Bill Cosby wants victim to give her ‘hush money’ back: she wants to ‘have her cake’

Bill Cosby’s rightfully tattered reputation was completely shredded a few weeks ago when an incriminating 2005 deposition surfaced. Cosby admitted giving women drugs, but then he tried to say Quaaludes were a method of “seduction.” There is so much wrong with Cosby’s twisted belief that he has the right to rape any woman by simply slipping her a pill.

Cosby’s lawyers are fighting back. Their new filings already revealed Cosby’s belief that he had full “consent,” to have sex with these drugged-up women. Now Cosby’s trying to reclaim the hush money he paid to victim Andrea Constand. Can Cosby really be this stupid?

Bill Cosby has filed legal papers seeking a refund on the money he paid to one of his sexual assault accusers, alleging the woman broke their confidentiality agreement.

The philandering funnyman is asking a court for “sanctions” against Constand, saying the former basketball manager at Temple University violated the terms of her hush money.

In a new court filing that refers to Quaaludes as “disco biscuits,” Cosby claims Constand and her lawyers “are intent on reneging on what they promised (him) – confidentiality and finality.”

He says the push by Constand to have his full deposition released is a breach of their 2006 settlement. She wants to “have her cake and eat it too,” he claims.

He ominously suggests Constand might be required to “disgorge some or all of the money paid to her by defendant as part of the settlement.”

Cosby’s new filing accuses Constand’s camp of helping leak the full deposition to the New York Times in recent days because it failed to inform its private court reporting service of the confidentiality clause.

“That conscious neglect has led directly to a colossal breach of that confidentiality,” Cosby’s filing states. He points out that Constand isn’t trying to toss their full agreement, just the privacy pact. “Obviously, she wants to keep what she was paid,” his filing states.

This is amazing. Cosby admits to paying women off, and now he’s trying to take that money back. And it’s all so public! There would be no reason for Cosby to pay any of his victims unless he was trying to avoid criminal charges, which is exactly what he was trying to do. Now he’s dumb enough to ask a court for his money back. Not only is Cosby a predator, but he’s an entitled idiot.

One more thing. A few days ago, the California Supreme Court denied a request from Cosby to review a lawsuit against him. This means the plaintiff will be able to depose him, so maybe we’ll end up hearing him say even more disgusting stuff about his victims.

        I work in a big law firm … I’ve seen some sh*t. I wouldn’t rule out anything. In my experience, crazy clients often pick equally crazy attorneys because otherwise working together will be a nightmare.

        The victims should keep fighting all this crazy. I had six (6) lawyers against my abusive narcissist husband who is a multimillionaire with a team of equally cruel and driven attys. All six dropped me, but my 7th had faith, and I got smarter too! I just won back nearly all custody of my son; our son has scant time with that cruel man. (When it comes to fathers, the courts want them to “try” to get better) However, If I can win, Cosby’s victims can win too. I wish I could send them money for litigation! We may be in a new era where the vulnerable get more help from the courts. Have faith!!

        Just read a thing about him on Gawker. He mutilated (and caused illness on) women during plastic surgery procedures, and sometimes just went ahead with surgery without anesthesia, only using a local, when no one was around to administer it. Supposedly Cosby assaulted an associate of his, even. The doctor lost his license and is now dead. I guess it takes multiple sociopaths to keep this kind of rape and/or disregard of women as human beings thing going.

    The parties have been prohibited from releasing the memorandum because of a confidentiality clause that was part of the settlement agreement, but the deposition itself was never sealed. This month, Ms. Constand’s lawyer asked the court to lift the confidentiality clause so her client would be free to release the nearly 1,000-page deposition transcript. The Times later learned that the transcript was already publicly available through a court reporting service.

    This is one BAD PR move for Cosby; to seek the settlement back. He looks like the bully. Since the info was readily available, do the efforts of Constand’s lawyers matter legally, in rescinding the payment? Maybe she doesn’t care?

