Lindsay Lohan’s alleged smackdown victim isn’t pressing charges

This disappointing news came out a few days ago, and I’m sorry I didn’t get to it before now. Apparently, my Team Random Fired Betty Ford Employeee status is in major flux. Dawn Holland, the Betty Ford ex-employee who allegedly was the victim of a Lindsay Lohan drunken-smackdown several weeks ago, is no longer “working with the authorities” on the battery incident. Meaning that Holland is no longer interested in pressing charges against Lindsay, which also means that a potential assault charge won’t be going on Lindsay’s record and affecting her probation. Which means we’re even further away from seeing The Crackhead in jail.

The ex-Betty Ford staffer who claims Lindsay Lohan assaulted her earlier this month will not only drop her criminal complaint, she’ll refuse to cooperate with authorities … TMZ has learned.

Dawn Holland, who told TMZ earlier this week how Lindsay ripped a phone from her hand causing a severe sprain, now says Lindsay should not be prosecuted.

Holland’s lawyer, Keith Davidson, tells TMZ, “Dawn will not continue to press charges against Lindsay, nor will she be assisting any further in the investigation or prosecution.”

And this is interesting … we asked Davidson how his client would respond if she’s subpoenaed, and he said, “She won’t.”

Davidson says Holland and Lindsay share a common bond — they’re both recovering addicts, Holland does not want “in any way shape or form to do anything that would violate Lindsay’s probation or cause an arrest.”

Davidson says, “A crime has quite simply not been committed by Ms. Lohan.”

Ugh, I hate this. I really do. I was all prepared to completely go to bat for Holland. But the crack hustle never ends… which brings me to another point: was this part of some kind of pay-off situation? Did Mother Crackhead open up her checkbook? Or did Holland just figure that this whole thing wasn’t worth the trouble? Ugh.

    I’m gonna go with “payoff”. After all, isn’t there a quote from Blohan along the lines of “Oh, you want money.”? But from what I’ve read, Holland is in for a shitstorm in the new year, including an investigation from the feds & something else I don’t care to remember right now.

    Blohan sucks! Just once, I’d like her to get her comeuppance. Honest to Buddha, it’s not like it’s not overdue or anything! ARGH!!!

    Holland was in no position to demand a settlement for silence. She f’ed up big time by doing that interview with TMZ before lawyering up. Probably under lots of pressure by Lilo’s lawyers, Betty Ford reporting her HIPAA violation, etc.

    Exactly this wasn’t a payoff.
    This woman’s case fell apart as soon as she talked to TMZ. There is a 50/50 chance of Lindsay ending up in jail before February 25th if she can’t stay away from drugs or alcohol.

    I agree with Alejandro Holland broke federal law by speaking to TMZ . Lilo actually could have sued her and Betty Ford under HIPAA. Crack hustle wins again. I am just hoping the fact that she refused a breathalyzer effects her probation.

    Just because a victim doesn’t press charges doesn’t mean a prosecutor/ DA can’t haul Lindsay into court…it will just be harder for the DA to get evidence, he/she may have to subpoena the victim (and if you are subpoena’d, you HAVE to go). So I hope the DA does have enough evidence and goes for it!

    Must be nice buying your way out of trouble everytime you fuck up. I cant believe she got away with refusing to take a drug test IN REHAB and instead took a breathalyzer test hours after the fact…. well actually I can because she gets away with everything.

    As one who’s regulated by HIPAA, I wouldn’t divulge any info to any entity about anyone. But I’m not Holland. She probably knew she had the shit end of the stick and conducted herself accordingly.

    I hate to say anything that remotely sounds like I’m defending Lindsay because, let’s be real, she probably did assault Holland. But, this Holland woman completely screwed herself by talking to TMZ. I don’t smell a pay off here. I agree with Alejandro.

    As much as I’d like to blohan in jail and getting that Jailed Heat Part Duex, this ain’t her doing.

    In fact, she hasn’t need to lift a finger to make this happen.

    The fired worker, according to other gossip sites, has shady past. More importantly, she screwed over Betty Ford. Betty Ford takes its NDA very seriously. Why else would stars pay mega bucks to come to rehab, but for NDAs that give them expectation of privacy? By breaking it, the fired worker not only broke her contract, but she also besmirched Betty Ford’s reputation.

    I bet what happened was Betty Ford, not Blohan, threatening to hang dry this rat.

    Oh, there was a payoff but not by Blohan. Betty Ford paid off BOTH Blohan and Dawn Holland. Blohan isn’t going to sue Holland because she doesn’t have any money, Betty Ford does and is ultimately responsible for the behavior of their employees. Holland isn’t going to sue Blohan because she doesn’t have any money, Betty Ford does and does not want Holland talking about a potential cover up regarding Blohan. It besmirtches Betty Ford’s reputation. Ironically, Blohan single handily f ucked up Betty Fords reputation all by her lonesome.

    I didn’t buy the “payoff” thing because does Lindsey have enough money to pay someone off..

    Privacy ha! LL, I assume with Betty Ford’s concurrence, has turned her spa-stay there into a circus. If Ford ever was a ‘serious’ rehab, it isn’t regarded in that manner now. And so Ford joins all the others, both individuals and institutions, who’ve used LL’s remaining shreds of fame – AKA notoriety – to their own gain and to LL’s detriment. If LL cared about gaining back her health and building a career in acting (and I’m not saying RE-building because, as an adult, she has done nothing of any merit), she’d be quietly at Hazelden for many months, refusing all photo ops and staying low-key and out of sight.

    I’m confident that LL assaulted Holland, and am therefore confident that Holland didn’t back away from pursuing this because it didn’t happen. We’ll never know the reason(s) Holland did so but I think we have noted reasonable scenarios here in this forum.

    I agree with Alejandro as well.

    It seems we’re at a consensus, talking to TMZ was a huge mistake. The least she should’ve done was consulted a lawyer first. Probably figured LL wouldn’t be held accountable at all. She made an impulsive decision, probably because she knew whatever info she had to offer would only be valuable for so long, before the paps got the story elsewhere. So there was pressure on her to make a decision fast. 10k is pretty persuasive.

    I strongly believe there was no ‘pay out’ to prevent Holland from pressing charges… only an agreement that LL/BF wouldn’t sue (which both LL & BF have grounds to do.)

    But something bothers me about what was said. About Holland also being a recovering addict, and not wanting to do anything to interfere with LL’s recovery.

    A recovering addict should KNOW that LL isn’t going to get any better while not being forced to face consequences of her actions, being enabled. It’s really doing LL a disservice, making her MORE likely to continue to disregard the recovery program & fail. A true addict understands the way an addict thinks, & that sometimes being tossed in jail is the best thing for them.

    Yeah, if this all quietly goes away and Dina doesn’t sic her goons on Betty Ford for harboring a vicious attendent, there was definitly a payoff. Once two days had passed and Gloria Alred hadn’t become involved, you knew it was over.

    Would it really be a violation of federal law protecting patient records/confidentiality for an employee of a medical facility to report that a patient assaulted him or her? I would not have thought that such a report (to the police or to the public) of an alleged crime would be violate record/confidentiality protection statutes. My blood pressure is protected for sure, but my punching my doc in the nose? Also, would not Lohan’s sentencing judge have the motivation and the authority to investigate a criminal complaint against Lohan that was immediately withdrawn after it was made?

    Paidoff by Lohans. Nothing she does now will get her job or her credibility back so it’s not like she’s trying to clear her name. It was too late for that as soon as she spoke publically and named names.

    Lindsay will probably keep her hands clean until the probation expires, then screw up publically when it won’t affect these charges or probation.
