Lindsay Lohan is in violation of her bail, judge issues new bench warrant

Oh, for goodness sake! It turns out we were totally wrong to give Lindsay the benefit of the doubt. The dumb bitch was drinking on Sunday night, and her SCRAM bracelet recorded everything. The judge and the prosecutor were in a meeting this afternoon, and they decided that by violating the terms of her bail, she forfeited that $100,000, and the judge issued a new bench warrant and a new $200,000 bail charge. TMZ reports that the same bail bondsman just posted her new bond.

Maybe the next step for Lindsay Lohan will be to actually stay away from the open-bar party scene. Two days after Lohan’s SCRAM ankle bracelet suspiciously lit up Sunday while she was at an MTV Movie Awards afterparty, a judge determined that the actress was indeed in violation of her bail and issued a new bench warrant for her arrest.

Beverly Hills Superior Court Judge Marsha Revel also hiked Lohan’s bail to $200,000, where it was previously $100,000 keeping her a free woman for the time being.

“At this time, the court finds she was in violation of the conditions of her bail,” Revel said after she, prosecutor Danette Meyers, and Lohan’s attorney, Shawn Chapman Holley, emerged from a private meeting in chambers.

Both attorneys said that they’re still waiting on the full report about what the alleged violation entailed. A SCRAM checks for alcohol consumption every 30 minutes by testing the wearer’s perspiration. And apparently the accessory is smart enough to know if the wearer is drinking or was just splashed by someone else’s drink.

“We could see [evidence of spilled alcohol in a report]; however, we can easily tell the difference,” SCRAM spokeswoman Kathleen Brown tells E! News. “A spill or something else in the environment would create a rapid spike much faster than the body would ever consume alcohol and would evaporate and burn off much faster than the body can metabolize alcohol.

“Our confirmation process includes an evaluation that ensures there is no chance that an alcohol alert is anything but consumed alcohol.”

Though Lohan herself didn’t appear in court today, a few media helicopters actually cared enough to hover above the proceedings, and several news trucks and a scrum of photographers were stationed outside the courthouse.

Lohan found herself in hot water after wandering eyes at the MTV party noticed a red light flashing in the general vicinity of her ankle. Despite myriad protestations via Twitter that she wasn’t drinking, the judge hauled her (well, her lawyer, anyway) into court after getting the initial report that something was amiss.

“It’s from the light-up bracelet Johnny [a pal at the party] put on me—also, they can check probation records for alcohol as i got tested YESTERDAY,” she wrote less than an hour before the 3 p.m. hearing.

The 23-year-old has remained a constant fixture on the party circuit despite being fitted for the SCRAM upon her return from the Cannes Film Festival last month.

She’s due in court July 6, when the judge will determine whether she violated her probation by skipping a court date when she was in France after having supposedly misplaced her passport.

Her new tweets, after the new bench warrant, read: “poeple just won’t leave me be though and accept i’m happy and well… i did not violate anything .. At all.” Dumb jackass.

    I think I said this morning, sooner or later! No surprise here.
    I very much agree she needs to change her surroundings – no more parties or clubs, were the alcohol and other things are readily available. She’s an addict! But she still doesn’t think she has a problem.
    I’m glad the judge is staying strict with her.

    I don’t think people should be thrown in jail for having addictions. Drinking or drugging and DRIVING, yes. But if people want to destroy their lives with drugs and alcohol, that is their choice and the state needs to butt out.

    I think the SCRAM device does not register under .02, so Lindsay may have been playing games with it by drinking a little but not enough to set it off. The problem there is that one’s metabolism is not the same 24 hours a day, so what she could get away with in the morning might not be the same at night.

    Anyway, so glad she got caught, and the cost is $100,000 with the possibility of losing $200,000 for the new bail. Idiot.

    Does anyone know how this bail stuff works? Did she forfeit the down payment of the 100,000 or did she lose 100,000 total? Who is that bails bondman paying for her? I wonder if it’s free for Lindsey so all of this doesn’t matter. I mean, does she have to pay the person back or does she have an “special agreement” with that person.

    Why hasn’t this judge thrown her in jail already? Sheesh.

    I don’t know if it’s the blond hair or the drinking “ban” she’s on… but her double chin has gone down significantly and either she had some botox on those 40-year old looking lines on her forehead don’t stand out as much either.

