Christina Aguilera released, won’t be prosecuted for public intoxication

Okay, here is what is good about Christina Aguilera’s arrest for public intoxication: she wasn’t driving. Bitch just likes to get her drink on, and then she just gets driven places. Unfortunately, her driver/handler/boyfriend Matthew Rutler was drunk as well – probably because he was trying to keep up with Christina’s boozehound ass. So when they were pulled over, Rutler got booked for DUI, and Christina was taken in for public intoxication. Now, some of you said that you really have to be completely wasted to get a charge of public intoxication – is that how it is in California? Because in Virginia, you can get a public intoxication charge at the drop of a hat. I know people who have public intoxication charges because they had one or two drinks at a bar and then walked home, where they were stopped by a cop and arrested. Anyway, different rules, I guess.

So Christina was just released from the pokey, where it seems that cops were just waiting until she sobered up. TMZ has a photo of Christina hunched down in the backseat of her chauffeured car here. And now the sheriff’s department is saying that they’re probably not going to pursue the public intoxication charge, that it was just a placeholder until Drunky McClownFace sobered up:

Christina Aguilera was arrested for public intoxication early Tuesday morning and jailed for her own safety until she recovered. Her boyfriend was also arrested for investigation of DUI.

The singer was released from custody at the West Hollywood sheriff’s station at about 7:30 a.m., according to Los Angeles County Sheriff’s spokesman Steve Whitmore.

“We have no desire to prosecute, none whatsoever. It just for a public safety issue,” says Whitmore. “When she was able to navigate and to think on her own and make her own way, she was released.”

Aguilera, 30, was a passenger in a car driven by boyfriend Matthew Rutler that was pulled over at 2:45 a.m. when deputies noticed the vehicle driving erratically. Both were booked, Aguilera for public intoxication, Rutler for DUI.

“She was not capable to taking care of herself. She was incapacitated,” says Whitmore. “She was cooperative. She was not belligerent in any way whatsoever. She was just intoxicated.”

By law, a person can be held in custody if they cannot take care of themselves, he says.

“As she got better, she just said, ‘I would like to leave,’” says Whitmore, and deputies granted her request.

Aguilera’s reps were not immediately available for comment.

Was this Christina’s wakeup call? I doubt it. There’s still a ways to go until Rock Bottom. I bet when Christina’s team brings up rehab today, Christina will fire all of them.

Also – just how drunk do you have to be for the cops to deem you “incapacitated”? Well, at least she wasn’t yelling at the cops and calling them all whores. Like she did with her brother’s girlfriend.

Oh, and I bet the boyfriend gets dumped too. That’s next. She’ll blame him and call him a bad influence.

    Drunks like her usually need someone to blame for their troubles, so it’s probably a good bet she’ll dump him for “embarrassing her this way”. I’m sure the ugly trolls will be lining up outside her door to replace him. Someone from “Intervention” needs to get in touch with Xtina- THAT would be an awesome hour of television!

    yes, in california to be arrested for public intoxication you basically need to be causing a huge disturbance, fighting, damaging property, back talking a cop, etc. they usually just arrest you to get you under control. they’ll throw you in the drunk tank for the night, but they usually don’t book you unless there are other charges.

    i bet christina bitch slapped the cop that arrested her boyfriend haha.

    Explain to me how someone can be charged with public intoxication as a passenger in the backseat of a car?

    Even worse, if an intoxicated passenger in a car can be thrown in the drunk-tank, no person who is wasted and does the right thing by taking a taxi is safe.

    Cripes, with this kind of fascist BS, three-quarters of the population would have been in jail at one point in their life (New Year’s Eve, anybody?).

    According to the cops they just held her because she was so drunk they didn’t think she could make it home on her own, she isn’t actually getting charged. Imagine if they put her in a cab she went home and died of Alcohol poisoning or choked in her sleep etc.
    Xtina get some help and dump your boyfriend STAT.

    I don’t really think it was the case of her just being drunk in the passenger seat. The fact that she didn’t get released from the drunk tank until just now speaks volumes about how intoxicated she was, because I believe they check your blood alcohol and it has to fall below the legal limit in order for you to be released. And in most places I’ve been, you have to be causing a real drunken scene in order to be popped for public intox. The police were well within their right to arrest her. They’re not charging her, but if she’s drunk enough to let her bf drive her drunk and then isn’t coherent enough to take care of herself, then she probably needed a few hours to sober up. Child stars, man.

    A (Canadian) police officers take on the situation:

    Since homeboy was getting booked for a DUI his car would be towed. That meant that Xtina would have to get out of said ride, hence being in public. They also had no one to hand Xtina off to so the police had to keep her in custody for her own safety. So they charged her with the misdemeanor, booked her as per processing and then monitored her. She then couldn’t be released until legally sober.

    Basically if anyone had been there to claim her and take her home it wouldn’t have happened.

    I think it’s wrong to assume that Xtina was even moderately coherant! She could have been close to/or passed out in the back seat. If a cop determines that a drunk can’t function and is so out of it that they can’t even make a call to have someone get them, what are they supposed to do? I don’t think it’s weird at all that she was taken in. How many times have we seen pictures of her where she’s literally being carried out of clubs and restaurants?

    @Roma: I hear what you’re saying but it depends too on the individual officer(s).

    I know of situations where the cops have waited with an individual and fired them in a taxi. Or, in the case of an impaired female in the company of someone who’s been arrested, driven her home. They have the authority to apply their discretion.

    “Is there someone you want us to call?” is by far more frequent a response from a Canadian officer in a situation like this where a woman is concerned than going through the hassle of processing the person and holding them in custody.

    That would have involved initially charging her with a criminal offence since as I’m sure you know, we don’t have misdemeanors here.

    Certainly Augilera would have her assistant on speed dial. The police could’ve been discreet and called them but chose not to.

    They wanted to make a fool out of her. Okay, she did that by herself but you get my drift. Maybe they were trying to drive a point home. Maybe they wanted a story to share with their fellow officers for shits & giggles.

    Who knows with cops? After G20 in Toronto, I certainly don’t.
