Lindsay Lohan’s judge: “if you plead in front of me, you are going to jail, period.”

Lindsay Lohan just had a hearing in the case of the purloined necklace/probation violation. It was in front of the same guy who seemed to go relatively lenient on her the last time, Judge Keith Schwartz, and TMZ was right in their prior coverage that he wants jail time for her – eventually. She wore a kind of low cut shirt and black suitjacket with a big stone necklace pointing at her cleavage. At least she was dressed more appropriately, but when she walked out I could see that she was wearing a tight white maybe miniskirt pants, since white signifies her “innocence.” The outcome was that another date was set for a hearing on March 10. The judge said that if Lindsay settles and cops a plea at that time she’s definitely going to jail. If she doesn’t settle, she’ll be seeing a different judge on a later date named Judge Sautner. This sh*t never ends. The highlights from Judge Scwartz’s speech include:

I’ve never met you before [your last hearing]. I treat all people the same

Number One, this case does involve jail time
If you plead in front of me, if this is resolved in front of me, you are going to jail, period. If the case settles here, you will be going to jail.

Number Two, if this case doesn’t resolve here… Judge Sautner will impose sentence.

There is going to be jail time in this case, the issue is what it is.

I don’t want you getting back into the system…

I want you to reach whatever potential you have and move on…

I would like to have additional psychological information…

Such as [seeing a therapist]

You need to get a reliable trustworthy and reasonable sponsor unrelated to any of your family members. I need somebody unrelated to you who is not moved by seeing anything other than you succeed…

You’re going to come back in front of me one more time.
If the case settles, that’s great…

The one thing you and your attorney have to understand is that the next time you see me on February 10 it’s either to settle or set another preliminary hearing.

So Lindsay squeaked by again and was seen smirking (screenshot above) when she realized that she wasn’t going to jail yet. All that talk about how she would go to jail at some point was lost to Lindsay, because she was smiling and thinking of her next fix.

TMZ explains it better than I can as I don’t get all the details in this case, but apparently if Lindsay doesn’t cop a plea she’s going to have to go to trial at some point, and that means up to a year in state prison.

TMZ broke the story this morning … the judge will throw Lindsay in jail if she accepts a plea bargain.

Judge Keith Schwartz told the famous defendant bluntly, “I don’t care that you’re Lindsay Lohan.”

Judge Schwartz did not say how much jail time Lindsay would do if she cops a plea.

And, Judge Schwartz wants a psychological evaluation that will help him understand what makes Lindsay tick and what particular sentence is appropriate.

The judge explained … if Lindsay pleads guilty or no contest, it will be an automatic admission she violated her probation.

And the judge announced what TMZ first reported … Deputy D.A. Danette Meyers made a formal offer to settle the case. Lindsay’s lawyer, Shawn Holley, will noodle over the offer before deciding, but the judge indicated Lindsay’s probably not going to accept the D.A.’s offer. As we reported, Meyers wants significant jail time.

If Lindsay doesn’t accept a plea, she’ll stand trial and if she’s found guilty she could get 1 year in state prison.

Lindsay is back in court on March 10. She has the option of pleading guilty and basically throwing herself at the court’s mercy.

I see her taking her chances on a trial and getting way more time behind bars than she would by pleading out. This is far from over.

Update: Michael Lohan is giving a press conference bitching about how Dina is enforcing her order of protection against him, and how she’s using her children as “ploys to mediate things and pawns.” He said that he hopes this goes to trial because all the evidence wasn’t turned over to Lindsay’s lawyer until recently. He said of potential jail time, “I don’t see Lindsay as a criminal. This is all a result of her addiction.”

    So the judge wants further psychological evaluation…. Does that mean she’ll get off on terms of mental issues?? I really hope she is convicted in a state prison, it may be the thing that wakes her up. Lindsay is just too delusional at this point

    Also assuming she’ll get more probation regardless of the outcome so guessing this will keep re-playing as she literally can’t keep her nose clean!! (pun intended!)

    I disagree. The judge is full on board and part of the game. He basically showed Lilo and everyone else his hand and he is a coward. Basically, he warned her not to say anything so he can pass the buck to another judge who can then show her leniancy having never had her in his court. If this is not the explanation, why was this hearing even held in a court back-logged with work. This was nothing but “pass the celebrity buck time.”

    Damn, and to think how quickly it took for my friend to land in prison for assault compared to this “little girl.” He just wasn’t famous enough. Oh, and he pled out to 90 days at Riker’s followed by rehab, taking responsibility for his actions.

