Lindsay Lohan negotiating a plea deal on her crack thievery case

Back when Team Crackhead was all “THERE WILL BE JUSTICE” regarding Lindsay Lohan’s crack thievery, it truly seemed like Lindsay and her crack legal team (ha!) would forge ahead with a long-winded and excessive legal battle. And then Team Crackhead got their hands on the jewelry store surveillance tape. All of a sudden, Little Miss Crackhead is ready to talk deal. Interesting, isn’t it?

Lindsay Lohan’s lawyer and the prosecutor have been trying to hammer out a plea bargain but have hit a wall, so now they’re having a powwow with the judge to break the stalemate. Sources connected to the case tell TMZ … Shawn Holley has been speaking with Danette Meyers about copping a plea in Lindsay’s felony grand theft case — the whole necklace thing — but Meyers won’t budge on six months in jail.

So … we’ve learned Holley and Meyers will go to court next week and meet with Judge Keith Schwartz in his chambers. We’re told Holley will ask the judge what sentence he’d hand down if Lindsay pleads guilty or no contest.

Sources familiar with the case and Judge Schwartz believe His Honor would probably go for a three-month sentence.

Our sources say both Meyers and Holley believe Lindsay will only do 20% of the actual sentence because of overcrowding. So, if Judge Schwartz gave Lindsay three months, she’d only serve 18 days.

Judge Schwartz is known as a settlement judge, so it’s likely a deal can be struck … IF Lindsay’s willing to accept reality — that she’s going to do some jail time, no matter what.

So, wait. Now whatever jail sentence Lindsay gets will automatically get reduced to 20%? California is so screwed up. Let’s see… if Lindsay gets sentenced to six months, that means she’ll end up doing about five weeks? Well, then, that should be taken into account when handing down the sentence. Sentence her to excess, so that 20% of whatever the sentence is will still wipe that damn crack smirk off of her face.

    What kind of favoritism crap is going on when a lawyer can meet with a judge in private and ask what sentence he will give before presenting the case? The judge is suppose to hear arguments,consider plea deals between opposing counsel, and give an impartial ruling. Lilo and these Cali judges are systematicly destroying my last vestiges of hope for this country.

    Yes, Kaiser: CA is very screwed up. I wish I could say I was leaving, but I’m only going from SD to SF.

    You may have noticed I refer to it as the “legal system” and not the “justice system”: in CA, I believe justice is rarely served. “Legal machine” is much more apropos.

    @ Rita – I don’t practice criminal law in California, but it is possible to meet with a judge to get feedback regarding sentencing. This judge will usually not be the one who does the trial if there is one. But its not unheard of to meet with a judge to try to get the parties (prosecutor/accused) to settle on a GP with a joint submission for sentencing. Wow – this post is not near as much fun as the one on Gerard Butler’s beard!

    Of the several reasons why everyone dislikes her, two of the main one’s are surely that 1)she refuses to take responsibility for anything and always blames someone else, and 2)that she never seems to face any consequences for her actions.

    Serving a couple of months in solitary confinement is hardly the end of the world and could go a long way to rectifying the problem. If she’d just woman up and quit whining, people may be more positive towards her.

    I can’t stand the TMZ coverage of Lindsay anymore. Just days ago they were saying that the surveillance tape would vindicate her because blah blah blah.

    They have some deal with LL, without a doubt, to paint her in the “best” light. I’m sure that’s why they didn’t break the LL no Oscar party for you story.

    @Rita-there’s nothing weird about going to judge to break a stalemate-the original report is kind of inaccurate. It’s not unusual if you have a deadlock in negotiations to go speak to the judge and pass on to the client that the alternative might be worse.

    It majorly sucks but even in criminal court, judges don’t go out of their way to try cases-time consuming and expensive

    How about instead of reducing her sentence, we let someone who has actually served time out a few days early for good behavior? We could make that a standard practice so our jails wouldn’t overcrowd. That way when a celebrity like Nicole Richie gets busted for driving the wrong way down a highway while high on pot she can serve more than 82 minutes and actually suffer more than a slight inconvenience in her daily routine.

    She should be sentenced to 364 days, which I believe is the maximun county sentence. 365+ days goes to prison.

    Thanks for the info. I won’t have a problem with it as long as the prosecutor is there as well but I don’t think it is appropriate to ask how a judge will rule if one pleads this or that. The judge is not there to “help” counsel with preparing the case. In my state, it is illegal for one counsel to approach a judge without the other counsel in attendance.

