Seriously, ladies and gentlemen, stop buying these trashy tabloids. First off, most of good tabloid stories come online, so we’ll cover the stuff for free so you don’t have to spend your money. Second of all, by buying these rags, you perpetuate stories like this week’s In Touch Weekly. Apparently, Brad Pitt and Jennifer Aniston were “caught kissing”. By whom? Ah, by this mysterious “former bodyguard” named “Bill”. As someone pointed out in last week’s In Touch post – where “Bill” told us about Angelina Jolie “abusing” her children – “Bill” might be a pseudonym for GerBILL. Excellent.
So, the basic story that “Bill” lays out for is much like every other In Touch story about how Brad and Jen are going to reunite any minute now, just wait for it….
In an exclusive interview, Angelina Jolie and Brad Pitt’s former bodyguard reveals that since Brad and his ex-wife Jennifer Aniston reconnected at the 2009 Academy Awards, they have hooked up four times — three times in LA and once in New York — and even recently shared a passionate kiss.
“I know that he still loves her,” the ex-bodyguard Bill, who for security reasons chooses only to be identified by his first name, tells In Touch.
In fact, there was one date that Bill says brought them closer than ever — and since then, their relationship has heated up even more. Brad and Jen arranged a secret meeting at the trails off of Western Canyon Road in Beverly Hills on December 9, Bill says.
At 3:30p.m., Jen pulled up to the location in her Bentley, and Brad arrived on his motorcycle. After Brad climbed into Jen’s passenger seat, “They were very cozy, clearly embracing,” Bill reveals for the first time. “Several times, Brad and Jen were hugging and kissing.”
After talking and nuzzling for about 30 to 40 minutes, Bill, who was on “paparazzi watch,” advised the pair that they should leave, as photographers were spotted just a few miles away. “Jennifer left first, flashing Brad a quick peace sign and a smile,” says Bill. “Brad jogged back to his motorcycle, drove off and went for an hour bike ride.”

You know its funny- I used to buy In touch and Life & Style because they devoted most of their coverage to who is wearing what, who wore it best. My sister and I would drink coffee on Sundays and get fashion ideas or make fun of someones poor choices.

OOPS,a JP fan found a posting of Brad at the Beverly Hills Hotel at 3:50p on Dec 9th in his car at X17. The same time that he should have been nuzzling with Jen.(Jen arrived @3:30 and they nuzzled for 30-45 minutes) BTW X17 noted on that post that Brad hasn’t been on his bike since his accident in Oct. Dang IT fact check make sure there are no pics or spottings of a celeb before publishing this BS. Google is an amazing thing.

Here in Britain, they’d get immediately sued for printing “lies” or simply for “injuring” someone’s reputation. Case in point was the whole Max Mosley Nazi-sex-orgy scandal a couple of years ago. He sued and won (even though the story was true) because he successfully argued that the NOTW breached his privacy (article 8 of ECHR).
Same with kids really, you’re not supposed to print pictures of minors in UK publications unless it pertains to a missing child or permission has been given for the story by parents and a judge.
Well I guess I answered my own question since the UK is signed on to the ECHR and America is not although surely it’s signed on to the UDHR but then again it is subject to each country’s laws. Hmmm. Anyway, just rambling…carry on.

@Macheath – Libel laws here are very protective of the average citizen, there are a number of legal options available to them. Including publication of private facts, meaning it doesn’t even have to be a lie, just something that shouldn’t be made public. However, once you are legally considered a “public figure” and the combination of the first amendment, freedom of the press, they are pretty much on their own. THeir choice is to fight back in the press or ignore it. That’s why it is virtually unheard of for a tabloid to be sued here, while it happens frequently in Britian (usually with the injured party winning.) To win there is a high burden of proof and high criteria and all the tabloids have legal departments to make sure they stay right on the line and are not open to a lawsuit. That is the basics anyway. I can tell you more if you are interested.

