Lindsay Lohan checking into Morningside rehab in Newport Beach today?

Lindsay Lohan’s three-month rehab sentence is supposed to start today. I’m writing this Wednesday night, so we’ll see what happens. Lindsay posted the header photo on Tuesday night on her Instagram (and then she took it down) – she posted it with the message “90 days and 270 looks”. She changes her clothes three times a day? I’ll believe that when crackheads fly. Earlier this week, Page Six reported that Lindsay had some kind of deal with Celebuzz to “blog” about rehab either during her court-ordered sentence or after – sure. But first she has to settle on just one rehab – yesterday, TMZ made it seem like it was still up on the air:

Lindsay Lohan has less than 24 hours to hightail it to Seafield Center in New York … but even as she packs her bags she’s telling people she may bail on the rehab facility because they won’t let her smoke.

Sources close to Lindsay tell TMZ … she doesn’t think she can hack not smoking for 90 days.

We’re told Lindsay asked her lawyers to try and convince Seafield to make an exception and, failing that, find a facility that would let her puff away.

Sources say Seafield was unbending — no smoking, no exceptions. So lawyers triggered Plan B — we’ve learned they contacted Morningside Recovery in Newport Beach — a place Lindsay once rehabbed at for a short time in 2010.

Morningside staff tells TMZ … they DO allow smoking. Problem is … we’ve learned the City Attorneys for L.A. and Santa Monica haven’t signed off on Morningside. We’re told prosecutors had no idea Lindsay is thinking of bailing on Seafield.

Lindsay is acting like she’s going tomorrow … She Instagrammed this photo of herself packing, saying, “90 days and 270 looks.”

Lindsay’s lawyer is supposed to appear in court tomorrow with proof of enrollment — and the expectation is that she’ll have enrolled at Seafield.

FYI — Lindsay is packing 270 outfit changes, but if she goes to Seafield, she’ll have to leave 263 behind. They only allow 7 changes of clothes.

I know it’s gross to many of you, but I think it’s particularly hardcore to demand that recovering addicts give up a LEGAL addiction with cigarettes. I mean, I think the focus should be on putting down the crack pipe, and if you have to smoke cigarettes to get through it, so be it. Let cigarettes – which are still legal – be your crutch.

Anyway, Hollywood Life reported last night that Lindsay had chosen Morningside Recovery in Newport Beach for sure. Then TMZ said that LL was definitely flying back to California to check into Morningside, and that there was a lot of crack drama:

Lindsay Lohan is in BIG TROUBLE … She’s thumbing her nose at prosecutors and flying to California tonight … presumably to enter a rehab facility that is not part of her plea deal.

Sources familiar with the situation tell TMZ … Lindsay is about to board a private jet in NYC.

TMZ broke the story … Lindsay’s lawyer and prosecutors agreed she would enter the Seafield Center rehab facility in Westhampton Beach, New York. She’s required to show up by tomorrow morning.

But as we reported earlier, Lindsay was freaked out because Seafield won’t allow her to smoke. We’re told she may be headed for Morningside Recovery in Newport Beach, CA … which does allow smoking.

Problem is …. prosecutors did NOT sign off on Morningside. What’s more … we’ve learned NO ONE from Lindsay’s camp has contacted either the L.A. City Attorney or the Santa Monica City Attorney to get the change of plans approved.

In short … by not entering Seafield … Lindsay has violated her plea deal. Lindsay’s lawyers are in court tomorrow along with prosecutors, where her attorneys are required to show proof of enrollment in Seafield. It’s a good bet the judge is going to be pissed, and a better bet prosecutors will be pissed.

If the judge believes Lindsay has violated the deal, he can throw her in jail for 90 days.

Michael Lohan has been telling everyone who will listen (mainly Radar and HL) that Lindsay REALLY wants to go to a rehab in Florida and she feels like she’s being “forced” to go into this Newport Beach facility. Which is bang-on. She IS being forced, per the terms of her plea agreement. Anyway, Lindsay is apparently in “hysterics”. Of course.

I’m sure we’ll have lots of crack shenanigans today. Stay tuned.

    Ugh I can’t believe that I used to live in the OC. It’s nothing but a constant party down there. I wish her luck though, I’m sure it will take about a week before some stoned dude breaks her out. If that long.

