Duchess Kate & Pr. William win in French court, criminal investigation launched

These are more photos from Duchess Kate and Prince William’s Solomon Islands trip, which I believe was the next-to-last stop of their Asian and Pacific tour – Tuvalu is the last stop, and they’re already there. What Kate Wore doesn’t have the ID on the pale yellow dress – all they have is a confirmation from the Palace that it’s by “an independent dressmaker”. Meanwhile, the bright yellow shirtdress is by Jaeger, a popular, relatively inexpensive UK label. I’m not particularly in love with either dress, but I don’t hate the pale yellow one. It looks pretty cute.

As for the Boob & Crumpet-gate, the French court has already made their ruling on the emergency filing by Will and Kate’s lawyers. The basic gist? The court said the French tabloid, Closer, is barred from publishing any more photos of the couple, and the mag has to turn over all of the photos to Will and Kate.

A French court Tuesday ruled in favor of Kate Middleton in wake of her topless photo scandal, as the Duchess of Cambridge waved to onlookers as she and Prince William left the Solomon Islands, not showing the slightest stress in the middle of the growing controversy.

The court in Nanterre, France Tuesday confiscated the digital copies of the topless photos published by the French magazine Closer, and ruled the publication is barred from further publishing topless images of the beauty.

The court also launched a criminal investigation of the photographers involved (and Closer magazine) as to whether privacy laws were broken with the pictures, Reuters reports.

Leaving the Solomon Islands, Kate looked resplendent in a primrose dress with lace overlay as she and Will prepared to leave for Tuvalu on the last leg of their Diamond Jubilee tour of Southeast Asia.

As we previously reported, Last Friday, Closer published a 5-page spread of topless photos of Kate, hyping the issue saying, “Discover the incredible pictures of the future Queen of England as you’ve never seen her before…and as you will never see her again!”

Tuesday’s court ruling only affects the French publisher. Italian magazine Chi published a 26-page spread of the images Monday. (Noteworthy is that former Italian Prime Minister Silvio Berlusconi owns the publishing house that released both publications.) The Irish Daily Star also published the topless photos.

Yeah, the problem is definitely that the photographer (and Closer?) have already re-sold the photos to the Italian tabloid, plus I keep hearing rumors that the photos have been sold to some American outlets, maybe even p0rn outlets. This French court ruling doesn’t apply to those sales – if Will and Kate want to bar American or Italian publication of the photos, they’ll have to go to court in the US and Italy. But I’m sure Will and Kate consider this ruling a victory – because it is! And a criminal investigation is being launched, so maybe more will come of it.

      PrOn is a relative term. It’s not illegal to publish pornographic images IF those images were obtained in a public place. If you were to have sex in public (or in any place where it was clear you did not care about privacy), yes, somebody could take your pic and publish it. The only limitation would be if the pics are considered OBSCENE (then, they could be stopped). But sex can totally be published – so don’t do it in public! Just an FYI.

        Okay, but as far as I’ve heard, they were on PRIVATE PROPERTY. Doesn’t that break some damn laws when perv-o paps sneak pics of the woman trying to tan her boobs on the grounds of a private estate?

    Ok, so this is from an American’s point of view. If sunbathing in the nude is not that big of a deal in Europe why is the Royal family making such a big deal about this? If she was outside and nude why doesn’t she just blow this off? I really believe the only reason we are still talking about this is because Will and Kate are.

      I am german and there are many FKK beaches here (meaning Freikörperkultur/Free-body-culture). So I guess Europe is more open about being topless or nude in public, BUT that doesn’t mean that they are open about being photographed and the pics being published. There is a moral and legal line!

        I definitely agree about the legal line. I don’t think that these pictures should be sold if what people are saying is true and they were on private property and there was any trespassing. However I still believe that they need to move on from this and just leave it as a lesson learned. When you’re nude, stay inside, you’re Royalty.

        Wow! It is indeed interesting the amount of misconceived ideas that people have and spread! I’m not German but I do live in Germany and you are so wrong! In general, Germans will be more open about being naked in some public spaces (like sauna), but that doesn’t mean that they will be flashing their assets all over the place! Also, it is well known that this relationship with nudity comes mainly from the former DDR, and you still see a big difference between west/east on this subject. Anyway, there are specific beaches for nude sunbathing. It’s not common AT ALL that they will just get naked anywhere. Most of my german friends in fact don’t feel comfortable with it and they mainly keep it for sauna, some not even that.

