The Daily Mail, their readership and the part of England they represent telegraphed one of their biggest concerns when it came to the Duke and Duchess of Sussex moving to America last year. That concern? That they would not have any “claim” to a Sussex child born in America. As far back as one year ago, there was a deeply offensive claim that Britain “owned” Harry and Meghan, and more than that, that Britain “owned” Archie. That Archie belonged to the Crown. I don’t think it’s a coincidence that Meghan and Harry took Archie to Canada in December 2018 and Archie hasn’t been back to the UK ever since. Meghan isn’t going to let ANY of them get their hands on her baby, and it will be a while before Archie sets foot on British soil (just my opinion). Now with Sussex Baby #2: Montecito Baby, the predictable papers are running pieces lamenting the fact that Montecito Baby will be an American citizen at birth.

Prince Harry and Meghan Markle’s second child will be entitled to American citizenship as an automatic right if born in the US, it has been revealed. The Duke and Duchess of Sussex are also believed to be able to apply for dual UK and US citizenship, with the baby automatically becoming a British citizen because of Harry’s citizenship.

Harry, Meghan and Archie left Britain for Canada in November 2019, meaning their first child Archie has not seen any of his British relatives since he was six months old.

They then moved to California, where they have bought an £11million mansion in Montecito and signed multi-million pound deals with Netflix and Spotify. The Duke is expected to return to the UK this summer to see his family for the first time since the couple decided to leave Britain and step down from their roles in the Royal Family in what was dubbed ‘Megxit’.

Meghan was already said to be unlikely to join him for ‘personal and practical’ reasons, sources said. The new Sussex baby will become eighth in line to the throne, after Prince Charles, Prince William, William’s three children George, Charlotte and Louis, Prince Harry and his eldest child 21-month-old Archie Mountbatten-Windsor.

I just laughed a little bit to myself at the fact that Montecito Baby will get his or her Social Security number before he/she gets a British passport. This too will become a point of contention among the Daily Mail readership: how can Meghan keep her children away from the Queen? And Grandpa Charles? Doesn’t Meghan know that the British people feel they have a claim to the Sussex kids? As for the citizenship issue… America has birthright citizenship, so of course Montecito Baby will be an American citizen. It will be curious to see if Harry and Meghan even attempt to apply for British citizenship for this second child though. Because, and I cannot stress this enough, they are beyond done with that dusty little island.

Hahaha she won’t be harassed about which hospital she gives birth in either!! They’ll get to release a photo of the Montecito Baby in their own time, when they’re ready.

    A British passport is pretty limited in a post Brexit world. I’d take the American and go.

        Absolutely right. Take ALL the passports you can get. American passports may be even more limited than British passports, so don’t think just because you’re American that you are entitled to all of the same privileges abroad as British citizens and vice versa!

        He is not.

        British naturalisation laws do not guarantee automatic citizenship to anyone born out of the UK, even if BOTH parents are British.

        In this case, only one parent is British so he/she will not be entitled to British citizenship.

        I know this for a fact, first because I am a naturalized British citizen, secondly because the son of a dear friend of mine (French mum, British father) has been rejected for naturalization constantly and he has already appealed twice.

        Granted, money and lawyers are not a problem for the Sussexes. I only wanted to highlight the fact that British citizenship is only automatic when both parents are British AND the baby is born in UK.

        AlpineWitch, it’s interesting that your friend had that experience! A close friend has one British parent, but was born and raised in the US, with only visits to family in Britain. They were able to get their dual British/American citizenship quite easily. BUT, they had to do it before they turned 18. I guess if you wait until after it is much harder.

        Alpine Witch – I’m surprised by that. A friend of mine is Scottish, married to an American and living in NYC. Both of their children were born in NYC, both children have both US and UK passports. She got UK passports for the kids when they were infants and pre-pandemic they travelled back and forth regularly (her parents still live in Scotland). It may be that it must be done before the child hits a certain age – 16, 18, whatever.

        @alpinewitch that’s crazy your friend couldn’t get his UK citizenship. My husband was born in the US to a UK dad and a US mom and got his UK passport at 40.

      Yes, it is nowadays.

      Ages ago I really wanted to naturalize because it brought less difficulties in terms of visas for language and study categories but post-2016… Canada, Australia and New Zealand have all put barriers on that, Canada and AU even want native speakers to prove they are fluent in English.
      I am lucky, as I am a dual citizen and still can go to Europe with no issues with my first passport.