    I agree – let her smoke, if she’s geniunely coming off drugs and alcohol (as opposed to sneaking them in!) it’ll be hard enough as it is.

      Then all they would be doing is replacing one addiction with another. The point of them not letting her smoke would be to stop her from having these crutches ( drugs, alcohol and smoking ) and make it so that she stand on her own two feet with out relaying on other things.

        Not really. I went to AA when I quit drinking, and they don’t encourage you to quit smoking as well as if you fail at the smoking, the tendency is to say hell with it, and drink as well.

        So they encourage getting a handle on the drinking and then worry about the smoking. At least that’s how they when I went.

        We could go on and on about this. Cigarettes, although unhealthy, do not contribute to her antics.

        Why would they stop sugar, caffeine, and sex too? Unless those substances/activities are being used to excess and disrupts the persons day to day life of course. Nicotine is often a crutch for people going through withdrawl and people become dependent on it during hard times. If this safety mechanism were to run out or suddenly stop working they person could suffer a hard relapse. Isn’t it better to learn how to walk free of these vices rather than replacing 1 crutch with another?

        To add to the above. Her antics are rooted in her mental illness. The drugs probably make it easier for her to mask her pain from herself. Rehab of sorts and AA preach that you should cut ties with all your friends, hangouts, activities that you were exposed to when you were using. That imo is the hardest part. To start over from nothing. Once all of this is done she can make real progress on healing her issues from a mental standpoint.

        Will this happen? She would have to cut off the world. Lindsey’s followed everywhere so to escape seems near impossible. I do feel for her on some level.

        FLORC, you summarize my point in the first sentence. Does nicotine disrupt her day-to-day life? unlikely. Does it provide a crutch? Perhaps and so what. So doesnt Methadone, Suboxone, and a slew of other approved treatment regimens for both addiction and mental health diseases. I hear and respect what you are saying about replacing vices, addressing mental health, etc. I am a nurse, I hate what cigarettes do to people. Would never advocate smoking.
        Until I see evidence that smokers are more or less likely to relapse- and there is none either way- I don’t see the pphilosophical issue with smoking in rehab,

        That was a truly thoughtful and well-worded response. I feel a little bad with my run on thoughts and sentences. I’m a nurse too and you don’t need to tell me how awful they are.

        I just see Lindsey’s behavior as seeking anything to alter her state so she doesn’t have to deal with her own thoughts and feelings. Nicotine may not disrupt her life now, but if she learns to use cigarettes to sooth her through a rough withdrawal she may become physically and emotionally dependent. Then it will inhibit her day to day life. If all possible crutches are taken away … You got it.

        Taking Cigs and sometimes other things like coffee, out of the equation early on just seems like a preemptive and necessary strike to full recovery.

      Even if she should be allowed in a facility that lets you smoke…WHY didn’t she use the many weeks of freedom she had to get this worked out? Coachella is more important?

      This is yet another way for her to disrespect the court and justice system. They wouldn’t allow this to repeatedly happen with regular folks.

      Alcohol is legal too. Legal vices, including alcohol and smoking, can still be addictions. The entire point of rehab is to overcome the need to rely on stimulants to cope. Any type of stimulants.

      I agree too Poppy, might as well let smoke (meaning they should allow her to rehab in a facility that permits smoking). She’s already firmly addicted to tobacco – not something she’s just picking up now in detox. Believe me, I have NO compassion for this twat, but I also know the point of these rehab facilities is not to sort out every issue in a person’s life, it’s to get them off the substances that contribute significantly to repeated dangerous and illegal behavior.

      But it still p*sses me off to no end that she can pull these last minute boners and never seems to be held accountable in any way.

    I think this is all planned. She will bail on rehab, the judge will sentence her to 90 days in jail(starting at a future date)and she will only serve a day or two due to overcrowding. That’s it, sentence served and she won’t have to give up her cigs or Adderal.

