Lindsay Lohan is still being investigated for battery, probation violations

Remember how Lindsay Lohan went out drinking several weeks back, when she was staying in the Betty Ford Clinic’s Sober House? And remember how she missed her curfew and when a clinic employee told her she would have to take a Breathalyzer, Lindsay smacked the crap out of the woman? Yeah. Days after that story became public (after an attempted coverup by Mother Crackhead), Dawn Chapman, the employee, sold her story, got fired, and then likely got paid off by the Lohans, all to get her to refuse to cooperate with the police. So Dawn isn’t pressing charges, but the Palm Desert police aren’t letting the issue go. All of that crack payoff money, for naught.

So much for Lindsay Lohan’s clean start in 2011. Police now assert the actress did, in fact, commit battery against a Betty Ford employee in a Dec. 12 scuffle – and plan to hand the case over to local prosecutors for review.

“The investigation determined Ms. Lohan violated several aspects of her probation, including the battery [charge],” the Palm Desert Police Department said in a press release Monday, adding that they plan to notify Lohan’s probation officer.

Lohan’s attorney, Shawn Chapman Holley, wasn’t immediately available for comment. Lohan, 24, was released from rehab Monday and faces a routine Feb. 25 progress review hearing.

L.A. Superior Court Judge Elden Fox previously warned Lohan that any more slip-ups would be met with six months in jail. As of Tuesday, however, the court still hadn’t received formal notice of the incident.

Betty Ford employee Dawn Holland was fired the same day she went public with claims that Lohan threw a phone at her and yanked another phone out of her hand, causing a sprain after a confrontation at the famed Rancho Mirage, Calif., clinic.

Holland stated that Lohan was acting “out of control” and had alcohol on her breath and refused to take a Breathalyzer test when she was caught coming home past curfew.

Police continued their investigation despite Holland’s decision to recant her claims, with her attorney stating that Holland, a former addict herself, had no desire to see Lohan prosecuted.

YAY! Applause for the Palm Desert Police Department. They’re not star-struck pushovers like the LAPD. Let’s hope they follow through, and Blohan faces consequences for this incident. Also: I love that Shawn Chapman Holley was unavailable for comment. I really feel for Holley. That poor bitch has probably already gotten a million calls from Lindsay, all of them starting with “HEY, can I sue…?” Speaking of which, THAT is how Lindsay can afford a $7000-a-month rental. That’s her “milkaholic” lawsuit money.

One last thing – everyone in Venice Beach is totally pissed off that Lindsay is moving in. Venice Beach residents, once a Blohan moves in, property values drop and it’s time to find a new hipster paradise.

    A few things I really don’t think the worker got paid off. I think she got badgered and blackmailed and threatened with a suit herself. She actually violated federal law. And believe it or not Lilo could sue the pants off of her. I am still betting that the feds will fine her and take that Radar money back from her.
    Second yeah I can see that Venice would be pissed off it’s one of the few walkable cities in the LA area if she lives in one of those apts near the beach the paps would clog the sidewalk etc.
    Finally I would love it if she actually had a consequence for her action and ended up paying for what she did because I’m really not looking forward to another one of her bouts of crazy.

    Regardless of what the rehab worker WANTS to do at this point, assault is a crime therefore the police can pursue it and bring charges if they want to.

    On another note, when did a 50-year-old former porn star take over Lindsay Lohan’s body???

    I’m glad the police are continuing to investigate it, both Lindsay’s behavior and the woman who sold the story.

    I’d be PISSED if that lunatic moved in near me. Even with the “milkaholic” settlement (which could not have been very much) I don’t know how she can afford $7K rent.

    @Lucy2: apparently her leggings line isn’t completely bankrupt (shocking, no?) and she also regularly gets paid by paparazzi when she calls them herself or grants an “exclusive” to Radar. I don’t know just how much money that is, and for the sake of all that’s holy I have to believe it’s dwindling, but it seems to be enough to keep her afloat.

    I just don’t think anything will come of this since the BFC employee isn’t going to cooperate. It’s going to fizzle out just like all of the charges against LL. Some day, though, she is going to step in it and not be able to wiggle her way out. Let’s just hope she doesn’t take anyone else down with her.

