Lindsay Lohan to be charged with lying to the police for her June car accident

Here are some new photos of Lindsay Lohan last night in Manhattan. Guess who was with Lindsay? ALI!!! This is the first time I’ve seen Ali in MONTHS. I haven’t seen her since before she mysteriously went to “South Korea” to “model” over the summer. Well, Ali is in NYC with the Cracken, so you know some crack shenanigans are going down soon. As for Lindsay’s outfit…busted. She looks like a cracked-out raccoon. Is that a raccoon pelt?! And Ali looks… er… poor Ali. That poor kid.

Lindsay has been in NYC for more than week – she was there during Hurricane/Frankenstorm Sandy, staying at a hotel. But the Cracken will have to return to LA sooner rather than later… TMZ reports that Lindsay is going to be charged with “lying to police” from that cracktastrophe on the Pacific Coast Highway back in June. That was like two dozen cracktastrophes ago!

Lindsay Lohan will be charged with the crime of lying to police after her car accident in June on Pacific Coast Highway … TMZ has learned.

We broke the story … Lohan told cops she was NOT behind the wheel of her Porsche when it slammed into the back of an 18-wheeler. Fact is she was — according to multiple witnesses.

Law enforcement sources tell us … the case will be filed as a misdemeanor by the Santa Monica City Attorney … possibly this week.

The charge could spell huge trouble for Lindsay, because she’s currently on probation for the jewelry heist. The criminal filing could trigger a probation violation, and Judge Stephanie Sautner — the jewelry judge — could send her to the slammer for a long, long time.

And law enforcement sources tell us … cops found prescription pills in her purse after the crash. Witnesses tell us pills were also scattered in her trunk. Our sources say authorities were prepared to charge LiLo with drug crimes, but Lindsay’s lawyer, Shawn Holley, gave cops documentations from Lindsay’s doctor, saying the pills were properly prescribed. Authorities then backed off that charge.

As for the charge of lying to cops, Lindsay almost dodged that bullet. You may recall, after the accident, Lindsay went to the hospital where she was interviewed by cops, and that’s when she told them she wasn’t behind the wheel. Her lawyer, Shawn Holley, made a mad dash for the hospital to muzzle her client (see video), but she was a few minutes too late.

Comedy and crime — it’s all about timing.

Yeah, here’s what I don’t understand (and please, California legal experts, explain it to me): how is this not an AUTOMATIC violation of the terms of Lindsay’s probation. Like, if and when Lindsay is charged with lying to the police, why wouldn’t that automatically trigger a probation violation and she would have to go straight to court/jail? Isn’t that what her judge said when they were going through the terms of her last probation? That if she screwed up even once, her probation would be null and she would immediately face the consequences? But I guess not… because the California Justice System is all “Meh” when it comes to Lindsay Lohan. They don’t want to deal with her anymore.

        Erika – I get exactly what you mean but I think people are saying she looks 40 not because 40 is expected to look terrible (most 40 year old celebs and 40 somethings I know look waaaay better than her ass) but because 40 is the age by which a person can start to look really rough if they have lived a rough unhealthy life so far. A lot of people through their 20’s even 30’s can get away with a lot of shit and still look alright, however it seems that Lindsay did not have that grace period that many young adults have. She went from being gorgeous to decrepit in only 3-4 years, hence why she “looks 40”. I’d say it’s to do with a particularly damaging combo of drugs that she’s on, unlucky genes and the fact that her skin type can potentially age faster than others.

      And again Linsay Lohan.. As a retired, or rather semi-retired professional who spent his life working with troubled adolescents & young adults many of her issues are sadly obvious. I have worked with children from all socio-economic groups, and yes what some call the “rich & famous.
      Perhaps more troubling is the attention or “play” she receives out of Hollywood. This is a troubled child; now in her 20s- a troubled young adult. She gets presented to the youth of the world as some kind of “role-model?” Not too cool folks. A perfect pair of Hollywood role models, for all children, would be the two “Deschanel” sisters; Zooey and Emily. Why the media does not use them as more of a benchmark or example for today’s youth may also be pathetically obvious. It gets more press, more attention to exploit a dysfunctional and unhappy child than a pair of young women who were obviously raised by not only two great artists but loving and caring parents, with solid values, morals, and principals. I have read that both of these girls do acts of out-reach to help others like gifting to Focus Adolescent Services, (Focusas.com) to help them save American children. It would also be my guess that they both telephone their parents and grandparents every week. I would come out of retirement to help this Lohan child for free. She has had no real childhood; lost or stolen the same impact. She cannot be happy; most of us know that fame and fortune is no substitute for a happy and productive life. Time and again, for decades we have seen where this life pattern leads; a tragedy. She needs to apply the proverbial brakes and admit the need for help then get the help from a compassionate individual. She has been medicated enough. Perhaps all of the above and then hang out with others like the two Deschanel sisters; a positive peer group. We, the public, need to open the doors to our hearts and offer mercy rather than disdain and constant criticism.

