A-Rod playing hardball in divorce case; prenup may be iron-clad


NY Yankee All-Star and alleged Madonna-lover Alex Rodriguez (whom we refer to up here in the Boston area as “A-Fraud”) is not going to give his soon-to-be ex-wife, Cynthia, any more of his millions than she’s entitled to in the prenuptial agreement she signed. A-Rod’s lawyers are also looking to have any accusations of his infidelities removed from the record- though they’re careful to avoid actually denying the allegations.

Yankee slugger Alex Rodriguez is playing hardball against his wife in their divorce case, saying he wants their prenuptial agreement enforced and charges that he cheated on her removed from the record.

In court papers obtained exclusively by the Daily News, A-Rod’s side responds point by point to Cynthia’s July 7 divorce filing.

The All-Star admits the marriage is “irretrievably broken,” but says that because Florida is a no-fault divorce state, he doesn’t have to say why and he’s not going to.

Cynthia’s allegations that he “emotionally abandoned his wife and children” and that the pair broke up because of his “extramarital affairs and other marital misconduct” are “immaterial and impertinent and should be stricken,” the papers say.

The documents are expected to be filed today in Miami-Dade Circuit Court in Florida. In her petition to the court, Cynthia asked for the couple’s $12 million waterfront estate and “equitable distribution” of all assets acquired during the marriage.

While naming no figure, she petitioned for alimony and child support, including such benefits as life and health insurance and private schools – suggesting she be able to maintain the “high standard of living” A-Rod has provided his family so far.

Rodriguez, whose 10-year, $275 million contract with the Yankees makes him baseball’s highest-paid player, says several times in the response he wants the prenup enforced.

“Husband denies any duty to support wife beyond those obligations specifically set out in the parties’ prenuptial agreement,” the papers say. What those terms are wasn’t immediately known, but apparently they don’t suit Cynthia.

If he has to go to court to fight her challenge to the prenup and wins, he says he’s entitled to recover from his wife any “reasonable attorney’s fees and costs” he incurs. A-Rod strikes a conciliatory note when it comes to the children, saying he “has been paying, and will continue to pay … reasonable and bona fide expenses” for daughters Natasha, 3, and Ella, 3 months.

Cynthia may have shot herself in the foot by marring A-Rod in the state of Florida. According to state law, prenups are generally enforceable unless the disputing party can prove that the agreement was signed under duress, there was fraud involved, the terms were “unreasonable,” (meaning that one person keeps all the assets while the other gets nothing), or that one of the parties wasn’t fully aware of the other’s assets at the time. Of course, Cynthia could take the high road in this whole mess, and not go after A-Rod’s millions- that is an option. But her actions since the split, including using his credit cards to fund a first-class trip to Paris before filing for divorce, tells me she is pissed, and wants to hit him where it hurts. So it looks like no one is going to be the bigger person here.

    If she signed the agreement then she shouldn’t get anything more. I think it’s ridiculous when spouses think that when they get divorced the pre-nup is null and void.

    I think ‘fraud’ refers to -at the time of marriage-
    She should have had an asshole clause to include the infidelities.

    Actually, I find it difficult to believe that anyone would assume that she should be ‘classy’ and renounce to an at least moderately significant portion of his assets. He has more money than he could ever need and the allegedly conciliatory terms expressed towards his daughters’ expenses are so vague that they could very well be limited to mere payment for the children’s alimentary needs.

    In short, he is a miserable, selfish pig.

    Also, pre-nuptial agreements are designed to protect the interests of both parties in case the marriage dissolves in ordinary circumstances. Infidelities cannot be counted as such and should, at least partially, have an incidence in a final ruling – by either altering or entirely nullifying the pre-nuptial agreement’s terms.

    On a final note, we should understand her: being publicly humiliated and so callously pushed aside must be painful. It’s only natural that she would try to retaliate in one form or another.

    I highly doubt that the soon to be ex Mrs. A-rod is illiterate and therefore knew exactly what she was signing when she was signing it, so why on earth she thinks that she is entitled to more than is outlined in the terms of that contract is astounding.
    He may be a cheating a$$hole, but I guess I just don’t see how that entitles her anything more. Doesn’t one run that very same risk no matter who one chooses to marry?