        I wonder to which places you go that you only get naked Germans? Maybe that will answer better your preconceived idea 😉

      Good point. Also I think by now they should know better. Paps are everywhere so if you don’t want your topless photos in the media just don’t go topless. They deserve privacy but with the constant media frenzy around them they should know better!

      I’m obviously not talking for every European, but I’d say for most people there is two types of nude. Practical or natural – for lack of a better word(simply a person not wearing clothes, swimming, sunbathing, being in the sauna) and sexual (usually something one reserves for private moments). While you can be totally chill about being nude while sunbathing:
      1. If someone takes a picture of you – it’s creepy as hell.
      2. If someone makes the situation sexual or shameful (in this case “OMG you guys, look at Katies boobies”) it’s not natural any more and probably makes you uncomfortable.
      I don’t know if it makes any sense? :/

        Yes actually, that pretty much describes how I feel. I really like being in the sauna because it feels like a very body-neutral space. Nakes bodies aren’t sexual there, they’re just bodies. It’s very freeing to sun myself in the sauna garden.

        Doesn’t mean I wouldn’t be bloody incandescent if somebody took photos and published them like this.

        Yes, this is how I feel. I’ve breastfed and been naked in saunas and sunbathed in my own garden on holiday, miles from anywhere, naked. It wouldn’t give anyone the right to take and sell photos, in fact here, they could go to jail for doing it. My body, my decision. Not anyone else’s.

        There’s also something really icky about spying on someone in private and then selling those photos. It isn’t just her, or even the nudity, it’s the fact that people have the right to keep private stuff private. I remember being really weirded out by those Natalie Portman wedding images. I still can’t believe mainstream media were willing to use those.

      @Po – I think this is less about breasts and more about privacy. With a good telephoto lens, that photog could have easily been a half mile away (not just down on the street and looking up at a balcony). His view through the telephoto lens would have allowed him to see far beyond the naked eye, including into the bedroom I assume is right behind the couple (assuming the blinds weren’t drawn).

      So I think the suit is more making a statement (rightfully, I think) that you can’t hide in trees 1,000+ meters away w/ a high-powered lens to peek in bedroom windows or private balconies.

      And you say that based in your American knowledge?
      Europe is composed by many different countries with totally different cultures. Just because in some countries from Europe people feel comfortable sunbathing or going to the sauna naked (like it is in Germany), there are many others where it would even constitute a crime to parade naked in a public beach or sauna. This is a big difference among nationalities in Europe and always a big topic to deal with when people move from one country to the other and have to adjust to it (one way or another).

      That is just to rectify your misconception of Europe and Europeans…

      Apart from that, maybe they just picked this fight because they do think that it’s not such a big scandal and that is the perfect time to make a point clear to the paparazzi? If it was such a big thing I guess they would be efficiently advised to make less waves out of it.

      Europeans claim to be a lot of things they are not. There is a lot of modesty in Europe as well as America.

      And its a myth that most Europeans speak lots of other languages! I’ve traveled throughout Europe and met lots of people who only spoke the language of their own country. Some spoke two languages, but that was about it.

      Oh, and Europeans call Americans fat, but they have just as many fat people in Europe, especially in the United Kingdom. Which I don’t understand, because the food in the U.K. is horrible and bland. I lose weight when I go over there.

        I was in Germany not that long ago, in non-touristy areas, and the lack of obese people was noticeable. As was the lack of fast food places.

        The fresh eggs and vegetables were wonderful too.

    Poor Cambridges. They probably need a year’s worth of holidays to recover from this scandal.

      Yes they need another vacay to help them get over the trauma of kate’s royal boobs being photographed can I sugguest they have one of their servants pick up a phone and call their royal rich friend Richard Branson to go and vacay on his private island where Kate can suntan and run around naked all she wants.

      I’m not surprised they won in court there is no way the French Government was going to allow a ruling against the British royal family which would probably have seen the royals boycotting Le France. It’s all a little too late though kind of like closing the gate after the dog has run away, the pictures of the future queen of england’s boobs are all over the internet as is her husband rubbing sunscreen on her naked ass.LOL.