    @Rita-I think they both go in: that’s why I thought it wasn’t accurate. Ex-parte contact with a judge is a no-no no matter where you are. The judge can drop hints, then the lawyer goes and tells the client the worst case scenario. As in “The judge is seriously pissed”. Just a guess, but I think the conference is to get Crackhead to understand jail for more than 3 weeks is in her future.

    I hope the judge refuses to “negotiate” to 3 months. Let her get 6 months (and 20%) of that at least!
    And she will get more time in jail for the probation violation too, right?

    Funny how all the wind is out of her sails now. So much for her claims of innocence.
    Given that she was also on probation when this happened, I hope they don’t just give her the minimum. At least the prosecutor seems determined.
    Short of her getting sent away for decades, the length of jail time probably won’t change her, she’ll go right back to her cracky lifestyle.

    If she pleads guilty, won’t she always have to answer YES when asked if ever convicted of a felony?? 😀

    I remember reading that the Judge could order her to serve her full time no early release. I read that if the judge puts it in an order the sheriff or whoever can’t just turn her out asap and say it was because of overcrowding. That’s what I’d like to see, the judge give her 3-6 months, and her actually have to serve it all. But she will probably serve less than three weeks and get out and go right back to her cracked out ways.

    I just wonder about the state of her internal organs when I look at that first pic 🙁

    If any image should be used to deter and frighten the living daylights out of the young and drugs – it has to be an earlier pic healthy of Lindsay compared to the top one – horrifying!

    Anyhows, of course she’s taking the plea, even she knows she’s really guilty, but as another poster said, she’s already on probation and broke it – surely they have to come down hard on her??!!

    BUT…will her probabtion be extended for 3 years??? U know she can’t possible stay legal for that amount of time…so what happens then???

    She won’t even be doing 18 days she will be doing less than 2 weeks. The biggest issue is the probation.

    As for the 20% thing, the California prison system is so packed they have issues with poor sanitation, epidemics, major medical oversights or errors (even prisoners deserve health care), and a very high rate of suicides.
    I believe the it’s the ACLU that has has been given the opportunity (certiorari) to make the 8th Amendment argument (cruel and unusual punishment) before the US Supreme Court re: the CA overcrowding situation. CA has a “three strikes you’re out” law that doesn’t require all the crimes to be violent crimes (I believe), thus the packed jails.
    FYI, the US has the highest incarceration rate of any developed (and perhaps any developing) country in the world, by far. I wonder what percentage of that number is prisoners in California?

    @REALIST–your facts are a bit skewed but parts are correct. Sorry, I’m too tired to sort them all out. Here are a few though. The overcrowding applies to prisons and jails. The 3 strikes law applies only to major felonies and thus does not affect jail population whatsoever. Overcrowding is caused by a number of issues including financial (building new facilities–which no one wants near them)and an increase in population (both legal citizens and illegal aliens–a very large percentage of prisoners are illegal aliens)

    On the LiLo topic–She’s finally in some seriously hot water. Her previous crimes were misdemeanors. This crime however is a felony. Even if she receives only a short sentence, she’ll be on probation for a few years. If she violates that probation, she likely would end up in prison.

    I know extremely little about the legal system (especially California, as I’m on the East coast.) But… Is she getting special treatment/consideration because of who she is, or is this the ‘norm’ with the sort of crimes she’s committed?

    After already being on probation for drug/alcohol abuse, being accused of assault of someone working for the rehab facility, & now indisputably stealing a necklace worth $2,500 (ON CAMERA)… Wouldn’t most of us be tossed in jail for a harsh amount of time, without anyone giving it a second thought?

    Or is this because she can afford an ‘above average’ lawyer? Someone else gets caught with a tiny bit of marijuana, & they’d end up totally screwed….But Lindsay Lohan repeatedly does what equates to a huge ‘middle finger’ at the legal system, & she’s not punished for it.

    I can’t help but be thankful I’m not a celebrity because I can’t imagine the awful pictures people would post of me in mid smile/grimace/eat/frown/etc… why must you always post such unflattering pics of her? How about we hope that she gets well, gets treatment? As a mother of an addict I know the heartache involved and whenever I see Lindsey I just feel sad for her.

    Dlisted has it that the surveillence tape somehow got released….radar or someone equally “trustowrthy” is saying the store sold it.
    Here’s what I found interesting…
    Timing of the release.
    Police had the tape, then prosecution had the tape.
    No release to gossip sites.
    Lilo’s team gets a copy.
    Tape shows up on gossip sites (in short order) with claims that the store sold it.
    I call crackie hustle.
    I’m betting defense wants to say store had this as a scam/setup and/or already made the money back or something like that.

    My question is does releasing a tape change what’s on it? I mean stealing is still stealing, isn’t it?
    Any lawyers here?
