Lindsay Lohan could be sent to jail for 30 days while she waits for next hearing

We’ve heard that Lindsay Lohan had several dirty drug tests during her probationary period, with reports claiming that she tested positive for cocaine and amphetamines. A bench warrant has been issued for her arrest, but it’s been put on hold until Friday, when she needs to show up in court. In the mean time she’s been out partying and hitting her old Hollywood haunts in between occasionally going to AA meetings, calling the paps and issuing statements about it to TMZ. Lindsay of course initially denied doing any drugs, which is pretty typical for her, but then let someone with more sense take over her Twitter account claiming she had a disease (addiction) and was taking responsibility for her actions – as if she even knows that word.

So now we’re wondering what Lindsay’s fate will be, and how long she’ll be forced to sit around detoxing, doodling her prison diaries, and chowing Twizzlers behind bars this time. Radar Online reports that Lindsay could potentially go to jail for a full 30 days, at the judge’s discretion, just while she waits for another hearing. Lindsay has a new judge assigned to her case after her previous judge, hero Marsha Revel, voluntarily recused herself after prosecutors complained that she tried to find a rehab facility for Lindsay.

Lindsay Lohan’s jail stay may be much longer than is expected, RadarOnline.com has learned exclusively.

Her probation will be formally revoked on Friday, RadarOnline.com has learned but once that happens she may have to go behind bars and wait for a probation violation hearing to be held, a source close to the situation told us.

Los Angeles Superior Court Judge Elden Fox will formally revoke LiLo’s probation, and then schedule the probation violation hearing. A source close to the situation told RadarOnline.com: “Lindsay could be remanded directly into custody on Friday, pending the probation violation hearing, and it’s very likely that Judge Fox will do that.

“Lindsay was allowed to remain out on bail last time until her probation violation hearing, but Judge Fox probably won’t give her that privilege because of her failed drug test, and this is her second probation violation hearing in less than three months.

“By remanding her directly to custody, Lindsay would stay behind bars until the probation violation hearing, she wouldn’t allowed to get out early. The probation violation hearing could be set for the following week, or as much as 30 days from now. If it’s set for 30 days from now, Lindsay will remain behind bars during that time if that is what Judge Fox decides.”

And, of course, Lindsay is looking at even more jail time after the probation violation hearing, thanks to testing positive for cocaine.

Sources close to the actress tell us: “Lindsay is extremely upset and despondent about her latest setback. She is trying to put on a brave face, but she knows that she is in hot water.”

Lindsay’s probation was revoked yesterday by Judge Fox, and a bench warrant was issued for her arrest, but ordered held, pending Lindsay’s court appearance on Friday morning in Beverly Hills.

I googled Lindsay’s new judge, Elden Fox, and he’s the one who sentenced Winona Ryder to probation in 2002 for her shoplifting conviction. It’s what prosecutors recommended so it’s hard to tell if he’s a hard ass or not. He’s already ordered Lohan to meet a bunch of requirements, including going to counseling, attending AA five times a week, and having random drug tests twice a week. For each violation she faces an additional 30 days in jail. So what’s she’s looking at this time, 30 days in jail as she waits for a hearing and additional 30 days for each failed drug test, for a total of 90 that will probably be reduced to 45? There could potentially be even more time tacked on there if she missed therapy or AA sessions, which is probable in her case. As Kaiser mentioned in an earlier story, experts do think it’s likely that she’ll be sent to jail right away. There’s speculation that she could get a minimum of 45 days without the option of early release.

Speaking of Winona Ryder, her misdeeds were relatively minor but after her shoplifting conviction her career didn’t retain a fraction of the potential she once had. (Look at where her Girl Interrupted costar, Angelina Jolie, is at this point vs. Winona.) Lindsay, apart from when she hit the scene years ago, didn’t have much of a career to speak of. Just like the way she’s handling her probation, she pissed away every chance she had. It might be tragic if she wasn’t such an entitled unworthy brat. In Lindsay’s case it’s just predictable.

