Bristol Palin sued by heckler she called “homosexual” after he called her mother a “wh*re”


Last September, footage came out of Bristol Palin getting heckled at an L.A. bar called the Saddle Ranch after she seemed to thoroughly enjoy a ride on a mechanical bull. It was all conveniently filmed for Bristol’s reality show, (You can see the video here) although Bristol’s ignorant response to the heckler kind of belied the theory that it was a setup. The guy, unprovoked, called Bristol’s mother a “whore” and “the devil” and said that “If there is a hell, she will be there.” Bristol’s brilliant comeback to this rant was to ask the guy “Is it because you’re a homosexual?” I could go on, but I’ll spare you.

Well now that guy is suing Bristol and the Lifetime channel, which will be airing the premiere of Bristol’s reality show next week FYI, for using the footage without his signing off on it. The timing is very suspect to me, although the plaintiff claims he tried to contact Bristol’s people and Lifetime for weeks and had no other recourse. Here’s more, from Reuters:

A man who heckled Bristol Palin in a Los Angeles bar and insulted her conservative politician mother, Sarah Palin, filed a lawsuit on Wednesday accusing the single mom of defamation.

Talent manager Stephen Hanks also sued cable channel Lifetime, which includes film of the 2011 incident in Bristol Palin’s upcoming reality TV show, claiming he had not given the program’s makers his permission to be filmed.

The lawsuit, filed in U.S. federal court in Los Angeles, stems from a widely publicized September 2011 incident at a bar and restaurant on the famous Sunset Strip.

The amount of damages is not specified but Hank’s lawyer, Los Angeles-based Michael Gulden, told Reuters the suit had been filed in federal court because the plaintiff was seeking more than $75,000.

Representatives for Palin and Lifetime did not immediately respond to requests for comment.

Palin, who rose to fame because of a teen pregnancy when her mother was running for U.S. vice president in 2008 as a Republican, had just ridden a mechanical bull at the bar when Hanks, who was a customer there, shouted out that her mother was “a whore” and said she was “evil”.

Video of the exchange that was widely posted on the Internet shows Palin, 21, confronting Hanks, asking him if he was gay, and getting into a heated exchange with the man who heckled her.

Palin later told celebrity magazine In Touch that the incident was one of the reasons she had decided to leave Los Angeles and return to her home in Wasilla, Alaska.

Hanks claims in his lawsuit, however, that Palin had bought a new house in Alaska in July 2011, and that she had defamed him by publicly blaming their encounter for her decision to leave Los Angeles.

Hanks also says he suffered emotional distress and invasion of privacy over Palin’s questions about his sexuality, and the use of the incident in publicity for the TV reality show.

“Bristol Palin’s conduct was outrageous”, states the lawsuit, a copy of which was obtained by Reuters.

“Bristol Palin first accused Plaintiff off ‘being a homosexual’ in a degrading manner in front of others … she then in a magazine article blamed Plaintiff for her decision to leave Los Angeles for Alaska even though she had purchased her home in Alaska … more than two months before the encounter,” the lawsuit adds.

Palin’s reality show “Life’s a Tripp”, which chronicles her stay in Los Angeles with her now 3-year-old son Tripp and her return to Alaska, is scheduled to premiere on the Lifetime cable channel on June 19.

Gulden said Hanks had tried without success to solve the matter outside the courts with Lifetime and its parent company A&E Television Networks, which is owned by NBCUniversal, Disney-ABC Television, and the Hearst Corporation.

“He has communicated with A&E regarding use of the footage, and they were non-responsive. He felt (filing the lawsuit) was all he could do to protects his rights,” Gulden told Reuters.

Bristol’s response to this guy may have been outrageous, but he said some truly obnoxious, uncalled-for things about her mother, and he started it by yelling that her mother was a whore. She was just minding her own business enjoying that bull ride. I can’t believe I’m defending Bristol, and there’s no defense for what she said, but what excuse does this guy have? Her mom wasn’t even a potential candidate for anything in September of last year, it’s not like she was influencing anyone but Fox News viewer with her hockey mom “everyone is out to get me” shtick.

In related news about Bristol’s upcoming show, “Life’s a Tripp,” People magazine has a couple of new promotional clips. In one, Bristol cries and begs her 16 year-old sister Willow to stay with her in L.A. because she has no other family there to help care for her son. It seemed very self-centered and entitled to me, and in no way realistic. She was filming a reality show at the time and she still presumably has the cash she earned on Dancing with The Stars. Put the kid in preschool and hire a babysitter. Your family, especially your 16 year-old sister, doesn’t owe it to you to care for the kid you had as a teen. Who knows how much of this is real, but I doubt Bristol can act well enough to cry like on cue.

    Whu does she force her reality show on her son ? He didn’t have a choice! How about using Mom’s money to get an education, seetle down in her own house and raise that little boy correctly. Hell no, bitch wants L.A ‘s fame and stardom. Disgusting. And I think the same about all “reality shows stars”.

      I agree. She always complains about “Hollywood”, and how she is “real” in comparison…yet she is constantly trying to turn herself into a star. Going on Dancing with the Stars, Secret Life of an American Teenager, TWO reality shows about herself, one reality show with her mom….such a hypocrit. I think it is HORRIBLE that she is selling out her son’s privacy to further her dreams of stardom (hint to Bristol: get some talent).

