Howard K Stern charged with 11 felonies in Anna Nicole Smith’s death

Anna Nicole Smith’s lawyer and faux boyfriend Howard K. Stern has been arraigned on five additional charges in her death. All of the counts related to him helping her illegally obtain prescription narcotics. He’s pleaded not guilty, along with two of Smith’s doctors, Dr. Sandeep Kapoor and psychiatrist Dr. Khristine Eroshevich.

More charges were filed Wednesday against the lawyer-boyfriend of Anna Nicole Smith, with prosecutors claiming he helped obtain the drugs that killed the former Playboy model. Howard K. Stern was charged with five more felony counts in an amended complaint filed by the Los Angeles County district attorney’soffice, bringing the total number of charges against him to 11.

Smith died of a drug overdose on Feb. 8, 2007, in a Florida hotel room. Prosecutors call Stern an aider and abettor of two doctors, Dr. Sandeep Kapoor and Dr. Khristine Eroshevich, who are charged with improperly prescribing the drugs that killed Smith. All three pleaded not guilty in May to conspiring to illegally provide Smith with controlled substances. They re-entered their pleas Wednesday to the amended complaint. Outside court, Stern’s attorney said the additional charges were filed because prosecutors realized their case against him was weak. “They are using a shotgun approach,” Steve Sadow said. “They are throwing everything at him to see what sticks, and nothing will stick.” Sadow argues his client should not be blamed for Smith’s death because Stern was relying on the doctors to treat the former model, who he said was recovering from an illness at the time of her death.

“Anna Nicole was a very strong-willed woman,” Sadow said. “She took the prescription medications because she thought it was in her best interest to control her pain. A preliminary hearing is set for Oct. 5 but prosecutors asked for a delay until Oct. 13. A decision will be made following a scheduling hearing Oct. 1.

There’s also the big issue of what kind of relationships Smith had with her doctors. There’s a photo of her with Kapoor at a gay pride parade and the prosecution is saying they had some sort of inappropriate personal relationship. His lawyer is arguing that’s not the case, since Kapoor is gay. She says they didn’t have a social relationship either, they just both happened to be at the same event. I can buy that. However I’d love to hear the excuses that come out of Dr. Khristine Eroshevich’s lawyer. Look what kind of photos are floating around of Eroshevich and Anna Nicole.

Anna Nicole Smith and her psychiatrist were captured on film in various contorted sexual positions, according to new legal docs.

We reported this morning that the legal docs describe Anna Nicole and Dr. Khristine Eroshevich naked in a bathtub together. Authorities claim the two women had a personal relationship “that crossed the boundaries of professionalism.”

The documents are very specific: “One photo showed both naked women embracing while looking at the camera. In another photo, Dr. Eroshevich is sitting between Anna Nicole Smith’s legs while Anna…was in a more reclined position.

In the third photo, Anna Nicole Smith has her ankles on each of Dr. Eroshevich’s shoulders while they are holding hands and their clasped hands are resting in the area of Anna Nicole Smith’s vagina posing for the camera.”

More than a year ago we saw a photo of Anna Nicole and Dr. Eroshevich, naked in a bathtub with a sex toy nearby. We did not publish the photo.

If even TMZ finds themselves in an ethical quandary over a photo, it’s got to be seriously bad. I can’t wait to hear how Eroshevich is going to explain those pictures. There’s no non-salacious and rational explanation I can think of. All of the defendants in this case are creepy, just different levels. Howard Stern is creepy because of his appearance and Svengali-like hold over Smith. But of the two doctors I find Eroshevich the worst. I mean presumably she also functioned as a psychiatrist to Smith. Yet… those photos. This woman must be seriously psychologically disturbed.

Anna Nicole was victimized from all sorts of people. It just goes to show the powerful way drugs can take over your life. In her case they made her so doped up that she agreed to all sorts of things she probably wouldn’t have otherwise. And they ultimately led to her death. Even though it’s been several years coming, hopefully she’ll get some justice soon.

    No doubt Stern felt he loved Anna and no doubt he felt the best way to keep her (unto himself) was to help her stay drugged.

    This Eroshevitz woman creeps me out bad. She always just smiles and explains everything away, like she is the crazy mother goose and everybody else is wayward children.

    Good, I am glad that enablers are starting to get in trouble for the part they play in an addicts life. He loved keeping her doped up so he could control her, separate her from those that really cared for her and get his greedy fingers on her money.

