Johnny Depp lost his bid to appeal his failed libel case against the Sun

Every single thing about and around Johnny Depp is toxic these days, so we do tend to avoid all of the minor stories about him, just because we don’t want to be swarmed with pro-Depp bots. That’s absolutely a thing and it adds yet another layer to the toxicity around Depp. In November 2020 (in what would turn out to be Election Week), Depp lost his libel lawsuit in the UK. He had sued the British tabloid the Sun, Sun columnist Dan Wootton and Amber Heard all because the publication referred to him as a “wife-beater.” The court case was an absolute mess and of course every part of it was widely disseminated by the British media. And in the end, Depp lost. A judge found that it wasn’t libelous to call Depp a “wife-beater” because he is, in fact, a man who abused his then-wife, Amber Heard.

After that ruling, Hollywood began parting ways with Depp. He was pushed out of the Fantastic Beasts franchise, there were articles in the trade papers about how no one wanted to hire him because he is now “radioactive.” In the wake of his loss in court, Depp made a big point of saying that he would appeal and drag this out even more. He actually did file an appeal. And… it just got shut down.

The Hollywood actor Johnny Depp has lost a bid to overturn a damning high court ruling that concluded he assaulted his ex-wife Amber Heard and left her in fear for her life.

Following a three-week trial in July last year, Mr Justice Nicol dismissed the star’s libel claim against the publisher of the Sun, finding that a column published in April 2018 calling Depp a “wife beater” was “substantially true”. The judge that ruled Depp, 57, assaulted Heard, 34, on a dozen occasions and put her in “fear for her life” three times.

The actor asked the court of appeal to grant permission for him to challenge the ruling, with the aim of having its findings overturned and a retrial ordered. However, following a hearing last week, on Thursday the court refused Depp permission to appeal.

Lord Justice Underhill and Lord Justice Dingemans emphasised that an appeal against the trial judge’s decision on questions of disputed fact faced serious difficulties. Part of Depp’s argument relied on further evidence that Heard had not yet given away most of the $7m (£5.1m) she received in her divorce settlement, which she had said she was donating to charity.

At last week’s hearing, Depp’s barrister Andrew Caldecott QC said the claim was a “calculated and manipulative lie”, which gave Heard “a considerable boost to her credibility as a person”, and “tipped the scales against Mr Depp from the very beginning”. But Lord Justice Underhill said: “We do not accept that there is any ground for believing that the judge may have been influenced by any such general perception as Mr Caldecott relies on. In the first place, he does not refer to her charitable donation at all in the context of his central findings. On the contrary, he only mentions it in a very particular context … and after he had already reached his conclusions in relation to the 14 incidents.”

Underhill concluded his ruling by saying: “We refuse Mr Depp’s application to admit further evidence in support of his proposed appeal and we conclude that the appeal has no real prospect of success and that there is no other compelling reason for it to be heard. We accordingly refuse permission to appeal.”

It’s complicated and stupid, but here’s what I understand: when Amber Heard and Depp were spending months trying to figure out their divorce, Depp was smearing Heard as a lying golddigger who was just trying to get her hands on a big divorce settlement. When the divorce settlement came in, Amber immediately announced that she would be donating the entire settlement to charity. Depp then pitched a fit and tried to act like he still had some “say” in how Amber spent her money, and he tried to directly donate the money to charity and claim that it was her settlement money (when it was just Depp financially abusing her). And now, years later, Depp is still f–king pissed that his golddigger narrative blew up in his face, and he’s trying to pretend that Heard didn’t donate her entire divorce settlement to charity, something which has no bearing on whether or not he abused her (and is, in fact, none of his g–ddamn business anyway). In fact, this entire legal drama is further proof that he is an abuser and he continues to financially and emotionally abuse his ex-wife by inserting himself into her life constantly. So that was the root of his “appeal” and the court was like “nah.”

      There are sadly a lot of women on Tumblr who are definitely not pro-Trump who are completely in Depp’s court. They haven’t read the docs, and they won’t, because they’re afraid of what they’ll find. It’s all under the cover of “women can be abusive too”, which yes, but not in this case, for which we have crystal clear evidence that Depp was the abusive one.

    I feel like she commented that no, she hadn’t donated the full amount- because she has giant legal bills to pay. And that seems totally above board to me. Being financially abused by a famous junkie who is bankrupt but apparently has endless credit is expensive.

