

Initially, the restraining order was supposed to stay in place until Dec. 3 … but today, the judge acknowledged there was a clerical error … and the order can only stay in effect until Thursday Nov. 29.

The order prohibits Gabriel from going within 100 yards of Nahla, Olivier or Halle.

Gabriel wanted the order to end TODAY — but the judge shut him down.

Now, Halle and Olivier will have to go to court by Thursday if they want to keep Gabriel away from them and Nahla.

Oddly enough, both Radar and Page Six are claiming that Gabriel DID win the right to see Nahla again right now, saying that after the judge met with Halle and Gabe’s lawyers behind closed doors, the judge “tweaked the restraining order to allow him to see Nahla again… it wasn’t clear how Aubry would be able to see Nahla because he’s still under orders to steer clear of Berry and Martinez. We’re also told that Aubry may not be able to work for months due to his nasty collection of facial cuts and bruises.” Basically, I think we have to go through all of this again on Thursday. Only I guess the lawyers will be more prepared then. Hopefully.

Radar had a very sympathetic pro-Gabe story yesterday, before the court made its ruling. A “source” told Radar:

“Gabe has had enough, he has now twice been accused of criminal behavior resulting in his recent arrest after a fight with Olivier Martinez on Thanksgiving. Gabe will ask the judge to prohibit Martinez from having any contact with Nahla. Gabe will also ask the judge to re-instate his visitation with Nahla after Halle obtained a protective order after Gabe’s arrest which doesn’t allow him to have any contact with his little girl. Gabe believes that the judge will be disturbed by the fact that Olivier suddenly inserted himself into the custody hand off on Thursday. Halle’s nanny/housekeeper is supposed to be the go-between for the parents when Gabe picks up and drops off Nahla.”

I think the idea of prohibiting Olivier from seeing Nahla makes sense logically – after all, if the argument is “Gabriel should be seen as violent,” then you can easily make the same case for Olivier. And if Gabe’s version of events is true (or even mostly true), I would NOT want Olivier around any children either. At the end of the day, I suspect that this legal move will just make Halle and Olivier even angrier. You know what really worries me? The nightmare scenario in which Halle and Olivier just pick up and take Nahla to some country where an extradition order would never be honored. I think that might even be Halle’s Nuclear Option, you know? So let’s be thankful right now that both Halle and Gabriel are still channeling their anger and rage and drama and insanity through the court system.

As for the possibility that Gabe will actually face criminal charges (he was initially charged with misdemeanor battery), TMZ and Radar are in agreement that it is unlikely. TMZ says the cops will recommend that Gabe NOT by prosecuted because the fight was “mutual combat”. But Radar says that Gabriel wants Olivier to face criminal charges for the attack.

Also: bizarre story, but Extra is reporting that in Gabe’s restraining order filing, he referred to Halle as his “ex-wife”. They were never married to anyone knowledge, so… maybe it’s just a typo?

Poor Halle Berry “feels she’s left with no alternative but to quit her career”

Sorry I missed all of this new information in my earlier post. If you want to read what we’ve already covered about this Gabriel Aubry-Halle Berry-Olivier Martinez story, go here. The latest news is that Gabriel filed for his own restraining order against Olivier, and Gabe is now claiming that Olivier attacked him and tried to kill him. Gabriel submitted photos to the court which show his badly beaten face, and his version of the events is in direct contradiction to Halle and Olivier’s side of the story (which they got out early – suspiciously early). Here’s more info:

*We’ve known for a while that Halle had security cameras set up on her property, and that Team Gabriel really wanted those security tapes to see the light of day. According to Radar, Gabriel swears in his application for a restraining order that he “repeatedly asked cops to secure security footage before it was destroyed” immediately following the fight with Olivier. Gabe says in his declaration: “I told the officers that [Martinez] was the one who attacked me, and repeatedly told them to get the security tapes from Ms. Berry’s security cameras before she and Mr. Martinez deleted them.”

