Questions about missing millions at Madonna’s charity Raising Malawi

Madonna has confirmed to media outlets that she is in Malawi to adopt Mercy James, and that she hopes the Friday court hearing will go her way. Madonna’s tireless publicist Liz Rosenberg also confirmed the meeting between David Banda and his biological father, saying, “Madonna is committed to maintaining an ongoing relationship with David’s Malawian roots.”

The Associated Press has the information on where the adoption case stands now, as well as information about the current protestations of the adoption. A coalition of Malawian non-governmental child-advocate groups called “Mwakusungula” has spoken out against Madonna’s adoption of a child with multiple living relatives. The AP has more:

Madonna has confirmed her attempts to adopt a young Malawian girl and said through a spokeswoman that she is following standard procedures in adopting the child amid criticism by some that she was using her fame to quicken the process.

The 50-year-old pop superstar also confirmed she took her 3-year-old son David, also adopted from Malawi, to visit with his biological father Yohane Banda for the first time since she and David left the country in 2006.

“Madonna is committed to maintaining an ongoing relationship with David’s Malawian roots,” said Liz Rosenberg in a statement Tuesday morning.

In her statement, Madonna confirmed she is trying to adopt a girl named Chifundo “Mercy” James who is about 4 years old. Malawian welfare official and another person involved in the proceedings had confirmed an adoption application was under way and spoke on condition of anonymity because the case is considered sensitive.

The girl’s 18-year-old mother was unmarried and died soon after she gave birth, according to the child’s uncle, John Ngalande. Her father is believed to be alive but has little contact with his daughter, he said.

A coalition of non-governmental organizations called Mwakusungula have criticized Madonna’s adoption attempts, saying that adoption should be the last resort and that children need to be taken care of by their own family.

“Mercy James is a child who has her extended close family members alive and we urge Madonna to assist the child from right here,” a statement from the coalition said.

But others have said that the adoption would give enormous opportunities to the child that she would be unable to achieve in the impoverished African nation. Malawian law is fuzzy on foreign adoptions. Regulations stipulate only that prospective parents undergo an 18- to 24-month assessment period in Malawi, a rule bent when Madonna was allowed to take David to London.

Madonna may also face challenges as a single mother; she divorced Guy Ritchie last year.

Madonna first traveled to Malawi in 2006 while filming a documentary on the devastating poverty and AIDS crisis. Her Raising Malawi organization, founded in 2006, raises funds to provide food, shelter, education and health care for children.

Ah, the oh-so convenient Raising Malawi charity. As it turns out, Fox News was one of the news outlets who wondered what exactly is happening with Raising Malawi and all of those millions of dollars Madonna has allegedly given and raised. Raising Malawi isn’t certified as a non-profit, and there are some serious questions about the $3.7 million fundraiser that Madonna and Gucci sponsored for Raising Malawi last year. Before Madonna “adopts” another child from Malawi, maybe someone should ask her where the money went from her big star studded 2008 fundraiser for that country.

We tried: this column has tried to ascertain from The Raising Malawi Foundation and from Madonna’s Kabbalah-backed Raising Malawi where the estimated $3.7 million has gone from the February 6, 2008 extravaganza. So far: No answers.

The fundraiser had some problems, however. Even though Raising Malawi had been in business for two years, it was still not approved as a sanctioned non profit at the time. Instead, Gucci formed its own Foundation — known as a 501 c3 — to collect the money. They brought UNICEF on board to give the event a feeling of legitimacy. But in the end, the efforts expended were for Raising Malawi, an organization founded by the Kabbalah Center of Los Angeles. Raising Malawi teaches the Kabbalah curriculum, called Spirituality for Kids, to Malawi orphans.

Now, fourteen months after the fundraiser, there’s no accounting for the money that came in. At the time, Gucci claimed that they’d underwritten the entire event, that $3.7 million had been raised and that it had been split between Raising Malawi and UNICEF.

But since then, The Gucci Foundation has still not filed a Form 990 tax statement, and neither has Raising Malawi. Calls to Gucci haven’t provided any information, and calls and e-mails to Raising Malawi haven’t been returned.

Where the money has gone — and the whole story of Raising Malawi — comes at an inconvenient time for Madonna.

I gave Madonna the benefit of the doubt last week, because I really want to believe that despite it all, The Gristle is a good mother who loves her kids. But I can’t turn my back on all of this controversy. What makes it worse (in my mind) is that Madonna seems to be actively courting these controversies. She seems to thrive on them, like, how could she try to adopt a child or hold a fundraiser without screwing it up so badly? How hard is it to hire a tax attorney to get your charity a non-profit status? How hard is it to follow adoption procedures?

