A British high court said that Prince Andrew was properly served by the Yanks

Duke of Edinburgh death

My minor in International Law from Dick Wolf University is getting a major workout these days. As we discussed, on Monday, lawyers attended a virtual hearing in the civil lawsuit against Prince Andrew in American court. Andrew’s lawyers were quite hung up on this idea that Andrew was not properly “served” notice of the lawsuit, even though the lawsuit was widely covered in the British and American media, and even though a process server dropped off the notice at Andrew’s home following weeks of Andrew actively dodging the server. Andrew’s American lawyer (newly hired) filed a motion and there was some dodgy speculation that the Hague Convention protocols were not used or something. At the end of the day, the issue of “was Andrew properly served” was booted to UK courts and guess what? They… um, took Virginia Giuffre’s side and said Andrew was properly served.

The fog surrounding the question of whether Prince Andrew was properly served with a New York sex-abuse lawsuit cleared a bit Wednesday after an English high court authority declared he was. In a letter to the New York lawyers for Andrew’s accuser, Virginia Roberts Giuffre, a judge known as the “Senior Master of the Queen’s Bench Division,” one of the oldest judicial offices in England, declared that she was satisfied that the Americans had met the requirements of international treaty standards for process service in a civil matter.

“I confirm that service of legal process on solicitors acting for a party who have confirmed that they have instructions to accept service is valid service under English law,” wrote Barbara Fontaine, the Senior Master, who also bears the antique title of “Queen’s Remembrancer.”

Under English common law tradition, a master is a judge of limited jurisdiction in civil matters in the superior courts of England and Wales.

Fontaine acknowledged that Andrew’s legal team at the London firm Blackfords is entitled to challenge her decision, as they have done since the lawsuit papers were left at his residence, Royal Lodge on the Windsor Castle estate, on Aug. 27. Andrew wasn’t there; instead a police officer on duty at the gate to the property took the paperwork. The paperwork also was sent to the prince’s lawyers by mail and email.

If they still object, Fontaine called on Andrew’s lawyers to agree to another method of service that meets the Hague Convention treaty standards so as to avoid further wrangling over the issue.

I mean, it’s sort of funny. The Senior Master of the Queen’s Bench Division just called the Queen’s Favorite Son a sniveling little B. Fontaine was like “if you don’t like the way you were served, then tell us the way you want to be served and we’ll make sure the Yanks serve the f–k out of you.” That’s it in a nutshell. Anyway, apparently at this hearing, there was some talk of a possible settlement, but the judge shut all of that down because there are still so many procedural issues to deal with. The issue of a settlement has been brought up before, and I’m under the impression that Virginia is open to settling and her lawyers would like to open up those discussions. They’ve just found Andrew and his lawyers unwilling to even acknowledge them.

HA! I love it. She really did say “just shut up and tell us how you want to be served rather than being such petty b!tches about this.” Andrew’s lawyers have the lawsuit, they have the papers, they’ve been served. And now the UK courts are saying that as well.

‘The Queen’s Remembrancer’ sounds like a character in a dystopian fantasy world who’s cursed to remember all the terrible things their monarch has done when everyone else cannot.

Which is totally different to -the Queen’s- dystopian fantasy world where she pretends her family are paragons of virtue and everyone else is cursed with the knowledge that these people have done terrible things protected by immense privilege.

Now there are some great writing prompts!

      • NiqGee says:

Right?!?!?! It sounds like an amazing medieval fantasy novel with a Chosen One coming in who isn’t forgetting like everyone else and teams up with the Remembrancer to undo the whole monarchy. I love it! Who’s going to write it? I’m ready to read the crap out of it.

    • Emma says:

Yeah, the Queen’s Remembrancer, so make them remember their sins! Ugh these people.

    • Veronica says:

Gotta love those archaic British titles. This one brings to mind the revenge of a mistreated memory foam mattress.

  3. Amy Bee says:

This is not the actions of an innocent. I think Andrew will end up settling and Mummy will pay the damages.

This part took me on an amusing mental trip:

“I mean, it’s sort of funny. The Senior Master of the Queen’s Bench Division just called the Queen’s Favorite Son a sniveling little B. Fontaine …”

I’ll admit, I was skimming, so momentarily, I didn’t realize that one sentence ended and another began. Instead of you merely calling Andrew a “B,” I thought Andrew was being referred to as a “B. Fontaine.” Like the senior master of the Queen’s Bench Division just whipped up some fantastic RuPaul-esque drag slang to call Andrew a special sort of B.

Now I wish that’s what literally happened, because Andrew is a B. Fontaine — and then some.

I love that all of Andrew’s antics to avoid this suit have only added to it’s profile and legitimacy. Like, he didn’t have to force a British High court judge to call him out, he could likely have settled this, quietly, years ago, as many white dudes with privilege do. He’s brought this pain on himself and his family, basically, and he seems befuddled by his predicament.

Which makes me wonder exactly how he thought it would go? Does he really believe he can hide out at Balmoral for a bit, then make a glorious comeback? I guess we shouldn’t be surprised – this is the same man who thought his interview where he claimed he doesn’t sweat because of his military service (?) Was a resounding success. So his judgement is not great. But if he does entertain that level of delusion, why isn’t there somebody with the interests of the BRF in mind to keep him in line?