*We previously heard that Olivier threatened Gabe repeatedly before and during the Thanksgiving fistfight, but Radar says that Olivier’s exact words (as Gabe remembers them) were: “We called the cops, [and when they arrive], you’re going to tell them that you’re the one who attacked me, or I’m going to kill you.” Does anyone else think that this whole attack might have been premeditated?

*Gabe will be family court today asking the judge to lift Halle’s protection order so that he can see Nahla. Gabe’s defense is that Olivier instigated the fight. Halle’s lawyers will be appearing during the hearing too, and Halle might show up herself.

*Yesterday, LAPD detectives arrived at Halle’s home to interview her and Olivier. We don’t know what was said.

*Radar has a hilariously obvious pro-Halle story up right now – it’s all about how Halle the Martyr has resolved to “give up” her acting career because of all of the horrible drama. A source says:

“Now that a court has ruled Halle can’t move to France permanently, she feels she’s left with no alternative but to quit her career. It may seem pretty dramatic, but Halle doesn’t know what else she can do to stop the tabloids writing about her. In the last few years, she has worked on only a handful of films, so she can dedicate most of her time to Nahla. She also thought that would make her less of a target for the paparazzi, but with all the drama going on in her personal life that hasn’t been the case. Halle thinks that Nahla’s upbringing has been far from ideal. Her picture is taken by photographers all over the world whenever she’s with her mom, and Halle would hate to think that Nahla may come to believe that’s a natural occurrence. But she made a life as an actress, an Oscar-winning one too, so it would be hard for her to just quit,” the source opines.

CPS reopens investigation into Halle Berry & Gabriel Aubry following holiday fight

Here’s Part III of this holiday season’s epic Halle Berry/Gabriel Aubry Disaster. As we discussed throughout the holiday, Gabriel Aubry and Olivier Martinez got into a fist-fight outside of Halle Berry’s home on Thanksgiving. Gabe was dropping off Nahla, and Olivier reportedly said something to Gabe to instigate the fight, but Gabe threw the first punch. Both men sustained injuries, but only Gabe was arrested (for misdemeanor battery), and Gabe is already out on bond or bail or whatever. Meanwhile, Halle has been using this situation to further her own continuing claims that Gabriel is an awful, violent person – she’s already gotten an emergency protective order (meaning that Gabe can’t come near her or Nahla), and Halle is also seeking a permanent restraining order against Gabe. Because of course. Now Radar reports that CPS has re-opened its investigation of Gabriel… well, they’re investigating the entire situation, it seems like.

The L.A. County Department of Child Protective Services will be formally re-opening an abuse investigation involving Halle Berry and Gabriel Aubry’s daughter, Nahla, following the Thanksgiving brawl between her father, Gabriel Aubry, and her mother’s current boyfriend, French actor Olivier Martinez, RadarOnline.com is exclusively reporting.

“Detectives from the LAPD formally contacted CPS after Gabe’s arrest, because Nahla was present when the fight occurred,” a source close to the situation tells Radar exclusively.

“Nahla wasn’t actually involved in the melee, and by all accounts, Halle whisked her out of the driveway as soon as the fight between Olivier and Gabe started. However, DCFS was contacted because there has been a history of allegations of physical abuse. Social workers will be interviewing Halle, Gabriel and Olivier about what happened on Thanksgiving. DCFS must ensure that Nahla’s environment is safe.”

As we previously reported, while dropping Nahla off with Halle on Thanksgiving morning, Aubry got into a knock-down, drag-out brawl with Martinez.

The cops were called, and both men ended up getting treatment at Cedars-Sinai Medical Center in Los Angeles. Aubry was booked on suspicion of misdemeanor battery, posted a $20,000 bond and has a December 13 court date.

Meanwhile, Berry has reportedly gotten an emergency restraining order to keep Aubry away. The two have been in an ongoing child custody battle. Berry was recently shot down by a Los Angeles judge who ruled that she couldn’t move with Nahla to France, because Gabriel lives in Southern California.