    She would be there about 37 minutes before being released due to “overcrowding”.

    I have a friend who is a bail bondsman. The simplest way she could explain it to me is that people have to come up with 10% of the bail amount in cash plus guarantee the rest in secured interests – like a house or a car. A bondsman has the full amount of the bail sitting in a trust account to pay the court should the bailee not fulfill the requirements or skip their court date (kinda like insurance).

    The way a bondsman makes their money is that even though the bailee only has to put up 10%, they still have to pay back the full amount of the bond to the bondsman plus interest if anything goes wrong (and they can lose their house/car or whatever it is they used to secure the loan).

    If it all goes the way its supposed to, the bondsman keeps the 10% down, the bailee shows up for court or follows terms of probation, and the court is happy.

    I really, really wanna know what the bondsman in this case is getting to not only put up 100k but another 200k after she lost the first one. It *has* to be good.

    how many alcoholics or drugaddicts do you know who have the common sense to realize getting into a car while high might be potentially hazzardous to others?
    maybe you should have a conversation with someone whose loved one or family member for mowed down by a drunk driver or with the general tax payer, because guess who is paying for all the courtcosts and police action involved?
    Hardly ever has a drunk or druguser solely affected their own life unless they live on a deserted island. maybe when one of your own gets hooked on drugs or alcohol you’ll realize that that is a really really dumb statement to make, because they cannot and will not clean up the mess the leave behind.

    I bet her throat just got so parched hob-nobing with her rich and famous peers, that she had to drink a lot of that fancy water to keep from being dehydrated. That’s what the SCRAM device was picking up – her fancy water! Because even though it’s her job as an actress to go to these industry parties even though they’re riddled with temptations – it’s her job! – you can tell that she takes the law and her court-mandated sobriety very, very seriously.

    It’s totally the water’s fault.

    $100 (cash) says that’s her legal defense.
    (Double down if she ends up with an endorsement deal like she did with that nicotine patch company during her first round of legal troubles.)

    Funny that she mentions the tabs, blogs, and media are lying, but doesn’t mention the JUDGE! What does she think, the court is making things up? Disregard the medias, Lindsay and instead focus on what the judge and your lawyer are telling you. I still think she doesn’t get how dire her situation is. She isn’t getting hired for a reason (Lovelace film aside and I’ll believe it when I see it) and it’s not to do with what tabs say. I would think that producers and directors make their decisions on more than just what tabs say, after all. They’re smarter than that. It’s not like THEY’RE living with a high school mentality.

    I’m truly curious what has and hasn’t changed since the SCRAM. You can see just by the pictures alone she was doing some crackedy-cracked-out-crack before the bracelet (the skin, pupils, hair, wrinkles, bloat, etc. in the court pic). And she looks slightly better now….but she’s clearly not totally sober as we know from her prescriptions alone.

    And let’s not forget that alcohol she drank was mixed with the drugs … I mean “medication” … her dentist gave her. She was probably high as a kite. All she had to do was pay 10% of more bail, so it sounds like she had a good time! I’m sure she’s laughing her ass off right now! She’s managed to drink and drug her way through probation, with little to no consequences. No wonder she feels entitled. As it turns out, she actually is.

    Most people, if fitted for a SCARM device for 30 days, would not even enter put themselves in a predictament where alcholo is present, eg. not going to a bar for fear of setting it off. Especially if its only 30 days.

    im sure the judge could easily find a way to put her in jail. for example, dont give her the option of bail for a second time after she violated the first one – *obviously*. the only reason she’s NOT in jail is b/c the court, at its discretion, can grant her bail terms. this judge is only being “strict” if you’re using a very low standard.

    Mrs Odie – this whole thing stems from a DUI. She WAS out drinking/drugging and driving, endangering herself and everyone else on the road. They haven’t done all this because she’s an addict, but because she broke a pretty serious law, and then repeatedly failed to meet the conditions of her probation.

    My sister is in rehab for crystal-meth. She was caught driving (with my three nephews in the car!) around 2 in the morning, one needle used and another primed and ready to go. My nephews now live with their father in Nebraska (we’re in CA); my parents are paying several hundreds per month for my sister’s nine-month-rehab stint; we’re all praying it works. But look at the cost. Not just the financial toll, but the human toll as well. You can’t put a number on that. No one can.