        Good theory, however I’m not so sure as I heard she more or less had no choice to take the 90 day rehab because the actual jail time was quite lengthy, like a year or more. But I predict she will find a way to skate out of her consequences, of course.

        bluebelle: She has 2 sentences hanging over her head. One is 180 days, the other 240. Her 90 days in jail will be the minimum she will do, based on these sentences. And why oh why didn’t the judge find her in contempt and add more time to her sentence? Just another judge without balls. I’m starting to actually get angry. There is not one of us here who would get away with that stunt not one, but she does. Why? No really, why? It’s time the people of CA started asking questions loud and clear. Start with starstruck Sheriff Lee Baca. Why does she get released early for overcrowding when she is in a private cell? She is ALONE in a cell. Where does this bullshit overcrowding come in? If it’s that overcrowded why not early release for the ones that are actually living in those conditions? Write letters to the editor of the local paper inquiring about celebrity justice and a judicial system that is clearly biased to favour celebrities. Publish Blohan’s rap sheet. You would think that alone would open people’s eyes to the fact she should be in jail. Protest in front of the courthouse. Throw rotten tomatoes at Blohan (ok just kidding, but I’d sure enjoy it.

        Lady D, I feel your pain and don’t believe for a second that she will be held accountable for the further violations she will inevitably commit. It’s really a fame/class thing, the courts sadly almost always favor those with money while the poor innocents sit behind bars and this is the system the lawyers love as it lines their pockets with gold.
        I have no doubt she has access to all the drugs her heart desires and I can assure you her body/skin reflect years of habit. In the end the laws of compensation with catch up. Break those laws, pay the price.

      I don’t know enough about her deal, but a poster (not sure if it was this site) mentioned something to the effect of “it was 90 days of rehab or jail, but the prosecutors/judge agreed that she would DEF NOT be released early due to overcrowding if it’s jail. She does the full 90 days, either way. If it’s jail, then 90 in jail with no chance of early release”

        I think I remember reading that as well. Either way, in jail not only will she be able to smoke, she will also not have to go through the hours of therapy. I’m pretty sure she also will be able to still take any prescribed meds.

        The LA Sheriff runs the jail, and they decide who to release early using a “Matrix” that ranks criminal history and current charges. Because Lindsay is a nonviolent offender (and I know, drunk driving, etc.), she’ll be one of the first to be out. I clerked for a Judge who routinely tried to ensure that people would at LEAST have to serve a weekend, even had me call the jail to try and get a promise from the staff, and it never worked. They have their own system.

      A commenter on another gossip site said that she must have something big on someone important to have gotten away with as much as she has, and while he/she was probably joking, I think it’s true. I know prisons/jails are overcrowded and she’s a nonviolent offender, but she blatantly thumbs her nose at everyone and she constantly gets away with it. Heck, the judge that has been the hardest on her stepped down shortly before Lindsay was due back in court a month or so ago.

        I’ve also read comments from people who know more about Michael Lohan than I care to and they said Daddy Lohan has a lot of “undesirable” connections. Despite their strained relationship, Michael is the one Lindsay calls when she’s in trouble. I think Michael may be the one who has the connections that keep Lindsay out of jail, no matter how many times she thumbs her nose at the judicial system.

        Remember when they let out god awful Paris early? The judge sent her back. You’re right about it being the correctional facility, but I would hope the judge sends her back a la Paris. She’d probably upscond to NY and who knows what would happen then! Can’t wait to find out. She really needs to hit her absolute bottom if she’s gonna get better. But, unfortunately, she seems like she’s more of a person w mental issues than a person who was also raised in a shitty environment. Plenty of people were raised shitty and are not shitty people. But, plenty of people has mental issues (i don’t mean that despairingly, either). That don’t do what she does – self medicate. I’m not a doctor, lol, so I have no idea what would work best for her. Certainly nothing that teaches her she’s a victim. No bueno.

      The jails in California like in a lot of places in the country are extremely overcrowded, but building new facilities are expensive and unpopular.

      I have a feeling the sheriffs let her go after a day or two 1) because the jails really are overcrowded and 2) because by letting her go they’re drawing a lot of high profile attention. And then when people ask why she got let out they have a forum to complain about overcrowding. I tend to see political motives in everything though.

    I agree – let her keep her ciggies. In my state, there has been talk of not allowing smoking in treatment facilities but it’s almost cruel to take their one legal vice away. Yes, free them of meth, cocaine, Rx drugs and/or alcohol but let them have their cigarettes. And yes, alcohol is legal but that’s a different beast in terms of addiction.