Earlier this year, Aubry was accused of shoving Halle’s nanny while she was holding Nahla. The nanny filed a police report but the Los Angeles City Attorney failed to file charges against Aubry citing a lack of sufficient evidence.

“Gabriel is extremely concerned about his arrest and the fallout this could have on Nahla. She is his entire world and is hopeful that once the truth comes out, he won’t be formally charged with any crime,” the source says.

Radar has a history of being more Team Gabriel and TMZ is usually more Team Halle, so take that as you will. I’ll buy that CPS has reopened their investigation, and I’ll buy that Gabriel is very, very concerned – as he should be. Personally, I think Halle (and Olivier) manipulated Gabriel into this position, but Gabriel definitely needs to take responsibility for his own awful actions.

Celebuzz has a lengthy discussion with some legal experts about what could happen next in this ongoing custodial dispute – you can read the Celebuzz story here. Basically, the experts say that if Halle gets her restraining order, that will be “the game changer” in this custody dispute, and it could possibly end Gabriel’s custodial rights. The experts also expect for Halle to raise the issue of moving to France once again, but they stress that even if the court finds that Gabriel is a violent monster (?), that doesn’t automatically mean that Halle and Olivier will get to move to France with Nahla.

Halle Berry will be seeking a permanent restraining order against Gabriel Aubry

Here are some newish photos of Halle Berry on Friday in LA with Nahla. Halle took Nahla to see Yo Gabba Gabba! Live at the Nokia Theatre. Other celebrities were there with the kids, of course, but Halle and Nahla definitely got the most attention. As we discussed on Friday, Halle’s ex and her current got into some kind of awful fist-fight outside of her house on Thanksgiving. Gabriel was arrested, charged with misdemeanor battery and released on bond. Olivier was not charged with anything because – as it seems currently, from an investigative standpoint – Olivier only injured Gabriel in self-defense, meaning that Gabriel started it.

So, what’s happening around this situation now? There’s not a lot of information, surprisingly enough. I kind of expected Halle to release more details to TMZ, maybe even give a statement to People Magazine. But that hasn’t happened… yet. Maybe she’s waiting for the holiday weekend to be over so that more people will be paying attention. Here are some bullet points of what we know now:

*TMZ reminds us that Halle got an “emergency protective order” against Gabriel, meaning that he cannot be within 100 feet of her, Olivier or Nahla. To enforce this protective order, Halle is now rolling with armed security guards.

*TMZ says that Halle will be going to court this week to ask for a restraining order against Gabriel. “Sources” (cough) say “Halle and her lawyers are alarmed that Gabriel allegedly started the fight with Olivier Martinez right in front of 4-year-old Nahla. Although a judge issued an emergency order of protection — requiring Gabriel to stay 100 yards away from Halle, Nahla and Olivier — that order expires Tuesday. We’re told Halle’s lawyers will be in family court asking a judge to extend that protection for an indefinite period of time.” Halle’s argument boils down to “Gabriel is violent and she doesn’t want him around Nahla.”

*You can see a photo of Gabriel’s bruised and swollen face here at TMZ. He has a black eye and it’s super-puffy. I bet it hurts like hell too. Olivier’s injuries are said to include a “screwed up” hand and a sore neck and shoulder, maybe.

*Radar says that Halle’s security cameras captured the fight, but the video hasn’t been given to the LAPD (who are still investigating the situation). Radar says Gabriel wants the video to be turned over – maybe he thinks the video will prove that Olivier instigated the situation?

Ugh. Hot mess. And it’s only going to get worse, you know.

