Oscar Pistorius sentencing: he could get ‘house arrest & community service’

Oscar Pistorius’s sentencing began today in South Africa. The judge is hearing testimony from Team Pistorius right now about how devastated he was and is following his murder/manslaughter of Reeva Steenkamp. A month ago, Pistorius was found not guilty of premeditated murder (the equivalent of first degree murder) but found guilty of culpable homicide (the equivalent of manslaughter). Basically, the judge said that the prosecution didn’t prove that Pistorius intended to kill Reeva, but his actions were negligent. South African legal experts claimed that the guilty charge could end up netting Oscar some serious jail time, or next to nothing at all. It’s all in the hands of the judge for sentencing. Here’s some of what went down today:

South African athlete Oscar Pistorius was a “broken man” after killing his girlfriend, Reeva Steenkamp, his psychologist has told a court hearing. Lore Hartzenberg said therapy sessions with Pistorius were often interrupted by his weeping and retching. Prosecutor Gerrie Nel accused her of avoiding questions about an alleged new love in Pistorius’s life.

Pistorius faces up to 15 years in jail, although Judge Thokozile Masipa may suspend the sentence or impose a fine. She said the athlete had acted “negligently” when he shot his girlfriend through a toilet door, but had genuinely thought her to be an intruder.

His psychologist was the first defence witness to speak at the sentencing hearing, which could last several days. Lore Hartzenberg told the courtroom that Pistorius was “very emotional” during grief therapy sessions, which were often disrupted by his weeping and retching.

She said the athlete felt “vilified and humiliated” by the media and social media networks, making him feel “utterly worthless”. Prosecutor Gerrie Nel said it was “very strange” that Ms Hartzenberg was “avoiding” answering questions about Mr Pistorius having a new relationship. Ms Hartzenberg said Mr Pistorius had never mentioned a new girlfriend in the therapy sessions. She said she had only heard about the relationship from reports in the press.

Oh, Pistorius didn’t talk about his 19-year-old girlfriend in therapy? That’s interesting. It sounds like Pistorius puts on his wailing and sniveling performance for the therapist and then goes home to his 19-year-old girlfriend. I wonder why the girlfriend isn’t more relevant to the proceedings?

The analysts continue to insist that there’s a real possibility that Pistorius could get NO jail time whatsoever. A probation officer (a defense witness) recommended that Pistorius “should serve house arrest and community service.” The prosecutor called the suggestion “shockingly inappropriate.”

    I will be pleasantly surprised if he gets jail time. I think this judge feels sorry for him. The whole thing makes me sick. He knew exactly who was behind that door when he slaughtered that poor, innocent young woman.

      I’m okay with the house arrest as long as he stays in the house where he shot Reeva and there is a cardboard cutout of her in situ, (where her lifeless body lay in the bathroom, blood and all).

      ETA: And now I feel like I don’t deserve my human card. :-C

        He is vile and doesn’t deserve freedom. He meant to kill his girlfriend and he’ll allegedly kill the next if she starts acting the same. I wish there were a different judge for sentencing, but at least the prosecutor isn’t letting up on him.

      Oh. Hell. No. I feared this would happen. Why does the judge feel sorry for him? His story sounded preposterous. Even if you did think there was an intruder in your house, wouldn’t you wait for them to come out of the bathroom instead of shooting them through the door. Makes no sense. I believe in my state you can’t shoot even if you know there’s an intruder in your house. Your life must be in imminent danger. I feel for Reeva’s family.

        @Betty who said “Even if you did think there was an intruder in your house, wouldn’t you wait for them to come out…”. Well, it is complicated. I guess it depends on where you live. Where Oscar lives, it is highly plausible that the criminal would have a knife,gun etc. to kill the person that gets in their way and how much you trust your countries police station differentiates too. Don’t get me wrong. I know this fucker KNEW it was his girlfrind, i am not believing in anything that come out of his mind. I am just trying to explain why a judge who should remain objective would accept Oscar’s ‘story’.

      I also think he should be banned for life from ever owner or handling a firearm. I think that’s actually pretty reasonable given the fact that he’s proven his reckless disregard for the safety of others in his use of the same.

        That’s a great suggestion ( in addition to jail) I hope there isn’t an Australian version of the NRA or next they’ll be prompting the gun crazies to vouche for his right to bear arms

      @GoodNames I don’t think that the judge feels sorry him. From the little bit I’ve read about her she is very hard on men who commit acts of violence against women.

      Judge said he didn’t have time to make something up…really? I wonder what he was doing when the guard asked if everything was OK and he said yes, comely …AFTER HE BLEW HER AWAY
      and the judge crossed a very important line of perspective… yes bought the act

    I will be furious is he gets house arrest. He killed his girlfriend in a violent crime and should have to pay for it. Also, you lost all rights to whine about being labeled a murderer when you did in fact not just kill but over killed someone.

    Most likely he’s going to get next to nothing. His crocodile tears and uncontrollable sobbing sucked in the Judge and Jury. They think he showed “remorse.” Good grief, don’t they know bad acting when they see it! Another pampered self-entitled brat is likely going to go free or almost free. As a token punishment he might get a little house arrest or community service, and that’s a maybe. It would be nice once in a while to actually see justice being served.

    I am so afraid that his over-the-top theatrical performances will net him a minor inconvenience like house arrest. It will be a travesty if he does not get some serious prison time. Reeva deserves at least that – as does her bereaved family.

    from what i read around the interwebs, some quarters are blaming the prosecution for not making an airtight, foolproof case against OP. and they say now it’s catch22 for the judge?

    He took a human life and it was not an accident. There is no way to explain accidentally shooting someone in your own bathroom when you know there was another person in the house. The only way to explain it as an accident (using the word loosely) is if he was very high on drugs (out of his mind) like when a person puts a baby in a microwave.

    Has anyone else here thought what would have happened if this situation were reversed and a woman shot a man? I have been thinking along those lines. If a woman did this I think the entire thing would have been handled differently.

    I believe the Psychologist should be fired. Looking at the whole of this guy all the behaviors before and after there shooting are one of an abuser/murder with a personality disorder.

    I wanted justice.

      Sadly, there is no such place. That’s why it’s all the more frustrating that he won’t see justice. If there really was punishment after death it wouldn’t be so infuriating when he gets his wrist lightly slapped…

(And no doubt, there will be a next time). It’s obvious that this particular “Judge” has been purchased for the right price.

    THIS is making me sick! Why is it that legal systems all over the world seem to not work properly,since people(even non-famous) get a slap on the wrist for murder or rape. I live in Germany and we had a couple of cases here in the last few years where it was atrocious to see the amount of compassion the court granted to the offenders. It’s like a perverted sense of humanity, they are able to make up excuses and weird explanations for the most obvious of crimes, with all this psychological evaluation, you will find loopholes for anyone in almost any case. I know I will punch holes in my walls, if this SOB gets no proper punishment!Aaaarrgh!!!

    This judge has been a big disappointment to me — she was touted as being a huge advocate for DV victims.

    he so meant to kill his girlfriend. based on other incidents I’ve read about him, he’s very violent. now he’s just playing a part so he can get off lightly.
