As we discussed this week, Lori Loughlin turned down a plea deal and ended up getting indicted for more crimes. On Monday, it looked like Lori could possibly be facing two years in prison. By Wednesday, the new indictments came down and she could be facing more than 20 years in prison if convicted. For weeks now, I’ve become convinced that Lori truly believed that she could simply treat “federal charges of bribery, tax fraud and money laundering” as a PR crisis which could be solved with autograph signings outside of the courthouse and anonymous quotes to People Magazine about how churchy she is. Life comes at you fast, though.

First, People Magazine had a lengthy story about how Lori and Mossimo Giannulli were in serious denial. When federal prosecutors offered them a deal which would have had them doing 18-24 months in jail, sources said: “They weren’t ready to accept that. They’re really not seeing how serious this is.” Now that they refused the deal and have gotten indicted a few more times, sources say: “They decided to roll the dice and it may have been a bad gamble. Now they’re in worse shape than before.” People Magazine also had a story about how, yeah, the prosecutors want all of the parents to serve jail sentences. The source said: “They want to send a clear message, and that message includes jail time. Prosecutors know this is a high profile case and they want to make an example of the defendants.” The only way to avoid a jail sentence is a not guilty verdict at trial, and prosecutors stress that they have a mountain of evidence against Lori and Mossimo. Then E! News chimed in with an exclusive that had many of the same details:

For awhile, as Lori rattled around the 12,000-square-foot spread they first snapped up for nearly $14 million in 2015, she was able to keep the worst of the “what ifs” at bay. Firm in her beliefs that surely she wouldn’t see the inside of a prison cell, a source tells E! News, she neglected to join the 13 parents (including fellow actress Felicity Huffman) and one university athletic coach who agreed to plead guilty to the charges of mail fraud and honest services mail fraud.

“She has been in complete denial and thought maybe she could skate by,” the source explains. “She refused to accept any jail time and thought the DA was bluffing. She was adamant she wouldn’t do any jail time.”

But without work to busy herself with—on March 14 Hallmark announced they were severing all ties with Lori, which is, perhaps, for the best considering she was forced to surrender her passport rendering her unable to travel to her series’ Vancouver sets anyway—she’s had more than enough time to stew and second guess her gut reaction.

“Lori is finally realizing just how serious this is,” says the source, noting the former child model is beating herself up for not accepting the initial deal. “She is seeing the light that she will do jail time and is freaking out.”

“She refused to accept any jail time and thought the DA was bluffing. She was adamant she wouldn’t do any jail time.” First, it’s not a “DA” it’s a federal prosecutor. Second, imagine the privilege. Imagine the Becky-ness. Imagine thinking so highly of yourself and your bullsh-t “faith-based” lifestyle that the prosecutor was like “look at this sh-t ton of evidence we have against you” and saying “nah, don’t believe it, I’ll take probation thank you very much.” Lori did all of these crimes and she knows how much evidence there is. And she’s still stuck in her bubble of privilege where nothing bad would happen to a rich white lady like herself. Throw the book at her.

      Her legal counsel is terrible and clearly not either understanding the seriousness of her crimes or not communicating them well. Wonder if her lawyers skipped out on law school and fast tracked the way to becoming lawyers 🤔

        Lawyers can give all the advice in the world, but eventually we’ve taken an oath to be zealous advocates for whatever course of action our clients decide to take. We can lay out all the facts and strenuously disagree with their position, but in the end, certain decisions belong solely with the client, legally AND ethically. I could be disbarred if I went into a courtroom (or negotiating table) and purposely advocated against my client’s stated decision. I doubt her lawyers advised her against the offered plea. I believe strongly they forcefully advised her to take it. But, ultimately, once she, as client, rejected it, even if against the advice of counsel, they could not work against her. She’s the client. She pays for advice, and she is entitled not to accept it. Lawyers are duty-bound, in this type of situation, to hold their noses and bluff and hope for the best possible outcome for the client, even knowing it won’t be good. A law license is not a license to go rogue – that’s a fast track to the disciplinary committee. The clients have the sole decision-making authority. We have (limited) leeway with respect to strategy to obtain the client’s goals. But we advocate for the client, even stupid ones.