Gabriel Aubry & Olivier Martinez got into a fist-fight at Halle Berry’s house

I’m just putting this question out there: is Olivier Martinez just as crazy as Halle Berry? I’m starting to wonder, because it would honestly explain so much. That’s why Olivier hasn’t run for the hills yet. His crazy is feeding on her crazy, drama upon drama, and on and on. Anyway, it was less than three weeks when the judge ruled against Halle Berry, saying that she could not move to France with her daughter Nahla Aubry, because it would effectively end Gabriel’s custodial rights. I’ve been waiting to see what Halle’s next move would be because OBVIOUSLY that would not be the end of it. That only made Halle feel more persecuted. So when Gabriel Aubry went to drop off his daughter at Halle’s home on Thursday morning, guess what happened? Olivier Martinez came out to talk to him – and by “talk” I mean “talk smack”. A fist-fight ensued, because all of these adults act like children most of the time.

Gabriel Aubry was arrested Thanksgiving morning after a melee at Halle Berry’s house, which sent both Gabriel and Halle’s fiance Olivier Martinez to the hospital … TMZ has learned.

Law enforcement sources tell TMZ … Gabriel showed up to Halle’s house with Nahla for a custodial hand-off. We’re told Gabriel was still in the motor court (a rich person’s word for a giant driveway) when Olivier walked up to him and said, “We have to move on.”

According to witnesses, Gabriel then pushed Olivier and threw a punch at his face, but Olivier blocked it and the punch struck him in the shoulder instead. We’re told Gabriel then pushed Olivier to the ground, and Olivier cold-cocked him in the face, and a struggle ensued, ending with Olivier pinning Gabriel to the ground.

In the struggle, Gabriel suffered a broken rib, contusions on his face, and possibly a more serious head injury. Olivier may have broken his hand and suffered neck injuries as well. There are conflicting accounts as to whether Gabriel was rendered unconscious in the fight.

Police were called and Olivier made a citizen’s arrest for battery against Gabriel. Gabriel was escorted to the ER and, ironically, Olivier went to the same ER an hour later. The two were just down the hall from each other.

Law enforcement sources tell TMZ … a judge has issued an emergency protective order, which requires Gabriel to stay 100 yards away from Halle, Olivier, and Nahla.

And finally, there’s this … specifics about the argument between Gabriel and Olivier are sketchy because they were trash talking each other in French.

It’s pretty shocking — considering Gabriel was out with Nahla just last night for a movie date at the Grove.

5:55 PM PT — Gabriel has been booked for misdemeanor battery. According to his booking sheet, he’s listed as 6’2″ and 180 pounds. He’s still in custody and his bail has been set at $20,000.

5:30 PM PT — Sources tell TMZ … when Gabriel and Olivier started going at it, Halle rushed Nahla inside the house so she missed the brutality.

3:35 PM PT — Gabriel has been released from the hospital and is currently at an L.A. jail where he is being booked. Olivier has also left the hospital and has returned to Halle’s home.

Us Weekly’s LAPD sources say that the investigation is still ongoing and that “the cause of the fight between the two men is unknown.” A “source” (Halle) went to People Mag and said, “Gabriel attacked Olivier and Olivier defended himself.” Gabriel’s bail has been set at $20,000, which I’m assuming he made immediately and went home.

So, what’s the general opinion on this? Gabriel – fairly or unfairly – comes across like a dude with a short fuse who is now known to be “prone to violence.” Which is never good. I could make some excuses for him – Olivier was probably trying to start something because of course – but that doesn’t change the fact that Gabriel should have been mature enough to walk away (or drive away). In the end, no matter who or what instigated whatever, I’m sure this is going to end up badly for Gabriel. Halle has some serious ammo now.

Halle Berry cannot move to France with daughter Nahla, judge rules

For more than a year, Halle Berry has been engaged in a legal and custodial battle to move permanently out of California. She wants to move to France with her fiancé Olivier Martinez, and she wants to take Nahla with her. The problem? Gabriel Aubry, Nahla’s father, put his foot down. Gabriel believed that this “moving to France” thing was just another attempt by Halle to deprive him of his custodial rights. Halle’s side always seemed to be that she didn’t want Nahla to grow up around the American tabloid press culture, and that somehow France would be better for Nahla. Of course, Duchess Kate’s topless photo scandal ruined that (Kate was photographed topless… on a private estate… in France). This particular custody issue has been going on for a long, long time, and it’s just been resolved. Sort of. Apparently, the judge just ruled on Friday that Halle is NOT allowed to move Nahla out of the country without Gabriel’s permission:

Halle had been fighting tooth and nail with her baby daddy Gabriel Aubry to bring Nahla to Paris, where Halle wants to live with her fiance Olivier Martinez.