    Hey Pont Neuf – your points are a little absurd. He may be a lying, cheating jerk, but he is talented and works hard for his success. Saying he “has more money than he could ever need” is a short sighted. Haven’t you ever heard the phrase ‘the more money you have, the more money you spend’? $12M mansions aren’t for us bottom feeders and he lives the life he has EARNED. You don’t see A Rod out there gambling on boats like the Minnesota Vikings players or throwing his life away on dog fighting, gun chargest, etc. He’s earning his keep, working hard and is obviously willing to support his children. And in this day and age, how could infidelities NOT be counted as “ordinary circumstances”? In a perfect world, people wouldn’t cheat but the reality is that they do and it happens wayyyy more often than any of us would like believe. I agree that he’s a pig for cheating, but he’s hardly the first man to do so and just because his pockets are deep doesn’t mean he should be penalized any more than anyone else. And who’s to say she hasn’t cheated too? You never know! On a final note, retaliation is not a “natural” thing to do. Putting your children first, instead of your greed and desire to be vindictive, THAT would be natural. Sorry, sister. I don’t think A Rod is right, but I also think a pre-nup is a pre-nup. They knew darn well in 2002 that he was talented and worth a lot of money. She married him for better or for worse and unfortunately, his huge success is a double-edged sword for everyone involved, especially him.

    As detailed in an article in PAge Six/Cindy Adams (I know, such high news..but it isn’t the Star) Mrs. A Rod holds a Masters in Psychology and has worked with children. So she’s def. educated and able to support herself. That said she IS the mother of his two kids so he shouldn’t totally screw her over. I think they should be able to meet somewhere in the middle. She was foolish to jump the gun and file before she had proof i.e. a P.I take pictures, etc. She should have gathered evidence of infidelity not just rumors and suspicions- intangibles that are useless in court.

    When A-Hole carries a child in his body for 9 months and gives birth, he would have then ‘worked hard’ in my mind.

    Baseball seems to be his passion, (along with hookers). He is obviously talented in that field, but I doubt he considers it working hard for the $$. It’s the gravytrain.

    Cops & Firemen work harder for a minute percentage of his salary, my respect is with them.

    I used to think he was good looking when he played for Seattle, back in the day. But now I just wonder what anyone would see in him, besides $$$$. Cynthia knew that when she married him, and since she signed the pre-nup, I think she should be stuck with it. Yes, it sucks, but that’s what you get when you chase after money instead of character.

    **Not to say that an individual can’t have both, but an athlete of his caliber is likely to have no character at all**

    In regards to ARod and his prenup with Cynthia – I read about it on Huffpost – why should she be entitled to anything more than what is outlined in the contract, of which I’m sure she will be more than well taken care of? Unless she can prove he cheated and there is no clause for it in the agreement I don’t see where she has a right to additional money.

    Hes Dominican. Which means he is mixed race [white and black, though hes more white obviosly]..he cant help the way he looks. And 99% of all Latinos are mixed race..’spanish’ is not a race.

    Besides he looks damn nice to most people. His blue eyes are natural, they just stick out due to his dark skin and they are beautiful as its the first thing you notice about him. His lips are sexy.

    so you just come off as racist saying he looks wierd. Do you make mean comments to mixed kids when you see them to ?

    he wishes he was puerto rican….I mean he actually does. He tried to play on the Puerto Rican national team during world games….problem is he was born in the US

    AND his parents are from the Dominican Republic. He needs to buy a map. He finally played for the US team.

    Depends on the state, but if infidelity can be proven then he could have a problem which is why he wants it stricken from record. It does not fall in the divorce for usual cause. Many a pre-nup has fallen due to cheating.

    Just ask Shaq. I mean he bought Shaq’s Starr Island home in Miami during Shaq’s little divorce debacle. Blaming his wife of being a spendthrift then getting caught with pregnant girlfriend……oops.

I think we are all aware that spanish is not a race, so stop accusing people of being racist just because someone is commenting on his looks. if katie price, katie holmes, tom cruise, and every other celeb who has people commenting on their looks is fair game, so is a-rod. he doesnt get a pass just because he happens to ‘appear’ more ethnic than other celebs and so therefore, no one is allowed to comment because then its racist. take the PC all the way, or take it home.