        However, the original sites, whether they be news sites or tabloid, from which these stories come from use paps very heavily. Perhaps you are unaware of this salient fact.

        So unless you only read monthly glossies where only advertisers and ‘at home’ or ‘in the studio’ pics have been used, or you know for a fact that celeb in picture called the paps themselves, then you are participating in the pap culture by being on this site.

        I am not going to be a hypocrite and condemn the paps as though I don’t read any of it.

        There is a line though, no? I’m sorry to keep mentioning this, but those wedding photos of Natalie Portman’s seem wrong. I also think a ban on shots of celebrity kids might not be a good thing – poor little Suri Cruise would be helped by that. I mean, I’m human and interested, but it isn’t right. A ban on those would help an awful lot of small children. And stop parents exploiting them for image and PR, too. And an “obvious private settings” provision might be good, too. Cover the Portman wedding, as well as shots like these.

    I loved the dress the Samoan people gave her! (strapless with full skirt in traditional fabric).

    She has been really well-dressed on this tour. It’s no doubt warm and she’s worn appropriate and lovely clothes. And she’s looked as relaxed as possible on this trip considering the circumstances. The topless women greeting her might have been the absolute highlight of their trip!

      Harry played it right. There was no heat on him after 2 or 3 days.

      The press ran the story. No one cared.
      They went to Prince Charles for a reaction. He said it was no big deal.
      Harry was shipped out for his next tour of duty and all is forgotten.

      William has done more damage than those pics alone could ever do imho.

        Harry may be fine stripping down to his birthday suit infront of strangers. This is safe to assume, but Kate has shown it all to the cameras before and she never complained once, to anyone so we must assume the same for her to be fair.

        Harry’s scandal left a cliff hanger that there was something more scandalous to come… sex tape? drugs?
        Kate’s boob scandal has a cliff hanger with more to come… Sex..smoking?

        They’re so freaking alike you can’t make this stuff up!

        The difference is Harry moved on and those sex and drug photos/videos are no longer interesting enough to be a threat.
        William and Kate Kept it in the public eye and now it’s this huge thing.

        I’m still not convinced Kate cares. It’s all Big Willy’s ego trip.

        I’m a bit skeptical about the ‘intimate’ photos claim. The pics published yesterday in ‘Chi’ were no more raunchy than the ‘Closer’ pics. I reckon if there was anything more juicy out there we’d have seen it by now. Also, I don’t think KAte and Wills are daft enough to get down to any action in front of ‘the help’. Getting your boobs out is one thing, doing the business quite another.

    They have a right to privacy to. Those pictures crossed the line. They were at a private villa and supposably those pictures were taken from almost a half mile away. If that isn’t invasion of privacy I don’t know what is.

      Cathy, you don’t get it. While they may *have* a right in an ideal world, we don’t live in an ideal world. The reality is that in exchange for luxury, riches, fame, and privilege, Waity gave up pretty much all her rights to privacy. It’s useless to moralize over what should and shouldn’t be morally right. Fact is, there are few morals when it comes to celebrity, paps, publishers, and $$$MONEY$$$. In Western economics, it’s called supply and demand, and its ruthless. Waity and Willy were just plain stupid if they didn’t realize this.

      But part of me thinks Waity really coveted all this attention anyway.

        And let me just add that as soon as she started dating PW, Waity became a commodity for the media. She could have turned that into something else much more noble if she had sincerely pursued charity and other work (like many Royals do), but she chose not to. So thus she remains: nothing a media commodity, known for nothing but her appearance. Everything she has done for the past ten years has led her to this pathetic moment in her history, and nobody should feel sorry for her. It’s nobody’s fault but hers.

    Good for them. I think this snuffs out the scandal honestly.

    Sure there may be more photos but at this point they’ve managed to make sure the photographer/tabloid/and anyone else looks like filthy criminals. Anything that gets published after this point will just be taking further advantage and done SOLELY to make money.

    They know they look justified (and they are) and they know whomever takes it further will just look desperate for attention. Supportive public opinion can be quite a good thing even in the middle of scandal. Its why Harry’s stunt never got to be a big deal.

