Charlie Sheen loses bid for full custody while Brooke goes to rehab

Brooke Mueller is back on whatever she was smoking before, crack if the stories are to be believed, and is now in rehab yet again. It’s at least her fourth time in treatment that we know of and she seems to alternate between doing drugs or staying in a sober facility so she won’t do drugs. Brooke’s relapse gave Charlie the opening to step in between gigs on his crazy tour and request full custody of his two year old twin sons with Brooke, Max and Bob. There was a hearing yesterday to determine custody, and both Brooke and Charlie showed up. The judge shot Charlie down and left custody as it was, with Brooke. The boys are staying with Brooke’s mom and family, and won’t be cared for by porn stars and nannies at hotels while Charlie does his little ranting act around the country.

The embattled former Two and a Half Men star lost his fight against his estranged wife Brooke Mueller for full custody of their two-year-old twin sons, Max and Bob.

According to a source, a judge in Los Angeles presiding over a closed door hearing just allowed Mueller to maintain primary legal and physical custody despite a well-publicized relapse in her crack cocaine addiction.

Despite appearing “unsteady on her feet” and “glassy-eyed” Mueller was all smiles as she left the Stanley Mosk Courthouse.

“No comment,” she told RadarOnline when asked if she was pleased with the decision.

A source says that while Mueller undergoes drug treatment at an undisclosed rehab facility, her mother, Palm Beach, Fla, socialite Moira Fiore, will provide primary care for the boys.

Sheen wasted no time getting back to his work commitments. The 45-year-old hightailed it out of court and straight onto a plane to Chicago where he is scheduled to continue with his Violent Torpedo of Truth tour.

Meanwhile, Bob and Max were oblivious to the hoopla surrounding their parents โ€“ enjoying a day at the park with their nanny, playing on the jungle gym and swinging in the swings.

At least the kids are ok. The odds are stacked against them with those two addicts as parents, but Brooke’s family is doing what they can. There are plenty of other people in Max and Bob’s lives who want to help too. TMZ reports that Charlie’s other ex, the sober one Denise Richards, offered that she’d take the boys for a while.

TMZ also reported that the Mueller-Sheen custody hearing was closed to the public after someone brought up “questions of abuse.” I hope it wasn’t anything serious. Thank goodness custody wasn’t granted to Charlie. He couldn’t be bothered to properly care for one of Denise’s pugs, who died of malnutrition as a result. She told him he couldn’t bring the other dog with him on tour and he proceeded to verbally attack Denise for it.

Here’s Charlie in Toronto on 4-15, where he had a “bipolar awareness walk” of about 1.2 miles from his hotel to his gig at Massey Hall, I’m not kidding, that raised thousands. Good for him?

    It speaks volumes that CS isn’t sane enough to take back his own kids from a woman actively using drugs. Good call by the judge.

    On a side note, CS looks like my Grandpappy before he died. He was 86.

    i have a real problem with the outcome of this case. while i don’t think charlie should have regained custody, i think its ridiculous that they left brooke with custody… she needs to be stripped of custody because she cannot stay clean for longer than a few days. i think its appalling that the courts are okay with her dumping her children on her parents while she gets high.

    @lem – I agree. This is BS. If these were ordinary people, a court would remove the kids from BOTH parents – likely they could still be placed with Brooke’s family – but THEY would have official custody. How can they leave these kids technically in the custody of that cracked out looney?? There is a difference. Right now, the kids are with Brooke’s family, but if she has custody she has the right to take them back whenever.

    I know this has been mentioned before, but seriously, why hasn’t a guardian ad litem been appointed for these children? Because both families have money falling out of their a$$es? All the more reason.

    I don’t get it either, why the courts haven’t made the grandmother or someone the guardian. Neither parent is fit to care for a old shoe, let alone 2 children. Poor kids – hope they have a great nanny and others looking out for them.

    CS likely was given the heads-up about Brooke’s upcoming trip to rehab so he organized the “bi-polar walk” to gain him some favour with the judge. It’s a shame that this walk just happened to follow the same path his limo would have taken had he been driven from his hotel (The Ritz Carlton) to Massey Hall. I took the day off work last Friday otherwise I would have seen this mess walk by my office building as I’m about 1 1/2 blocks from Massey Hall.

    Give the kids too one of the follow: Brooke’s parents or Charlie’s brother Emilio. both see to have their shit together. Denise is also a better option. At least they’d be with their sisters and someone who isn’t a complete psychopath.

    Totally not her responsibility, but good Lord give the kids some time with Denise. At least her children are safe and healthy and seem to be happy. It sucks that not only do they have all the resources to make themselves better, but they still take advantage of their families. For goodness sake, Charlie’s dad and mom raised his first daughter her whole life!

    Thank God for Brooke’s Mom, the twins have a stable environment even though their folks are not fit. I’m glad they got to stay in the only home they know.

    I’m glad he didn’t custody according to Radaronline he hasn’t seen those boys in over three weeks.If he cared he could take his private plane to LA to see them.He has visitation. after the court case he flew to Connecticut

    Wow, those hats seem incredibly insulting to me. Like its some horrible, horrible thing for Charlie to be thought of as bipolar as opposed to an abusive drug addict who only cares about himself and his next hit. Its okay Charlie, we don’t want you either.

    Also, it there’s a lot to be said about his stability when she had a very public falling, yet he still lost.