    The biggest obstacle to getting jail time for celebs are the jailers! They beg the courts to keep them away because of the circus they create in an already overcrowded, insane system. I say toss that scrawny cokehag into the general population and see what happens! “maybe” she’ll be O.K….if not, Dina has Ali waiting in the wings.

    oh blah, blah, blah. Im so sick of them doing stories about her having to go to jail when everyone knows that she will get out of it. I think the jail threats are for tabloid news stories only, doubt they’ll do a thing but another slap on the wrists and then more interview offers. She makes me sick now. Im all for a LL boycott.

    I think she will be sentenced on Friday otherwise because it is a misdemeanor case she has the right to bail out.
    She entitled to bail until the formal violation of probation hearing takes place unless she doesn’t ask for bail depending on the hearing date.
    If she gets 60 days she will serve an absolute maximum of 30 days due to time off for “good behavior” if early release for overcrowding isn’t allowed.

    Ok safe to say this woman has real problems. I am all about consequences, ask my 10 year old. But what is jail going to do for a drug addict?

    When you parent a child you always try to have the “punishment” fit the crime. And yes, she broke the crime of reusing/continuing to – but isn’t that the very definition of an addict?

    Do I feel sorry for Lohan, I am not sure. But this case has got me wondering how many people are in jails for using drugs? Might we as a society not be better served by trying to help them kick their habit?

    I never understood why Winona didn’t got back on her old level. I mean, shoplifting, is that such a big deal in Hollywood? The have forgiven people with far worse criminal records.

    I don’t understand much of US law, but aren’t the days that Lindsay sits in jail waiting for her hearing deducted from the sentence she will be getting for violating her probation?

    Winona seems to have disappeared by her own choice after the jail stint. She seems to have mental issues. She was always a quirky, leaning toward indie type roles, she’s never been America’s Sweetheart type like Reese Witherspoon.

    As for Lindsay she wont get it until something horrible happens to her or she god forbid hurts somebody else.

    @brandy, not putting down Arizona, but I doubt there are as many criminals there. The jails are over populated in Lilo-Land, so unless you are charged with murder, chances are you are gonna get bonded out. Specially if you are a “celebrity” like lilo

    She does NOT look “extremely upset and despondent” She’s out partying all the time till they make her go to jail. While there is early release due to overcrowding, I say she belongs there because she has proven to be a danger to society, hitting a baby should be an indicator, duh, they can’t lock her up long enough to suit me.

    She might be “entitled” to bail, but that doesn’t mean that she will get it, especially considering that this is her SECOND probation violation in THREE months. Any mere mortal would already be in the clink. I’m betting this new judge, who seems far more harsh than our beloved Revel, tosses her ass right in the pokey on Friday.

    @nycmom10024: I don’t think she’s an addict – or at least not a typical one. It’s not like she’s clean and then goes on a bender and nearly kills herself (like the Hoff for instance). The UCLA doctors at the addiction center didn’t think so either – they used the term ‘personality disorder’. She uses because she wants to and has absolutely zero self control and honestly believes the rules don’t apply to her.

    I don’t believe much can be done for her, and I fear nothing will be done TO her until she kills someone by mowing them down with her car. She needs to be removed from society because of her sociopathic behaviors (see exhibit hitting baby in stroller because it was ‘in the way’).

    @samigirl: I think that the “source” for her being best friends with murderers was Dina, and we all know how reliable that source is. She was in isolation; very hard to make friends when you’re locked down 23 out of 24 hours, and your one hour of rec time is ALONE.

    Winona’s a bad actress is why she never got bigger. And I’ll believe she’s in jail for 30 days when I see it. She’ll get another chance, just you wait and see. They’ll get some paid expert to declare she has no drug issues again and it’ll all repeat itself. Dina needs to go into rehab herself and learn to be a parent instead of a drug buddy to her daughter.

    And Lindsay’s outfit on this page is how a fugly outfit can actually make you look like you’ve gained weight on camera. Hideous clothing! I like her hair swept back but she needs to stop it with the colored in hair and skin pickling solution and cut off the damn extensions already. Isn’t that look over YET?

    no way will this spoiled twit go to jail for any length of time, rehab either. she will do the jail/rehab circuit again and again (for a week here, two weeks there, not enough to actually do any good) until she either fades away or ODs. so is she an addict? lindsay says she isn’t, until she thinks she can use it for some sympathy and then she says she is. does it even matter anymore?