Makes me wonder how many times before Andrew’s scandals got paid off. How many times did things just go away for him to feel this confident in this approach? A ton I’m guessing.

  6. Merricat says:

    Lol for days. Tick-tock, Andrew.

  7. MY3CENTS says:

I hope he continues to be arrogant and stupid and not settle. I hope this gets even more publicity and that they’ll drag his sorry sweaty ass to open courts were he will be further questioned , that his rapist behavior will be plastered all over the media and that all of this puts a bit of a dent in his enabling mommys jubilee.
Let their criminality, stupidity and arrogance finally be their downfall.

Oh hey, we went to the same law school!

  9. Eurydice says:

According to the BBC, the ruling is that Virginia’s lawyers have the right to ask the High Court to serve Andrew with the papers and the High Court has agreed to do so. They can do it in a variety of ways, by mail, to the lawyers, to another party or Andrew himself. So interesting to see what happens.

    • Jay says:

I’m holding out for a singing telegram with balloons.
      🎶 You’ve… been…served!
      you’ve been served!
yes, it’s more than you deserve🎶

  10. Wiglet Watcher says:

I hope if she settles that part of the settlement is an admission of guilt.

Well Andrew, only a couple of months until Ghislaine Maxwell’s trial starts. I hope you’ve got a storage room full of Depends because you’re going to need it. Regardless of whether or not she goes for a plea deal, there will be additional information and proof revealed about your long relationship with Epstein and Maxwell that will show you were NOT on “official trade business” when you were hanging out with them so no diplomatic immunity for you. Virginia’s lawyers have now provided further information to the High Court, and the High Court has accepted the request for service under the Hague Service Convention. You gonna go after both these entities? You’re just f*cking lucky your ass isn’t going to be hauled off to jail for the rest of your miserable life, but you’re going to have to pay, perhaps more women you’ve abused will now have the courage to come forward, and by the time your brother succeeds to the throne you will be permanently banished to some remote royal residence, hopefully crumbling and with no central heating. And take your vulgar ex-wife with you.

    • Tessa says:

I don’t think Prince Charles will do a thing. I agree with the rest of your post though. And it’s a shame that Fergie is let loose on the media after Philip passed away.

  12. LaraW" says:

    LOLOLOLOL

I get the impression that the UK judicial system does NOT appreciate being used as an excuse for Andrew to dodge civil litigation. Also: ouch to the firm that’s representing Andrew. The reputation they’re very quickly acquiring is not the reputation any firm wants hanging over them. I mean, on the one hand, there’s mounting a zealous defense for your client. On the other hand, there’s blowing all the goodwill the judge may have had by playing pointless games on technicalities this early in the matter.

Should have accepted service gracefully and saved testing the judicial system’s tolerance for bullsh-t on an issue that actually has some merit (and real contention) behind it.

    • Eurydice says:

But, but, but, they’re high-powered and the best money can buy!! I love a headline I saw that said “Lawyer in Celebrity Cannibalistic Sex Case Reps Prince Andrew.”

  13. BitsyCS says:

Andrew’s method seems to be the same as his Mummy’s: avoidance and pretending things don’t exist instead of dealing with them. So stupid but especially stupid in the era of the internet. Maybe this worked in earlier times but not gonna now!

  14. Cj says:

What 2022 wants is a lawyer having to straight-faced produce evidence Prince Andrew doesn’t sweat to a packed courtroom.

And then we get what we NEED which is a 2023 law and order SVU episode where a foreign diplomat is caught and convicted because of DNA in sweat, which dropped over his victim, which he denied could ever be his because reasons. And Mariska Hargitay leans over him in interrogation just before he’s arrested and is like “looks like you’re sweating now”

  15. Tim Peterson says:

Am I the only one that has noticed that every member of the Royal Family appears to be deeply, and fundamentally stupid? I’m not accusing them of being clueless, or out-of-touch, just bone stupid.

    • Niamh says:

Not every member. Anne is anything but stupid. The rest, including Harry, are stupid.

      • Tessa says:

Anne has made some bad life choices. Harry is the smart one for getting away from the toxicity and taking his wife and family with him.

  16. Keri says:

Yeah Harry is unfortunately dim as well but harmless, gentle soul. He is just very lucky he married a woman who isn’t. Not saying she engineered the move entirely but a short sighted woman would have insisted they stay for the presumed ‘status’ and wealth. I like Harry.

    • Tessa says:

I don’t see Harry as “dim.” Harry is very bright, it’s his brother who is not the sharpest knife in the drawer IMO. Harry wanted to leave and she supported him.

    • Rea says:

Harry acts like a bro but he is smart. Because he knows how to use his influence and charm people to get what he wants. He seems very calculative and that is why his image is clean. He is like his mother Diana.

  17. Rea says:

Wow things are progressing at a steady rate. Honestly never thought Andrew would be the fall out guy. Because remember y’all there are other more famous people who are American that should be investigated at depth. Why have we not heard of Clinton or Gates?? Andrew is the fall out guy. In every crime there is someone who falls while others get writ flicks. There’s a lot of odd shit in this case too Epstein’s death. BS. I am not a conspiracy person but I wasn’t born yesterday either. People don’t just die under watch. There had to be a motive for him to die. If he had wanted commit suicide he would have done so a long time ago. It makes 0 sense he went out this fast.