    At the end of the day I don’t believe a woman’s body has the right to be used for someone else’s profit simply because they can. Heaven forbid she not spend every second looking over her shoulder, she too…whether people like the title, fame, wealth, or her eyeliner, deserves to have her body treated with some respect.

        I merely pointed out that she often likes to make secret visits to charities and what not and said visits are often published by the media.

        It makes you wonder why they even bother saying the visits are secret if they’re going to be reported (I bet they were leaked by the Palace) plus it’s also counterintuitive to her image: the public wants to see her work and paying secret visits isn’t going to cut it.

        Don’t forget that said “secret visits” are always reported by the Palace after it already happened, like an afterthought. And that no pics ever exist. We’re all just supposed to believe she makes these visits when the Palace says she does. Not even 1 small photo just to prove she was there and she’s committed to her charities.

        It’s her role to visit them and show some ‘proof’ of the work done by her as well as by the organizations she chose after 8 months of very, very, very, very careful consideration. Researching charities to support is very taxing and difficult. 😉

        Having her go on these secret visits is a waste. It also doesn’t help that she only ever goes once a month and for only 1 hour each time. What can you accomplish/contribute in 1 hour visits and then it’s “See you next month!” It doesn’t speak much of consistency and commitment on Kate’s part to be able to go to the salon 3x a week for her hair treatments but can’t even commit to spending more time to her patronages.

    As for Kate’s second yellow dress; it’s another tablecloth number.

    this was a clear invasion of privacy, a line was crossed and i don’t blame kate or william at all for being topless on a private property .

    i can completely understand william’s decision to take legal action, he was in a difficult position. if they would not have taken any action, it would have meant that it was okay to publish those photos which was not . BUT imo he did not win the case and the legal action made things worse . 10.000 euros is nothing for the magazine, they probably earned more in revenues and in free publicity, the photos are all over the internet, other magazines are publishing them outside france, people who did not even heard or interested in her (in my home country in asia) heard about the photos on news in international section because of legal actions taken by them and went and saw the photos out of curiosity . imo william added fuel to the fire and now more people will see these photos then before and magazines will earn more then before and in future will not hesitate to publish these type of photos. harry’s response to his photos was work of a genius , it never made to the international section of news and nobody who was not interested in royalty like my friends saw or searched or even remember his photos which is not the case with them.

    i am sure kate did not wanted this to happen and just for this reason alone she should have known better . before everybody jumps on me let me remind you that few months ago the honeymoon photos were also published , they thought that the resort was safe and clear and security was very tight and yet the photos were taken so just for her own sake she should have know better. the photos will be on internet forever, papps break laws to take photos and magazine publish them knowing that it is illegal and she knows the drill , she is not new to this , what happened was illegal wrong and cannot be justified but this is a battle that she can’t win. once the photos are out they are out , no one and absolutely no one can censor the internet , so for her own sake she should have know better because people will break law and try to exploit and make money ,it’s your responsibility to be safe and take care of yourself.

    just for a recall now we have seen naked photos of DOE , cahrles, diana, andrew, fergie, sophie, william, harry, kate , you know in all this york sisters come out looking good. no matter what their parents did in their lives and how media want to portray them ,they have never done anything to embarrass royal family in any manner . imo they are most well suited as future monarchs after anne.

      I agree with all of that, but just as an aside, Eugenie was caught streaking (running naked through the grounds) at her school with a friend for a dare. No photos exist, but still – I think that leaves us with Beatrice! Though Peter Phillips might be an even better bet. Princess Anne’s older than Andrew, after all, and her kids work hard.

    Jesus. I know he did this to prevent other paparazzi from trying this crap in the future but in terms of PR this was just all around bad. This story could be dead by now if they had played it like Harry did. Nobody’s talking about his royal nakedness anymore so … well played.
    Let’s hope that after this stressful tour and all the suing this poor workaholic couple can relax on another nice vacation. And let’s hope they hire better security and PR people. Because the ones they have now really need to be fired.

    I want to ask because so much has been swept under the carpet…..

    Why did the palace NOT do this emergency ruling when they were informed of the photos days ahead of publishing??