        @Enny Yes, 1000x!! Attorneys are allowed to make some decisions for their clients but big ones including whether to plead or go to trial is solely up to them. If there is a situation like this where they are looking at enhanced prison time or more charges but don’t follow my advice to accept a plea, I make them sign a waiver for my file so that it is documented that they were aware of the consequences and my advice but declined to follow it. That way, when they are later sitting in prison for years and start looking to blame someone (bc that’s at the root of most of their issues anyway – failure to accept personal responsibility in life) they can’t come back and try to say it’s my fault!

      Indeed. Also, the Hollywood lifestyle is such a bubble of privilege people like her have NO idea what the world is really like outside of it. When actors get in trouble for something Hollywood-related, they can always buy their way out of it and the PR machines smooth things over.

    In her defense, in this country in this time that we are now living in with the monster in the White House setting horrifically awful examples on what seems like an hourly basis, if I was a insanely wealthy white woman with zero principles, I’d probably feel like I was untouchable too.

    Having said that, it would be really nice to see that level of undeserved entitlement and arrogance be rightly punished under the word of law for once.

    So she isn’t getting bad legal advice, she’s just too precious (in her mind) for jail. She’s also a special kind of stupid. If I saw my fellow defendants make haste to cop a plea, I might read the writing on the wall and do the same.

      That stood out to me, too. ALL the other defendants accepted the plea deal, and Lori, quite literally the face of this scandal, thinks she’s going to get off BETTER than them? She’s forever associated with this, other than Huffman I couldn’t name any of the other 13 who plead, and I’ve followed this scandal pretty closely. Her lawyers must be exasperated.

        She is definitely “forever associated with this”. Maybe when she hits 70 she’ll finally get hired by Hallmark again, playing an 85 year old granny who passes away at Christmas. But Granny will already have precious gifts under the tree for her family; wrapped in Hallmark paper with Hallmark cards. Soooo sweet.

      If she only had a computer and a search engine, she could have easily researched the subject (instead of doing pap strolls). Yes, Lori. wealthy people with no previous criminal record can go to federal prison.

      She might want to work on her cleanup skills, as one of the first jobs at Camp Cupcake is supposedly dining hall/kitchen duty.

    At first I thought she must be one of those smug people who are always the exceptions. When Felicity had feds knocking through her doors guns drawn early morning, and we saw this one strolling around canada looking smug.

    But now I think she would have been a lot better off if she HAD been home that morning. I think the armed federal raid ensured Felicity knew she was in deep doo doo day one, and if Becky here had been home, she may have ended up serving a lot less time in prison.

      That’s an interesting point @Darla, maybe her wake up call just came too late.

      She needs to take PR lessons from Felicity who, don’t get me wrong is disgusting and should serve jail time, has handled the PR side of this PERFECTLY since day one. Always looks serious and sad in public (as does her husband), dressed down, no autographs or fan photos, the well drafted (by whomever) statement, and took. the. plea. She may well have saved her career. It won’t be what it was, but she will work again. (Watch for the establishment of some charity to help underprivileged students once her sentence is done). Take notes Aunt Becky!!

    I’m honestly amazed she didn’t try to bribe the prosecutor. Imagine feeling so entitled that you think you can choose your own punishments for crimes you’ve committed. I hope her lawyers have been telling her the full and harsh truth here.

      I honestly don’t think much will change in college admissions. Rich people will continue to buy their way in through the “regular” means of promising huge donations to the schools for buildings and whatnot like Dr Dre at USC.