Depp, and all of his followers who won’t stop commenting on what a demon Amber is all over the internet, seemingly don’t understand this case and why it panned out how it did. The case had nothing to do with her or her actions or her donations or ANYTHING. She wasn’t on trial. Depp brought this case up himself to continue punishing her all on his own. HE chose to challenge The Sun, and it’s HIS responsibility that he lost.

My ex did something similar – the judge financially ruled in my favour repeatedly, and then my ex would try to make it his decision how my money would be handled, how the things the judge gave me would be managed etc. When they can’t even accept a judgement you know they’re absolutely nuts. The control aspect is mental. I’m so happy he lost. Well done Amber.

    Look I don’t know about his fans and the insane number of bots that have been purchased; but what I do know is that his handlers/advisers are mind-bogglingly incompetent. That, or they HATE him. Who is advising him to proceed this way? “Oh we shall triumph in our defamation suit in Virginia!” Ummmm, no. No you won’t. Do these people know anything about American law??

    He will continue to waste his money and take exactly zero steps towards rebuilding any measure of good will. And the fact that on top of all this he now goes the earpiece route instead of learning his lines and makes god knows what other demands while not bringing in box office? He’s got a very long way to go before Hollywood would again consider him anything more than an expensive headache.

    So either he has some horrid advisors who will be gone when the money is; or this is all him and he will just continue to self-destruct. Wild.

      I think he’s on a self-destruct path myself. I find it hard to believe that any of his high priced legal advisors would have recommended he let this play out in the courts when they have always rushed to settle other things quietly. It certainly doesn’t break the abusive image when he insists on doing things that aren’t even in his own best interests, no matter what the financial cost (Just think all that money could have gone to sick children!). His loyalists still seem to think it’s somehow honorable to fight to the finish even if it costs him every dime and bit of pride. In reality, I think they just enjoy the camaraderie they feel being part of something bigger than themselves–especially if it manages to involve harassment, bullying and misogyny–and also like Trump’s base, they are generally pretty lonely and miserable people.

    It’s so awful. I don’t even comment about him on social media because his fans are unhinged. And I don’t even get how women (supposedly women) come out and say that it’s okay he hit her because she caused it and abused him too? Like listen to yourselves!

    And him pushing for another case in VA is just a mess. He won’t leave her alone. Even if you want to lie to yourself about Johnny Depp was taking advantage of and all that crap, he won’t leave her alone. That dude is absolutely angry that she left him. Him using the VA case to try to show she cheated on him? I mean what is going on here? He reminds me of Sofia Vergara’s ex.

      Exactly. He will not stop until he has exhausted every court that he possibly can. And even then he’ll find ways to go after her. Hopefully he runs out of money soon.

    • He and Nick Loeb should be the poster boys for the MRA/MGTOW crowd. (And Depp ALSO looks like the poster boy for PICK ARTISTS too.) They are both abusive men who used the courts to abuse and should face major sanctions for doing it. I never believed that he was not abusive in other relationships. He paid people off. He’s going to lose all his money if he keeps going on this way. I don’t think it’s his advisors, I think they can’t control him. I love that he lost his appeal.

        Ha! I’m with you all the way. When I was young I romanticized Depp like a lot of teenagers do, but in my adulthood, it’s pretty hard to ignore all the red flags. It’s certainly possible it was the first time he was physically abusive, but having seen the state he’s left his prior partners in, I don’t doubt there was coercive control, if not violence, in all of his relationships. His exes seemed like lifeless shells of their former selves with the typical signs of PTSD: depression, anxiety and drug & alcohol abuse. He’s good at sizing up his victims, always young, naive and timid. But he met his match with Amber and her determination to see this through has really been impressive. It’s tough even to witness the social media attacks on her, especially from other women. She really is owed a huge debt of gratitude for the efforts she’s made to advance this fight for survivors and all women and instead she’s subjected to more bullying and harassment. Unbelievably, the most misogynistic views appear to be coming from the women. Hopefully some cyber-bullying legislation will follow! But the appeal loss was definitely a good start!

        Where did is say she does not have a right to defend herself? We all learned too much about them both. He is gross beyond belief. I have seen more than I need to. I don’t want her career to end by any means. I just think waiting prior to making a comeback with positive associations will be better for her. I hope he never comes back

    He’s insane to keep suing like this. He is losing all his money on it (money is something he seems to care about) when he can’t get another job that pays Disney bucks. After he took all those crappy roles to secure his kids future somehow their future doesn’t matter much when he thinks he can get revenge in his ex.

