Madonna wins adoption appeal; sending jet to pick up Mercy James


It seems there’s no denying Madonna. After Madonna’s first adoption attempt on two-and-half-year-old (3-year-old?) Mercy James was denied, Madonna and her lawyers sent into motion an extensive appeal. Personally, I thought it was a fool’s errand – it seemed the legal system of Malawi had enough of Madonna, and I doubted a different judge would send mercy James to live with Madge. I was wrong, though. Just this morning (in Malawi), a second judge ruled that Madonna had the right to adopt to Mercy. This comes after Madonna’s representatives denied that the appeal would go Madge’s way, but no matter. There’s also some vague discussion of “a private jet being prepared”. Don’t worry, Madonna isn’t going to physically go to Malawi and pick up her new daughter and comfort the little girl through what will be a difficult transition – no, Madge is just sending the jet.

Madonna’s family has just gotten bigger, now that the pop star has legally won the right to adopt a daughter from Malawi.

Preparations are already underway to bring Chifundo “Mercy” James, 3, from the African country to America private jet, after the singer stayed up throughout the night hoping for a courtroom victory.

“It’s the early hours in New York now but my client has been awake all night waiting for this,” Madonna’s Malawi lawyer, Alan Chinula, tells PEOPLE. The attorney spoke to his client as soon as the ruling was made official, at around 2 a.m. her time Friday. “She was ecstatic when I broke the news to her. She said, ‘Thank heavens.’ ”

Chinula says he is “now awaiting instructions from New York to start preparing travel arrangements for Mercy. I have to be there for her passports and everything.”

It is likely to take three to five days before the paperwork is ready and the child is able to leave and join fellow adoptee David, also 3. He was formally adopted in 2008 after some controversy and legal challenges.

Madonna, 50, is not expected to fly out to Africa from New York, but Philippe Van Der Bossche, director of her Raising Malawi charity, has been asked to arrange a private jet as soon as possible.

It is believed that Mercy may, in the short term, be moved to the Kumbali lodge where Madonna stays when she is Malawi.

The ruling – by Malawi’s highest court – was made after a lower court had turned down Madonna’s first bid to adopt Mercy in April. That court had said the singer had not spent enough time in Malawi.

Congratulations are in order! Madonna got her way – as she almost always does. Though I don’t think much of many, many aspects of Madonna, I do think that Mercy’s life will be better with Madonna, and I’m not just talking about Mercy’s quality of life. Though I don’t find Madge to be the best mom in the world, she’s far from the worst, and I believe she genuinely loves and adores her kids, and feels a real connection to Mercy. I also have to give Madonna some respect for not backing down in the face of her first adoption denial. Though I questioned Madonna’s press-seeking motives, and her nonexistent concerns for another country’s laws, hopefully it all came from a good place. I hope, I hope. Congratulations to the happy family – I’m sure Lola is thrilled to have a new little sister!

    Are you saying she is not going to pick up Mercy? If so, that is pretty shitty of her. If it meant so much, she should be there, not her handlers. I hope I read that wrong. Maybe she did win the appeal so they’d be rid of her. Why she couldn’t find an orphaned child here in the US of African heritage is beyond me. Maybe we know too much about her here.

    I am happy for that little girl. A life with Madonna is better than a life in an orphanage. Although I would prefer these celebs let the children stay with their living relatives (most of these orphans have)that way, they will escape the depravity of being a celeb spawn.

    The fact that some of these kids have living relatives and are put on an orphanage (and am sure there are good reaons for that) is just sad! Theres no way that the child would actually bond with any of them, in a greater and deeper sense! It´s not like they go to pick her up to spend the weekends together, as a family! So yes, Mercy will not only have a better life with better opportunities, but she will have the opportunity to belong to a FAMILY (with a mom, siblings, family dinner´s, vacations, all theses special moments in our lives that most of ppl take for granted, but many never get the chance experience it!) and that´s how it should be to any child! I truly believe Madonna, depsite of it all, can provide all that! Congratulations to the family!

    Color me ambivalent.

    There’s just a whiff of child-buying and a display of power by Madonna, AJ, etc. in these adoptions.

    Yes, I know, the children might be better off. But the trade-offs are real, including a loss of cultural and familial ties.

    There are many needy and deserving adoptees right here. Why aren’t they tugging at the heartstrings of these “supermoms?”

    Besides me, is anyone else concerned that little Mercy may have a serious want for a father when she gets older? Nothing against single parenting, but with her three older siblings all having daddies, little Mercy might want one too. Just saying…

    I’m not going to join the debate over whether or not little Mercy’s life will be hurt/enhanced by being adopted. I know too little. But what I DO know, is that sending a jet for a little person going through such traumatic changes is the cruelest thing that i have ever heard. If this is true, i think we finally know the full measure of Madonna.

    Although I fully appreciate what Madonna is doing for little Mercy, I don’t understand what makes her above Malawi law.
    A lot of “regular” people make BIG sacrifices to adopt children from foreign countries, so why couldn’t she make those same sacrifices?

    I just don’t understand.
    Either way, at least Mercy will (hopefully) be better off.

    as for not single parent issue, am still of the opinion that is better to have one parent, than none!

    Yes, Edwina in AbFab just had them send over a selection of babies so she could pick, LOL. Then later when her own daughter was pregnant by an African man she got super excited because her grandchild would be “the Gucci of babies–a mixed race baby” and then she would be totally cool and hip by extension.

    The brilliant Jennifer Saunders had Madonna nailed years ago.

    Now Mercy will get to not watch television, not eat sweets or anything not approved by Madonna, and have her every move pre-planned by Madonna or her handlers. There’s a reason the kids prefer their dads.

    My biggest wish now that Madonna has purchased yet another child is that the “handler” that gets Mercy is kind and loving, and that she won’t be scarred enough to be able to deal with and get over it by adulthood.

    I do agree with adoption, and I think it can be wonderful for the child. I don’t agree with buying children who have living relatives that want them. If Madonna cares so much about this girl, she absolutely could’ve provided everything the family needed to get Mercy back home, and for her to have a good life with them instead.

    Taking this child away from the father, harassing the grandmother, making the father appear to be an opportunist…excuse me, the opportunist here is Madonna. The gimp is about to head off on a world tour, and is adopting a child. She may as well put her in a plexiglass box on stage to have her on display.

    Amazing that the laws were broken that were put in place to stop the children from being exploited, and they were ignored so the child could go to…the biggest exploiter I’ve ever seen. Ironic.

    Why is Madonna so hell bent on taking this African Baby away from her biological Father & Grandmother? They want Mercy to remain with them even though they can’t give her a lavish lifestyle? WOW! Is buying Black people back in style! At least Angelina Jolie seemed sincere about her daughter’s adoption & the child’s African distant relatives didn’t disapprove. But Madonna is bullying the Malawian gov’t & the baby’s family who are 100% against this!