    If the kid has all these living relatives why is she in an Orphanage? It’s like they smell money and come out of the woodwork. I doubt they’ve even visited Mercy in the Orphanage. The Granny said she was going to take her when she was 6…ya right…like her financial situation will be so much improved then.

    That’s exactly the Q I asked yesterday – why actively court so much controversy? And the Raising Malawi ‘missing millions’ is just more of the same. I really do believe she sees herself as untouchable and so far above the law as to not actually qualify as a planet earth-dweller any more.

    Leandra: The child is in an orphanage because her living relatives can’t afford to provide for her right now. However, it sounds like they’re hoping to bring her home at some point.

    Madonna has always gotten her publicity by pushing the boundaries of what people are willing to accept. First, she used sex. Now at 50 she knows that her time of using sex is really limited. So it’s onto the next area of female status, mothering. If she adopts babies that are culturally different, through means that are attypical of the female stereotype (ie. not being nice) that she can get our attention.

    @Nony, wow that is twisted. Thanks for the info. that explains a lot. It’s like the Scientology Sea Org, I guess she is brainwashing her future army to get ready to overtake the world, it’s kind of like colonisation. I’ve said it before, why is the world idely standing by as this freak buys herself children from third world countries? There are so many needy children in the US. Do you see any wealthy Europeans or Japanes flying in on their private jets and APOTING children by way of greasing palms?

    Leandra your comment comes from ignorance. The families there are literally penniless and many of the children are in homes, or orphanages, with family visits. You don’t know if her grandmother visits her or not do you? Fact is these children DO have families that DO love them and all they need is a LITTLE cash. Tiny amounts. Not their kids taken away. David’s father also couldnt afford to feed him etc and yet visited him regularly and was taken away too. So sad.

    If she wants to do this, do it, but do it in private. Why do we have to know about this? Why does she have to tip the press? Why does she have to court cameras on her trips there? It’s all part of her publicity train and we fall for it every time. I’m so over this broad and her supposed attempts at living a “real” quality life. It’s not possible.

    Big of her to let David’s father see him after only 3 years. That’s quite a commitment to keeping that connection alive. It will be interesting to see where all that money raised for Malawi ended up. I doubt if it went to anyone in Malawi.

    I read elsewhere that David asked his father who he was, and seemed surprised when the dad said he was his father. Way to let David know about his family and heritage, Madonna… Seems she might have mentioned it before just showing up with him.

    Nope, of course! They adopt poor children, from African origin or not, living in orphanages in Europe. And only few are adopted, the others live with the new family but can’t be adopted if they have one single contact with a living member of their natural family ONCE a year (visit, post card or phonecall). The law is cristal clear. Children are not to sell, they can be helped to be raised.

    Poor kids! I don’t imagine how they’ll feel in 20 years. Hey, Madonna & co, give them some money to stay gathered, if you want to help, don’t “kidnapp” babies. Thanks!

    I am no Madonna fan but David seems well looked after. She also kept his name and identity and did not try to give her some fancy name to rhyme or satisfy her whims. I am not a fan of celebrity adoptions but these particular orphanage, the children are up for adoption. All these relatives just come out of the wood works because they smell money. I am certain David’s father thinks David will give him some money when the time comes or Madonna herself will buy his favours every now and then. I have seen pictures on the internet of hims sporting a new suit. No money for guessing who bought it for PR/ photo ops.

    The charity money should be easy to follow. If it isn’t, then it is called fraud. I am a Board of Director president for one non-profit and Board Member for another. I have guided one organization through the non-profit application process and IRS audit. And I can tell you, if it this is how it is going down, then the IRS is culpable. All of the people who donated likely deducted the money on thier taxes, etc. etc….

    I know any of my organizations would mother-f-ing hear about it from the feds if we allowed ourselves to be represented as a 501 c3 org before it was legal, or share those profits with an undeclared non-profit!

    I would like to add that Madonna is giving TOO MUCH hope to other African children, the adoption of David B. is too much exposed! And it makes them more unhappy if it could be possible).

    Don’t separate families, be they very poor.

    When I first graduated a few years ago I had to work for a lot less than I thought I would have to. My advice to anyone just out of law school is to get your foot in the door and worry about the money a few years in the future.
