Michael Douglas’ ex wife still fighting for his Wall St. sequel money

Michael Douglas is currently undergoing chemotherapy and radiation treatment for throat cancer, his rep confirms, but he says he’s “very optimistic” about his prognosis. Wall St.: Money Never Sleeps premieres in late September, and from my calculations Douglas will be about 6 weeks in to an 8 week course of treatment at that time (depending on when he started). We’ll have to see if he makes the premiere or does any promotion for the film, but he’s already canceled interviews and people will of course understand if he has to skip the premiere. There’s one thing that Douglas isn’t putting off, though, and that’s the court battle with his ex wife over the Wall St. sequel. According to the terms of Douglas’ 2000 divorce with his first wife, Diandra Luker, Luker is eligible for 50% of his earnings from any “spin offs” of films he made when they were together, from 1977 to 2000. That includes residuals and merchandising rights! Luker got a hefty $45 million dollar settlement in 2000, but she’s looking for more since the original Wall St. movie was made during their marriage in 1987. She’s claiming that Wall St 2: Money Never Sleeps fits the definition of a “spin off.” Instead of delaying a hearing over this issue, as Luker has volunteered to do, Douglas wants it to move forward as scheduled and allegedly wants to “get it over with.”

Despite being diagnosed with throat cancer, Michael Douglas refuses to delay his court battle with ex-wife Diandra Douglas over her claim that she’s entitled to half his earnings from the upcoming ‘Wall Street: Money Never Sleeps,’ which opens Sept. 24. Diandra had offered to postpone the hearing, but “Michael declined — he wants to get this over with as soon as possible,” a source told Page Six. Lawyers representing the actor and his ex tangled in a New York court Tuesday.

The suit appears to hinge on a clause in Michael and Diandra’s divorce settlement that entitles her to 50 percent of any earnings Michael receives from any movies he did — including residuals, merchandising and ancillary rights — during their 23-year marriage. According to Diandra’s lawyers, that provision includes any “spinoffs” of Douglas’ movies.

That, her camp says, should include director Oliver Stone’s ‘Wall Street’ follow-up, in which Michael reprises his Oscar-winning role as Gordon Gekko.

But Michael’s lawyer, Marilyn B. Chinitz, says his ex is misinterpreting the agreement, and it doesn’t apply to the ‘Wall Street’ sequel because it wasn’t on the horizon when the two split, and he couldn’t have guaranteed that he’d be in a sequel if one were ever made.

“When does it stop? … She’s not Mrs. Michael Douglas” anymore, Chinitz told a judge Tuesday. “It’s enough. It’s time for Ms. Douglas to move on and let Mr. Douglas move on and enjoy his life, without having to concern himself with someone trying to claw back moneys that they’re not entitled to.”

Since their divorce, Diandra has made $6.3 million from her stake in residual proceeds from other past projects, Chinitz said.

Diandra’s lawyer, Nancy Chemtob, says her client isn’t money-hungry and isn’t clinging to her ex-husband. “She has her own identity, and she’s proud of it,” Chemtob said. “My client is not greedy. The exact opposite is true. Mr. Douglas is seeking to shirk his financial responsibility that was entered into when he signed this contract.”

Michael and Diandra’s divorce remains one of the costliest in Hollywood history. The pair’s split was bitter, to say the least, with Diandra accusing Michael of sex and alcohol addiction and multiple infidelities. In 2007, Forbes magazine compiled a list of the 10 most expensive celebrity divorces and listed the Douglases’ at number eight. Diandra walked away with an estimated $45 million and the couple’s homes in Beverly Hills and Majorca.

Michael’s legal team is seeking to have the case dismissed, arguing that the suit should never have been filed in New York in the first place, as the couple’s divorce was finalized in California, and that the case has no merit because ‘Wall Street: Money Never Sleeps’ is a sequel, not a “spinoff.” “They’re not the same thing,” Chinitz said in an earlier hearing.

I’m honestly torn on this issue. MSat first reported this story and told Luker “it’s time to go out and get a job and earn your own damn money.” I definitely see her point, and the fact that Luker has already earned a whopping $6.3 million post-divorce on top of the $45 million she already got makes her look like a gold digger of the highest order. She was married to Douglas for 23 years, though, and she had a great lawyer and worked out a very favorable deal for herself. She’s trying to enforce it and get half of Wall St. 2. In a way I don’t blame her, as greedy as it looks. Now that Douglas has cancer, though, she’s looking less like an ex wife trying to maintain a lifestyle and more like someone sponging off a rich ex using a divorce clause that never should have been there in the first place. Maybe Douglas is hoping the judge will see it that way too.

    I am probably the only commenter who is completely on her side he was the Tiger Woods of his day and cheated on her ruthlessly for over 20 years. And even recently when his son was jailed he did everything in his power to paint her as a horrible parent and blame her for everything eventhough he admited to being an absentee parent. He more than likely signed the agreement to keep her from talking so now he needs to STFU and pay her the money.
    I do hope that he recovers from his cancer though.