      Canadian prisons are smoke free. I’m pretty sure the jails are too. WCB made smoking in the workplace illegal about 5? years ago. They banned smoking in bars at the same time. Lots of bars put out large to create smoking areas and then had to shut them all down a year later. Under these rules semi drivers are not allowed to smoke because the cab is their workplace.

    She picked the facility, allowed her lawyer to get it cleared by the court, tried to bully them to get her way and, when they didn’t bend, decided to stay FU to the entire process.

    This is in lieu of prison for God’s sake.

Doesn’t the court have to sign off on her rehab and they haven’t even been informed of this change? LL is just playing with the system the judge needs to actually grow a backbone and put her in jail for the whole 90 days that will stuff her up but hey she will be able to smoke.

    I agree, it is hardcore to have to give up Cigarettes as well as whatever someone is on but it needs to be done. Maybe giving up the crack first, and then the cigs would be a more achievable aim.

    And all this is purely academic, she’s not going to rehab and she’ll spend a day and a half in prison for her trouble. Does my nut in, PEOPLE ARE TRYING TO HELP HER and she’s thumbing her nose at it. There are people dying for the opportunity she’s been given.

    Nothing will come of this. She’ll go where she wants, and the CA courts won’t care. I really wish I knew what she had over them to make them bend over backwards for her so often.

    I agree with you that LEGAL smoking should be allowed. It’s scientifically proven that people have a better chance of kicking a habit if they don’t try to change everything at once; stopping smoking while stopping other addictions is just asking for the majority of people out there to fail. Some will make it by going cold turkey on all their addictions, but most won’t. One thing at a time does work. This is one thing I agree with Lindsey on – ugh!

    LL has had WEEKS to figure out what program she was going to attend, and you are telling me the prosecutors/judge are allowing last minute changes? I don’t buy it, but if they are, they are bigger f*cking jokes than I even originally thought.

    The amount of taxpayer dollars wasted on this beast kills me. And, no rehab facility worth a sh*t would allow someone 270 outfits…that is absolutely preposterous. But, so is the whole long misadventure that Lohan calls her life.

    according to tmz this morning shes going to that facility which was NOT signed off on by the courts in Newport beach. I wish she would stop being so damn arrogant! she really acts like shes above the law. I admit i use to be a fan of hers..we’re a few months apart in age so i guess i grew up watching her. she lost my respect with her arrogance and continued addiction problems. smoking is also an addiction and i think she should have to quit that too

    My little foster brother, who is 13, was sent to a juevenile boot camp of sorts back in November.
    It’s some kind of logging camp/horse ranch waaaay up north in the woods. In the morning he has school & mandatory counseling & then the rest of the day is spent doing physical labor. Chopping wood, building fires, shovelling sh*t, maintaining fences & outbuildings, as well as cooking & cleaning.
    In March they had to do a week long camping trip…we’ve had an unbearably long winter w/ tons of snow in our state…and they had to build their own shelters when they arrived at camp as well as cutting their own firewood & digging their own holes to sh*t in.
    We hear he is doing very well. Interesting how when forced to provide basic, true necessities for himself his desire for his former “necessities”, his addictions, have disappeared.
    Wonder how Lindsay would do in this environment?
    But she’d never make the flight.

        She had that opportunity at the Downtown Women’s Shelter and decided it wasn’t fulfilling to her. She was an ignorant ditchpig about the whole court-ordered DWS experience.

    perhaps she should have been planning this rehab stay a bit earlier, instead of world-travelling/partying and waiting until the day before to pull this crap. Had she not waited until the last minute, she could have found a rehab center that caters to her smoking, cleared it with the court, with days to spare.

    The court should put their foot down and tell her where she’s going, or a felony warrant will be issued. Its her own fault she waited until the last minute.

    As for not allowing smoking, this rehab center also caters to nicotin addiction, so no smoking areas for anyone..

    The police should look over those 270 outfits, I bet at least half the stuff is stolen, and there’s probably oxy sewn into the seams!

    Why is this all last minute? She was sentenced a month ago, right?

    I have no problem with a smoking facility letting her smoke, but if the NY rehab’s policy is clearly no smoking, she should have known that and shouldn’t ask for exceptions. I would assume the other patients choose that FOR it’s non-smoking policy.