        I totally agree—not much will change. I’m a (special ed) teacher at a large public high school and was chatting about this scandal with one of the counselors and the IB coordinator yesterday (both of whom have kids ready to go to college) and they were describing the admissions process for highly-selective schools. Basically, parents with means are throwing their money at getting their kids into college in a multitude of ways—paying specialists to map out their kid’s high school coursework for all 4 years to make sure they get the right classes, using their connections for desirable internships/volunteer gigs, paying for tutors, paying for test prep, paying for elite sports opportunities (travel teams, etc.), touring colleges, paying for interview lessons, etc. None of those things are illegal, but they certainly tip the scales in favor of the wealthy.

        I feel you on can’t shop. My friends and I have clothing exchange parties every now and then, so we all get new things to wear (and sometimes books and houseware stuff). It’s awesome.

        I like the color of the sweater but have zero desire to look anything at all like Aunt Becky. She looks so mean!

    I would be shocked and surprised if she actually served jail time. I think it’s more likely she’ll get a deferred sentence and a lot of community service. I fully expect to see her back on our TV screens within the next two years.

        Every time I see Lori, a flashback of her as a teenage model comes to mind. She was one of the primary models for the girls’ clothing sections of JCP catalogs when I was a kid. I knew little about her other than she married a clothing designer and did guest roles here and there.

        She does not sound like a good strategic thinker. I think she’s throwing things at the wall at this point. She will probably do anything to make a buck once she is released (because I do believe she’s headed to a women’s fed lockup). I doubt it will be acting. She’ll be pushing 60 by the time she’s clear of her legal issues (best case scenario).

    The statutory penalties mean nothing, unless there’s a mandatory minimum or a low cap. It’s Guidelines based and hers will still be low. She should’ve taken the deal and let her attorney mitigate the heck out of it and maybe the judge would’ve given her probation. That’s what I do when I defend these cases.

      Question – she isn’t the only one who hasn’t taken a deal. What do you think is the line of reasoning for attorneys in these other cases, and what is likely to happen? Of course, that’s assuming the other clients took their attorney’s advice in whatever course they chose.

        …and IRS fraud is another 20 years. An article I read from a lawyer noted both the fraud and the IRS charges together could total up to 40 years of which she will do at least 14 years. Another article said she was looking at 5-9 in federal prison on these charges.

    She will demand a jury trial and her lawyers will try hard to stack the jury with wealthy white women who consider themselves Christians. Then she will play up her innocence and motherly love as well as her love of God and belief in forgiveness. And it just may work. I do not have much faith in the “justice ” system. Privilege still counts too much and so does skin color

    In a post about Cardi B, some agreed and others disagreed about the drugging men and stealing period of her life to get ahead, and one poster commented that I was “what abouting” when I mentioned how Epstein got a wrist slap for using teens for sex with powerful men. Lori’s attitude is forced down the throats of many people of color, and hard working people of any persuasion, daily in the media and in real life. Young people, like Cardi B, who do stupid, dangerous things like she did think that they should be able to get away with it because of the Loughlin’s and Giannulli’s and Epstein’s of the world. Sometimes a Martha Stewart goes to jail, though some could argue that going after her was seriously sexist since many men in business have done worse than Martha and weren’t indicted for the tax crimes she committed. As a woman of color, I feel that Lori and her family’s attitude is something that most minorities get to experience with people around them at work most days who don’t understand how entitled they are and how much that entitlement seems molecular because of the denial, like Loughlin’s. When you are a person of color, the Lori’s of the world are doing the same crap, different day. Sometimes really nice people don’t understand their entitlement and are open to understanding how it effects all of us, and sometimes it’s garbage people like the Gianullis depending on the region where you live in the U.S.

    I am curious if the attorneys for all of the clients in this case let each other know if they were taking the plea. I assume they did, Lori & Mossimo had to know how many others were taking the plea, why not do what the majority was doing? Their denial must be huge.

    I hope she goes to jail and as the level of entitlement is just off the charts, but I don’t want one famous person to go to jail. I want all the parents guilty of this to go to prison. Martha getting punished for financial crimes didn’t punish the people who tanked the economy (and got handsomely rewarded). I hope they all get appropriately punished.