      It is a really bizarre move. It’s as if he’s completely lacking the ability to understand what is appropriate. There are people who have done some messed up stuff, but they usually try to get back in good terms with the rest of the society. Cosby is behaving as if he truly believes that he’s above everyone else and doesn’t care what others think or want. Some next level arrogance. It’s actually pretty scary.

        @ORLY I agree with you that he probably truly believes that he has done nothing wrong. That said, he should know by now that the society does not agree with that point of view, yet he hasn’t said “I’m so sorry, I had no idea it was wrong. I would never want to hurt anyone.” He has his own twisted set of rules of conduct and he doesn’t seem to care that the rest of the society doesn’t agree with those rules. I do think that he is dangerous as he lacks the ability to feel shame or remorse.

      What is even more bizarre is that if he voids the settlement, I think legally she is free to write books, give interviews and generally go after him with everything she’s got. Oh how I would love to see him be able to break this agreement. It will bit him in the ass big time.

      Here’s the problem, first eliminate Cosby in your mind as the rapist and person in this lawsuit, replace him with just some person who agreed to a financial settlement that included keeping your deposition from being released. Now the deposition is released to the public. Any good lawyer would try to retrieve the settlement as the agreement wasn’t upheld. They have to prove the victim released the info though.

      Is it a bad PR move? Probably, but does he really have a good one. No, and I think it is fairly obvious that he really doesn’t believe he did anything wrong. Doesn’t make it right, but it is what we are left with. I wish people would also concentrate on either changing statute of limitation laws or making the system of reporting rapes easier for victims as these ideas could change the system for everyone. Maybe something productive could come out of this mess.

    I remember when he was touring last, and the hecklers came out in force, he was livid and the quote from him about why he continued to tour was “I have to share my gift,” the gift being his comedic take on life. I remember being struck by the entitlement of that quote–how anybody could think that their own thoughts were so important that the whole world would suffer if they were not spoken and shared.       I worked for a Sr. VP once who was dreadful, an utterly horrid human. I was hired by the CEO to find and fix whatever was causing productivity and morale issues. Staff when I got there were silenced, fearful, jumpy. I assessed, watched, had quiet conversations, and felt it was down to this sociopathic jerk. On advice from a former mentor, while I did all I could to protect the staff — I sat back and allowed the Sr VP to hang himself, while I observed, took notes and made perfect records. I met with HR. Case closed, jerk gone.

      This Cosby thing reminds me so much of those six months, it is chilling. Now his victims can have the grim “relief” (for lack of a better term) of watching him reveal himself, hang himself, via the cockiness and entitled sense of self, the same likely sociopathy that generated his alleged behavior in the first place.

        I admit that it gives me a sense of relief to see him hang himself with these odd reactions. It really is scary to be in contact with someone who doesn’t behave in a humane way, but is able to conceal it from the majority of people. It’s also scary when you try to inform others, but they just think that you’re overreacting. I’m glad your former mentor advised you in that way, because these people are great at turning your words against you.

        Technically, we can’t prove what he’s done and technically, he could sue to get his hush money back, but to any normal human being, all this reeks to high heavens. You don’t end up in a situation like this and react to allegations like this if you were a person with a conscience who cares about the world around him.

    Right. I said from the beginning that Constand situation was really problematic because she agreed to settle, cashed the check and then a few years later went public. There can be a few reasons people settle–usually to avoid the risks and costs involved, and considering the wealth disparity between Constand and Cosby, not to mention his status, it made sense why she chose settlement instead.

    But when she later went public, it was easy to question her motives. It looked like she’d perhaps run through the settlement money, tried to get more and when that failed, went public. Unfortunately that scenario is also something that actually happens in settlements too. So when some people were initially skeptical, as offensive as that might have been, it was understandable at least. That’s why the other women coming forward was so critical!

    But Constand’s settlement is still a big issue and it’s entirely possible that she might have to return the settlement money, as weird and outrageous as that may sound. Plainly Cosby is being a vindictive schmuck – surprise! – and trying to break her.