    Like Dr.Murray, they may not have directly killed the people whom they were with, but they sure as hell played a pivotal role in it and deserve to be held accountable for their actions. This may help others in the future from obtaining meds illegally and unnecessarily.

    I’m sincerely hoping we’ll see jail time for these people if convicted. It’s far too common for docs to lose a license and simply move to another state open a new practice.

    None have credibility. Seating a jury won’t be easy.

    There are some seriously disturbed individuals in the profession of psychiatry–I read somewhere that they enter that field trying to get some sort of understanding of themselves. Then you have the psychos like this Dr E; she knows enough about the way it works on the “inside” to know how to spin it so that the patient comes off in the wrong 99% of the time–but THIS? Ha. Let’s sit back and watch her try to wiggle out of this one. Preying mantises (spelling intentional) like her need to be taken down hard so that their victims–like poor Anna Nicole–can get some peace & justice. I just hope that there are no more Anna Nicoles for this wretched piece of inhuman greed.

    drugged or not drugged…I’m not sure there was much Anna Nicole wouldn’t do.
    I haven’t seen any photos but based on description the lady Doc was way in the wrong. So sad when people who are supposed to help, do the very opposite.

    From what I understand they would crush the pills and liquify them so that they could inject them. They being her doctors and Howard K Stern.

    She took them on her own accord but she was so far out of it she didn’t really have the right mind to make those decisions… Very sad to me I wasn’t in to Anna Nicole till her daughter was born and what a mess that was very very sad how she died and the circus that followed no matter how you live life you don’t deserve that kind of ending…

    I’m gonna edit that to no doubt Stern felt he loved the potential payday Anna could bring, and felt the best way to get and keep her money all to himself was to keep her drugged up.

    SolitaryAngel, you’re right about that. I’ve been in therapy since I was 9 (I’ve had lifelong anxiety/ADD problems yaaaay) and every therapist I’ve ever had went through a far more effed up childhood than I ever did.

    Enablers. All enablers. It seems everyone has a price they can be bought for. I no longer believe in professionals being the only ones who hold up to an ethics code. Its seems they too can be bought.

    Howards Stern always creeped me out over the fact that Anna seemed to be his ONLY client. And he was so obviously into her … in a Norman Bates “mother” kind of way. Weirdness all around.

    I have always loved anna nicole smith, for some reason I have been facinated by her and for some reason she has also reminded me of my other idol marilyn monroe. So sad that both of these beautiful women died so awfully. When dannilyn was born i thought that howard k stern really loved anna. But I am beginning to see that maybe all he loved was her money and that she was his ticket into the spotlight. RIP Anna.

    mh…i don’t think the drugs alone made anna act the way she did. she was always…naive (from what i saw on tv). the drugs took it to another level.

    i remember the story a journalist told in tv…he had a meeting with anna in her mansion or hotelroom or whatever and he came in and she was naked or getting undressed and let him film her posing naked in and at the bath tube and so on and he was just there for an interview. she always seemed very…i’m sorry for using this word…”cheap” and hungry for attention.

    now all people are talking about “poor anna”…like they talk about poor marilyn monroe was used by the film studios and poor michael jackson was used by this one and that one and so on…but when those persons were alive…people didn’t think that good about them.

    anna made bad choices and it’s your choice to take drugs, isn’t it? and i mean…she was a mother…she was responsible for her son (before she got danielynn) and acted that way.

    i don’t know.

    I really do hope Stern and those two idiot doctors get what is coming to them. I remember that disturbing video of Stern filming a pregnant Anna high off of her tree and dressed in clown face. In the video Stern could be heard in the background remarking how valuable this video will be. Then and there I knew Stern was the devil. Everything was for sale in her life. Why would a person scrape the bottom of the barrel by videotaping a drugged out pregnant women and callously comment about the financial possibilities unless they are a heartless, greedy b*stard. I wouldn’t be surprised if Stern had something to do with her son’s death also. The biggest losers in all of this mess have been of course, Anna, her son Danny, and her daughter Dannilynn. Anna’s addiction and her determination to stay drugged brought her down so low that she was surrounded by a bunch of greedy vipers. What a sad ending for all concerned. Don’t even mention Stern and “love” in the same sentence. The man doesn’t know what it is.
