Lindsay Lohan’s alcohol ed report is too “explosive” for open court

Lindsay Lohan’s big hearing is today, so we should be hearing within hours whether or not Lindsay is going to jail for up to a year for the violations of her probation. One of the biggest parts of Lindsay’s hearing will be the report that is supposed to come in from the Right On Program, Lindsay’s state-authorized alcohol-education program of choice. Right On is fighting the quash the district attorney’s subpoena for their records pertaining to Lindsay, which the DA says is unheard of in these types of cases. Right On’s lawyers say they will turn over their records, but not in open court – they want the records to be examined in closed court, then destroyed. The DA is all “WTF?” And Radar claims that Right On’s records are potentially “explosive and shocking”. Hmm….

That information will likely be made public Tuesday morning when Lindsay’s probation officer will take the stand in a Beverly Hills courtroom and questioned by prosecutors who want to know if LiLo is in compliance with conditions set under terms of her probation related to her 2007 DUI conviction. Those conditions include her not drinking alcohol and attending alcohol education classes.

The Mean Girls star has been ordered to appear at Tuesday’s hearing, and if she found to not be in compliance, she could be taken into custody immediately, and put behind bars.
The probation department has randomly drug-tested Lindsay star once a week since her May 26 court appearance.

Meanwhile, as RadarOnline.com previously reported, the District Attorney prosecuting Lohan will ask a judge during Tuesday’s hearing to force the court-ordered alcohol program overseeing the troubled actress’ rehabilitation to turn over its records immediately.

Danette Meyers, the deputy district attorney, served the Right On Program with subpoenas last month. But she revealed to RadarOnline.com exclusively that the “alcohol education program has failed to provide… records about her attendance, meetings, and progress reports.

“The state-authorized program is citing HIPPA and Title IX as to reasons for not turning over the documents — I have never had this happen with an alcohol education program involving anyone,” Meyers told RadarOnline.com exclusively. “This is a state-authorized program, and these are routine and common requests.

“The alcohol education program is coming to court this morning with their own lawyers to object to the subpoena I served them with,” Meyers told RadarOnline.com exclusively. “It will probably be one of the first issues we deal with in court. The program is saying that they want me to look at the documents in closed court, and that the copies of the documents be destroyed immediately, and I will object to that.”

Los Angeles Superior Court Judge Marsha Revel will rule if the Right On program is required to turn over the docs to Meyers, and whether or not staffers from the school will testify.

Meyers told RadarOnline.com exclusively she wants to examine “SCRAM [representatives,] the probation officer assigned to Ms. Lohan’s case, and hopefully people from the [alcohol education] school.”

Meyers said that it’s up to the judge to determine if Lohan has violated the terms of her probation, and if she has, what the punishment could be. (Lohan could face up to a year in custody if Revel rules that she stands in violation.)

“If Ms. Lohan is found to be in violation, Judge Revel will ask me what my position is, but it’s only a recommendation,” Meyers told us. “We will just have to see how things go. If Judge Revel does find her in violation, Ms. Lohan could be remanded into custody immediately — it’s up to the judge.”

TMZ claims that Lindsay is still falling short of her required alcohol education classes, so is that what’s in the report that’s so shocking? Eh. I would only be shocked (and even then, not so much) if Lindsay went to her alcohol classes and chose to smoke a crack pipe in front of everyone. I think TMZ and Radar are trying to prepare us for the possibility that the judge could send Lindsay’s ass to jail for cause. I will consider myself prepared.

    This is a never ending drama.. And it really needs to end.

    The court system needs to be fair. If this had been anyone else..non celebs. then she would be in jail. Sometimes too many chances is too many chances.

    Alcoholics have many “bottoms”. Hospitals and Institutions are just two of the hundreds of consequences resulting from not treating the condition. The ultimate and final bottom is either a slow and painful death from organ failure, death by misadventure or a quick cardiac arrest. Lindsay’s running out of bottoms and jail would be a preferable one which actually may give her some clarity to save her own life. Come back, Lindsay. We’re still saving you a seat.

    I predict that the reports will say she’s in full compliance. Right On has had plenty of time to be paid off by the Lohans and doctor the reports in Lindsey favor. Why do you think Dina didn’t have money to pay for a $20 ice cream cake? All their money is going to pay off the people at Right On.

    Short of a pharmacopia of illicit drugs in her system countering RightOn’s claims LH is “in compliance”, I won’t be shocked by whatever is in those reports.

    Perhaps RightOn is covering their own arses, worried they’ll lose state funding/certification due to enabling LH through court-ordered classes. But that would not “shock” me either.

    Right On is like Cirque Lodge and Promises: they make money by coddling rich folks with substance problems who then claim they’re addressing their problems.

    @Joe I like what you said there about “saving her a seat”. That kind of captures it perfectly. I think we’re all still holding that place in our hearts where we can love her again when she gets better. As much as her actions are deplorable, I genuinely hope she sees her way through. It’s hard being in your early twenties, having access to drugs and alcohol and parties, and having had super shitty parents. It sends you kind of nutso, actually, to have as shitty of parents as she did. I speak from experience. It’s so hard to heal from a situation like that. Only a profound moment of both personal discovery and some goddamned self awareness will ever wake you up. It’s sad that there’s absolutely no one out there who can help her.

    I am dying to know why Right On doesn’t want to comply. It sounds like they do have the basis to refuse (eg HIPPA) but confidentiality is generally waived if you’re in a program because the court sent you there. Reports from the program are at issue in the case, same as when you plead insanity – the shrink’s notes are admissible.

    I’m imagining all sorts of horrible things that could be in the reports… but I’m sure somehow this is all blown out of proportion.

    My sister is a recovering addict/alcoholic and she was arrested for DUI twice in a 2 day period. She damaged property, but luckily didn’t hurt anyone. She was sentenced to 120 days in jail and served 8, then was released due to overcrowding. It isn’t just celebs who end up not serving their time for drug and alcohol offenses. “Regular” people also get released early.

    A few weeks in lock up would force Lohan to dry out.

    And maybe come out with better decisions making skills about making that unfortunate film.

    It would give me great pleasure to see the smug look wiped off her face when they haul her butt to jail. Although it wouldn’t be a long sentence, it would still be fun to see the overly entitled brat finally getting punishment of some kind.

    I don’t know about her Right On report being too “explosive” for court, that sounds like a bunch of hokey-ness to me. I don’t feel sorry for her for being an addict, either. She has had ample opportunity to embrace recovery, and she has repeatedly chosen not to do so. No sympathy from me.

    It’s not a violation of HIPAA if she signed the waiver that is required before starting any court ordered program. If they didn’t have her sign it, they are in danger of losing their state certification because really, what good is a court ordered program state sponsored program that won’t cooperate with the court?

    Update – I am listening to the hearing now, and clearly this “program” is completely disorganized and pretty much ignored the court’s orders. Sounds like a good reason to hide from the state.

    Paul E. Stanley: No way would they risk their state funding for a pay off. The Lohans can’t offer what they continue to be paid by the state. I think she could afford the cake but her overwhelming sense of entitlement lead her to believe she shouldn’t have to pay.

    What can you say during alcohol ed classes that is “explosive”? I’m not trying to be mean to Lindsay but I’m going to traffic school soon and am looking for some tips. I assumed you just sat and listened and did a test, apparently I can curse people out which would be awesome.