        Did you know that Canadians are also not allowed to participate in the Green Card lottery? Not sure of the reason why, but probably similar to the British.

        Canada requires fluency in French OR English. I am an American on PR in Canada and waiting on dual citizenship as we speak(my test has been in epic limbo and they finally started online tests in December).

    Lordy these people. It’s the “it can now be revealed” line that gets me. Of course this baby will be a US citizen!!! It’s not like they’re relying on some little known aspect of US law for that. It’s a pretty upfront part of citizenship.

    Yeah, the only way that family will see Archie and any future child is if they come to California. We all know the Queen and Philip’s won’t do it. The Cambridges are probably persona non grata with the Sussex’s. MAYBE Charles and Camilla will pay a visit after baby #2 is born.

    And the only thing I can see Harry even CONSIDERING returning to the UK for is the Diana statue unveiling. And that would depend on the pandemic.

    Most are guessing the baby is due in June and there is no way in hell Harry won’t be around for the birth and the immediate weeks after. No birthdays, no Trooping etc.

      Definitely not. Pandemic travel restrictions won’t ease up by Summer. That means 2 weeks of quarantining when Harry gets to the UK, 1-2 weeks of actually doing what he came for and 2 weeks quarantining again. That’s 5-6 weeks away from Meghan, Archie and their newborn. I don’t see him wanting to stay over a month away from them.

      I can see Harry & Meghan returning to the UK for a funeral – either Phil or Liz’s. There is no way they skip those – it’s just “not done.”

      Pandemic or not, there will be a state funeral for each of them, although the timing will determine whether or not foreign heads of state attend or send representatives who are not already in the UK (does VP Harris go or does the yet-to-be-named US ambassador attend as Pres Biden’s representative, etc.).

    I do think baby sussex #2 (im still so excited!) will have a british passport. No matter how much i wish things were different, harry is still a prince of the UK, and meghan a princess. So yes he/she will also have a british passport. Not to mention that baby and archie can officially claim the title prince once charles becomes king, as they are direct descendants of the reigning monarch

        Once they are both 18 it truly is THEIR call to make. I never said they were going to be titled “prince” or “princess”. I said that they would be able to claim that title if they wanted to.

        The only way Archie and his sibling won’t be legally HRHs is if Charles dies before Liz or if Charles issues new Letters Patent. If none of those scenarios happens, the moment Liz closes her eyes for the last time Archie & his sibling will legally become HRHs and there’s nothing Charles*, William or the British press can do about it. Whether either child will ever be styled as HRHs will be up to their parents, until age 18.

        Louise & James could claim their HRHs the moment they turn 18 as well.

        *Charles would have to issue a new Letters Patent banning Archie & his sibling from being HRHs and actually he should follow Sweden’s model and strip HRH from anyone not in direct line to the throne.

      He’s not automatically entitled because his mum never became British, plus the baby will be born abroad.

      However, they’ve enough money to cover the expenses to get him one! 😉

      • Considering the Sussexes’ baby will be 8th in line to the British throne — right after Archie —-, I’m sure his or her British citizenship will be worked out by The Firm. I truly think this is a non-issue. All Sussex children have or will have dual citizenship.

      I definitely think the baby will have a UK passport and citizenship, if for no other reason than the world can be an unpredictable place. I’d never want some technicality or petty decision I made in the past to limit my options for mobility in the future.

      Archie has dual nationality. He fulfils this condition for US citizenship:

      “A person born abroad in wedlock to a U.S. citizen and an alien acquires U.S. citizenship at birth if the U.S. citizen parent has been physically present in the United States or one of its outlying possessions prior to the person’s birth for the period required by the statute in effect when the person was born (INA 301(g), formerly INA 301(a)(7)). ………… For birth on or after November 14, 1986, the U.S. citizen parent must have been physically present in the United States or one of its outlying possessions for five years prior to the person’s birth, at least two of which were after the age of 14.”

      ‘Prior to the person’s birth’ does not mean immediately prior.

      Harry is still a British citizen and both children will also have British citizenship.

      Meghan and Harry would have to apply for US citizenship for Archie, although he is entitled to the citizenship without taking tests etc. There are rules in place to ensure that a child of one American parent who is abroad but has lived in the US for the required amount of time can gain access to their US citizenship. Being born in the US makes in a little easier in that you don’t have to apply.

      Yes. Meghan has to apply for his citizenship to be recognized, since he wasn’t born in the US, but it should be automatically approved.