    I actually like Ali’s hair. I think it suits her. Honestly… she looks better than she usually does. Maybe being away from the Cracken over the summer did some good.

      Ali looks awful! The hair could not be more unflattering; the 50’s style hand bag, and a general vibe of an old-timey housewive make her seem forlorn and devoid of any joy of life.
      Also, I am curious to see some close-ups of her to find out what she’s had done when she was supposedly ‘modeling in Asia’. I believe that time was spent exclusively undergoing and recuperating from multiple plastic surgeries. I guess the unveiling will come in spring, when she can dump the overcoats.

      Also, why does the 3 Strikes Law not apply to her? She’s had at least 2 former convictions, and this charge would make it number 3. How is it that her lawyer ALWAYS finds a way to get her out of trouble???
      If she were slammed with a 3rd strike she’d get mandatory jail time, which at this time seems to be exactly what she needs and the only thing she deserves. After all, that law was designed to protect the public from habitual offenders, which she fits to a T.

      I can only assume that simply being charged isn’t a parole violation, that she would need to be convicted? I’m no expert, but that would make sense… “innocent until proven guilty” because, technically, it could be a bogus charge without substance and then she could turn around and sue for false imprisonment or something.

      We all know she’s guilty, guilty, guilty, but LEGALLY I guess they can’t do anything yet.

        According to TMZ, even being charged can result in a probation violation.

        You’d think it’d be a no-brainer that “obey all laws” includes not lying to police about a fender bender.

        Warning! I’m not a lawyer, but my understand is …

        If you’ve been charged with a new crime, your probation officer MUST file a petition to revoke your parole. That part is automatic. However, you’re not locked up for a minor parole violation until after the parole case goes before a judge. Gaols are far too full to hold everyone accused of violating parole while they’re waiting for trial.

        What’s interesting is that the burden of proof in a probation revocation case is different to the usual “beyond reasonable doubt” standard. When it comes to violating probation, you only need a “preponderance [51%] of evidence” for conviction.

        So she could be found not-guilty of lying to the cops in the main case but still found guilty of violating parole (by lying to the cops).

      Being charged for anything new IS the violation. I think I remember LAST TIME this happened to LL, they booked her for the new offense, but she was not immediately violated upon her new arrest. I think she was bailed out on the new charged, and a hearing set, to see if the Judge would actually violate her or not. I guess it’s at the discretion of the Judge. Then don’t forget, she has to face the charges for lying to the police as a separate matter.

    I don’t think it can be a probation violation until she either is convicted (by a judge or jury) or pleads either guilty or no contest. Technically, she can’t violate her probation until she actually DOES something. Now, everybody knows she most likely did lie to the cops. However, she needs to be found LEGALLY guilty first. Once that happens, a probabtion violation hearing can happen. However, that is still the choice of the district attorney. So basically, its just a waiting game at this point. I wouldn’t give up hope yet that Lindsay might not get some jail time. Just wait!

    Just like when Chris Brown got arrested for stealing someone’s phone and NOTHING happened. That was a probation violation which means you can not get ARRESTED for anything it does not matter if you get charged or not. Just the arrest will (or is supposed to) cancels the probation and you go straight to jail–but this will NEVER happen to Lohan. Gawd who did she blow to get this get out of jail free card? Everyone in the California Legal System.

      Lindsay Lohan got warned repeatedly to get her butt in gear.

    I know for non-industry people in US it seems like a joke to go to South Korea for modeling work, but it’s really quite a good place for models right now. While Japan used to be the place to be, nowadays Korea and China are better for international models than Tokyo. The Korean agencies that hire foreign models usually do a contract with a fixed salary, so whether or not the models get work when they arrive in Seoul, they’ll leave with money in their pocket. (I’m not sure if this is correct, but I’d estimate something like 10-20.000USD for 2 -3 months contract.)

