On Friday, TMZ had a story about Lindsay’s crack legal team trying to negotiate a plea deal. As the judge and the prosecutor said the last time she was in court, any plea deal would involve jail time, and Team Crackhead had seemed to get this “jail time” negotiated down to something like 18 days. Anyway, shortly after that, TMZ had another chapter in this ongoing crack saga – even though her legal team is negotiating a plea deal, Lindsay still refuses to “cop a plea” that would involve any jail time: “Sources close to Lindsay tell TMZ … she doesn’t care what kind of deal Holley gets — if there is ANY jail time involved, she wants no part of it. We’re told Lindsay wants to go to trial and believes the surveillance tape will clear her name.”
Ah, yes. The surveillance tape. Lindsay’s team has only gotten to review the tape over the past week and a half, and I personally believe that Shawn Chapman Holley knows how bad the tape looks for her crackhead client. But that’s not stopping Lindsay from pushing a version of the story that makes her look like SHE is the victim (of course). And of course she’s been helped by the fact that the jewelry store just SOLD the surveillance tape to Entertainment Tonight (and probably other outlets too). ET is going to show the tape tonight, and they’ve already released some stills (here, and on this post).
The jewelry store surveillance tape that could be make-or-break in the felony theft case against Lindsay Lohan has been sold, RadarOnline.com is exclusively reporting. The security video was sold by the store itself! The footage was sold to a company that intended to make the footage public. Entertainment Tonight licensed rights to the video from that company.
This development could complicate the case against Lindsay, and RadarOnline.com has learned that it is causing turmoil in both the prosecution and defense camps.
“Neither side wanted it released,” a well-placed source tells us. “Neither side sanctioned this sale.”
Lohan is accused of stealing a necklace valued at $2,500 from Kamofie & Co., a jeweler located near her new home in L.A.’s Venice Beach district.
The starlet is due back in court March 10 when she has to tell the judge if she’s accepting a plea deal that he’s already warned her will come with a jail sentence or try her hand at trial by jury.

This isn’t the best news, honestly, but Team Crack/TMZ is working overtime to convince everybody that this is the best news ever because now people will get to see that Lindsay’s crack thievery is… something else? Absent-mindedness, I think. I don’t know… I buy that the tape doesn’t show Lindsay filling out paperwork to “borrow” the necklace, and I believed the report that claimed the tape showed that Lindsay’s shop-lifting hustle involved the dude in these photos causing a distraction. And basically, what all of this boils down to is Lindsay blaming the jewelry store for not catching her stealing in real time. Stay strong, Team Crack.

I have never been in a high end jewelry store that didn’t have a big ass scary guy at the door. With a gun.

Even if she’s acquitted on this charge all of the important people in Hollywood (and everyone in the rest of the world) know that Lindsay is a liar and a thief because she’s just publicly told too many lies and stolen too many things. Her parents are also a media liability so except for if she makes a big comeback ten years from now I think Lilo’s acting career in A-list or B-list Hollywood is over because she just brings too much drama and negativity with her and she’s not a great actress. The only people who are going to want to be associated with her are those looking to cash in on her notoriety. Game over.

@Hautie this isn’t necessarily a high-end jewelery store but a trendy boutique in Venice they are small places with huge mark ups.
@Innocent I wouldn’t be cheering if I were you whether or not the store ruined the case your idol’s crack thievery is on display for the world to see-her career is over. Why would this ruin the DA’s case? At the most the store owner would be held in contempt for selling the tape. I don’t see why the DA would lose this case just because the video was sold, it doesn’t change what is shown on the tape.

I don’t understand why this messes with the case for Lohan and doesn’t for everyone else.
I can think of a dozen instances in which I’ve seen surveillance video on the news of some thief and the person hadn’t been put away yet. Why is lohan any different? She is no different than someone stealing from Walmart in my eyes.

‘Trendy’ boutique or not, had the store even been in business long at this point? There’s a very… unfinished… quality to that space: fabric hanging loosely from the walls like sheet/curtains in the ghetto, cheap and ill-fitting chair covers, the stand-alone fan by the door, and… is that a milk crate in the corner in the top pic?!? Sure looks like one.

