“Borat” get major legal victory, three lawsuits settled

After the Borat movie came out just about anyone who was in it sued the film’s creators and star Sacha Baron Cohen. Okay well not quite, but close. It was a ton of lawsuits, which was frankly to be expected for a movie of that nature. Play a lot of pranks on people and/or make them look dumb in some way, and you can’t really expect that everyone’s going to be a “good sport” about the whole thing.

Luckily for Cohen, three of the lawsuits have been settled.

NEW YORK — A New York judge has tossed out lawsuits brought by a driving instructor and two etiquette school teachers who said the makers of the movie “Borat” deceived them.

Judge Loretta Preska says all three accepted money and signed agreements releasing the filmmakers from liability. She noted in a Sept. 3 ruling the agreements said the plaintiffs consented to appear in a “documentary-style” movie.

In the 2006 film “Borat: Cultural Learnings of America for Make Benefit Glorious Nation of Kazakhstan,” British comedian Sacha Baron Cohen plays an uncouth and anti-Semitic journalist traveling the United States in pursuit of Pamela Anderson. Cohen often fools people with his gag interviews.

Lawyers for the plaintiffs haven’t returned phone messages seeking comment.

Obviously there was no actual ruling, so it’s not like it set a precedent. Which would have been sort of nice actually, for there to be a more clear line between balancing free speech and individuals’ rights. However that part about the “plaintiffs consented to appear in a “documentary-style” movie” sounds like they were upset by the nature of their scenes or the film itself, but weren’t arguing that they were ever actually deceived.

I’d think that if the studio that put out Borat had any common sense they would have realized it was a potential legal disaster and protected themselves vigorously from the beginning.

    All of people in the film probably had to sign a consent and release form – this is the legal equivalent of “crying over spilled milk.”

    Yes I do think the people who sued him were just a bunch of whiners. They were trying to cash in and get a piece of the pie. They were greedy, nothing more.

    Hehe. I loved Borat & I’m super excited about Sascha’s next flick.

    Everyone even remotely connected to Borat had to sign waivers; plain & simple. I guarantee that the movie’s production company knew exactly what they were in for & provided for everything in the waiver.

    The plaintiffs should have read every bit of fine print BEFORE they signed. They are just embarrassed that they were splashed across the world & exposed for the idiots they are.

    Hell, I’d be embarrassed too.

    as much as i liked the ali g show, Borat fell painfully flat! oh yeah, and in case you didn’t know… most of it WAS staged, and yes, the frat boys got what was coming to them. Bruno will most likely flop, and SBC is a real asshole, on a hole new level. HE’s one of the only performers that turns his viewers and fan base into jerks. YOU are the real butt of his jokes if you actually pay to see his next film. HE’s overpaid and over-hyped, i wish he’d go back to defacing political figures.

    the studio did indeed protect itself because the lawsuits were highly anticipated. they had an enormous waiver document that everyone who appeared in it had to sign. SBC has a very very good lawyer who drafted it up so that it would be impossible for these fools to sue him. how exactly does he turn his viewers and fans into jerks? I dont get it. he is one of the most clever performers out there.