    I think it’s fine for a facility to be non smoking. I am sure there are some patients that would prefer that or need that for their recovery. So if you DO want to smoke, don’t go there. Make arrangements BEFORE you vacation in Brazil and go to Cochella. Not the freakin’ night before you check in.

    I know it’s not going to happen but I’m holding a tiny bit of hope that maybe THIS time she’ll be held accountable.

    While it might seem “cruel” to take away her cigarettes, true rehab facilities work to not only detox but end addictive behaviors. Allowing her to smoke would only allow her to redirect a behavior, not fix it or face the reasons why she has these behaviors in the first place. While it may be legal, allowing it keeps her from dealing with her issues.

    The reason she can’t smoke in rehab? NYS passed a ban on smoking years ago. Any state/fed funded facility (Medicare, Medicaid, etc.) will lose credentials if smoking is allowed. You can sneak a puff or two, if you’re a good sneak or actress. Lohan is neither… she even sucks at sneaky.

    it always has been. 90 days vs. jail for a few days?
    If they would only throw the book at her!
    Then let her out to harm or kill herself and get it over with.

    Sorry can somebody explain this for me? The court demanded that she go to a 90 day lock down facility, which apparently didn’t exist in the US. They finally agreed on a facility in New York.

    Apparently this was an issue with her because she wouldn’t able to take her aderall, or whatever drug she claimed to need for her ADHD, never mind that this is really true or not. And she was upset about that but went to Brasil and coachella without even discussing this issue.

    Now she is going somewhere comepletely different entirely? How is that ok with the court?

      I don’t get it either. Lilo is totally above the law, apparently. I don’t blame her for her awful, entitled attitude because it seems like everyone goes out of their way to make sure she gets what she wants.

      Honestly it feels like this. Boohoo I’m sentenced to jail because I did something bad and deserve to be punished…. But I choose to spend that sentence in a five star hotel in Hawaii.

      How is that ok with the judge?

    The point is she is treating this like an extended vacation. She doesn’t want to do the work to get healthy. Rehab is not supposed to be fun or easy or a way to show off your 270 outfits while smoking and popping adderal. Which is what I think this is really about, taking adderal, the smoking since it is legal is just a conveinent Lindsay excuse. She doesn’t want to give up adderal since it’s speed and she doesn’t want to gain weight.

    If the judge doesn’t violate her probation like he said he would. He said ‘he won’t even have a conversation he would just throw her in jail’

    Then the legal system is a joke and we should all just commit crimes as we see fit.

    I truly believe that the only way to save Lins is to put her somewhere for a year or more and then keep her entire family away from her. If you ask me both her parents should be arrested for child abuse. They have earned money and fame off their kid and turn her into a joke and a trick. She at one time really had talent. I think this chica carries lots of guilt about lots of stuff that we will never know about and the drugs help her in her sick mind to not think about it all. I wish her luck and hope she can find the strength to keep on living and trying to stay sober.

    Oh, Good Lord. TMZ is live streaming her attorneys in court right now. Her lawyer is trying to say that they moved her choice of rehab due to the prosecutor’s office supposedly leaking the details to the “internet”. Um, I am sure it has been Lindsay or her family leaking the details, not the courts. I suppose the courts also leaked that she checked into another facility this morning, even though they didn’t know until today. Yeah, right.

      Her lawyer is the most unprofessional POS that I’ve ever seen. He constantly interrupts the judge and rambles nonstop. He’s one of those morons who thinks that constantly talking makes others think he knows what he’s talking about. The prosecutor slapped right back at him about his allegation that they leaked the info by saying that somehow the media knew that she was at morningside this morning when Heller admitted that the prosecution didn’t know until they arrived in court lol

    She just got away with it once again. Checked into Newport Beach rehab that lets her do whatever she wants. Does not have any of the required restrictions on her. It is even being investigated at this time and under danger of being closed.

    Cigarettes are a severely deadly addiction. But most importantly, if you’re still addicted to *anything*, you are still an addict. For someone with an addictive personality (which Lohave obviously has), becoming not-an-addict requires a core personality change, otherwise you’ll just pick up something else again and have the same behaviors all over again. Like a dry drunk.