      One could argue her motive was regret in quietly closing the case because of the unequal power dynamic, and the media’s apathy to the story. It’s possible that after an abundance of allegations surfaced, whereby Cosby basically called the accusers sluts and liars, she felt compelled to tell her story adding credence to those allegations. Or it could be a combination of motives; money and a sense of justice. What actually is a fair amount of cash to erase devastation from someone having taken away autonomy of your own body, and then mocking you with offering such quotes as , “Tell your mother you had an orgasm”? I’m not sure any amount is enough.

      Bill is most likely a psychopath. A lot is planning went on. My understanding is that sociopaths are more spontaneous. It’s hard for sociopaths to form relationships. Psychopaths get married ,have children ,have good jobs. He ticks off every box in the psycho category. That’s my opinion.

    DB—I can see from a Legal standpoint why if Constand does need to come forward again on record, some of the money she could be forced to pay back as it was part of the initial settlement that she not make public statements.

    He can sue for the hush money, but it does not mean he will ever get any of it back. Enforcing a judgment is a hell of a lot harder than actually winning it. Plus she can likely delay these legal proceedings and avoid paying him a penny if she files for bankruptcy, which is what I probably would advise her to do anyway. At this point she has nothing left to lose, and it will just make Cosby look even worse.

      It would be hard to collect the money even if he won you are right about that, and they also have to prove that she or her team knowingly released the deposition. My understanding is was someone at the firm hired by Corstand’s attorneys. That will be a difficult case to win off of someone else’s deed. Unfortunately, just as I think it might be difficult for the victims to win defamation suits against Cosby based on what his lawyers said, which is unfortunately a big component to a lot of the victim’s lawsuit.

      I don’t think this is really going to court though. I think this is because her team wanted to release everything now, and Cosby’s lawyers don’t want to this is lawyers posturing for position. Which is what will happen in any of the other civil lawsuits that will be filed. Be prepared if they finally get to court. There will be grand gestures from all sides. Could be interesting and he has definitely lost the whole PR battle so we will probably be hearing a lot more stupid crap from Cosby’s team, as they have little to lose but money now.

    1) Constand had nothing to do with the release of the deposition. That falls squarely on the shoulders of Cosby’s legal team, who failed to secure the confidentiality of all of entities involved in the pre-trial process, including the court reporting service.

    2) His filing makes a pathetic claim about “disco biscuits” being what everyone did in the 1970s to enhance sex. Of course, a mass of allegations are about his rapes in the 1980s, 1990s and 2000s. I’d ask if his lawyers were really that stupid, but then again – look at #1.

    It was the Judge in the case & not the Plaintiff that unsealed the deposition. The judge is not bound by the confidentiality agreement. He stated he unsealed the deposition due to Mr. Cosby’s self moralizing & professions of ethical & correct behavior. So his constant “you should live this way blah blah blah BS” eventually bit him in his druggy-rapist butt.

The denied petition clears the way for the delayed deposition of Cosby to proceed. If the deposition does in fact happen it will be the first time Cosby speaks about the allegations since the unsealed 2005 case.”

    I’m starting to think that THIS is what will make him shit his pants. I’d lay odds that his attorney will come out with a statement in the next month or so that claims something like this::: “Mr. Cosby has been devestated by these allegations. So much so that his mental state has suffered to the extent that sitting for a deposition would be of no value. He is confused and is showing signs of dementia.       I’ve thought the same thing. Wouldn’t put it past his sociopath lawyers to coach Cosby on how to sound with dementia or some kind of illness, or even find a quack doctor, bribe him to sign off on an evaluation claiming dementia or illness!

    In his ego driven quest to get his money back Cosby would, most likely, again be deposed. Ultimately he could actually end up in court if the woman involved stands her ground and has a good attorney (and my money says there are a number of very good attorneys lining up to take her case). I cannot believe that Cosby wants the public exposure and humiliation that would come with the guaranteed media heavy three ring circus of such a court case. I see this threat as little more than a scare tactic, publicity stunt and/or lawyer massaging Cosby’s ego. This is a very old wound that, once reopened and fully exposed, just might finally convince Cosby’s remaining supporters of what a true sleaze ball he really is and apparently has been throughout his career.
