Congress Meets to Certify Electoral College Vote at the U.S. Capitol

Last night, the House voted to compel Mike Pence to invoke the 25th Amendment. The vote went ahead even though Pence sent a letter to Nancy Pelosi ahead of the vote, wherein he wrote that he did not feel it was within his constitutional authority to invoke the 25th with only eight days left in Trump’s term. He called the House’s vote “political games” and claimed that invoking the 25th at this moment would “set a terrible precedent.” You can see the full letter from Pence to Speaker Pelosi here. Still, the House still voted and it passed and today the House will vote on impeachment. All of which leads me to this remarkable article in the NY Times about Pence’s relationship with Trump, which included some really astounding moments:

Trump called Pence a p-ssy ahead of the election ratification: Mr. Trump was enraged that Mr. Pence was refusing to try to overturn the election. In a series of meetings, the president had pressed relentlessly, alternately cajoling and browbeating him. Finally, just before Mr. Pence headed to the Capitol to oversee the electoral vote count last Wednesday, Mr. Trump called the vice president’s residence to push one last time. “You can either go down in history as a patriot,” Mr. Trump told him, according to two people briefed on the conversation, “or you can go down in history as a p-ssy.”

During the Capitol siege, Pence stayed in the basement: Evacuated to the basement, Mr. Pence huddled for hours while Mr. Trump tweeted out an attack on him rather than call to check on his safety. “He set Mike Pence up that day by putting it on his shoulders,” said Ryan Streeter, an adviser to Mr. Pence when he was the governor of Indiana. “That’s a pretty unprecedented thing in American politics. For a president to throw his own vice president under the bus like that and to encourage his supporters to take him on is something just unconscionable in my mind.” When the mob burst into the building, Secret Service agents evacuated him and his wife and children, first to his office off the floor and later to the basement. His agents urged him to leave the building, but he refused to abandon the Capitol. From there, he spoke with congressional leaders, the defense secretary and the chairman of the Joint Chiefs of Staff — but not the president.

Don’t give Pence credit for Not Doing Fascism: “I’m glad he didn’t break the law, but it’s kind of hard to call somebody courageous for choosing not to help overthrow our democratic system of government,” said Representative Tom Malinowski, Democrat of New Jersey. “He’s got to understand that the man he’s been working for and defending loyally is almost single-handedly responsible for creating a movement in this country that wants to hang Mike Pence.”

Pence & Trump’s meeting came five days after the attempted coup: The official description of the hourlong conversation was “good”; the unofficial description was “nonsubstantive” and “stilted.”

Trump fundamentally believed that Pence could overthrow the election: Mr. Trump was told, incorrectly, that the vice president could stop the final validation of the election of President-elect Joseph R. Biden Jr. in his role as president of the Senate presiding over the Electoral College count. Mr. Pence’s counsel, Greg Jacob, researched the matter and concluded the vice president had no such authority. Prodded by Rudolph W. Giuliani and Jenna Ellis, two of his lawyers, Mr. Trump kept pressing.

The Times details the weeks of conversations between Pence and Trump, where Trump’s batsh-t legal advisors (like Rudy Giuliani) were insisting over and over that Pence could overthrow the election results and install pro-Trump electors. Trump just couldn’t get it, he didn’t want to get it – he thought Pence was so loyal that Pence would help him do the coup. The fact that Pence actually sought legal advice from outside advisors is both disturbing and yet… smart. I guess. And the fact that Trump called Pence a “p-ssy” to his face is pretty extraordinary, but not as extraordinary as the fact that Trump literally sent a violent mob to the Capitol to murder Pence and Speaker Pelosi, the next two people in the line of succession.

The other point of the Times story is that Pence feels/knows that he probably kneecapped his own presidential ambitions by, you know, not doing the coup. The fact that Team Pence is largely leaking all of this sh-t tells me that Pence is actually very seriously positioning himself to be MAGA-adjacent and yet an old-school Bush-era Republican.

        Pence is a coward and a do nothing and a his doing nothing to overthrow our government is not hugely impressive, but it does fit his MO to do nothing in regards to the 25 Amendment. As I was reading elsewhere, it’s not just that he’d have to invoke it, he’d then be faced with the conundrum of pardoning Trump. His do nothing mantra has worked so far. Why stop now? (Don’t get me wrong, I’m glad he wasn’t murdered by a treasonous mob because MYGAWD! but I’m perfectly happy for him to shuffle into obscurity on Jan. 21st, emerging only to give testimony at the trials).