    I’m praying for her . I’m an addict in recovery and I know how difficult it is to stop using. I have been in rehab 6 times. She has to leave LA to recover IMO

    I never comment on stories about this chick because I have this irrational near hatred of her. I like to think of myself as a nice person and I don’t ever wish anyone harm, but… Damn. I just can’t with this chick. She and her family are just such despicable people, such wastes of oxygen, that I just can’t. She never learns, she never changes, and with her, it’s just another day, another crack hustle, another person she’s hurting. And the most infuriating thing of all is that she gets away with it, every goddamn time. She never faces real consequences for her actions. Everyone just lets her keep going, like the Energizer Crackie. If any of us did the things she has done we would be doing hard prison time. But her? Nope, she’s just moving to a place on the beach for a crazy price next to her ex so she can relax on the beach, stalk her ex, and call the paparazzi so they pay her for “candid” photos.

    So will she face consequences for this new wave of wrongdoings? Of course not, she will get off and end up just doing more of the same and getting away with it. It’s bloody maddening.

    my POF regarding what the staff member did, and how she handled the confrontation and the ensuing situation, has not changed.

    I do find it interesting that she has a choice whether or not she helps the police. In Canada, if a crime is committed, a charge is laid, even if a witness does want to cooperate.
    so if the police were called, lindsay would be charged and the staff would have to testify. I do not understand how she gets a “choice”.

    @eja the police can choose to press charges with or without her cooperation and she can be called as a witness in court if called to testify however she can’t be forced to cooperate with the investigation meaning make a statement and actively submit evidence.

    technically, Dawn Holland didn’t violate any HIPAA laws as she did not disclose any privileged medical information. She did, however, violate the Betty Ford Center’s non disclosure policy, and for that, she was fired. However, Lohan and her lovely mother will certainly attempt to sue. I have a feeling that there’s something on that alleged videotape/security tape that has caused the sheriff’s department to move forward with the assault charge. They might not NEED Holland if they have enough on the purported tape.

    @Liana I hate to defend Lilo but I have to disagree with you. I have to say I’ve had several jobs dealing with HIPAA and I know that alot of companies have crazy rules regarding it because its never really been tested in court how far one can go. And according to Radar the reason she was fired is that Betty Ford was concerned she violated HIPAA and used a confidential document when talking to RADAR.     As for Lohan, it’s been said before, I’ll say it again – it’s the ATTENTION she’s addicted to. I’m not saying she doesn’t have a drug problem, but I it isn’t nearly as bad as it’s made out to be, only because people keep thinking that’s her main problem when it isn’t. The girl is hardcore addicted to attention, to the paparazzi, to being a star. It doesn’t matter that she’s long past the point of a Hollywood return, it doesn’t matter that there are other actresses who have surpassed her and many more coming up behind her, all she wants to be is a STAR. If you could cure that she’d have a fighting chance. But she doesn’t.

    And GeekChic, I co-sign everything you said. And anyone who thinks she’ll actually do real jail time because of this, or will learn anything at all…well, what’s that saying about a bridge in Brooklyn or something? Yeah, that.

    @mln – they’re covering their asses over a “possible” HIPAA violation. The thing with HIPAA is that it is supposed to prevent the unauthorized disclosure of privileged and protected medical information. Lohan refusing a breathalyzer and possibly going apeshit on a worker is not necessarily a “medical” issue since the police were brought in because of this. It became a legal issue and therein might sit the legal loophole for the feds to not get involved and get this supposed “healthcare worker” (who shouldn’t have sold her story to anyone) off the hook. It also occurred in a sober house, which is not always considered a healthcare facility. Federal laws are sketchy on what exactly is and is not covered under HIPAA (my uncle is an attorney who deals with HIPAA regs as part of his retainer for a major hospital). He said that by turning in evidence of a possible HIPAA violation, Betty Ford takes itself out of the equation and puts everything firmly in the lap of Dawn Holland, thus protecting them from potential lawsuit. Could she go down for a HIPAA violation? Yeah, she could. But it’s not a given and not probable.

    When Robert Downey Jr. stuggled with addiction for years and kept getting into trouble, I felt sad for him. I don’t with Lindsay and I think it is because Robert nor his family/friends ever went in front of the cameras or were interviewed in articles where everything that came out of their mouth was BS like Lindsay. Robert took responsibility for what he did and didn’t blame everyone else, that is why I am so happy to seem him healthy and back to working

    I can’t help but wonder what will happen when they stop talking about her or taking her picture. That’s when people truly become desperate for attention.

    People feel she gets away with it, but she doesn’t.
    There are so many actors and people in show business that are on drugs and don’t get caught and can just keep at it.

    We are all being deluded by the news about this one girl with a drug problem, to divert the attention away from the real villains, the dealers and pushers and those who make money on the misfortunes of others.
