Katherine Jackson files for permanent guardianship of Michael’s kids & his estate

Katherine Jackson, mother of Michael Jackson, has officially filed for guardianship of Michael’s three children. The papers were filed in Los Angeles, and a hearing is set for August 3, five weeks from now. Katherine Jackson has also filed to take over “the children’s estate”, which from all evidence is probably all of Michael’s estate. Since Michael’s will hasn’t been made public, my guess is that he left all of his assets or nearly all to his children. Katherine filed for full and permanent guardianship of the kids this morning – and this afternoon she was granted “temporary” guardianship until the August hearing.

The children are with Katherine now, in the “Jackson compound” in the San Fernando Valley. The rationale Katherine (or her lawyers) have given for the filing is that “Minor children are currently residing with paternal grandmother… They have a long established relationship with paternal grandmother and are comfortable in her care.” Of course, for the two oldest children, Prince Michael and Paris, there is the matter of their birth mother Debbie Rowe. Legal experts are coming out of the woodwork to claim that Rowe has the best shot at getting full custody when this thing comes to court:

Michael Jackson’s mother is caring for the singer’s three children and asked the court Monday to declare her their guardian. The guardianship papers were filed in Los Angeles Superior Court on Monday. A hearing has been set for Aug 3.

Jackson left behind three children: Michael Joseph Jackson Jr., known as Prince Michael, 12; Paris Michael Katherine Jackson, 11; and Prince Michael II, 7. The youngest son was born to a surrogate mother.

The filings show that Katherine Jackson is also petitioning to take over the children’s estate. Its value is listed as “unknown” in the filing. The filing lists the children as living at the Jacksons’ family compound in the San Fernando Valley, northwest of Los Angeles.

“Minor children are currently residing with paternal grandmother,” the filing states in an explanation of why Katherine Jackson should be appointed guardian. “They have a long established relationship with paternal grandmother and are comfortable in her care.”

The filings provide no other declarations by Katherine Jackson, nor do they state whether Michael Jackson left a will.

The filings note that Deborah Rowe is the mother of the Jackson’s two eldest children, but list her whereabouts as “unknown.” An e-mail message sent to Rowe’s attorney seeking comment wasn’t immediately returned Monday morning. For Michael Jackson’s third child, nicknamed as Blanket, the filing states “None” for the mother.

Londell McMillan, the Jacksons’ attorney, said the family hasn’t heard from Deborah Rowe, the mother of Jackson’s two oldest children, about custody.

“I don’t think there will be anybody who thinks that there is someone better” than Katherine Jackson to have custody, McMillan said Monday on NBC’s “Today” show. “She is a very loving host of other grandchildren.”

There was no word from the family on funeral plans. Many of Jackson’s relatives have gathered at the family’s Encino compound, caring there for Jackson’s three children.

Given the secrecy surrounding Jackson’s children throughout his life, it’s no surprise that there are lingering questions about who will care for them. What is almost certain is this: Their fate will be decided in a courtroom.

Experts say the person who has the strongest legal claim to Jackson’s two oldest children is Rowe. As for the youngest child, Jackson’s wishes will be more influential. It remains unclear who Jackson designated as potential guardians for his children. Those details – likely contained in the 50-year-old singer’s will – have not been released.

Prince Michael II’s mother has never been identified, and while she may surface, it is likely that she signed away her rights, said Stacy Phillips, a Los Angeles divorce attorney who has represented numerous high-profile clients.

Rowe would have to undergo an evaluation by the court to determine if she’s the best person to care for Jackson’s children. So, too, would anyone else who applies to become the children’s guardian – some of whom may have Jackson’s blessing.

“If he did indicate a preference, that will be given great weight, but that will not be determinative,” said Los Angeles attorney Gloria Allred. “Children are not property, they cannot be willed to another person.”

Whoever wins custody of Jackson’s children won’t automatically gain control of their inheritance, Phillips said. “For many people, the person or persons who are taking care of their kids are not necessarily taking care of their money,” Phillips said. “There’s a benefit to that _ a sort of a check-and-balance.”

Rowe, or whoever is designated the children’s guardian, will receive payments based on Jackson’s estate, Phillips said.