    Oh yay, now I get to tell all the people I know who were congratulating Pence on “doing the right thing” that he really, really wanted to do the wrong thing, and even had a lawyer look into doing the wrong thing before he did the right thing.       That’s my takeaway from this too. If there was any way he would have overturned the vote, Pence would have done it. And for once I agree with trump. Mike Pence is a spineless wimp (hate using the word pussy to describe lack of courage).

      I am not a Pence fan by any means, but I don’t think he wanted to support Trump on this – I think he wanted to do the right thing and that he consulted with a lawyer to give his decision more gravitas. The lawyers helped make the decision constitutional and not personal.

    Pence still won’t invoke the 25th after Trump sent a mob to hang him in front of his wife and daughter (and do god knows what to his wife and daughter). His wife and daughter had to hear chants calling for Pence’s execution. So you know what? This is the only time I’ll ever say this but Trump was right. Pence is a p*ssy: he’s one for not invoking the 25th after his boss’s attempted hit job on him. WTF, Mike?

      He doesn’t have the votes for the 25th. He needs a majority of the Cabinet to support it. Chao, DeVos, and Wolf all quit instead of doing their job. Pompeo is going full Trump extremist puppet. Even if Pence wanted to invoke the 25th, he couldn’t.

        It should have been done anyway – even if it is just on the record, even though the remaining fascists in the administration are ok with tearing down the fabric of the democracy, even if it is just a symbol .
        If he had one ounce of courage he would have sent the message loud and clear that this should not be tolerated by anyone from any political party.

      So I thought about this too. But maybe, just maybe, they are trying to go by the book. Because the 25th is more for when POTUS is incapacitated, which takes a bit to prove. So the best legally viable way is to go with impeachment knowing full well that this will remove him. yeah, I know, I can be naïve and maybe I am here as well. BUT I was so disappointed when they certified the EV and then adjourned. But the heavy hitter met to move with impeachment. Who Knows at this point. Those well versed with the process please correct me if my thinking is totally off.

      The 25th amendment is not nearly as punitive as the 2nd impeachment. If impeached the 2nd time, 45 won’t receive the usual post-presidential perks like the travel budget and the pension, among other things. That letter that Pence wrote may be a bit of theatre. Like maybe he’s playing it one way publicly while privately, he wants to make sure 45 is punished as much as possible while also showing Congress as the “bad guys” instead of Pence. (I doubt Congress minds this in general.)

      I personally don’t think that will be possible, once all of the Congressional republicans are on the record with a vote to impeach/convict Trump.

      oh no, it’s not ignorant at all. this is the exact question that ‘old guard’ republicans have been trying to answer for the past 5 years. the answer was always going to be either ‘be too cute by half and be left with nothing’ or ‘kill democracy in favor of white supremacy’. Pence and the rest of the old school republicans have always been fine with option 2, but it looks like the tide is turning juuuust enough to leave them with option 1. time will tell, though.

Not hamfisted like Trump and Pompeo, but Pompeo and Cruz are more ideologically Trump’s heir to Trumpism. Of course, Ivanka and Don Jr feel entitled to those voters.

    Pence may not be demonstrative enough for the new Republican Party. There may not be enough Liz Cheneys to counter the three-percenter supporters. The open racists are taking over the party. They don’t want to hide anymore, and they have been able to crawl from the shadows with Trump.

      I’m not sure I agree with your assessment re: Pence’s smarts. I think he was fundamentalist enough to be a viable statewide candidate, but he never really has had the chops to be a national republican, and really only looks smart in relation to the rest of the administration. Definitely agree with almost everything else you said though. And I’m willing to admit that I’m extremely armchair expert, so maybe he’s smarter than I realize (I just don’t see it).

    I only started to follow American politics when Trump was elected. Like the rest of the world, I couldn’t believe it, and thought that my lack of understanding was due to my lack of education about your history, your constitution and your style of government. Coming from a country with parliamentary federalism I really crammed on democratic republic congressional federalism.
    About two years ago, I concluded that you guys needed to lose the electoral college and that three parties – right, left and centre moderate – would change the political discourse. I did not predict that it would be the GOP that would implode, I thought that it would be the Dems since big tent and virtue checkpoints are ultimately incompatible. But let Cruz, Hawley etc. have the crazies, let those never Trumpers/Lincoln project folk have a party that would attract people like Manchin (I don’t think that they would take Pence though), and let there be a party for those with a social conscience.
    Of course my prescription means Jack. But it is a symbol of my horror and my hope. Good luck.

    Presidents receive Secret Service protection for life. Vice Presidents only receive six months (though the DHS can extend if they deem it necessary). Does Pence believe that Secret Service members would be the ones conspiring to murder him if he invoked the 25th Amendment?
