Does Sofia Vergara think Nick Loeb’s embryo lawsuit is ‘desperate & sad’?

As we discussed on Wednesday, Nick Loeb has sued his ex-girlfriend Sofia Vergara over her desire to destroy the frozen embryos they created while together. Sofia and Nick were actually engaged for a time, and he wanted a kid, so Sofia donated some eggs to the cause and apparently “insisted” on using her 44-year-old assistant as the surrogate, despite a doctor’s warning. They actually went so far as to have some of the embryos implanted into a gestational carrier TWICE, but it didn’t take either time. Now that Nick and Sofia are over (they broke up last year), Sofia wants the remaining embryos destroyed. Nick, who claims to be ultra-“pro-life,” says that he wants custody of the embryos because he’s totally going to have them implanted and possibly raise the child (and sue Sofia for child support, I bet).

The whole lawsuit is being done through aliases, John Doe and Jane Doe. As such, neither Nick or Sofia has gone on the record about these legal shenanigans yet. Instead, unnamed “sources” are sniping back and forth in Radar and Page Six. Here’s what Page Six had:

A source tells Page Six: “This is a complaint filed by Nick to stop Sofia from destroying the two female embryos. Nick filed as John Doe because he wanted to do it anonymously. They had agreed to freeze the embryos when they were together because Sofia didn’t want to carry another child, she wanted to do it via surrogate. But two attempts failed.”

The source continued: “If either of them dies, the other has the right to destroy the embryos. But Nick believes life begins at conception, that life is life, it is horrible to keep them frozen, these are his babies. He hopes the filing will be a test case for how frozen embryos should be handled.”

Another source defended Vergara, who’s now engaged to “True Blood” actor Joe Manganiello, telling us: “This is a desperate attempt for attention. Why would he claim that she was abusive to him and still want to have children with her? She is engaged to someone else. He is perfectly fertile and could go and start a family with another woman. This is a sad attempt to stay relevant and hold onto the past and her.”

And yes, the “why doesn’t he have a baby with someone else?” argument stands up, but only if you ignore the whole “Nick is super-pro-life and every life is precious” thing. But now all I can think about is how Nick allegedly loves blow and hookers. Classic conservative politics.

What else? In the John Doe filing, Loeb also claimed that Sofia had physically and emotionally abused him, calling him a “loser” and hitting him on four occasions. A source told Radar:

“Sofia never got physical with Nick, it just didn’t happen. Did they fight? Yes, and a lot, which is why they broke up. But to portray it as Sofia being mentally abusive towards Nick is reckless, and just not true. At this point, Sofia is saddened that Nick decided to let this play out in the media, but not surprised. Nick obviously wants to be a part of Sofia’s life, even though she is engaged to be married to another man. Sofia wants the embryos destroyed, and is also ready to fight for her rights in court. If these embryos were implanted into a surrogate, Nick would almost certainly go after Sofia for child support. As the highest paid actress on television, the financial incentive needs to also be considered.”

I enjoy how these sources are really going after Nick as an ex who just can’t let go. We already know Nick Loeb is the kind of ex-boyfriend who says douchey things about Sofia, like how she needs to dress “classier.” So, painting him as pining away for her… that’s a smart way to play it from a PR angle. From a legal angle? I don’t even know. This is a lot like an episode of Law & Order, and I think the solution at the end of that episode was… no one got to use the embryos? Something like that.

    My god how could a court even possibly give these to either party if they wanted to use them???? Force someone to have a child with an ex partner. Destroy them or keep them frozen forever if you’re that crazy.

      His argument is that they already HAVE two children in the two frozen, but conceived, embryos. Not an argument I agree with, but I’m not a conservative right to lifer.

      “Destroy them or keep them frozen”. Isn’t this the standard operation with the remaining embryos once a (consenting!) couple have successfully had a baby? Was his intention to have every single embryo carried to term? I’m really confused by this idea of an ultra pro-lifer even using IVF in the first place.

      I have eggs on ice left over from IVF. You have to sign so many papers in regards as to what happens to the eggs in case of divorce or death. For example should I die, my husband cannot use the fertilized eggs with another partner. Of course I said no, that’s gross.

      Basically how we signed is I have full control over my eggs if he was to die I can use them if I want. If we are to divorce they are still mine. Under no circumstance can he have access to my eggs even though they are fertilized by him.

      My thing was I did not want another woman to have my eggs under any circumstance. He signed over to whatever I wanted. He wasn’t very interested where these mythical egg creatures went.

      If we were to both die, we had to sign weather to destroy or make someone a “guardian.” I listed my life long best friend as “guardian” of my egg. None of our families can mess with the egg. She can no longer have kids breast cancer then hysterectomy in her early 30’s. I told her if she can find a carrier and she wants she can have my eggs to do what she chooses with them. Looking back I am glad she didn’t have me knocked off for my eggs.