One of my lesser peeves about the tabloid Michael Jackson coverage has been the repeated claims that Jackson was broke or bankrupt. True, he had millions and millions of dollars in debt, and he probably had horrible business sense the last decade of his life. But he wasn’t anywhere near broke, having made some brilliant financial decisions early in his career. Namely, Jackson owned one of the most profitable music catalogs in the history of music – the Beatles catalog of more than 200 songs. Most professionals estimate that one catalog alone is worth a billion dollars. And I’m not even getting into the other catalog Michael partially owned – his own. So no matter what, Michael’s children will have more than enough money, if some money-grubbing relative doesn’t get their hands on it first. My hope is that the courts step up and really represent the hell out of these kids’ interests. I hope Michael’s assets are placed in a trust that no member of his family can touch, and only monthly child support is paid out to whoever gets custody.

    The article doesn’t state Katherine Jackson’s age, but if Michael was 50 and he was one of her youngest children, she must be approaching 80.

    Is an 80 year old woman really the best guardian for teenagers? Or for a seven year old? She is filing for ‘permanent custody,’ but what about in five years, when that seven year old will be close to being a teenager himself, still in need of guidance, and she’ll be 85?

    It amazes me that out of all the brothers and sisters Michael has, none of them seem to be suitable parents. And these are the kids that Katherine Jackson raised!

    She may be a terribly sweet lady, but this doesn’t say a lot for her mothering ability.

    Neither does the fact that Michael Jackson constantly talked about how miserable his childhood was.

    If she couldn’t protect Michael from the wolves and vultures surrounding him – Joe Jackson being just one of many – how is she going to protect these three kids, at this advanced age?

    Fiz, word on the street is, they are no longer together. I am pretty sure he had a child “out of wedlock” that came to light in the 90’s.

    Plus I don’t think Janet would let the father near those kids. (IMO of course)

    Oh God no. If Katherine gets the kids then Joe Jackson will have access to them. And that SOB shouldn’t be allowed within 100 miles of them after the way he treated his own sons.

    The only people in that family I’d want to see the kids with are Rebbie or Marlon. They’re both pretty stable.

    IMO I think one of the siblings will step up to help Katherine care for these children. If you read the interview Debbie Rowe did with the Daily Mail back in Feb. 2008, she cares more about her horses & other animals than she does about those 2 kids. They were her cash cow & wanted them to continue to be. She does not deserve to all of the sudden become a “mother”, and from what she’s done in the past I think she’ll want a big payoff as she did with Michael. The real family that knows them deserves them, bottom line!

    Janet should likely be their guardian. No contest. She’s the youngest of her brothers and sisters; therefore she’ll be around until they are legal adults. Not to mention, she was very close with her brother. No better person to remind the kids of the man their father truly was.

    hojo, I agree that Janet (or Rebbie) should be the guardian. Janet and Michael did seem to be close, and Rebbie is NEVER in the spotlight/news/tabloids. in fact, a lot of people have never even heard of her.

    I don’t think Rowe deserves (or wants) to have those children in her care. Biology does not a parent make.

    This is wrong on so many levels. At her age, she is not an appropriate person to be parenting 3 children. She just isn’t.

    Most of all, though, is that she stood by and permitted her husband to abuse her own children. Even if she and her husband are separated, that goes to her (lack of) strength of character. She may be a “sweet lady,” but she was unwilling or unable to protect her own children; clearly she won’t be able to protect her grandchildren from whatever bad things come their way, whether it’s her husband or some other situation that would require a strong parent to step in.

    With all of MJ’s siblings, plus their adult children, there are probably at least a dozen relatives who could provide a stable and safe home for these kids. Giving them over to their grandmother permanently would be a huge mistake.

    The other thing is that at her age, while she might live many more years, it is unlikely that she will. The average life expectancy in this country is somewhere around 77 or so years. She is now 79. If she keeps these kids, the chances are very high that they will go through the loss of another “parent” before they become adults. It seems like a pretty cruel thing to do to these children. They have been raised without a mother, now they’ve lost their father, and if they live with their grandmother, they will probably have to go through losing her as a mother figure as well. Not a good idea. Those kids need to be placed with a younger relative for that reason, as well as the others I mentioned.

    @hojo: Janet has her own problems. I wouldn’t leave those kids with her. I hope either Rebbie or Marlon is able to take them. Marlon has been married to his wife since 1976 and they have three grown children and a grandchild. Rebbie has been married to her husband since 1968 and they have grown children as well.

    Teen marriages have a notoriously high failure rate but although Rebbie married at 17 and Marlon married at 19, both these siblings’s marriages have worked out. Marlon is the only Jackson brother who hasn’t been divorced.