    She needs to drop it. And to me, it does make her look greedy, unable to let go of her ex-husband, not moving on with her life, and bitter. That said, Michael D was classless in his remarks about her during their son’s drug trial. Maybe that’s what this is really about.

    Michael Douglas is sensible to get this over with especially if chemo takes a lot out of him. It’ll only make her look worse.

    There’s something I don’t like about her, but I agree that he was the Tiger Woods of his day. She lived with a lot of crap from him and he did trash her surrounding his son’s recent trial.

    It boils down to how the judge interprets that clause that was perfectly appropriate as part of a divorce agreement. I know very little about California contract law but I can guarantee there’s a lot of it so somewhere in some of it may be some precedent on new ventures related to older ventures and whether this new film can fit into the contract language. I doubt statements like “she needs to move on” will make any difference, though.

    No one “lives with a lot of crap” unless they want to. She was well-compensated – as intended, no doubt – for her “sacrifice,” and i’m sure that her new lips and 700 shoes thank him for his weaknesses.

    And i’m sorry but if she were such a great person maybe her son wouldn’t be in the pokey. Plenty of women make awesome single parents without the benefit she had of millions of dollars and manage to raise well-adjusted people. But if this is the kind of petty crap that is her focus then that kid had no f’in chance. She probably only had him for the extra money.

    It is probably more about revenge then it is greed. Diandra comes from a very wealthy family, and even without Douglas money, she was a very rich woman.

    I think she just hates him, and wants to continue to punish him for humiliating her during their marriage and for being a crappy father to their son.

    What a greedy pig. All she is doing is taking money from his young children. They don’t deserve the stress of watching their dad fight cancer and an ex-wife when they just want to love him during his rough time.

    Sure, he was a jerk for cheating but it’s time to let it go. She has no chance of living a happy life if she’s fighting for money from someone who is part of her past like that.

    It really doesn’t matter if this greed on her part, because this divorce papers are legal documents and should be followed as it was signed off on.

    For him to say that this movie Wallstreet has nothing to do with the previous movie is just outrageous to me, this character Gordon Gekko is in it playing the same character in the previous movie.

    This is what he signed in the divorce papers, this is what he agreed to do, him trying to run around wording in legal papers tells me he the one being greedy.

    Michael Douglas made only three movies last year one open in Spain with a limited run in the US, no release on DVD as of yet

    the other open in Seattle International Film Festival, this pass June and that film is being release later this year on DVD

    He has Wallstreet 2 out this year and only one movie out next year 2011 and only four movies beyond 2012.

    So do the math he just doesn’t want to shell out the money period.

    @Lola – Totally agree with you, not that that excuses a partner for philandering though. She looks like a dried prune. And I think they were probaly both terrible parents and their first mistake was coddling that brat son of theirs. I had a not so pleasant upbringing, and it is important to reflect on why you think and or behave in a certain way, so that you can improve yourself, but in no way do I use my past as an exuse to break the law and run around on my husband like a hound dog. Of course, I love hounds too (the 4 legged kind)!

    ITA with Fluffy Kitten Tail regarding Diandra’s motives for pursuing this action. I suspect she hates MD with a passion.

    Having said that, I’m torn on this issue and can see both sides of the story. On the one hand, yes, he was a crappy husband, she put up with an inordinate amount of BS during their marriage, and there may actually be language in their divorce agreement that entitles her to this money.

    On the other hand, it’s been YEARS since they split, and she does appear needy, greedy and clingy in going after this money at this point in time, especially in light of his current medical condition. My first inclination was that she needs to pull up her socks and move the F on.

    What it will all boil down to is what the actual contract language IS. I am very curious to see how the judge rules on this one!

    That woman is pure greed. She married someone else only when he agreed to pay her the alimony she was getting from Michael Douglas for the rest of her life whether they remained married or not. I heard it was 30,000 a month, just chump change. And of course they divorced within a year or two. And she is not a nice person at all coming from the people who wait on her hand and foot. I hope he does not have to give her another cent.

    I think Michael Douglas has spoiled his former wife and she just believes she can continue to go to him like he’s still gonna foot her bill in life and with that crappy botox job……girlfriend don’t you know that real men hate that kind of shit and think it’s really stupid and a huge waste of money. I would love it if you could turn around and use that money he would give you to benefit a child with special needs who is struggling just trying to survive in this world as you go about as you please! Your ex husband is dying and all you can think about is bloating up a part of your body that will eventually either be put into a casket or be cremated and what do you have to show for it. I love Michael Douglas and I hope and pray he can kick it with this cancer shit! My mom wasn’t as fortunate with all the horrible experience I have observed being a home health care provider for patients out of their homes I would rather go to the farthest mountain top and let a condor devour me before I would step foot into a chemo lab and be just another notch in their belts. I can’t even begin to think of what Katheryn Zeta Jones Douglas must be going through right now, maybe the same crap that I did with my own mom. How severely shallow and disgusting you truly are Diandra. Get over it and get on with your life!