    Wait, what happened to Judge Fox? Did this hearing also cover her DUI probation? B/c she potentially violated during her stay at BFC. & to Papa Crackhead, yes, all these shenanigans may be the result of her addiction, but she’s still a criminal. If she stole this necklace while high, she violated probation & is therefore a criminal. If she stole it while not high (she’s no where near sober), she’s a thief & therefore a criminal.

    I think the judge is a wimp, but TMZ (shock!) called it correctly. Preliminary on the theft charge and probation violation will be held together: a finding of probable cause on the theft is prima facia probation violation-she goes straight to county jail to wait for trial. The bull crap about a psyche exam is to give her time to get the inevitable through the crack head.

    The DA is probably holding some pretty good stuff. Blohan is and idiot if she takes the risk of a criminal conviction-that state tim, not county and NOONE will care about her extentions, trout pout, or implants around there.

    She’s going to jail either way. She needs to take the plea the DA is offering her for a couple months as opposed to possibly doing a year in state prison. If she goes to trial it’s highly unlikely she won’t get any jail time.

    I think the judge was just making sure she understood that her options are:

    A) jail
    B) jail

    She is refusing to take a plea deal unless it keeps her out of jail and I think a judge has to sign off on any plea deal and can change some of the details or reject it? (my limited knowledge of criminal law is based on Law & Order. I’d love to hear the L&O sound as LL walked into the court).

    She can either take a plea deal (go to jail), plead guilty and throw herself at the mercy of the court (go to jail) or go to trial (go to jail).

    My two cents as a lawyer (from another state):

    She has two options:

    1. take a plea and go to jail (because a plea is admitting guilt, which is a probation violation),

    2. reject the plea and go to trial, where she most likely will be found guilty and get a prison sentence.

    Misdemeanor = jail (county)
    Felony = prison (state)

    Being on felony probation is very different than being on misdemeanor probation (which she has been on for all these years.) Violating felony probation sends your ass back to prison quickly, without the option to put yourself in rehab, fight the charges, etc.

    So while crackhead doesn’t want to accept a plea that includes jail time (probably a 6 month sentence for probation violation), she should be more worried about the felony probation, as there is no way that she can stay out of trouble for 3 years.

    Bottom line: it will take several more court proceedings, but she is doing time, either in jail or prison.

    I think her only option is to pretty much take this to trial and try and beat the case. She is almost certainly going to jail for the probation violation.
    Felony probation would basically be like a prison sentence for her. Otherwise try and get it reduced to a misdemeanor based on the value and max out her sentence.
    Can’t believe she couldn’t make it to Feb 25th.

    um, with trial it has to be ‘beyond reasonable doubt’ for a guilty verdict.
    She may not go to jail-which is why some people do take their chances with trial.

    Also, this is how legal systems work-
    ie, the police did not arrest her with a concealed weapon or drugs on her person, in which case she’s violating probation and in jail.

    instead, she is accused of theft by someone else, so they have to go thru the motions of how it’s done in our legal system, for everyone. in this case, offering plea bargain at preliminary hearing first, followed by pretrial and plea of not guilty most likely, etc.

    ie, ppl always bring up race, money or notoriety.
    you have to look at each case…..they DO have this many hearings, prelim,etc.
    in the ‘real world’, ppl.

    I am witnessing this myself with a case in my circle of interactions…person is clearly guilty, much evidence already presented, has to do with pedophilia at that! and still this person is out awaiting trial which keeps getting postponed…it’s been many months now. it’s crazy how many trial readiness hearings, etc, are scheduled…

    Lilo’s legal process is the norm.

    A plea bargain usually means admitting guilt to a lesser charge or pleading guilty to the original charge with the understanding you will get a lighter sentence for cooperating. It is designed to save the government and tax payers time and money since it avoids a trial. If you believe you are not guilty but the evidence against you makes it likely you will be found guilty, you can plead “no contest”.

    @out of state lawyer. I’m a Cali attorney who doesn’t practice criminal law. I agree with your assessment with one addition.

    Lindsay is also going to have a violation of probation hearing. Even if she pleads not guilty, she most likely will be found in violation. The burden of proof for the violation is only “more likely than not.”

    If found in violation, Lindsay will go to jail until her theft trial or she finishes the time remaining on her DUI cases.

    So, she is going to jail one way or another.

    Suggested community servive for Lindsay and other members of the Hollywood DUI sisterhood:Collecting dog droppings off the streets, parks, beaches, and other areas where they don’t belong. Some areas have established dog DNA databases. If Los Angeles did this, it could analyze samples of dog dirt picked up by Lindsay, match them up with the DNA database, then fine the owners and/or put them to work with Lindsay. This would not only prevent water pollution, and protect the public from e.coli, roundworm, and other life and health threatening pathogens, but generate a lot of cash for L.A. The program would more than pay for itself.
