It was the story of the day yesterday – Linnocent tested positive for alcohol during a screening done by the LA Probation Dept, then she was called in for a hearing with the judge, and then she was let go, without jail or even a slap on the wrists, merely with a warning to not throw any more “house arrest parties”. The excuse for this miscarriage of justice was that Linnocent’s previous judge had ordered drug tests, but not alcohol screenings, so the Probation Dept. didn’t have any “right” to test her for alcohol in her system. Nevermind that the day before, Linnocent had done an interview with Life & Style claiming that “alcohol… is just not part of my life.” I guess she forgot to add “LMAO, JK! And SCENE!” So… basically, the California legal system says that a drunken cokehead who hijacked a car while high, thumbed her crack nose at the legal system for years, crack heisted everything that wasn’t nailed down, and beat the hell out of her rehab sponsor… is free to be a boozehound again.
So what is Linnocent’s excuse, now that she’s learned her very important crack shenanigan lesson? (The lesson: “Linnocent can do whatever she wants, because people have given up on trying to punish her.”) Linnocent has gone back to an old-standby, because her crack brain is too frazzled from years of drug and alcohol abuse to think of a new excuse:
Lindsay Lohan is adamant she did NOT drink wine, beer or liquor during her stint on house arrest … insisting her dirty test was caused by a fermented tea that contains a TEEEENY amount of alcohol.
Lohan has been telling friends she’s been drinking her favorite kombucha tea again … the same tea that caused her probation officer to raise a red flag earlier this year because it contains alcohol. The company behind the drink claims the alcohol content is less than .05%.
Of course, the judge ruled that Lindsay is ALLOWED to consume alcohol during her house arrest sentence … so the dirty test didn’t matter anyway.
TMZ spoke with Lindsay about the situation … and she told us, “I am responsible, and I’m following the rules and obeying my judge and the Los Angeles judicial system.”
She adds, “I’d like to do what I must to get my film career back and the respect of directors, actors, writers, studio heads, fans and so on.”

ROL has a story up saying Judge S refused to call Judge Fox to ask if he had wanted SCREEEEEEEEEEEEEEE to be tested for alcohol during probation, but Sautner refused to make the call. She was also ticked SCREEEEEEEEEEEE’s VOP was made public. The DA’s office is ticked and is apparently seeing if they can do anything about this. Or so ROL says. Who knows. Meyers has also been officially taken off the DUI case, although she states she doesn’t know why.
All of this is strange, as is her claim SCREEEEEEEEEEE just used “poor judgement,” and was allowed to drink alcohol WHILE UNDER HOUSE ARREST AND WHILE ON FORMAL PROBATION FOR AN ALCOHOL-RELATED OFFENSE. I also believe this is either 11 or 12 VOPs. SCREEEEEEEE is a repeat offender and THIS close to being a career criminal.

As a personal licence holder in the UK – any drink that is 0.05% alcohol or less is actually classed as alcohol free – so nce try linocent but I am not falling for this BS!! Why is Sautner even referring back to Fox? Fox put the case over for trial in Sautner courtroom. Sautner was the presiding judge, was over seeing the case, and deciding the punishment. What the f*ck does Judge Fox have to do with anything? I’ve read other comments on other blogs and no one seems to find this odd.
Another point of contention that no one addresses. “Judge Sautner said Lindsay is now restricted for the remainder of her house arrest to one friend at a time at her Venice loft, in addition to family members. And, the judge said NO PARTIES at Lindsay’s crib.”
OK question, was this ALWAYS the way it was suppose to be, and if so, she certainly violated her probation by having more than one guest, other than family. If during house arrest, the rules stated otherwise, why now, all of a sudden did the Judge limit her to one guest? I’m more than confused, not only on the rules of house arrest but the rulings of this Judge

When Judge Sautner sentenced Lindsay to 120 days in jail, which turned into her mini vacation, she said that she wasn’t going to have her tested for drugs and alcohol. She said that Lindsay had “psychological issues” that she was self-medicating for. I thought and still do, that that decision was insane, she’s on FORMAL PROBATION for f*ck’s sake! Even if Lindsay’s problems are psychologically based, she’s still abusing drugs and alcohol and getting into trouble as a result. Thus the wheel goes round. What part of this doesn’t Sautner get. I’m not that smart and it makes perfect sense to me. Prohibit drugs/alcohol, make her attend counseling, and hopefully this nonsense will stop, and maybe just save her life.
When Judge Steph said she could be on house arrest, she disavowed all responsibility because “how they choose to carry out my sentence is the sheriff’s business, not mine.” But I believe the sheriff’s office, as the body that is in charge of her incarceration (and house arrest is a kind of custody–she is in custody now) has the ability to drug/alcohol test her at any time without a specific order from the judge. I demand a recount, an investigation, and a royal microscope up Sautner’s robe!