      I think that he does have a case against her if he didn’t give his authorization to be in the show. However, most shows will post something on the door of the venue saying something like, “Warning: Filming for “whatever reality show” taking place inside. If you enter, whaterver production company has the right to use your image and likeness.” I would be surprised if the production company didn’t do this.

    The guy actually has a point. I agree he instigated it but that does not give Lifetime permission to use the video for her show. If he signed off on it, then fine but Lifetime & BP will be making money of off him and thats the part that is not right. I thought you had to have written consent before airing a person on a paid TV show, if not then they have to blur out his face.
    Everything out of the Palin’s mouth is usually a lie, just like BP blamed him for her move (which Im sure the residents of LA thank him) but she bought her house months before. This family are champions manipulators when it comes to the media. No different then when she tried claim Levi took advantage of her just to sell her book.

    I am curious how her book sales were? I cant imagine it sold well since most people are smart enough to see thru her publicity stunts.

      Then he should sue Lifetime only! I am not defending her, but please. Grow a pair dude. He started it. It is like starting a fight and then suing the person that beat you up. if he wants to sue in the basis that they didn’t get permission to use him, I get that, but seriohsly. People sue over every damn thing. Suck it up, put your tail between your legs, be a man and move on!

      Before you all freak out, I don’t think her calling him what she did was ok, but he said some awful things as well and no one cried and surd him for it. 🙁

    Wow. So many idiots in this story. Biggest idiot, IF this stuff is true and not just a publicity stunt: the guy who is causing the world to watch the video of him being a total jerk. If he’s upset about the footage, why bring everyone’s attention to it?

      There is more to his suit than just not signing wavers allowing cameras to film him, and to appear on the show:

      Bristol had publicly accused him of running her off back to Alaska, and had said that he had made her very afraid for her life, living in LA.

      Which he says he can prove is very much untrue, that she had bought a house 2 months prior to the incident, and was preparing her move back home. I think it tends to defamation of character, or something.

      One very important key point, when that guy heckled her, even if I did not agree with his cheap and bullying attack, Sarah Palin was still mulling running for President. And was one among very extremist many at that time who at every turn said some nasty, awful, borderline slanderous things about Barack Obama and his family. She was very much an outspoken birther herself, as well as demeaning every little step our First LADY had taken at the time to promote healthy eating (sugar cookies anyone?)

      The guy was wrong to attack a much younger woman in a bar by outright calling her mother a whore. It was vicious, and unfortunately for him, made Bristol look sympathetic. Her asking if he’s a homosexual was just another Palin saying idiotic things. On camera.

    This chick here is the byproduct of her mother. Her mother is constantly doing the most during that time to be relevant… Now maybe the club signed a contract stating anyone who is present can be filmed at the venue; now that could of been in the contract or placed in as clause either way that means the club should of informed his clientele that they will be filming… There’s more but you guys get it….

    I would think, that since this has already been shown all over the Internet and news from other sources (didn’t some dude record it on his phone) that it probably negates needing some kind of written release or something like that. Not a lawyer, but lifetime wouldn’t use footage that would get the sued for $75,000+ – I wouldn’t think they are making that much money on this show…

    Watched the clips: Wow Willow is really not a very active looking girl. Sarah is just beyond annoying and Bristol is selfish – to say the least. What 16 year old isn’t in school? I just wish this family would go away. Piper is really cute though.

    Last I knew, if you’re videotaped in a public place by a news cameraman your image can be used on the news broadcast or any re-broadcast of it. But, if you’re filmed/videoed by a cameraman doing a show which will later be sold for profit and aired they must obtain a signed “release” from each person that appears in the film/video. That’s why on many “reality” shows some faces are blurred out, or the names of businesses or license plates are blurred out in some shots. These people didn’t consent to have their images or names appear.

    If that’s still the case, I don’t know what kind of case this guy has. If he signed a release allowing Lifetime to show him (along with his behavior) on TV it’s not really Lifetime’s fault he feels defamed–it’s his own stupid fault.

    If they didn’t have him sign a release and are showing the footage, I think he has a fair argument. Beyond that, no.

    That said, the guy’s an asshat, and frankly anyone who would scream “your mother’s a whore” at someone deserves a bit of public humiliation.

    She hated LA so much that…she moved back there and wants her sister to go too? Hmm. Quite disturbed by their quest for fame, especially for a family that condemns all things “Hollywood”.

    This is unfortunately typical Palin behavior. They do a smear job on their detractors (you can look it up, they say their lives are threatened if someone dares contradict them or actually tells the truth). Sarah inflamed the internet with lies about a guy who was writing her bio (and living next door to her) that he was a pedophile etc.

    I don’t feel sorry for her that no one is there to take care of her ginormous baby (a hick in the making). You should have thought about that before you boinked someone.

    I am going to be completely honest. I personally wouldn’t have said what she did but I would have defended my Mom. In fact, most likely that would have been nice compared to what I would have said or done. I do not tolerate people running their mouth about my family. Say what you want about me and I will usually laugh it off. The gloves are off when it comes to my family.
    Why did he wait till now to sue? If he didn’t sign something and they show it, he has a point but I am over people suing over everything these days. Maybe he is embarrassed about his behavior and now he is trying to not come off as an @$$.