      This stuff is in writing, they had to sign something. They just can’t make it up as they go along.

        I’m glad you laughed because i seriously meant it as,a joke. I had a guy selling me life insurance and he kept going up and up in coverage. I said dude are you trying to get me killed. Don’t you watch dateline.

      I get WHY they are technically considered children… but it’s such a gray area since they could not survive without being frozen or implanted, or whatever. Since they both contributed to their development, about the only ‘fair’ thing left is to keep them in limbo, I guess. Nobody gets implanted, nothing gets destroyed. It’s just so creepy to want to keep the embryos and have a child with your ex (who you’re not on great terms with) and not actually want the ex involved. Especially when he (I assume) is perfectly capable of having children still.

      If he wanted a child bad enough, he could find a surrogate, or settle down with someone. It’s not like men have the same kind of limits on reproduction as women do. My only other guess is that he got snipped, and can’t have it reversed. But – that still doesn’t stop him from finding himself a wife or girlfriend or whatever and using donor sperm. I think it’s much more about a political stance, or control over Sofia than anything else – because if he wanted a child THAT BAD – he could absolutely find a way to have one.

    Are there any laws in place about who “owns” embryos and whatnot?

      No set laws as such, but there’s plenty of precedent. The big one is Davis v Davis. Couple divorced. He wanted the embryos destroyed, she wanted to donate them to an infertile couple. The ruling was that disposition of the embryos should be a 3 step process:

      1) Do the parents currently agree on what to do? If yes, do that – duh! If no, go to step 2.

      2) Was there prior written agreement on what to do? If yes, do that. If no, go to step 3.

      3) The right NOT to be a parent outweighs the other person’s right to use the embryo … with room for a possible except if that person has no other way to ever have children.

      So she’d be well within her rights to stop him from ever using the embryos. I don’t think the idea of storing them without use has ever been tested. I’d bet they signed something allowing the IVF-clinic the right to automatically discard the embryo after 5 or so years. That’s standard because otherwise the clinic would become responsible for eternal storage of any embryos if/when they lose contact with the parents.

        They sign papers expressing where they go. There are explicit documents which state where the eggs go and what happens if something happens. I have done IVF and I have ice creatures now, you have to sign chains of custody

    I see no scenario that a court would let him use the embryo without her permission. She’s right, if he wants a baby, find another lady.

    What a nightmare. But if those previous attempts didn’t work chances are these won’t either if they are her eggs and she was over 40 sometimes the quality of the egg isn’t good. He sounds crazy why would you want to have your exes child other than financial I’d be embarrassed if I were him – pathetic.

      As I understand, he wants complete control or “custody” of the embryos, so he can decide to implant them and even choose the surrogate.
      The embryos have Sofia’s DNA, so if they eventually become babies, they would have the right to receive child support… from Sofia, because HE would have custody.
      They should just anonymously donate the embryos to a couple in need. HE is totally out there, it is like Octo-mom, who could not bear with seeing her embryos there and asked the doctor to implant them all.
      Sofia does not want anymore children, their relationship is over. Her opinion must also count. No embryos for any of them!

      I read that there was a clause that said that if something were to happen, whether the death of either Sofia or Nick or just a break up between them, that the embryos would be thawed out and thus destroyed. Now he is trying to dispute that. I can’t see how a judge would ever entertain this, especially since Sofia is engaged to another man, and the reason for even freezing eggs or embryos is because women don’t remain fertile as long as men do. Nick can probably have children naturally with someone who actually wants to have a child with him, so I don’t understand why he is suing her over this. He is either insane, desperate for attention, or trying to mess up her happiness because he is bitter.

    He wants her babies because then he gets to control her and stay in her life forever. He’s from a very rich family and lives off huge trust funds so I suspect it’s more about control than money. Unless he spent his trust funds????

    He sounds completely insane. Way to ensure no woman in her right mind will touch him with a barge pole!!!! Self defeating for someone who claims to want children.

      There was implications during their relationship… that Sophia supported their life style. And his crazy business ventures. With her finally dumping him… means that cash flow got cut off.

      He very well could have a trust that funnels out money to him. But I suspect it is not near enough money… for all the hookers and coke he enjoys. Neither of those things come cheap.

      But I do believe not believe… for one moment… that he has great concern for a couple embryo’s. As much as he needs a influx of cash.

    I’m not sure how Sofia feels, but I sure think Nick Loeb is PATHETIC and CRAZY for this whole lawsuit. He actually seemed to have some class with the response he gave after it was announced she was engaged; calling her majestic and saying she deserves love and happiness. I wonder what brought on his newfound desperation.