    A photo of them on this terrace was leaked onto the internet, prompting tabloid stories about it and their vacation. That story went out at the beginning of the week, without a peep from them or the palace. The story also talked about the topless pictures which the palace very specifically said they would wait and see….

    Wait and see????? This is the internet. Prevention is always better than cure. Why wait for pictures to be published AND THEN INJUNCT when you were perfectly aware of said pictures ahead of time and with enough time to suppress said pictures!!! And they were offerred to the British press who work with the palace etc.

    Amazing!!!

    And then to act AS IF it was a sudden move. Magazines have deadlines unlike internet blogs. Harry didn’t stand a chance, these two did, didn’t take it, and now we will be able to google forever something that could have been prevented ahead of time.

    I think this is a temporary decision (at least from what I’m reading). The court isn’t deciding the ultimate issue of whether this is an invasion of privacy or a trespass. They are basically ordering no further publications in France and to have control of the images. It sounds like an injunction to prevent further harm until the major issues can be hammered out.

    I wonder though if this is going to basically result in “kicking the hornets’ nest” so to speak. The more fuss is made about this and the more they try to shut it down, more media outlets could start publishing them just to make a point about freedom of the press. Hey, it happened to Barbara Streisand…

    The yellow dress is a table cloth number?? No its actually very chic. Why does a person have to be dressed in head-to-toe black in order to be considered chic, good grief this is not the 1990s anymore. Prints and colorful clothing is so refreshing to see now.

      The first yellow dress is fine. The second one is a tablecloth. The tablecloth look accentuated by the fact it’s an A line and A lines always look ridiculous on anorexics ie- coat on hanger.
      The boobgate proves it all. Aside from the boobs, Kate’s ribs were all on display too and very concerning.
      I don’t see an heir arriving too soon unless she takes fertility drugs.
      Kate appears to be an anorexic smoker who joins her husband in avoiding royal duties including her own number one duty.

    I’m so over this scandal all ready. If laws were broken, naturally they have the right to seek justice, and I think William is trying to draw the line with the press. Not just for himself and Kate (who should be able to take care of herself) but for future kids (William knowing better than most what it’s like growing up while having the paps constantly after you). Kind of “I won’t tolerate anyone violating my family’s privacy”.
    But all of this is not exactly making the talk about Kate’s boobs go away any faster.

Too bad the boob photos have ruined any chance that someone will hold them accountable by writing an article on the real scandal which is that these two freeloaders skipped out on the Paralympics closing ceremony to sunbathe nude at a French chateau. This is why I’m not as outraged about the photos as some people. Sure, it was an invasion of privacy and they have the right to take legal action just like any other celebrity who is regularly featured in the tabloids. But can we please stop pretending that the new generation of Royal are anything more than entertainment for their subjects during tough times? Their survival and popularity as Royals also depends on buying the UK press and being photographed constantly but only in a positive light. Like Diana, the Royals now use the media for their PR stunts, but get angry when their privacy is invaded. They can’t have it both ways. If they don’t like that the public is obsessed with their private lives, then they need to stop feeding the media altogether. That will never happen so we can expect their privacy to be invaded and their future children’s lives to be open season as well. That’s the price to pay for being a British Royal. Not a bad deal in my opinion if I could go on vacation a dozen times each year.

        I tried to discuss the real story with someone (I really do not remember the name) where I basically said the real story is that they lied to the public by stating Willie had to work and she had to prep for tour which would prevent them from fulfilling their role as ambassadors. Only to discover they lied in order to deceive the public from another lux holiday while avoiding their duties! That is what should be the main focus or “scandal”!

        Although I did throw in she seems to be quite an exhibitionist because there was potential to be viewed from a public road and other property (as they know very well such as honeymoon photos on secured private beach). But I did forget to mention why the outrage now when she has done this before w Willie in places like Ibiza where she was in public walking, standing up topless and those photos were published. So why make a show now?