I totally forgot about the first amendment; it has a lot more force behind it than our version (article 10 of the ECHR). My prof at uni talked about how press and journalism evolved differently over in America compared to Europe especially due to the Bill of Rights. Fascinating stuff. Regarding the burden of proof being on the “injured” celeb, does that mean Brad has to prove that “Bill” doesn’t exist and is lying? Does the burden of proof always fall on the plaintiff in every instance? Surely, if he takes the matter to court, he should be able to demand that the publication reveal some evidence of fact. IT didn’t even use cautionary language like “allegedly” or “suspected”, they presented the story as fact. Are there no provisions for something like this? (By the way, I don’t mean to make this story sound bigger than it is but it’s a good example for me concerning journalism in America as a whole.)Are there any regulatory press bodies in the states? In the UK we have the PCC (Press Complaints Commission) which has a series of ethical codes that Editors are advised to adhere to (personal ethics of the individual journalist are subjective however) and members of the public or even public figures can complain to the PCC if they feel a breach was made by a publication. I suppose the first amendment makes such a body difficult to put in place in the states.

Proving “Bill” doesn’t exist would be very hard since the journalist don’t have to reveal their sources (only in extreme cases will a judge order them to and Brad and Angie aren’t that important in the grand scheme of things) Also, if “Bill” is lying and the reporter uses his information that is perfectly fine as long as the reporter was acting in “good faith.” With the press shield laws and just the spirit of the law make it very difficult to prove the journalist was not acting in good faith. They would have to show that the journalist knew for a fact they were lies and printed them anyway because they wanted to damage Brad and Angie’s reputation. However, there is no black and white standard of how hard you have to fact check what you report. But even if the journalist hated them and knew they were lies or knew “Bill” was falsely saying this to harm their reputation, they wouldn’t testify and would make sure to cover their tracks (and hide “Bill”). They don’t have to say use cautionary language because what they are reporting as fact is “Bill” told them this. Anything he said may be true or false but if he said it then they were reporting true facts. For example if I went in and told them that the sky is purple, saying “Lindsay said the sky is purple” is a true fact, even though the sky is purple is false (see how they are able to get around so many libel laws, the lines are very fuzzy.) Yes burden of proof lies with the plaintiff, which would be Brad since he filed the lawsuit, but because he is a public figure he would have to prove it had a major negative financial impact before a judge would consider asking journalist to name sources – it is rarely done and no judge is going to want to put their reputation on the line for celebrity journalism.
We do have a code of journalistic ethics public figures are not well protected. For major stories with a big, important impact judges are more likely to demand sources to be revealed and make sure the journalist was acting in good faith. Journalist and even news sources are outed all the time for questionable ethics, which does help you know how much faith to put into different outlets. The other factor that makes the cases hard to prosecute is saying the reporting is “entertainment” many of our 24 hour news networks are doing that now. Entertainment doesn’t really have to follow journalistic ethics. The big thing now with the 24 networks doing this is they air their entertainment shows and the show the deem real news report on the entertainment reports allowing them another loophole because news shows can report on entertainment shows.
So it can seem like a bit of a mess. It has pros and cons- the above are mainly cons but the questionable tabloid journalist are held to a lower standard than others and that is how it should be. I’m glad judges take the First Amendment seriously enough to realize that hearing arguments and having long trials on silly, entertainment reporting is a waste of the courts time and taxpayer money.
Did that make sense? I don’t mind answering them at all. Should use my law classes for something, right? I love talking about this stuff.
I would like to think that Jen has more class and better taste. Brad looks ultra repulsive these days. I have to wash my hands every time I look at his picture.

It makes sense that they never sued an American publication but did file a suit against that British tabloid; there is practically zero chance of them winning a case in America since they haven’t and probably will never experience a financial hit from the stories. Winning against a tab in the UK is much easier since finances don’t have to be a factor in a suit. Yes, it’s true that courts shouldn’t waste time and money on feuds between celebs and the tabs.