      Yes, his mother is a US citizen by birth and has met the US residency requirements necessary to cause her child to be a US citizen by birth regardless of where he may have been born. The citizenship exists whether she has filed the Consular Report of Birth Abroad or not. US citizens are supposed to present their US passport on entering the US regardless of what other citizenships and passports they may hold, so I’m sure they will have filed the CRBA and applied for Archie’s US passport and SSN shortly after he was born.

    Both of the Sussex kids are/ will be US citizens. I guess the argument would be that the new baby can run for president some day which is a stupidly premature thing to think about. I think the Fail is grasping for straws for things to write about.

        @Swack, there is actually an unsettled question in if Archie,or anyone born outside the US to at least one American parent, could be considered a “natural born citizen” so he may not be eligible for the Presidency.

        By the time Arch is an adult, he may not want to have anything to do with elected office!

      Levans, that is not true. If you are an American citizen born to an American citizen, even if you are not born in the physical United States, you can run for President.

      Otherwise John McCain would have been disqualified.

      If you are born to an American citizen you are automatically a natural born American citizen…even if you are not born in the physical United States, period.

        @Emmit the US Senate passed a resolution declaring John McCain a natural born citizen. This is an unresolved issue hence all the debate around Ted Cruz who was born in Canada. If the Senate hadn’t addressed McCain the supreme court would have to weigh in.

    Racism & xenophobia really caused the royal reporters to fumble their own bag. In this covid time they could have been eating with updates on this baby. They haven’t seen this level of SM engagement for ages & definitely didn’t get it with Eugenie. Now they will just have to watch from afar with just fan fiction& sniping from royal insiders to keep story going.

    On that note wonder on truth of zooms with the family or did she just keep camera at certain level?

    And yeah I will be so annoyed with the inevitable pieces about Charles being sad his grandchildren are away or Philip and Liz miss Harry etc after that ‘5 seconds’ to turn down wreath request’, palace assisting the Fail& other briefings against the Sussexes

    I’m so looking forward to how this all plays out with the American press. Somehow I doubt we’ll be seeing her in front of a hospital, 24 hours after having pushed a baby out of her, wearing heels, hose, and a dress. I always thought this was SUCH a tone-deaf message to put into the world when it comes to women and childbirth—very 1950s. I doubt the American press has similar expectations and I doubt she’ll even attempt to meet them. Because she has a clue.

    I don’t understand the fuss about the Queen not seeing her great grandchildren. I feel like by the time you’ve reached an age where your multiple grandchildren are having their own children, it stops being much of a fuss. And honestly, why do people care that parents, children, grandparents and now even great grandchildren live on separate continents. Isn’t that the norm for most of us who have relocated/migrated? My grandmother hasn’t met most of her great grandchildren and she isn’t fussed one bit.

      The United States doesn’t recognize titles, so I’m pretty sure that the father’s name on the certificate will be Henry Mountbatten-Windsor.

        It doesn’t ‘recognize’ titles only in the sense that they carry no special significance in the US. However, titles are part of a person’s identity and Harry will be listed with his own identity as HRH Prince Henry ,etc, The Duke of Sussex. Sussex can serve as a surname.

    Despite all the mishaps and unfortunate twist of events (Harry and Megh behind happily married and expanding their family), one is relieved that a new heir will soon sprout from the Cambridge household, so that we can enjoy the subtle charm of unhealthy comparisons for the next two and a half years. Thank God for CopyKate’s competitive spirit. It appears to me that the main difference between both babies to be born is not do much citizenship as the fact that Meghan’s child will NOT be a burden to the English taxpayer while Catherine’s parisitic idle existence might start to cause an uproar in those times of economic recession.

She only wanted to insert herself into the narrative while also hoping to have an excuse not to work for the next two years. With all the speculation here that her and PWT are not both living at Amner, it seems unlikely.

    I think the biggest thing is when Harry applies for US citizenship.

    (I still think about a story I read a long time ago about a athlete who applied and got citizenship here and when he was asked why he said, ‘Because my children are and I am not looking to get deported.’ So I cannot imagine Harry not even considering it in the future.)

    That will be the final nail in the coffin and the press is going to have a stroke.

    Anyway, yeah, the British press is probably fuming right now. Between them getting stateside with no official duties and the pandemic, they aren’t going to get any pics until H&M want to have them out. They probably won’t even show the new baby’s face ever.