      I think his children have always been the least of his concerns. He’s good at playing the concerned dad in the press, but when his son was hospitalized while Depp was touring Europe with his band, it was Vanessa who missed the premiere of her movie to be there for him, even though Depp had two travel days between shows. My impression is that Depp doesn’t field a lot of responsibilities on his own and that includes most family obligations. I’m sure there are a lot of kids who daydream about having Depp for a father, but the reality sounds like it’s more of a nightmare or a curse.

    I thought that JOHNNY was supposed to be the one to give the 7 million to charity??? I specifically remember that Amber had said back when they first got divorced that whatever she was awarded, she would donate. So Johnny, to be a dick, stated that rather than giving Amber her money to donate, that HE would donate it FOR her. Which is SUCH a dick move on so many different levels. First, Johnny would get a big tax break for donating 7 million (that was not HIS to donate). Second, It was just ANOTHER way to hurt Amber and to not have to give her money she was OWED. Third, I specifically remember reading that months after Amber was awarded the money (but never got it) Johnny STILL had not donated ANYTHING. So I have no idea how Johnny is complaining that Amber didn’t donate the money as she had said she would. HE prevented that!!!!

      Yes. Agreed. I am supporting ANYTHING Amber Heard is in. Has anyone followed all the flack the studio & Depp fans/loons are doing to try to re-write Amber’s part out of Aquaman 2? I hope they do not minimise her part & bring in a 2nd love interest for Aquaman due to “fans” supposedly wanted her out. More abuse from Depp IMHO.

        The reviews & box office numbers for Depp’s release City of Lies last week were absolutely abysmal. While Covid was certainly a factor, the domestic sales didn’t break $300k and the movie took a measly 11% of the market share for it’s opening week. That shows that his online support is getting amplified by bots OR at very least, his supporters aren’t buying movie tickets.

        Amber’s latest project, Zack Snyder’s Justice League, was also released last week and got excellent reviews, especially from fans, although there was a continued push-back over Amber being cast (despite the director liking her enough to increase her camera time & include her in new scenes) mainly from really vulgar and misogynistic *adolescents* but overall there was also a lot of positive feedback over her part. Depp fans, however, have continued to harass and bully anyone who gets within six feet of mentioning Amber’s name without some degrading connotation attached. They’re obsessive and honestly it’s really concerning. I hope she has adequate security and a can of bear spray at all times.

        Anyway, I’m really happy to see the support for her. I plan to bring everyone I know to support her projects just to show my thanks for her efforts and determination. It’s about time karma caught up with that man!

    My ex convinced me to quit my job (I was a scientist, essentially) when we got married and then it became a huge issue when I wanted to leave him. I had been out of the work force for three years, I couldn’t find old co-workers for references, and I didn’t even have a checking account. This s*it makes me so mad. I would have left before he broke my jaw if I had had the means. I know that wasn’t really Ambers case, but abuse is abuse.

      Oh my God!!! Thank God you got out alive! I think about your situation you described a lot when I see women getting divorced where they had been married a long time, maybe raised kids, but essentially gave up their own careers to support their husband’s. And then only to find themselves divorced and having to support themselves but without the job history they would have otherwise had…..I guess one can start over at any age but certainly, the older you are the harder it is…..and alimony is often a joke especially if the ex husband hides income………all the same I AM still glad you got out alive and didn’t become an episode of Dateline…..

    I find it ironic and kinda hilarious that he’s now toxic in the film industry after suing her. If he hadn’t done that, the industry would’ve “forgotten” all about it and carried on, per usual, just like they have for tons of other abusive misogynistic a-holes.
    But because there has now been a court ruling finding him a “wife beater,” the industry cannot ignore the issue.

    Besides the bots, unfortunately a lot of actual people are still insisting Depp didn’t abuse Heard too. I can only imagine they didn’t read the court docs. I did. Not only did Johnny Depp abuse her, but he did it coldly and with malice aforethought.

    I do believe that he wasn’t abusive until Amber. First, some men seem to feel free to abuse, or abuse more openly, once they’re married. Second, drugs and alcohol. He changed. It happens. Far too many women think that because they find some celebrity attractive (or did in the past), he must be good. Attraction is not a moral issue. You can think a guy is both hot and a scumbag. Though I don’t get how anyone could find drunken scarfman hot these days.