Halle argued the L.A. paparazzi scene made life in California too dangerous for her and her daughter — but today the judge in the case ruled in favor of Gabriel, refusing to let Halle jet to France with their kid.

The full details of the ruling are unclear — but one thing’s for sure … Halle did NOT get what she wanted.

Halle has said from the beginning she never wanted to remove Gabriel from Nahla’s life — she merely believed France would be safer for everyone involved.

CB usually covers these stories because I have a history of going hard on Halle. So, let me go out of my way to be fair to Halle: I do think she has a point about the American tabloid/celebrity culture and how detrimental that kind stuff is for a kid. Unfortunately for Halle, she had already tried several other legal maneuvers in an attempt to limit Gabriel’s custody rights, so this argument just seemed like the latest in a long line of bitchy moves. Also: I’ve always felt Halle used the celebrity press when it was convenient for her, like when she wants to push an image of herself as a loving mother and how she has a “happy family” with Olivier, there are always some happy, “candid” paparazzi photos. My point is that she’s an active participant in the gossip-game too, so this “I must move to Paris, to be left alone!” argument never really held water with me. So I’m glad Gabriel’s rights were upheld.

Halle Berry ‘rebelled against the notion that you have to have long hair to be beautiful’

Here are some new photos of Halle Berry and Tom Hanks at the premiere of Cloud Atlas in Berlin, Germany. Tom is lovely, and Halle is… Halle. She’s beautiful and she can do no wrong (at least when it comes to her physical beauty). Halle is wearing a navy Helmut Lang dress which is pretty good. I like a good blue dress, and this one is fine. I think I would like it better if the navy didn’t seem so “dusty”. Go bold or go home, especially when you’ve got Halle’s magnificent coloring.

Yesterday, People Mag published an interview with Halle in which she discussed the issues people have with her short hair, and short hair in general. I found it interesting…

It’s been more than three years since Halle Berry famously chopped off her hair, but it’s still an ever-present topic of conversation for the star.

“When I have my short, short hair, that’s when I’m my best self,” she tells PEOPLE. “But hair doesn’t define me. It’s just an accessory that I get to wear, like a handbag or shoes.”

However, at the start of Berry’s career, her lengthy locks did define her, since long hair is so often seen as beautiful in Hollywood. “I personally fought against that stereotype when I first started acting,” she explains. “I would go on acting auditions, and every black girl would have this long, curly hair, whether it was real or not. And I would go to these auditions and come back with nothing. So I had to somehow be different.”

Berry actually made her first big cut around 1989. “I remember I went up to my manager’s office and his heart probably stopped beating. And he said, ‘You’re never going to work, you’re not what they want!’ And I said, ‘Good. Let me be something different then.”

Two weeks later, she got her first TV job, as a model on the short-lived ABC series Living Dolls. “I had short hair and that’s why they chose me — because I was different and not like everyone else. It was the way I kind of rebelled against … the notion that you have to have long hair to be beautiful.”

Shall we really talk about this? I want to talk about this! I have long hair. I’ve had long hair almost all my life, save for a few years in college when I wore my hair slightly above my shoulders. I feel like I look better with long hair (and NO bangs) and that’s my call. I really don’t feel I have the face for short hair, nor do I have the face for bangs. In my opinion, very few women look better with bangs, and as for short hair… I think you do need to have a certain “face” for it. Like, Halle looks awesome with short hair. I think she looks better with short hair than with long hair. Anne Hathaway was not so lucky, and (just my opinion) neither was Emma Watson, who tended to look like Justin Bieber with short hair. For me, in my little world, it’s less about “long hair = the standard of beauty” and more about “see what works with your face.”