        I agree they can’t have it both ways. They’re suing one paper… what’s next??? They’ll have control of what gets published – meaning the public won’t have a right to know WHAT’S REALLY in their government AND WHAT’S HAPPENING TO THEIR TAX DOLLAR. Closer is a tax paying magazine. Tax payers fund the Royal trips all over the world. F.Y.I. Years back they had two panda bears touring the world in gilded cages – William & kate are nothing more than that today – put on for show by the government. The REAL STORY??? Why weren’t they supporting the athletes??? Oh, right, they’re on another vacation & preparing to sue anybody else who’ll get in their way.
        Another rant… Kate wore next to nothing when William saw her. She’s an exhibitionist and is famous for promoting herself and nothing else. To be honest, I don’t know why there are Royals – they killed each other and everyone else to get to their positions… they have a long line of graves under their crowns, What kind of society do we have where we have conniving murderers and their descendents as leaders?

What kind of work does “supporting” actually involve? there are thousands of workers dying every day doing the real back work, taking the real risks.     Surprisingly, Kate didn’t know about the photographers. This is surprising considering in almost every photo william seems indifferent to cameras while Kate is looking directly at them. (Take the photo where she is “eerily looking directly at the camera). Her and Pippa both. What did she expect? She wanted the position of parasite so badly she sued another paper for the same thing in her Waitie Katie days. Lie with dogs (William and Co.) and you get fleas. William is controlled by the Middletons and the Middletons will soon have titles in the Royal Court. He also seems to want his own way regardless of any consequences to anyone else.(the soccer incident) So ironic though seeing the aristocrats, rulers, and the highly educated bowing down to the “coal miners”.

    What’s sad about this incident is that up until now, Kate has been so perfect in her royal role and has tried so hard. They were probably at the place in France cramming for the tour ahead (lots of names and faces to memorize); she was tanning so she would look better in her outfits and didn’t want any tan lines on her chest.

    Those photos are incredibly offensive. I am so glad the court recognized this and responded appropriately. The royals didn’t place themselves in the public eye — they got there by being born, so they have the right to some privacy. It’s not like politicians or movie stars who have chosen to be in the limelight.

    The only person I feel sorry for is the Queen. She’s lived her life with class and dignity and now she’s assailed by nude pics of the younger royals. Yes the paps are sleazy. However, for Will and Kate to be two of the most media savvy people on earth, they were incredibly careless. She had a right to sunbathe topless, but that doesn’t mean she should–especially with a housefull of servants, any one of which could have snapped a pic with a cellphone.

      However, remember I also wrote just days ago of the possibility it may all be a huge PR move to increase popularity. Keep in mind, one of the roles of Royalty in 21st century is to generate interest (fund raising) for charity.

    It’s sad that the tour for the Queen’s Jubilee has been overshadowed by Kate’s breasts and William behaving like a right tit about this by practically issuing an invitation to the media to come after him, see his reaction, and see what he will do.

    Nothing represents the Queen better than having people the world over talking about her granddaughter in-law’s breasts.

    William and his team should have pursued this quietly instead of going on the offensive right away and announcing their plans so loudly and putting more focus on the photos by engaging in a back-and-forth with Closer magazine. Making the magazine pay the fine and banning further photos from getting published should have been enough.

    Kate herself had no problem using the paparazzi to win William back in 2007 when he dumped her. Google it. The crotch shots and the photos of her smiling directly at photographers while they took her photos outside of clubs. It worked for her, didn’t it? Bagged her Prince and all that with the media’s help.

    And since the sycophants love to bring up Diana and say how it was the paparazzi’s fault she died, then don’t forget that Diana herself used to tip the paparazzi off as to her whereabouts so she could make herself look better compared to Charles. She also played the media game and invited the paparazzi. She wasn’t a mere victim.

    Kate’s topless photos are disgusting and wrong, and the court was right to rule in her and William’s favour, but asking for jail time is too severe in this case and will only invite more talks and speculation.

    They’ll probably win jail time for the photographer, too. But that doesn’t mean they will come out on top. They will lose face and a lot of goodwill in this case, and I doubt the media will continue fawning over them if William shows that he wants to control whatever gets published about him and his wife, and that anyone who defies him will face serious consequences.

    This is more about William’s ego than it is about Kate’s privacy.

    They were in the confines of their abode at the time. That should be “off limits” to paps with telephoto lenses. If they’re on a public beach or public area, they are free game. Anyone in the confines of an establishment should never be photographed. I am also hugely against children having to be papped while with their parents out in public. Photos of this type should be illegal and there should be fines & legal action taken.