    I live in Seoul and I’ve actually seen Ali in some advertisement here. Those are local fashion brands that advertise in billboards, magazines etc. and usually hire foreign models to look more exclusive and international. In some local entertainment blog, I also saw a photo of her shopping in a local shopping mall. So there is no doubt she’s really been to Korea and really got some work here. I don’t think the media made a big fuss about her though. Maybe it was actually nice for her to be on the same line with other models with no public background and only work on her own talents.

      I saw one of her modeling jobs, an ad for local fashion brand, on a bus. She looked good. I think her background of course helped her to get a contract with an agency, but I’d say she’s pretty much same quality as majority of other foreign models traveling around Asia – not strikingly gorgeous, not bad, just good enough to get work and bring in some money.

      Even Coco Rocha was working in Asia before she made it big. I heard the was in Hong Kong or Singapore and didn’t work especially well because they didn’t quite like her look. Modeling is sometimes just about being in the right place at the right time, meeting the right people, having luck…

    Nothing will happen to her. She’ll go to court, no doubt about that, but nothing will happen. If she gets jail time, they’ll release her after an hour or two and cite “overpopulation in the jail” and she’ll be on her merry way, leaving a trail of crack head destruction. LL has caused a lot of people to think the California legal system is an utter joke.

    Blohan has had other scrapes with the law while being on probation.

    On other occasions, I think, her probation was revoked and then she was released on bail pending a hearing on the new crime and the probation.

    While I agree that she will skate, this case is better than the others because a) it involves police, and one assumes that the case took this long to prosecute because those men in blue were crossing all their Ts and dotting all their is to sew up this case against her. And b) she agreed to the terms of Sautner’s probation thing that if she screwed up, she didn’t get any more hearings–she would go to jail. She has skated on so many charges that it seems only fair that this one–with witnesses who are POLICE–should be able to get her into a cell. I’m keeping my fingers crossed (while acknowledging the futility of it all).

    THIS, ladies and gents, is why you pay for a good lawyer!!! Lohan is the prime example. Things not to look for a bargain on: surgery (which she is not heeding that one), and the best lawyer, especially if you are in a nasty divorce or in a criminal case. I worked in a pitbull lawyer’s office for years. They know how to cast reasonable doubt, discount witnesses, or negotiate like a mofo. You get what you pay for! Apparently Holley is very good at her job. The California legal system can only set it up, but Holley knows how to knock it down.

    Whats taken 5 months? The popo interviewed witnesses at the scene and knew she was lying 10 minutes after they got there. As for the probation violation, she was ARRESTED in NY and nothing happened. If the cops haven’t charged her already, I’m not counting on it.

Will she go to court in NY to face this charge, or does she have to be in LA? If she stays out of LA, can she avoid answering to the charge?

    The judge can sentence her to jail, but what’s the point? The sheriff will just release her within a few hours (telling her to show up late at night so she’ll be released after midnight – poof, credit for two days). The judge could try another house arrest, but in LA the sheriff still gives time off for “overcrowding”, defying all logic. The judge would have to make house arrest really strict like it is with ordinary mortals, or else LL will just party party party as before.

    And yes, any police contact can end up as a probation violation for ordinary mortals – certainly any new charges. The probation judge has far more leeway in evaluating the charges than the regular judge – doesn’t require the same degree of evidence to get the person in deep trouble, although this one is clearly a case of lying seriously to police and I don’t see how even Teflon Lohan could wiggle out of it if the police and DA decide to pursue it. If the probation judge decides the evidence suggests probable involvement, she can decide it’s a violation. And that’s what happens with ordinary mortals. Then they sit in jail while awaiting their judgment for the charges themselves as a separate matter. Many people in a county jail are actually just waiting for trial and half are typically declared not guilty. They just don’t have money for bail. Sometimes I wonder if the only way to explain Lohan’s teflon coating is mob connections

      Can’t quite grasp that concept. She is in a cell all by herself. Where the @#$ does the overcrowding come in? She gets an hour alone in the yard, and all kinds of visitors that get her out of her cell, but they let her out early for overcrowding. How many times has she been released early for overcrowding and why has no-one called the sheriff on this shit?

    I am also puzzled as to why she was not automatically in violation of her probation. I thought that’s how it worked.

    For this round of the Cracken Spoof Law Enforcement Games, I expect LL will spend as much time at the County Jail as it takes the sheriffs to bring her a latte & help her dial her phone for her one call.