    My husband is English, and I am American. We have two children, both born in the US, both with British citizenship through their father. We of COURSE requested both passports for our children. It doesn’t mean they have to go back– it just simplifies things for them should they ever return for a visit. If you have citizenship to a country, you are supposed to use the corresponding passport when entering that country– it otherwise causes a lot of immigration headaches. All that being said– my husband and I are normal people for whom the rules actually apply, so we actually have to make these considerations… royals probably don’t. Still, I would imagine that the Sussexes will apply for both passports for their baby.

      That is the downside of a US passport.

        You do have to file an annual tax form, but, because of an agreement between the US and UK, you do not have to pay taxes on income earned in the UK up to a certain threshold (the understanding being that you are already paying taxes in the UK). You can exclude something like $105,000 in foreign earnings.

        It is a downside of many passports….
        I am lucky because Italian government does not tax citizens abroad when they register at the consulate of the country they live in.
        If I were moving abroad using my British passport instead, I still have to pay the British state 15% in taxes above a certain amount of money.

      At what point were you able to ask for your children’s British passports?

      The son of a friend of mine has appealed 3 times, his father is British but he was not married to his French mum when he was born and he has been denied a passport until now (he is 21). He was born in UK too, he never left either.

        @alpinewitch, it seems like the issue with your friend is that the son was born before 2006, which meant that a British father had to be married to the mother in order for him to pass on his citizenship. Although it is noted that you if the dad is unmarried, you can petition it. It’s not an issue for montecito baby since the parents are married and if they weren’t, they changed the law in ‘06 so unmarried fathers can now pass on their British citizenship.

        Oh sorry, I just saw that you said the son was born in the UK and never left. It shouldn’t even be an issue then whether the parents are married or not. I’m not sure why it’s an issue if he was born in the uk to a uk parent. According to the gov.uk site, you are usually automatically a British citizen if you were both born in the uk and born when one of your parents was a British citizen or ‘settled’ in the UK. That is curious that your friend and his son is having issue with his British citizenship.

    I disagree with those saying they won’t ever go back to England. If Harry and Meghan didn’t care they would have ended their patronages. The pandemic is really the only reason they haven’t come back. Also didn’t Harry really wanted to leave and Meghan willing to stay? I think It’s funny that she still gets all of the blame and framed as she can’t stand UK. In the future I think they will make short trips, nothing long term. The relatives and tabloids are another matter.

      I agree with this take on it. They will return for their patronages and other working obligations, but won’t for official duties the other royals will carry out like the commonwealth service or even trooping. If they do return for christmas they won’t do the walk to show off the fake unity of a family of backstabbers.

    So bizarre for anyone to be worried about this. The chance that William, all his children, and Harry are going to die so Archie or the new baby become king is astronomical. The crown has no ownership of either of these children. This family needs to be left alone to live their lives in peace.

        There’s been no word on whether this special will be live or pre-recorded. I’m sort of hoping it was pre-recorded, and that a voiceover by Oprah can be appended before it airs: “As CBS was preparing to broadcast this special, it was learned that Meghan delivered a healthy baby boy/girl. Mother and father are ecstatic.”

      Totally agree. Especially since a shedload of readers and commenters in the daily mail are actually from outside the UK, often from America in fact.
      Slagging off people from other countries using naff generalisations doesn’t make anyone look any better, really.

    Ted Cruz and John McCain were born outside of the US to American parents and are citizens eligible to run for president. Does that not make Archie a US citizen, or a dual citizen of both US and UK?

      John McCain was born on an American military base, which is the same as being a natural-born American citizen. Ted Cruz had dual citizenship (American and Canadian) at birth, but his birth certificate had to be registered with the consulate/embassy to be “official.” So, Cruz had all the rights and duties of a citizen but couldn’t qualify for official status, to for instance get an American passport. H&M most likely registered Archie’s birth certificate so that he’s a dual-citizen and I would think they would file New Baby Mountbatten-Windsor with the British Consulate in CA so that both their children are dual-citizens.

    It is going to fun to see the RR and BRF tie themselves up in knots about the possibilities of an American-born heir(ess) to the throne 🙂 I wonder how H&M’s names will appear on the birth certificate; I don’t think a simple “Duchess of Sussex” and “Prince Harry” would work on an American birth certificate. It’s none of my business, but I do wonder if Harry will pursue dual citizenship and/or if both the kids will have dual citizenship.

    I am also hoping there may be at least one Senator Mountbatten-Windsor. I can see a blackout over the entire UK from PwT incandescent with rage should H&M become the parents of a future President Mountbatten-Windsor.