I, as well as Sautner, believe she has psychological issues, hence the pathological lying, just for openers. The fact that she abuses (not addicted) alcohol and drugs, in my opinion, is the catalyst for trying to quiet said demons. I’ve touched on these issues in the past with previous posts,(again, my opinion only) that she pathologically lies. For instance, “the I quit smoking” lie. The fact that she was photographed smoking cigarettes no more that 48 hours after that declaration, to me, says she has major issues. I mean, why make such statements? Smoking is certaily legal and no producer/director is going to not hire her for that. I get why she lies about the alcohol and drugs, but why lie about something as trivial as smoking cigarettes?
Miss Diagnosed, you ARE that smart and to some degree that makes the rest of us smart on this blog, due to the fact, that we all came to the same conclusion.
Just to add an addendum to my previous post of why I think Blohan violated her probation on more than one occasion, reason number 4, the fact that she refused SUBSTANCE TESTING, not alcohol on 2 occasions in May, which was REQUIRED under Sautner. Wouldn’t that be a violation, in and of itself? I looked it up, under Californis House Arrest, which is under the jurisdiction of the SHERIFFS DEPT., not the judges, it basically states, that once a defendent is remanded into the custody of the jail/and or/house arrest, the sheriff’s department is in charge. It also states, said Sheriff’s department can at any time enter said defendants home, search, or conduct drug/alcohol tests, whether or not the Judge in case orders it. Because, once Sautner gives her ruling, the power then switches over to the Sheriffs Department for carrying out her sentence.
Again, just my opinion, on why Blohan violated her probation on 4 different times, just in the last month!

Your post was not up yet, but we basically said the exact same thing. INVESTIGATE! The sheriffs dept. is in charge, not Judge Fox, who Sautner used as a scape goat, and certaily not Judge Sautner.

And why is Sautner holding on to the ability to (not) discipline her if the Sheriff dept is responsible for her at this point? I wish I could understand Sautner’s frame of reference. Does she think that Lohan is too big of a mess for the courts to fix/address? Does she feel that Lohan’s problems are best adddressed privately? That Lindsay is s bit mad and she doesn’t want to add to her woes? Her rulings seem utter madness but there must be SOME logic behind them.
Here’s another puzzler: Asst. DA Danette Meyers just stated that she’s been removed from the case without being told why. Is there bad blood between the DAs office and Sautner? Something definitely is fishy in the water.

The judge (along with the rest of the Cali-legal system) is an idiot. The girl had a DUI & was sent to alcohol rehab where she was caught going over the wall, then attacking an employee. Either the judge should be thrown off the bench, or she forgot to check the little ‘box’ next to the word ‘alcohol‘ on the form.

Hey guys…I’m coming off a busy few days so I’m playing catch up here.
I saw the story about the commercial for New Zealand Air. Ick. At least it be won’t be airing here (hopefully).
Love the photo with the posing in front of the privacy fence. Idiot. She puts it up to prevent pap photos then she takes it down when she needs to make a quick buck. I kept hoping she’d fall face first into the cactus.
That faux tan crap she had on for court was HIDEOUS. I used to work with a girl many years ago who did that and it was gross. She’d apply it to her face neck and hands and you could see where it rubbed off on her white blouses. I thought the technology of the product had improved since then. You’d figure with all her experience with it Linds would be better at it but I guess not.
Since she’s getting out of house arrest Wed. I’m sure she’ll be hitting the Chateau first thing. And since the court has now given her a free pass to drink we’ll be seeing photos of her drunkass soon enough.

That CS is what I’m hanging my hat on. She was sentenced 3 months ago and barely put a dent in it. She went, I think, 3 times but only stayed an hour or two each time, so basically nothing. I, like @ OhMyMy believes she’ll be having “dinner” at the Marmont the second that GPS monitor is removed. I’ve said it before and most posters concur, she will NEVER COMPLETE her CS in time.