    As said upthread, a lot of people have never even heard of Rebbie but she did have an album out in 1984 (85?) called “Centipede” which did pretty well. Rebbie is the real talent in that family; she has a terrific voice, but her husband and kids were her main priority.

    I had heard that the bad beef Jacko had with Paul McCartney over ownership was assuaged by Jackson stating that upon his death the song rights would become McCartney’s. So maybe the songs even go to him?
    Of course, I have nothing to back this up with but some memories of this a few years ago. I’m not even going to bother googling news links because I’m sure I’d get hits- everybody and their liddle dawggy are covering this from all angles… kinda like a really hardcore porn shoot =/ mindbleach, please

    “Children are not property”. That’s the main problem because in this case those poor kids have been bought (by their father) and sold (by their mothers) since their conception. And i can’t see any good solution for them right now: not the 80-years-old-grand-mother, not the self-hating mother-who-don-t-want-to-be-a-mother, not the brothers and sisters of their dead father. Nobody.

She got married at almost 18, had 3 kids who grew up to be normal and successful, with her husband who she’s still married to, more then 30 years later, and has stayed out of the spotlight and away from all of the Jackson drama, as well as Marlon Jackson.

    I think the last person in the world should be his mother to get those kids.
    This gives Joe access to those children and he molested his own kids for christ sakes and beat them. MJ kids need to have visitations with grandma but not to be living with her and I dont care if Joe lives somewhere else or not..MJ didnt want him around his kids and if they go to grandma JOe is going to be there and she is too old to stop him.
    I hope that nanny goes with them. I dont know if Rebe wants to get into this mess and I dont blame her and as far as the rest of the kids go they arent that well put together etiher and I wouldnt let Latoya have a damn dog.

    emily, it could be possible, just maybe, that she spoke up about custody right away because she cares about the children’s well-being. Wanting to reassure them that they have a home, and a family who loves them, doesn’t sound unnatural to me. I’d like to think that if my parents had died when I was young, my grandmother would have said, out loud, that she wanted to take care of me.

    Sorry Princess, with all respect, but i still think it’s very strange the fact that katherine and her husband want to administrate Michael’s will only four days after his death. Right now, they should be thinking about when and where to bury their child and not how many money he had left on his will. Besides that, the behaviour of Joe Jackson at te BET Awards said it all. I rest my case!

    um,my mother recently died,and i applied for probate that week.it’s a long an dcomplicated and stressful process…and alot of hoops to jump though-getting that ball rolling will have to happen,and it isnt going to be any easier to do it later…[the person still won’t be alive,and it will still be painful to deal with the logistics while grieving]. there are so many hoops and they take so much time….it’s not like katherine will have access to millions of dollars overnight,or even at all.
    When you wish to administer an estate,you are essentially in a legal contract;it is overseen by attorneys and the probate judge. It is a ‘job’. It can be comforting to have something to focus on during a chaotic,stressful and painful time. Everyone deals with grief differently. For me,it gave me a ‘task’,when all the funeral and gathering arrangements were made [each day feels like a week in the beginning: trust me. you are waiting 3 days for the service,walking around in a new world without that person,and looking at all of their stuff,etc.]Everyone deals differently. Some though my cold and impersonal;i honestly find that i’m doing the job i was assigned,and i have also cried and mourned,publicly and privately. It’s hard to explain until you are in the situation-you are sort of in a robotic like mode….doing what you can,going thru the motions….
    so,let’s not judge katherine jackson until we know.
    ALSO,having temp guardianship ove rthe childre until august is SMART,people!!! Anyone who tries to claim them now will have to go thru the courts and appeal her request;they will have to prove themselves.
    As for the father-joe-yea,i hope he stays far far away from them.

    MJ owned the Beatles Catalog with Sony. I’ve read annual income between 20-40 million. It’s all open, imo. What was his contract with Sony, default, etc.?

    Even if he is 1/2 a billion in debt, his franchise is more than millions on the global market. It will survive and prosper, just as Elvis franchise has.

    Michael’s song catalog is worth a lot of money, but the Beatles portion of it isn’t going to be worth much for very long.

    It was a 50-year contract signed in 1963, which means that in 2013 the Lennon/McCartney song rights begin reverting to Paul and Yoko Ono.

    I totally agree with lio – there is no obviously “normal” (and I use that term loosely) person in that whole family. Janet has plenty of issues on her own. Just because she looks all right doesn’t make her a good parent.

    The Sony Music Publishing contract was renegotiated in the 1990s.