And I don’t see why the release of this tape will affect her case. You see on the news videos of people committing crimes all the time, and it doesn’t affect their cases. The most I think will happen is that the store owners will get charged with contempt and the case will proceed as normal.
However, I do think that no matter what, Lindsay is going to serve jail-time. If she pleads guilty or no contest, that means she violated her probation, so that means jail-time for that and stealing the necklace. If she goes to trial, she’s pretty much hosed too, and then she’s going to be labeled a felon and the possibility of three years in state prison.
I almost wish she’d take this to trial, just so I could see the tears when she’s handed the guilty verdict.

I believe she stole the necklace but I’m thinking the charges should be dropped and the blame put squarely at the feet of the store owners or whomever sold the tape. It’s unacceptable that it’s legal for them to do that. Pity they can’t be fined $35,000.

this case will go forward. the release of the tape will not affect the choosing of a jury. and if lindsay is so damn innocent, WHY WHY WHY did she have one of her flunkies return the neckless to the police and not just go back to the store, explain what innocent mistake was made, and return it herself???

Videos and pics about crimes leak to the media all the time and people still get prosecuted.
Any Jury Pool that would be tainted by the video has already been tainted by the pics of her wearing the necklace, various reports about her activities. It isn’t like LL is normally seen going to Church and saving puppies.

I don’t see how this trashes the DA’s case or vindicates LL. It shows her trying on the necklace & walking out of the store with it without filling out the paper work to borrow it. Her “team” may think that it “proves her innocence” but its obvious that the DA doesn’t, seeing as how the case is still going forward

Someone at TMZ should hear from the CA bar for practising without a license. Photos, videos and other evidence in criminal cases go viral all the time-usually on the front page of the local news paper. Remember that A&E was sued after they taped cops breaking down a door and shooting inside? That tape was all over within 24 hours.
This isn’t news. It shows the crack-act in full bloom. The store is pretty tacky but videos are pretty reliable.

I think it was a stupid move for the store to sell it – if they did, good point about it only coming out after Team Crackie got access to it.
But I agree it shouldn’t matter – this is about whether or not she stole it, what happens with the tape afterward is irrelevant.
That store does look oddly low budget.

I still don’t think this will effect the DA’s case, and I definitely don’t see the tape’s release and jury tampering. In other cases information regarding evidence is released all the time, from videos, eye witness statements, DNA etc. If that is allowed and isn’t Jury Tampering then how would this be?

I want to see the tape because there are 2 completely different versions going around. One where Lindsay steals the necklace with the guy distracting the salesperson. The other is Lindsay is wearing the necklace for the longest time in front of the sales person who doesn’t even stop Lindsay when she leaves the store with it on. If nobody stops her it’s hard not to give Lindsay the benefit of the doubt. It’s not as if she’s a huge celebrity like Nicole Kidman where salespeople would feel intimidated. Lindsay is a nobody.

But what does it have with the OWNERS of the store who sold the tape? The girl who works at the store will testify in the court.
Of course the owners didn’t like that publicity as it was reported. But the thing is that that GIRL who works there HAD to file the report to police. Because otherwise it would look like SHE stoled that necklace. She is no one. She is just some ordinary worker. When owners would discover that expensive necklace is missing then the police would investigate like she stole it. That’s why she had to call police when she saw that it went missing.

I work in retail and we have certain rules for shoplifting.
One of these rules are not supposed to go after anyone that shoplifts.
Of course, these rules apply to the store I work at and may not apply to the store Lindsay stole from.
The sales clerk not stopping her doesn’t mean anything. Stealing is stealing. I have walked out of stores with stuff accidently. You know what I did? I returned it.
I’m not sure if this video tape will affect the case, but I’m pretty sure it will give Lindsay’s team a chance to try to declare mistrial. If that’s the technical term? Please, correct me if I’m wrong.

All the entertainment shows have clips of it, and I heard one of the reporters say they watched all 42 minutes of it, and it was “riveting” and “fascinating”. I felt sorry for her.
